제4차 산업혁명 시대의 자율주행자동차 상용화를 위한 안정적 법적 기반을 위한 법정책적 연구 - 자율주행자동차 특별법 제정(안)을 중심으로 - (The Propose a Legislation Bill to Apply Autonomous Cars and the Study for Status of Legal and Political Issues)

  • 2016년 다보스포럼에서 클라우드 슈밥이 언급한 '제4차 산업혁명'은 우리의 삶을 획기적으로 바꾸고 있으며, 그 정점에 자율주행자동차가 이 시대의 화두로 떠오르고 있다. 그러나 우리나라에서 자율주행자동차가 성공적으로 도입 및 정착되기까지는 아직 극복해야 할 과제들이 많이 있다. 특히 '인간' 중심의 법제도를 '인공지능'이 포함된 법제도로 패러다임을 변화해야 할 것이다. 자율주행자동차 시대의 안정적 운용을 위해서는 사람중심의 입법체계에 대한 획기적인 변화가 필요하다. 즉, 자율주행자동차를 운행하는 운행주체가 누구인지(무엇인지)와 일반도로에서 일반 자동차와 운행이 가능한지 여부, 교통사고 발생 시 민형사상 책임 문제, 자율주행자동차 관련 보험 문제, 개인정보수집과 이용에 관한 문제, 제3자에 의한 오남용 문제 등을 종합적이고 포괄적으로 검토해야 한다. 본 연구에서는 도로교통 관련 국내 법률, 해외 법제현황, 자율주행자동차 관련 법적 쟁점 등을 검토하여 입법론적 관점에서 자율주행자동차 운행 시 발생하는 제반 법적 문제 해결을 위한 별도의 법안 신설을 제안하며 그 법안에 대한 내용을 제시하였다.

  • 이 연구는 사회적 관심의 증대와 작은도서관 관련 독립법률인 「작은도서관 진흥법」의 제정 등을 통해 지속해서 증가하고 있는 작은도서관에 대하여 활성화 부진 원인을 진단하고 이를 개선하기 위한 정책을 제안하고자하였다. 이를 위해 작은도서관 운영 실태조사, 정책 및 지원과 법규 조사를 진행하였다. 이를 종합하여 작은도서관 활성화를 위한 정책 방향 및 과제를 제안하였다. 작은도서관 활성화를 위한 정책 과제는 '지역주민의 행복한 삶을 지원하는 작은도서관 활성화'라는 비전과 '포괄적 정책 근거, 정책 체계 혁신, 지속할 수 있는 운영 지원'의 핵심가치 아래 '정책기반 마련 및 실천 동력 확보를 위한 법·제도 개선', '정책 단위별 역할 재정립 및 협력체계 강화', '작은도서관의 안정적 운영지원체계 구축'이라는 3가지 추진과제와 14가지 세부과제로 구성하였다.

텍스트마이닝 기반의 재난현장 응급의료시설 대상지선정 프로세스 연구 (A Study on the Site Selection Process of Field Emergency Medical Facilities Based on Text Mining)

  • Purpose: In the case of mass disaster, the establishment of temporary medical facilities for the first aid and treatment is required for the stable accommodation of patients caused by the disaster. However, the criteria for decision making related to the deployment of field emergency medical facilities are not specified. So, The purpose of this study is to draw considerable factors needed for the deployment of field emergency medical facilities and to make proposal for site selection process of field emergency medical facilities on the basis of the factor. Methods: This study performs text mining of disaster-related laws, guidelines and documents to derive key factors affecting site selection, also proposes a decision making process and conducts virtual deployment to validate the process. Results: The key factors for the site selection derived as the size of the damage, the size of the DMAT inputs, the location of available place, and distance to the disaster base hospital. As a result of virtual deployment following proposed decision making process, It is confirmed that the site of field emergency medical facilities is changed depending on the type of disaster, even if the scope of the disaster damage was the same. Implications: The deployment of field emergency medical facilities requires a separate criteria for each type of disaster, not uniform, as a future research a quantitative approach of the criteria needs to be performed.

