Apple eases up on SDK policy: Avoiding antitrust? or strategic decision? (Apple의 폐쇄적 SDK정책 포기의 함의: 반독점성 시비의 회피와 전략적 결정)

  • Apple recently announced a new policy about software development kit that banned the use of tools that convert apps built on other platforms into iPhone apps. Therefore, Adobe cannot develop their software to AppStore that inquire to the Department of Justice and the Federal Trade Commission about antitrust actions. Someone argue that Apple try to exclusive smartphone market such as the Microsoft antitrust lawsuit in 1998, but this case is essentially different. First, it need to define Apple's software development kit for iPhone and iPad is whether antitrust or not. Because of the characteristics of two-sided market in Smartphone Apple's iPhone cannot monopoly in cellphone or smartphone market, but it can be an antitrust in application store market. However, Apple re-announced new software development kit policy that shows positive results. Instead of hastily intervened regulatory agencies, the DOJ or the FTC, it is quite desirable that watching the interaction between companies that whether market failures or not and if it's harmful for consumer's benefit. Adobe attack Apple to advocate consumers and developers freedom of choice, but the most important thing is conclusion based on a comprehensive analysis need to objective point of view that Apple do whether antitrust act or not and damage to developers and consumers who are both side of platform.

The Principle of Good Faith under Uniform Commercial Code (미국 통일상법전상 신의성실의 원칙)

  • The Uniform Commercial Code (UCC) sets the standards of good faith in a commercial transaction for the sale of goods. With every sales contract, there is an implied obligation for both the seller and the buyer to negotiate the contract and perform under the terms of the contract in good faith. The agreement between both parties and the customs in the industry determine how the good faith standard should be applied to a particular transaction. Generally, the meaning of good faith, though always based on honesty, may vary depending on the specific context in which it is used. A person is said to buy in good faith when he or she holds an honest belief in his or her right or title to the property and has no knowledge or reason to know of any defect in the title. In section 1-201 of the UCC good faith is defined generally as "honesty in fact in the conduct or transaction concerned." Article 2 of the UCC says "good faith in the case of a merchant means honesty in fact and the observance of reasonable commercial standards of fair dealing in the trade." The sales contract will generally determine which party is required to perform first. This provision helps to determine if the buyer or the seller is in breach of the agreement due to failing to perform as stated by the contract. Either the seller must deliver the items before the buyer is required to accept and pay or the buyer must pay for the items before the seller has the duty to act in good faith and deliver the items in a reasonable manner. If the contract does not specifically define who is required to perform, industry customs and fair trade may determine what is acceptable for the transaction. Under the UCC, the buyer is required to pay for the goods when they are delivered, unless the contract states otherwise. Therefore, the UCC imposes an obligation of good faith on the performance of every contract or duty under its purview. The law also generally requires good faith of fiduciaries and agents acting on behalf of their principals. This article discusses problems of the principles of good faith under the UCC. Specifically, this paper focuses on the interpretation of UCC sections and analysis of various cases. By comparing, also, UCC and Korean law, the paper proposes some implications of good faith issues for Korean law.

Analysis of trade newspapers related to dental hygienists as healthcare professionals using language analysis technique: using R program (언어분석기법을 활용한 치과위생사의 의료인화 관련 신문기사 분석: R 프로그램 이용)

  • Objectives: The purposes of this study were to analyze the trade newspapers related to 'recognition of the dental hygienist as the healthcare professional' using R program and to identify opinions of groups concerned with dental hygienists. Methods: This study was designed with contents analysis and cross-sectional. The subjects of the study were the articles for the last three years in medical and dental newspapers about the recognition of the dental hygienist as the healthcare professional. The collected articles were categorized and classified for each group's opinions about the issue. The key words were extracted according to the priorities of the opinions of agreement and disagreement. They were visualized after frequency analysis using R, a big data analysis program. Results: A total of 237 newspaper articles were extracted among 270 ones containing opinions. 245 were positive opinions and 25 were negatives. The main key words of the agreement were 'Amendment of Medical Law', 'Medical Practice', and 'Legal Guarantee of the Practice'. Advocates addressed that the issues should be resolved with the amendment of the law, as dental hygienists are not guaranteed to work based on the current law although they are actually doing the medical practices. Main key words of disagreement were 'Legal Guarantee of the Practice', 'Revision of Medical Technician Law', and 'Review of Job Type'. They described that the problem can be resolved by revising medical technicians act, and it needs to consider as job types of all healthcare professional. Conclusions: In the group who showed the positive opinions, it is possible to utilize measures such as promoting the cooperation of dental hygienists and developing public consensus through publicity.

