Suggestions for the Non-Taxation Scheme on the Compensation for Employee Invention of the University (대학 직무발명 보상금 비과세제도에 대한 제언)

  • The compensation for employee invention from the university can be taxed or non-taxed depending on the classification of the type of income. The government legislated the Promotion of Industrial Education and Industry-Academic Cooperation Act and the Technology Transfer and Commercialization Promotion Act in order to improve the research productivity of universities and industrial-academic collaboration via transferring the technologies. However, the confusion with taxation on the compensation of employee invention from the university has been incurred due to the difference of legal interpretation between government bureaus. In this research, bureaucratic conflict on the non-taxation scheme is examined in a legal aspect and the effect of non-taxation scheme is also studied in aspect to personal tax exemption. Finally, some suggestions are provided for the purpose of settlement of the non-taxation scheme in order to improve employee invention from the university.

An Analysis of Citation Counts of ETRI-Invented US Patents

  • From its foundation until 2004, ETRI has registered over 1,000 US patents. This letter analyzes the characteristics of these patents and addresses the explanatory factors affecting their citation counts. For explanatory variables, research team related variables, invention specific variables, and geographical domain related variables are suggested. Zero-altered count data models are used to test the impact of independent variables. A key finding is that technological cumulativeness, the scale of invention, outputs in the electronic field, and the degree of dependence on the US technology domain positively affect the citation counts of ETRI-invented US patents. The magnitude of international presence appears to negatively affect the citation counts of ETRI-invented US patents.

Exploring How to Develop Teaching & Learning Materials to Create New Problems for Invention ('문제 만들기' 활동을 통한 발명 교수·학습자료 개발 방향 탐색)

  • This research aimed to develop problem creating worksheets as a teaching & learning material for problem solving activities and assess its effectiveness. Activity worksheets for creative problem development were established. The effectiveness of the problem-creating classes taught to gifted students in invention was evaluated. In addition, effective strategies for encouraging problem creating and question making in teaching & learning processes were explored. The creative problem identification activity consisted of 5 steps, which are idea creation, convergence, execution, and evaluation. The results showed that elementary and middle school students taught in the classes using this problem-identification worksheet were highly satisfied with the program. This study concluded that it requires an educational environment, government level collaboration, and support to create a mature social atmosphere and educational environment motivating students to keep asking questions and identify problems. Through continual modification, additional ongoing efforts to increase the credibility and the quality of the worksheets as a creative problem solving and learning tool will be needed.

Curriculum and Implementation of 'Invention Classroom' in Seoul Area (서울지역 발명교실의 교육과정 분석 및 운영 실태)

  • The purpose of this study was to suggest the basement in making definite curriculum through the analysis of the curriculum and implementation of Invention Classroom in Seoul area and findings of the problems perceived by the teachers. This study analyzed the curriculums of 19 'invention classrooms' in Seoul area, asked the teachers about the problems and things to need improving through interviews and the results are following. First, it is necessary to make the more definite curriculum because there is a little big gap between the regions and the teachers in running the 'Invention Classrooms'. Second, it is necessary to narrow the gaps through the definite curriculum because the purposes, contents, teaching methods and evaluation tools perceived most importantly or emphasized most by the teachers were so different from the real suggestion in the curriculums. Third, it is necessary to suggest the definite guideline in order to overcome the regional gaps because there are a little big gap of implementation between the classes in planning teaching periods, credits needed and so on. Fourth, the teachers have perceived many problems in educational, administrational and financial aspect and so it is necessary to properly reflect them on planning the curriculum of Invention Classroom through many proper studies to improve them.