유통산업의 경쟁촉진을 위한 규제개혁 방안

  • The distribution sector is affected by a wide range of regulations. Many of these are related to health and safety, others are related to urban planning and environmental issues, whereas some mainly have an economic basis. But, regulations many be unduly restrictive, in which case they can drive up costs and ultimately prices, or they may, in some cases, reduce consumer choice. Unduly restrictive regulations could also increase costs indirectly, by reducing competition and thus lead to lower productivity growth. In the past few years, distribution sector has gone through drastic changes due to deregulation and market opening. Implementation of regulatory reforms served as an opportunity to change laws and systems which had been an obstacle to development of distribution sector. Market opening of distribution sector became a turning point to promote competition among domestic and foreign firms. However, for small and medium scale of the typical retail enterprises which were in no position to compete in terms of prices, additional facilities, and services, faced a threat of diminished trading area, and even of their existence. Because, large firms may have greater market power than small firms, as they can more easily extract favorable terms when procuring goods, and may also be able to deter entry by advertising outlays or access to the best sites. In addition, larger chain stores armied with sufficient capital dominated trading area and reduced customer's welfare by abusing their monopoly power when competing with other shops, and are often cited as an example of adverse effects of local monopoly. In order to minimize such adverse effects and to foster competition, regulatory reforms in distribution sector should set its goal to promote sound and stable distribution activities through market principle and restoring competition principle, and ultimately to boost customers welfare. Therefore, deregulation in distribution sector should be implemented in a way to promote customers welfare, eliminate entry barriers, and expand competition principle such as productivity and efficiency competition. However, it should be also recognized that deregulation of system alone is not enough to develop the distribution sector. To compete in a increasingly concentrated industry, small enterprises increasingly engage in co-operative arrangements, such as buying groups, strategic alliances or franchise agreements.

한일 다문화 정책에 대한 연구 (A Study on multi-cultural policies in Korea and Japan)

  • 다문화 사회와 다민족 국가의 도래는 새로운 시대적 변화이자 현상이다. 한국에 거주하는 이주민이 140만명이 넘는 사회적 변화는 한국적 상황에 적합한 새로운 이론과 정책의 필요성이 대두되었고, 우리나라 보다 먼저 다문화 사회로의 변화를 겪은 일본의 정책적 변화과정을 살펴보는 것은 매우 의미 있는 일이다. 본 연구에서는 한일 양국 간의 다문화정책의 추진이유, 법 제도 변화와 정책들을 비교분석하여 특징 및 차이점들을 알아 본 후 시사점을 도출하고 한국 상황에 맞는 새로운 다문화 정책 이론을 제시하였다. 새로운 한국적 다문화 정책은 첫째, 다양성 수용과 상호인정 둘째, 사회적 합의를 통한 정책의 방향성 수립 셋째, 다문화 규칙의 수립으로 경제적 규칙 및 정치적 규칙을 정립해야 할 것이다.

독일의 대체적 소비자분쟁해결법상 분쟁해결 절차에 관한 연구 -분쟁조정인의 법적 지위와 역할을 중심으로- (A Study on Dispute Resolution Procedures under the German Consumer Alternative Dispute Resolution Act)

  • The legal integration in the European Union that seeks a unified system in consumer disputes and the German Consumer Dispute Mediation Act based on this pursues the procedural fairness of consumer disputes and the equality of results. The role and legal status of the dispute mediator, who plays a very important role in this process, and the stable operation of the dispute resolution system and the guarantee of reasonable results through the guarantee of fairness and independence are very important values. In particular, the dispute mediator under the Act is conceptually different from the existing mediator or mediator, and through this distinction, the duties and contents of the dispute mediator are also distinguished. For this reason, the qualifications of dispute mediators that affect the outcome of dispute mediation are strictly stipulated. There have been some criticisms of this strictness, and such strictness is also seen as an excessive limitation. However, these standards can be understood as one of the efforts to make the dispute mediation procedure more systematic and to operate objectively in accordance with laws and procedures. In addition, in relation to the issue of independence and impartiality of the dispute mediator, the status of the dispute mediator is guaranteed in various aspects. In economic terms, it is not influenced by external factors, and furthermore, in order to guarantee job stability, the results of job security and dispute resolution are not linked. By examining the appropriate level of discipline for these dispute mediators, we expect the developmental growth of the consumer dispute resolution system under our Act.

