  • In commemoration of Vol. 30, Issue 1, our journal prepares four review articles and two original papers. The first review article provides guidelines for medical treatment for emergencies in an aircraft furing flight. This guideline addresses the resources and medical equipment available to physicians on board, common medical conditions, how to deal with them, including legal issues. The second review article covers historically meaningful animals that have contributed to aerospace research and the role of a veterinarian. The third one describes cardiovascular, musculoskeletal, and vestibular physiological effects of microgravity on the human body. As we are about to enter an aging society, the fourth review article introduces guidelines for safe overseas travel for senior passengers. The role of the aviation medical examiner is to maintain aircrew's health and to help them work long and healthy. In this regard, Choi et al. analyzed the physical examination data and sick leave data of an airline. Han et al. investigated the aerospace medical examination data of the Republic of Korea and suggested a solution to some common health problems of the crew.

A Study on the Seller's Obligation to Hand over Documents under the CISG (국제물품매매계약에 관한 UN협약(CISG)에서 매도인의 서류교부의무)

  • This paper examines the seller's obligation to deliver documents conforming to the terms of the sales contract as set forth in articles 30 and 34 of the CISG. Article 30 obliges the seller to band over documents relating to the goods. This obligation to band over documents is further elaborated in article 34. According to article 34, the documents must be tendered at the time and place, and in the form, required by the contract. If the seller has delivered non-conforming documents before the agreed time, he has the right to remedy the defects if this would not cause the buyer unreasonable inconvenience or expense. However, the buyer can claim any damages suffered despite the seller's remedy. Specific emphasis is placed on the interplay between the CISG and Incoterms. Incoterms contain detailed rules governing the obligations of the seller to provide for documents. Incoterms constitute international trade usage under articles 9(1) and 9(2) CISG and supplement construction of CISG with UCP under L/C transaction. In the event of failure by seller to deliver the necessary documents, the buyer has certain remedies available, such as the right to claim damages, the right to demand specific performance, and the right to repair. Furthermore, the failure to deliver the required documents under contract constitute a fundamental breach of the underlying sales contract as defined by article 25 of the CISG by the seller, and thereby enable the buyer to avoid the contract entirely article 49. However, it is stressed that since one of the main principles of the CISG is the preservation of the contract, the avoidance of the contract should remain a remedy of last resort.

A Study on the Trademark Registration and Nullity in China - Focused on 'Michael Jordan' Case - (중국 상표법상 등록과 무효에 관한 연구 - '마이클 조단' 행정판결을 중심으로 -)

  • In the past 10 years, there have been lots of misuses of the trademark system in China. For example, some Chinese companies have registered same or similar oversea's well-known trademark as a prior rights holder, and oversea's companies lost a chance to register their own trademarks or commence cases to acquire their own trademark determination in China. So Chinese government revised Chinese Trademark Law in 2014 to remedy these mistakes. Article 30 is intended to crack down on preemptive registration and compensate for the possible unfair consequences resulted from the principle of prior registration. Under the principle of prior registration, only where the unregistered trademarks of prior use have certain influence, and where the applicant of latter applied trademark knows or should know the prior trademark and the applicant has the bad faith of obtaining unjustified interests from goodwill of such unregistered marks, it shall be curbed by Article 30. Furthermore, trademark oppositions could be filed by anybody previously. Under the revised Trademark Law Article 44, oppositions based on absolute grounds can still be filed by anyone, but oppositions based on other available grounds can only be filed by a prior rights holder or a materially-interested party with undefined but similar to the standing requirement for filing nullities under Article 41 of the old law, and likely intended to cover trademark licensees and successors.

