The Study on Modification Methods of Residents Registration Number System (주민등록번호제도 변경방안에 관한 연구 : 주요 쟁점에 대한 인식조사를 중심으로)

  • On 23th December in 2015, Constitutional court of Korea decided the Resident Registration Act which could not changed one's Resident Registration Number was Unconformable to Constitution. And declared that the Resident Registration Act had to amend the article. This study analyzes the issues and preferences of people about the modification methods of Resident Registration Number System. In result, the residents agree on the autonomy of residents registration number change and prefer not including personal information to including personal information in registration number system. And the residents want to operate the Second number system besides resident registration number. However, they don't want to pay the change cost of resident registration number system. This results give a few of implications when the change methods of resident registration system would be prepared.

  • In 2015, Constitutional court of Korea declared that the Resident Registration Act was unconformable to Constitution. Therefore, the Resident Registration Act have to amend the article before 2018 for allowing to change one's Resident Registration Number. The most expensive cost to change one's Resident Registration Number System is the uncomfortable cost of changing the Number. This study invests the uncomfortable cost of changing the Number by Willingness to pay Method. In result, the cost of changing all 13 numbers would \ 160,000, the cost of changing 7 numbers would \ 108,000, and the cost of making Second Registration Number would \ 110,000. This result could be used to analyze the B/C ratio of changing the Resident Registration Number System.

  • From February 18, 2013, an information and communications service provider, we will not be able to collect the resident registration number by paragraph 2 of Article 23 of the Act on the Promotion of the use and protection of information and information network. Rather than a revision in accordance with resident registration number, than these laws, it had been used in the alternative, such as OTP authentication phone authentication I-PIN authentication of certificates that are recognized as such authentication. In this paper, we propose a new online identity authentication technology was and Utilization of IMEI, the OTP to introduce online identity authentication technology replacing the resident registration number.

  • As the status of public certificates expired due to the recent revision of the Electronic Signature Act, electronic signature-based public certificates were also lost in the means of replacing resident registration numbers(RRN). As a result, public certification institutions have recently been designated by the Korea Communications Commission as identity verification service providers through a review of the designation of personal identity proofing agency based on alternative means of RRN. However, unlike existing RRN replacements such as i-PIN, mobile phones, and credit cards, the personal identity proofing process for applicants for certificates is different from existing alternatives. The proposed method shows that it is possible to protect users' personal information and provide universal, reasonable, and safe identification services by applying improvements to electronic signature-based personal identity proofing services.

  • The Korean Housing Lease Act is special law of Civil Code and was enacted from March 5, 1981 as Law No. 3379 to guarantee the stability of residential life. And until January 6, 2015 there were 15 times revisions to protect the right of homeless people. However, it is true that many problems are exposed from enforcement. Because the processing without sufficient review of legislation. and it was enacted very quickly, so, at the part of opposing power that the Article 3 Paragraph 1 "if the housing tenant was delivered rental housing and finish the resident registration, from the day after even if the owner of the house was changed as third party tenant can resist with lease right". In addition, this provision made housing problems of the socially disadvantaged more seriously and the country did not made any way to protect this problems so many issues have been raised and a lot of disputes relating to Housing Lease. Therefore, in this paper derives a problem about opposing power of the Housing Lease Act for tenants of residential stability, and through the foreign legislation case, it propose the improvement to contribute to the residential stability realistically.

A Study on the Prevention of Appropriate Store and Gentrification to Restore the Function of the Commercial District in the Original City

  • Purpose: We would like to identify the appropriate size of stores in the commercial district suitable for the era of low growth. In addition, it is intended to present alternatives to prevent gentrification along with measures to revitalize commercial districts according to the selection of appropriate stores. Research design, data and methodology: The importance and commercial district usage patterns were identified through surveys by consumers and sellers. the demand and size of the commercial area were calculated based on the floating population and resident registration population. In addition, based on this, through metric analysis, the importance of the business district activation plan and what important matters can prevent gentrification were analyzed. Result: In this the study, 555 stores are currently operating in the target area, but it is seen as a commercial district with a scale that can operate 136 stores and 938 stores. In addition, it was analyzed that the Commercial Lease Protection Act needs to be strengthened to prevent gentrification. Conclusions: Due to the nature of small and medium-sized cities in Korea, commercial districts that have once lost their resilience must take much effort to find vitality. It is believed that local commercial districts will have resilience when diagnosis and recovery measures are adequately presented.