Effect upon The Technical Development and Production Stage of Technical Innovation in Small and Medium Industry (중소기업 기술혁신이 기술개발과 생산단계에 미치는 영향 실태분석)

  • The impact of technical innovation upon technical development and production stage in small and medium industry was analyzed through a survey. 54.0% of the respondents answered that employee invention compensation system was 'highly helpful' to technical innovation, while 23% 'important'. 170 of the respondents answered that technical innovation due to employee invention compensation system took place at the stage of 'technical development', while 138 'idea gathering'. That explains that many innovative activities are taking place in the course of idea gathering from customers, competitors and experts; and production stage also requires innovative activities.

  • There has been some controversy about imposing income tax on the compensation for university employees' inventions. In this research, various issues of taxation related to such compensation are examined, with Supreme Court Judgement 2014Du15559 as a means of understanding the confusion associated with this taxation. An amendment of the Income Tax Law is proposed based on the examination results, in order to promote research in the university field, which is able to make various types of compensation for employee inventions fall into the category of tax exemptions. It is concluded that if the Income Tax Law is amended to refer to the definition of technology in the Technology Transfer and Commercialization Promotion Act, instead of that of the Invention Promotion Act, the compensation resulting from newly emerging IPRs and technical know-how, which are currently taxed, can become tax exempt.

  • This paper presents the response strategy taken by the both parties who possess and infringe the patent rights in the case of patent litigation occurring in local companies. It is common that many entrepreneurs suffer from patent judgment litigation related to the intellectual property rights. Response strategy on the standpoints of patentees and trespassers are discussed in several cases such as infringement and abuse of patent rights, divulgence of trade secret and invention during employment in small & medium sized enterprises.

A TRIZ-Based Solution to Problems in Red Ginseng Processing (트리즈를 활용한 홍삼 제조과정에서의 문제해결)

  • As the word 'creation and innovation' has been the keyword in success, there has been an increasing interest in TRIZ (Theory of inventive problem solving). So far, TRIZ has been applied to electronics and mechanics as the prime mover of product innovation. This study is to explore the applicability of TRIZ to the biotechnology sector, a future emerging technologies, especially to problem solving and innovative research and development. This study was focused on red ginseng processing. Problem causes and contradictions were identified with regard to processing-related problems, and 'the 40 principles of invention' were applied to problem solving. Steamed fresh ginseng is called 'Red ginseng'. Cracks in red ginseng cause the loss of active ingredients and also are not of merchantable quality. In the 40 principles of invention, applicable ones were finally selected through contradiction matrix and brainstorming, the tools of TRIZ. With experiments, effective methods were suggested to prevent red ginseng from cracking in a steaming process.

The impacts of the experince of donation for education to improve the teaching efficacy of pre-technology teacher with Invent touring activity (발명체험 교육기부활동이 예비기술교사의 교수 효능감에 미치는 영향)

  • The purpose of this study was to verify that the impacts of experience of donation for education to improve the teaching efficacy of pre-technology teacher. The Invention experience of donation for education was performed with Invent-touring sponsored by Chunnam National University Invention Education Center for Teachers and was included by development of creative problem solving program, program execution and evaluation. Research participants were Technology education Majors and minors 20 students. The active locations were D children community center, K alternative school, D Elementary School and D middle school. For the study, various literature researches were reviewed intensively about donation for education and teaching efficacy. The instrument for the study was the modified STEBI(Science Teaching Efficacy Beliefs Instrument) for technology education by 3 experts. This study was designed by single group pre and post test design (One-Group Pretest-Posttest Design) and was conducted by the pre-test and post-test. Check the reliability of the tool was conducted with Cronbach ${\alpha}$ coefficient analysis, pre-test 0.840, post-test 0.746. The analysis of data from the 5% significance level, paired sample t-test was performed using the SPSS 19.0 statistical tool. The results were as follows: 1. Teaching efficacy of pre-technology teachers who participated in the invention experience for educational donation technology has improved. 72. The qualitative study was performed by the interviews with students who participated in. Humanism was positively change and learning opportunity was provided to develop the competence of technology education teacher. Based upon the conclusion of this study, the donation activity for invention education need to use learning strategies for pre-technology teacher to improve teaching efficacy.