The Legal Issues of Private Investigation Service in WTO/FTA System : Study of South Korea (WTO/ FTA 체제에서 민간조사업의 법적문제)

  • As crimes have increased to an extent that the police cannot cope with, there have been continuous discussions for the introduction of Private Investigation (hereafter PI) in Korea. However, attempts to legislate for the introduction of PI have failed every time PI bills for the introduction of PI were proposed. This was fundamentally because arguments both for and against the introduction of PI were sharply divided depending on the priorities. However, regardless of those clash of views, an apparent need for the legislation of PI service has arisen. As Korea opens its service market to other countries through GATS and FTAs, currently existing domestic PI law has been found to be inconsistent with international agreements such as GATS and KOREA-US(KORUS) FTA. This paper found that the Act on Usage and Protection of Credit Information which regulates PI service is inconsistent with the Article 12.4(a)(i) and (iii) of KORUS FTA and the Article 7.11 and the Article 7.13 of KOREA-EU FTA. If Korea does not modify the existing laws and establish new laws in relation to PI, such inconsistencies could lead to international trade disputes which could amount to billions of dollars. In this regard, the passage of the PI bill is necessary.

A study on the improvement of import conditions for salmonid fish to reduce the possibility of entry of infectious salmon anaemia virus (전염성연어빈혈증(Infectious salmon anaemia) 바이러스의 국내 유입 가능성 저감을 위한 연어과 어류 수입조건 개선안)

  • As Korea declared that the entire country is free from ISA (Infectious salmon anaemia) based on the OIE aquatic code in 2019, it is necessary to improve the import quarantine system that meets the level of ISA management in Korea. Currently, Korea imports Atlantic salmon and rainbow trout from countries which have history of ISA outbreak such as Norway and the United States, so there is a constant possibility that trade with these countries will bring ISAV (Infectious salmon anaemia virus) into Korea. Therefore, some amendments to the Aquatic Life Diseases Control Act (ALDCA) are needed to prevent the entry of ISAV into the Korea through international trade. The amendment to the ALDCA should contain a list of countries, zones or compartments that the Korean competent authority has allowed or banned imports of ISA-susceptible fish. In addition, the subordinate statutes or administrative rules of the ALDCA need to be revised so that on-site inspections/audit can be conducted for the evaluation of the ISA management system in exporting countries. After the revision of the subordinate statutes or administrative rules, it is necessary to strengthen the present import conditions in line with those that meet the level of ISA management in Korea. As for the strengthened import conditions, the competent authorities of exporting countries must export only salmonid fish produced in zones or compartments declared freedom of ISA to Korea, and must prove through lab-testing that ISAV should not be detected in the fish exporting to Korea. In addition, official veterinarians/fish health professionals of the exporting country should check the health status of the fish within 72 hours prior to export. Also, competent authorities of the exporting countries must attest that fish storage containers and water, ice and other equipment used for transportation should be cleaned and disinfected to avoid contamination with pathogens, including ISA. Therefore, the proposed measures presented here will further improve the current import condition for salmonid fish and assist decision-making on strategies to reduce the risk of ISA introduction into Korea. Also, it is expected to contribute to maintain the status of ISA-free country.

A Study on the Ways of Preparation of Disclosure Document and its Utilisation in Franchising: From a Franchisor Viewpoint (가맹사업에 있어 정보공개서의 작성 및 등록제도의 활용에 관한 연구 : 가맹본부입장에서)

  • The Freedom of Information System has been introduced into the society based on the Fair Trade Transactions Act, which was established by Fair Trade Commission (FTC) on May, 2002. However, the system itself has showed limitations in guaranteeing a reliability and transparency of the disclosure document. Thus, since February, 2008, FTC not only made franchisors to register disclosure documents but also adopted the Disclosure Document Registration System, which forced them to provide registered disclosure documents to franchise applicants and franchisee. Franchisors consider the newly adopted Disclosure Document Registration System a restrictive system. However, considering the recent trend of fast growing franchising industry and the importance of being competitive, franchisors need to utilize the disclosure documents to promote their business and to gain trusts from franchise applicants by providing truthful information. In that way, franchisors will be able to establish a foundation that franchising industry might be successful and reduce the agency fee by cutting out conflicts with franchisees. Thus, this study aims to study the ways of effective preparation of disclosure document and its utilization from a franchisor viewpoint.