Consolidation of Protection for Lessees by Improvement of Opposing Power System of the Unregistered Housing Leases (미등기 주택임대차의 대항력 관련 제도개선을 통한 임차인보호 강화)

  • According to the Housing Lease Protection Act, even though it is not registered, if the lessee has completed delivery of a house and the resident registration, the lease shall take effect against the third person from the following day thereof. Any lessee who has met the requirements for opposing power and obtained the fixed date on the lease contract document, shall be entitled to receive the repayment of the deposit from the converted price of the leased house, in preference to any junior obligors and other creditors, at the time of an auction as provided by the Civil Execution Act and a public sale as prescribed by the National Tax Collection Act. The lessee shall be entitled to receive a repayment of a specified amount of the deposit in preference to other persons having the security rights in the leased house. However those provisions give rise to many problems because the Housing Lease Protection Act allows the opposing power and the right of preferential payment from the following date of fulfillment of the requirement. For the purpose of solving the problems, this study suggests that the Housing Lease Protection Act need to be amended as follows. The fixed date should be added to the requirement of opposing power and the preferential right of specified deposit repayment. In addition, the commencement of opposing power and preferential right of deposit repayment need to be taken effect from the day that the requirement is fulfilled.

Standards for recognition and approval rate of occupational cerebro-cardiovascular diseases in Korea

  • Background: Although working hours have decreased in Korea, they are still high compared to that of other countries. In Korea, cardiovascular and cerebrovascular diseases (CCVDs) related to overwork in Korea continually occur, and the social burden from overwork is estimated to be high. This study investigated the amendment of regulations affecting the approval rate of occupational CCVDs. Methods: The change in approval rate of occupational CCVDs and related regulations were investigated using the Act and public notice on the standards for recognition of occupational CCVDs and the yearbooks of the Ministry of Employment and Labor. The CCVD mortality was estimated using data on the number of deaths according to the cause of death, the number of employed people, and resident registration population aged 15-64 years. The cumulative mortality of CCVDs was estimated using the Kaplan-Meier method. Results: Since the establishment of the standards for recognition in Korea in 1982, the scope of occupational diseases has been expanded to include intracerebral hemorrhage, subarachnoid hemorrhage, cerebral infarction, myocardial infarction, and aortic dissection. In 2013, the concept of working hours was introduced in chronic overwork. The approval rate of occupational CCVDs was 44.7% in 2006, which decreased to 12.9% in 2011. After the improvement of related regulations, the approval rate increased to 41.3% in 2018. From 2000 to 2017, the CCVD mortality of both the unemployed and employed tended to decrease, and their cumulative CCVD mortalities were 549.3 and 319.7 per 100,000 people, respectively. Conclusions: CCVDs are recognized as occupational diseases in Korea. The amendments to the standards for recognition, the introduction of the Occupational Disease Adjudication Committee, the principle of presumption, and the reduction of working hours have changed the approval rate of occupational CCVDs. A strategic approach is needed to further reduce the incidence of CCVDs.

  • Personal information processing works, including resident registration number is common to be consigned by IT specialized company due to high level expertise and tremendous cost. The accident related to personal information is increasing and most of accidents are caused by the consignee's leaking information. According to the Inspection of personal information protection and the management level diagnosis of personal information protection, public Institutions need to build the consignee's accident prevention and personal information management system as soon as possible. In this paper, the efficient enhancement ways for the personal information protection is studied. We analyze the law of business consignment and select basic management items related with personal information protection, and propose a analysis scheme for management level of personal information protection and a enhancement scheme for management system of personal information protection. This paper suggests consignee's management system of personal information protection for the enhancement way and the three Strengthening ways in law. To compose the a enhancement scheme for management system of personal information protection, we conduct questionnaire survey to 30 consignees(IT maintenance, notice printing, call center, welfare center) related to typical tasks of public organizations, present reference for this scheme, and execute verification of this scheme by focus group interview of consignor and consignee.

A Legal Review of Personal Information Protection for Invigorating Online Targeted Advertising: Focusing on the Concept of Personal Information (온라인 맞춤형 광고 활성화를 위한 개인 정보 보호에 대한 법적 고찰: '개인 정보'의 개념을 중심으로)

  • This study analysed the legal concept of personal information(PI), which was not differentiated from behavioral information, and established it clearly for invigorating online targeted advertising(OTA), which draw attention in big data era; by selecting Guidelines of Assessment of Data Breach Incident Factors and Guidelines of Measures for No-Identifying Personal Information based on Personal Information Protection Act(PIPA) and Enforcement Decree of the PIPA. As a result, PI was defined as any kind of information relating to (1)a living individual(not group, corporate body or things etc.); (2)makes possibly identify the individual by his or her identifiers such as name, resident registration number, image, etc. (not included if not identify the individual); and (3)including information like attribute values which makes possibly identify any specific individual, if not by itself, but combined with other information which can be actually collected and combined). Specifically, PI includes basic, proper distinguishable, sensitive and other PI. It is suggested that PI concept should be researched continually with digital technology development; the effectiveness of the Guidelines of PI Protection in OTA, the legal principles of PI protection from not only users' but business operators' perspectives and the differentiation between PI and behavioral information in OTA should be researched.