제도와 정책이 기업 수익성에 미치는 영향에 관한 연구: 한·일간 농산물 유통정책의 차이에 따른 도매시장법인 수익성을 중심으로 (An Study on Effects of Strategy and Policies on the Corporate Profitability: Focusing on the Profitability of Wholesale Market Corporation for the Different Agricultural Marketing Policy in Korea and Japan)

  • Purpose - This study intended to identify the effects of varied institutional systems and policies that regulate or define operations of enterprises upon the profitability of private enterprises through case analysis. Design/methodology/approach - The systems and differences in the institution and commodity distribution in Korea and Japan, which define the operation of the "Garak Wholesale Market" and "Ota Wholesale Market". We were examined in the presentthis study, and the statistical data pertinent to the trade volume and profitability of wholesale market corporations that substantially run both markets, were analyzed. Findings - The competition among the corporations that run the "Garak Wholesale Market" substantially is limited due to regulations over the mode of transaction and monopoly of trust thereby significantly higher level of profitability and safety are guaranteed. However, the institutional autonomy that enabled each distributor in the "Ota Wholesale Market" to compete with each other freely caused the distributors therein face difficulties in securing stable profits due to the relatively poor level of profitability resulted from the autonomy. Research implications or Originality - It seems the autonomy in commercial transaction in the "Garak Wholesale Market" in Korea needs to be secured to promote the competition of distributors therein through an amelioration of institutional systems and amendment of relevant laws that prescribe current management of various distributors/operators in the market.

A field investigation on an expansive soil slope supported by a sheet-pile retaining structure

  • An expansive soil in 4970 special railway line in Dangyang City, China, has encountered a series of landslides due to the expansion characteristics of expansive soil over the past 50 years. Thereafter, a sheet-pile retaining structure was adopted to fortify the expansive soil slope after a comprehensive discussion. In order to evaluate the efficacy of engineering measure of sheet-pile retaining structure, the field test was carried out to investigate the lateral pressure and pile bending moment subjected to construction and service conditions, and the local daily rainfall was also recorded. It took more than 500 days to carry out the field investigation, and the general change laws of lateral pressure and pile bending moment versus local daily rainfall were obtained. The results show that the effect of rainfall on the moisture content of backfill behind the wall decreases with depth. The performance of sheet-pile retaining structure is sensitive to the intensity of rainfall. The arching effect is reduced significantly by employing a series of sheet behind piles. The lateral pressure behind the sheet exhibits a single-peak distribution. The turning point of the horizontal swelling pressure distribution is correlated with the self-weight pressure distribution of soil and the variation of soil moisture content. The measured pile bending moment is approximately 44% of the ultimate pile capacity, which indicates that the sheet-pile retaining structure is in a stable service condition with enough safety reserve.

북한 대외경제중재법의 실효성 고찰 (A Study on the Efficiency of the North Korean Foreign Economy Arbitration Law)