  • Recently, accumulation of technology, transfer, absorption, and commercialization is being significantly recognized as a key factor for sustainable growth of the 21st century global economy. The government established "Technology Transfer and Commercialization Promotion Act" In order that the technology developed at public research institutions can be transferred to the private sector and commercialized; the technology developed in the private sector can be traded and commercialized. Also, the Article 14 of "Technology Transfer and Commercialization Promotion Act" is concerning technology transfer agents' registration, promotion, and support: it introduced the special status system of technology transfer agents and the government registers, manages, and supervises it. In most developed countries, the technology transfer agency is transferred to the private sector and it is referred as a technology transfer agent or technology broker. In the domestic market, despite the introduction of the above special status system and the building a various organization and transfer medium system for boosting the market's revitalization, some problems occurred; because the registration system of a technology transfer agent and legal basis and system about its following-up control fall short. For example, recently technology transfer-related performance exemption has brought the activation of technology transfer agent's registration, but there was the limit of selecting the expert above a certain level. Therefore, some countermeasures for this are urgent, In addition, through a compulsory training completion system before the technology trade agent registration is prepared, a short period of curriculum was not sufficient to provide applicants various specialized knowledge. In this research, it is considered about the reform of technology transfer agent through its comparative study in China and Korea. Some improvements are suggested for expanding the market of technology transfer commercialization, assuring the agents' service and strengthening the competitiveness.

  • The quantitative increase in maritime transport for domestic and foreign trade is one of the main reasons for the increase in marine pollution accidents. Despite the implementation of relevant laws in each country to prevent and mitigate marine pollution accidents caused by ships, human negligence (carelessness, intention, etc.) by ship workers has been reported as the biggest cause of marine pollution accidents. One of the most effective ways to reduce marine pollution accidents caused by ships is to reduce human negligence through systematic education and training of ship workers. Therefore, this study aimed to review the appropriateness of the statutory education and training curriculum for ship marine pollution prevention managers in accordance with domestic laws and regulations such as the 「Marine Environment Management Act」 and suggest improvement measures. To this end, we compared and analyzed the legal training·general education courses related to the prevention of marine pollution and marine disasters in Japan, where the laws and systems are similar to Korea, and investigated the cases of legal training for experts in land pollution prevention in Korea.

A Study on the Legal Standard and Verification Cases for the Judgement of the Tax Tribunal of FTA Conventional Tariffs (FTA 협정관세 심판청구결정의 법적 기준과 검증사례에 관한 연구)

  • The FTA conventional tariffs shall be applied that the imported goods are subject to the conventional tariffs under any agreement, and the origin of the good is the contracting state in accordance with the criteria for determination origin under any agreement. An importer who intends to be eligible for the application of a conventional tariff shall file a request for the application of a conventional tariff with the head of the competent customs house before the relevant import declaration is accepted. The purpose of this study is to examine the legal standard and verification cases for the judgement of the tax tribunal of FTA conventional tariffs. Through this study, this paper is to provide several implications for companies seeking the benefits of FTA conventional tariffs. The Korean companies to do the following: confirm the effective requirements for direct transport of goods through non-parties under the Korea EU FTA, confirm the criterion for application of conventional tariffs such as certificate of origin and claims for ex post facto conventional tariffs under the Korea US FTA, confirm the issuer of origin declaration and the recognition of origin declaration of bill of lading under the Korea EU FTA, utilize the tax appeal system by denial of FTA conventional tariffs, and prepare the discrepancies in interpretation of legal standard under FTA and FTA Special Customs Act.

Advancement Plan on Hazardous Material Classification and Comparative Study of the Criteria in UN GHS and Safety Control of Dangerous Substances Act (UN GHS와 위험물안전관리법상의 위험물질 분류기준 비교 및 선진화 방안 연구)

  • With the rapid change of industry and the development of science and technology, more than 100,000 industrial chemicals are being used and 2,000 new materials are developed every year. Chemical products have had favorable influence on our daily life and contributed very much to the prosper of human culture. But some materials are inherently poisonous and dangerous. Korea ranks as the number 7 in world's chemical products market and the chemical sector is contributing to the economic revival through importing and exporting of the products. With the increasing domestic as well as international interests about REACH and GHS, the need for the effective and efficient chemical material management system is getting bigger and bigger. In this research, we compare the criteria in UN GHS and Safety Control of Dangerous Substances Act of Korea for the development of global standard test methods and the classification and labelling for the chemicals, and suggest an advancement plan for the introduction of the GHS in a building block approach. In addition, providing the harmonized information about chemical hazards is suggested for the elimination of international trade barriers for chemical industries.