Hwang Doyeon's Medical Achievements and His Other Name, Hwang Dosun (황도연(黃度淵)의 의학과 그의 또 다른 이름 황도순(黃道淳))

  • Purpose : The purpose of this article is to make a clarification that Hwang Doyeon(黃度淵) was a official doctor(醫官) who even served as royal doctor(御醫), rather than merely a general doctor who worked in the private sector. The article also attempts to give a new perspective on the medical history about the late period of Joseon(朝鮮) Dynasty. Methods : In researching Hwang Doyeon's master work, the Gains and Losses of Medical Orthodoxy(醫宗損益), the article looks at his clinical medicines. Analyzing the historical records, the article makes an assumption that Hwang Doyeon and Hwang Dosoon(黃道淳), who was selected as an officer to discuss medicine with other medical officers(議藥同參), are the identical person. On this assumption, the article tries to reinterpret the medicine during the later Joseon Dynasty period. Result & Conclusion : The records, including the royal medical treatment records of the Gains and Losses of Medical Orthodoxy, the Daily Records of Royal Secretariat(承政院日記), the genealogy of Changwon Hwangs(昌原黃氏世譜), academic paper and government documents released posthumously, demonstrated that Hwang Doyeon and Hwang Dosoon are the same person. If so, we can have new historical interpretation about medical history of late Joseon Dynasty. First, during the late of Joseon Dynasty, there was an official and active medical knowledge interaction between government and private sector. Second, the Joseon's medicine has been established its own medical system based on the Treasured Mirror of Eastern Medicine(東醫寶鑑), trying to cope with cholera and other contemporary epidemics without relying on Chinese warm disease(溫病) medicine. Third, the Compilation of Formulas and Medicinals(方藥合編), is regarded not only as a must-read medical reading for medical doctors, also playing an important role on popularization of Korean medical knowledge.

  • In commemoration of Vol. 30, Issue 2, our journal prepared three review articles, two original papers, and a case report. The first review analyzed aircraft accidents caused by pilots' fatigue and presented a protocol to measure their fatigue, such as primary background survey, subjective drowsiness/arousal evaluation, sleep and activity log, sleep data, and performance measurement. The second review analyzed shift work patterns and work characteristics that may affect the fatigue of aviation mechanics. Also, desirable work principles for aviation mechanics (restrictions on working hours, appropriate rest hours, and night shift restrictions) were presented. The third review discussed the effects that allergic rhinitis can have on pilots (drowsiness and decreased arousal) and introduced a safe treatment method that can prevent these adverse effects. In the first original article, the ratio of 'incompatible (non-fit)' result in aerospace medical examination among Korean aircraft pilots for the past five years was investigated by age group and the common causes of nonconformity were analyzed. In the second original article, the prevalence, mortality, prevalence according to age groups, and regional characteristics of severe febrile thrombocytopenia syndrome were compared and analyzed in Korea and Japan for the past five years. Finally, in the case report, the cases of a patient diagnosed as gastrointestinal stromal tumors who received surgical treatment and chemotherapy were discussed, and the results of the judgment were presented.

(Efficient Methods for Combining User and Article Models for Collaborative Recommendation) (협력적 추천을 위한 사용자와 항목 모델의 효율적인 통합 방법)

  • In collaborative recommendation two models are generally used: the user model and the article model. A user model learns correlation between users preferences and recommends an article based on other users preferences for the article. Similarly, an article model learns correlation between preferences for articles and recommends an article based on the target user's preference for other articles. In this paper, we investigates various combination methods of the user model and the article model for better recommendation performance. They include simple sequential and parallel methods, perceptron, multi-layer perceptron, fuzzy rules, and BKS. We adopt the multi-layer perceptron for training each of the user and article models. The multi-layer perceptron has several advantages over other methods such as the nearest neighbor method and the association rule method. It can learn weights between correlated items and it can handle easily both of symbolic and numeric data. The combined models outperform any of the basic models and our experiments show that the multi-layer perceptron is the most efficient combination method among them.

Overview of respiratory diseases in terms of insurance medicine (주요 호흡기질환의 보험의학적 이해)

  • Lung diseases are common in general population and they are also important in insurance medicine. According to current textbook of insurance medicine, there are references of western research which performed at 1980s and early 2000. It's necessary to update the reference. In this article, several respiratory disorders such as Kartagener's syndrome, bronchial asthma, drug-resistant tuberculosis, etc are reviewed in terms of insurance medicine. Reference articles were used in Korean study, if possible. I hope this article being a role of helping many insurance doctors and underwriters in Korea.
