  • To the extent that CISG and UNIDROIT Principles address the same issues, the rules laid down in the latter are normally taken either literally or at least in substance from the corresponding provisions of the former. Nevertheless, we may find cases where the latter depart from the former. The purpose of this paper is comparison of the two instruments, especially in part of contract formation. The result of this paper shows the fact that in the chapter of UNIDROIT Principles on formation provisions are included on the manner in which requirements that an offer and an acceptance must meet are more comprehensive, and in result a contract may be concluded more easily.

  • Following the ratification of Vienna Convention for Ozone Layer Protection and Montreal Protocol, Indonesia will implement the phasing-out of to halon at end 1996. Questions are increasing especially from the users where halon has used for many years as the most effective fire extinguishing agent, concerning halon substitutes, alternative systems as well as the handling and utilization of the existing halon. Halon can still be used for critical and essential uses, however, such usage has been gradually eliminated, due to the emergence of halon-like replacement. A concept of halon banking system is proposed to considered, taking into account several aspects such as enforced regulation, institutional involvement technology as well as financing. This paper gives a general overview regarding phase-out implementation, alternative extinguishing systems and concept on halon banking system with special reference to Indonesian case.

중국(中國) 통일계약법상(統一契約法上) 계약(契約)의 성립(成立) (The Formation of Contract under the New Contract Law of China)

  • A contract is made when both parties have reached agreement, or they are deemed to have. After contract the law recognizes rights and obligations arising from the agreement. In order to discover whether agreement was reached between these two parties, we have to analyse the process of negotiation. Recently The People's Republic of China legislated a New Contract Law, which has come into effect since 1st of October 1999. This Law adapts the rules of United Nations(Vienna) Convention on Contracts for the International Sale of Goods and the Unidroit Principles for International Commercial Contracts. And this law is now widely enforced to commercial transactions between individuals, enterprises or other economic organizations of the People's Republic of China and foreign enterprises. Therefore, the foreigner who wish to make a sales contract with Chinese should understand the rules of New Contract Law of China. According to this New Law only a contract which contain offer and acceptance is valid and binding, and it is also pointed out that terms of contact must be certain. Though an oral contract is usually equivalent to a written one, in a case of commercial transactions written contract with signature is desirable. The purpose of this paper is to analyze the new rules of this Law and the new features of their application to commercial transactions in China.

The legal regime of air charter in china

  • Charter flight in international air law has, from very beginning, not precisely defined by the International Civil Aviation Organization (lCAO) since 1947 when it came into being. By practice, the operation of charter traffic is, in its very beginning, the subject to the regulations of national rules and bilateral charter agreements (charter annex clause) within the framework of normal bilateral agreement of international air services. Taiwan had signed a series of bilateral air service agreement under the name of the Government of the Republic of China when Taiwan was recognized by the United Nations and major members of international community as the sole legal government representing China before 1971, but that situation was changed since then. Taiwan has only maintained diplomatic relations with 25 States, but maintained semi-official relations with major powers of the world. The former agreements were signed within the framework of the Vienna Convention on the Law of Treaties of 1969 while the latter agreements were signed within the framework of administrative and civil law of two countries which were not in the form of bilateral treaty signed by two sovereign States in its proper sense of international law. The legal regime of charter flights between Taiwan and Mainland China is regulated by special arrangements negotiated by delegated airlines and airlines association or private law institutions.

UNCITRAL 제2 실무작업반의 제34차 회의 동향 (Some Developments at the Thirty-Fourth Session of the UNCITRAL Working Group II(Arbitration and Conciliation))

  • The thirty-fourth session of UNCITRAL Working Group on Arbitration was held in New York. Among the topics discussed at the session, many delegations agreed to reform the article 7 of the UNCITRAL Model Law on International Commercial Arbitration in light of the development of electronic commerce. As for the article 2(2) of the New York Convention, it was agreed to reflect the changes of the article 7 not in the form of a treaty amendment but in the form of an interpretative statement. The topic as to provisional measures has been found so difficult to reach an agreement that most of its texts submitted by the secretariat were left untouched for the lack of time. However, most provisions of the legislative texts on conciliation were dealt with by delegations. The next session is to be held in Vienna. While the Korean Arbitration Act of 1966 was fully amended in 1999, it seems interesting to look at the development in which the arbitration community of the world has already begun discussing the new dimension of the law and practice of international commercial arbitration. It may be considered early to start a new project of reforming the Korean Arbitration Act at this time when only three years passed after it was fully amended. It is, however, worthwhile to remember that some progressive efforts were aborted in amending the Arbitration Act of 1966. One of them is about the same issue on the insertion of some provisions on the enforcement of interim measures of protection to which the priority is given by the Working Group. It seems fair to say that it would not be dangerous to follow the developments and to adapt ourselves to such trends shown in the session. In Korea, the words “arbitration” and “conciliation” are misleadingly interchanged although these two words should be differentiated from each other in the sense of third-party binding decision. It is self-evident from the Korean Arbitration Act and judicial decisions that arbitral awards bind the disputing parties and are to be treated as final judgements by the competent courts. It is, however, not uncommon to find that the word “arbitration” is misinterpreted as having the same meaning of the word “conciliation”. One of the reasons for the confusion is that many legislations in Korea provide for conciliation as having the meaning of arbitration and vice versa. It may be probable that the proposed legislative texts on conciliation could be a kind of useful method to prevent such confusion from being uncontrollable. It is, therefore, necessary that the legislative texts should be introduced into Korea as a legislation on conciliation.