  • The economic cooperation between the South and North Koreas is a very important issue for the unification and economic development of both Koreas. In order to reach a successful economic cooperation, there is a need to coordinate the differences of the two countries before unification. The economic cooperation and the cooperation in other sectors will be followed by the entire unification. It is necessary to prepare a mechanism that could peacefully solve the conflicts and disputes that could arise during the actual process of cooperation, which will secure stable investments and trades. The study on the possibility of introducing the arbitration system as a conflict solving mechanism between the two Koreas is a very important subject, and the basis of this study is on the examination of the arbitration laws of North Korea. Therefore, the study on the efficiency of the North Korean arbitration laws on foreign economy is studying the possibility of a systematical solution to economic conflicts between the South and North Koreas. The problems and possible solutions of the North Korean foreign economy arbitration laws are summarized as follows. First, juridical cooperation system for both South and North courts of justice needs to be set up to smoothly carry out the main procedures. Mutual correspondence and telecommunication needs to be guaranteed, also remittance and the movement of goods shall precede. Second, the free liquidation of businesses by unit and the individual and independent management of wealth of the North Korean economic bodies, organizations and businesses shall precede to independently liquidate wealth and thus make arbitration possible. Third, amendments in the North Korea's foreign economy arbitration law shall be made to some parts of regulations on arbitration agreements and specific contents of written arbitration agreements to avoid conflicts regarding arbitration agreement. Fourth, the members of the North Korean arbitration committee shall impartially manage the committee only without taking the role of arbitrator, and the clause that allows the North Korean committee to nominate the arbitrator shall be erased. In case an agreement regarding the number of arbitrators is not reached, the three arbitrators general rule shall be applied. In case of requests from any of the parties, a third country arbitrator nomination shall be guaranteed. Also, the requested arbitrator by the party shall be nominated with the cooperation of the court. Fifth, the trial in case of non-appearance or written trial shall be added to the North Korean law in to prevent intended negligence or evasion. Sixth, regulations regarding the court's investigation of evidence shall be added to the North Korean law to make fair arbitration possible in case that government power is needed in order to investigate evidence. Seventh, provisions regarding majority decision shall be added in the North Korean law in the impossibility of unanimous decisions, and the certified system in the arbitration committee official text shall be erased to prevent arrogation and assure the power of the decision made by the arbitration government. Eighth, as "the wrong decision approved" reason for cancellation of arbitration in the North Korean law includes the content of the decision made by the arbitrator could lead to uselessness of arbitration, amendment will be necessary to limit it to legitimacy of the arbitration agreement and wrong procedures. It is hoped that this thesis will be of important use in understanding the issues on the workability and the solutions to the South and North Koreas' arbitration that could be presented during the negotiations for the countries' economic cooperation.

가상가치평가법을 이용한 대구수목원의 경제적 가치평가 (A Study on Economic Value of Daegu Arboretum based on Contingent Valuation Methods)

  • 수목원은 자연에서 생육하는 식물의 조사, 수집, 증식 보전을 통해 식물 종을 보전하고 식물 관련연구를 수행하며 식물을 일정한 야외나 실외 공간에 전시하여 국민들에게 식물에 대한 교육과 휴식공간을 제공하는 시설물이라고 정의 하고 있다. 이러한 수목원의 비시장적인 가치를 추정하기 위해 CVM 기법을 이용하여 대구수목원의 경제적 가치를 추정하였다. 가치추정의 방법은 대상재의 설정, 지불수단의 결정, 지불의사 유도 방법 결정, 가상적 상황설정, 설문, 분석, 추정액 도출의 순서로 진행하였으며 대구광역시에서 운영하는 대구수목원의 비시장적인 환경의 가치를 현재의 통화액으로 추정하기 위해 수행 되었다. 가치 추정은 DBDC방식으로 진행 하였으며 분석의 방법은 도출된 추정치가 비교적 안정적으로 알려진 logit분포를 가정한 함수의 분포 형태별로 각각의 추정액을 도출 하였다. 통계적 적합성을 바탕으로 1인당 대구수목원을 방문하여 얻는 연간 휴양의 가치는 WTPmean 12,718원, WTP median 11,033원, WTPtruncated mean 11,468원으로 추정할 수 있었다. 이를 토대로 대구수목원이 제공하는 연간 환경의 가치는 약 160억 원에서 190억 원으로 추정 할 수 있다. 이러한 대구수목원의 환경에 대한 가치추정법은 그 연구 대상지나 대상 재화만 변경하여서 기타의 환경재 가치 추정에도 충분히 적용 가능할 것으로 판단한다.