사용후 핵연료 관리 정책과 국제 동향 (National Policy and Status on Management of Spent Nuclear Fuel)

  • 2005년말 현재, 전세계 32개국에서 443기의 원자력발전소가 운영되고 있다. 현재 전체발전량은 약 3,000 TWh이며 전세계 전력공급의 약 16 퍼센트를 차지하고 있다. 2004년말 사용후핵 연료는 전세계 원전의 발전용량 368 GWe에서 매년 11,000 tHM 정도 발생되고 있으며 현재 운영중인 대부분의 원전이 가동정지가 예상되는 2020년에는 445,000 tHM까지 예상되고 있다. 이러한 관점에서, 사용후핵 연료 관리는 전체 IAEA 회원국에게는 그들이 취하고 있는 후행핵 연료주기 정책과 전략에 관계없이 국제협력 등을 통해 가까운 장래에 시급히 그리고 반드시 해결해야 할 필수 사안임이 분명하다. 지난 2006년 5월 15일부터 2주간 제2차 방사성폐기물안전협약 체약국회의가 오스트리아 IAEA본부에서 개최되었다. 동 회의에서 사용후 핵연료에 대한 국가 정책 및 전략, 그리고 그들의 현황, 향후 전망, 정책에 일차적으로 고려한 인자와 이행내용 등이 심층논의되었으며, 향후 개별 국가의 노력 및 국제협력의 방향 등이 확인되었다. 본 논문에서는 상기협약에서 논의된 사용후핵 연료 관리에 대한 국가정책 및 향후 추세 둥을 자세히 기술하였다. 또한 주요국가의 최근 이행내용도 요약정리 하였다.

국제상사조정 및 중재제도 개선에 관한 UNCITRAL 논의동향 (Discussion by UNCITRAL for Development of International Commercial Conciliation and Arbitration Systems)

  • At its thirty-second session in 1999, the UNCITRAL had before it the requested note entitled "Possible future work in the area of international commercial arbitration." After concluding the discussion on its future work in the area of international commercial arbitration, it was agreed that the priority items for the working group should be conciliation, requirement of written form for the arbitration and enforceability of interim measures of protection. the Commission entrusted the work to the Working Group on Arbitration which held its thirty-second session at Vienna from 20 to 31 March 2000. The Working Group discussed agenda item 3 on the basis of the report of Secretary General entitled "Possible uniform rules on certain issues concerning settlement of commercial disputes : conciliation, interim measures of protection, written form for arbitration agreement." At its thirty-three session in 2000, the UNCITRAL had before it the report of Secretary General on agenda item 3 discussed by the Working Group. The Working Group discussed the issues relating to certain aspects of conciliation proceedings ; (1) Admissibility of certain evidence in subsequent judicial or arbitral proceedings ; (2) Role of conciliatior in arbitration or court proceedings ; (3) Enforceability of settlement agreements reached in conciliation proceedings ; (4) Other possible items for harmonized treatment : a) Admissibility or desirability of conciliation by arbitrators b) Effect of an agreement to conciliate on judicial or arbitral proceedings c) Effect of conciliation on the running of limitation period d) Communication between the conciliator and parties ; disclosure of information e) Role of conciliator. It was generally considered that decisions as to the form of the text to be prepared should be made at a later stage when the substance of prepared solutions would become clearer. However, it was noted that model legislative provisions seemed to be appropriate form for a number of matters proposed to be discussed in the area conciliation. There was general support in the Working Group for the proposition to perpare a legislative regime governing the enforcement of interim measures of protection ordered by arbitral tribunals. It was generally considered that legislative regime should apply to enforcement of interim measures issued in arbitration taking place in State where enforcement was sought as well as outside that State. It was generally observed that there was a need for provisions which conformed to current practice in international trade with regard to requirements of written form for arbitration agreement. The view was adopted by the Working Group that the objective of ensuring a uniform interpretation of the form requirement that responded to the needs of international trade could be achieved by : preparing a model legislative provision clarifying, for avoidance of doubt, the scope of article 7(2) of the UNCITRAL Model Law on International Commercial Arbitration : and adopting a declaration, resolution or statement addressing the interpretation of the New York Convention that would reflect a broad understanding of the form requirement. There was general agreement in the Working Group that, in order to promote the use of electronic commerce for international trade and leave the parties free to agree to the use of arbitration in the electronic commerce sphere, article II(2) of the New York Convention should be interpreted to cover the use of electronic means of communication as defined un article 2 of the Model Law on Electronic Commerce and that it required no amendment to do that. The UNCITRAL may wish to consider to the desirability of preparing uniform provisions on any of those issues concerning conciliation and arbitration proceedings, possibly indicating whether future work should be towards a legislative text or non-legislative text.

EU의 우주행동강령의 의미와 평가 (EU's Space Code of Conduct: Right Step Forward)

  • 유럽연합(European Union: EU)이 2012년 6월 유엔의 우주의평화적이용위원회(COPUOS) 제 55차 회기에서 공식 제기한 우주활동의 국제 행동규범안(Draft International Code of Conduct for Outer Space Activities)은 그간 우주에서의 국가 활동 규범에 대한 미비한 요소들을 제시한 내용으로서 국제사회의 관심을 끌기에 충분한 내용이다. 현재 우주에서의 미비한 질서는 군비경쟁 금지, 우주쓰레기 경감 등을 통한 우주의 안전과 안보를 위한 지침, 그리고 우주활동의 정보를 참여 국가 간 교환하는 것이라고 할 수 있는 바, EU의 상기 제안은 여사한 문제들에 대한 행동 강령을 정한 것으로서 주목되는 내용이다. 2008년 말부터 시작된 EU의 제안 활동은 그간 일부 우주활동 국가들, 특히 미국과의 비공식 접촉을 통하여 접촉대상국들의 의견도 반영한 가운데 2013년 채택을 목표로 하는 자발적 이행 규범으로서 강제력을 가지고 있지는 않지만 미국은 우주에서의 군축 관련 규범 제정의 필요성에 탄력을 제공하는 계기가 될 가능성에 우려하는 가운데 현재는 방관하고 있는 입장으로 보인다. 이러한 미국의 입장은 우주에서 전략적 우위를 점하고 있다는 자국의 이익이 군축에 관한 규범의 제정으로 손상될 수 있다는 판단을 근거로 하고 있다. 이에 따라 미국은 유엔 총회에서 우주에서의 군비경쟁 방지(PAROS)에 관한 결의에 반대하고 군축회의(Conference on Disarmament: CD)에서 오랫동안 논의되어 왔던 우주에서의 군축을 촉구하는 논의의 장을 마련하는 것에 반대하여 왔다. 중국과 러시아는 2008년 우주에서의 군축에 관한 PPWT (Treaty on Prevention of the Placement of Weapons in Outer Space and of the Threat or Use of Force against Outer Space Objects)채택을 제안하였는 바, EU의 제안은 자신들이 제안한 PPWT의 추력을 저상시키는 내용이 되기 때문에 불편한 심정으로서 역시 소극적인 입장이다. 한편, 미국이 상기 입장의 연장선 상에서 PPWT에 반대 입장을 취하는 것은 이해하기 어렵지 않다. EU의 행동규범안은 주요 우주대국의 군사전략적 측면에서의 이해관계 때문에 그 장래가 명확치 않으나 우주쓰레기의 경감을 위하여 노력하고 우주활동의 정보를 상호교환하면서 우주에서의 안전과 안보를 보장을 통하여 가능한 우주의 평화적 이용과 탐사라는 기본 명제를 극대화 시키는 효과를 가져오는 것으로서 매우 바람직한 조치로 간주된다. 단, 동 규범안은 참여 국가들간의 협조와 연락업무를 수행하기 위하여 상설기구를 설치하도록 되어있지만 이는 기존 조직인 유엔외기권사무소(UN Office for Outer Space Affairs)가 담당하도록 할 경우 효율과 경제를 도모할 수 있을 것이다. 동 규범안에 대한 추후 구체 협상 시 여사한 내용도 논의될 것으로 보지만 EU의 우주활동의 안전과 안보에 관한 조치는 환경문제에서와 같이 국제사회를 이끌어가는 또 하나의 의미있는 기여로 평가받아야 한다.
