A Teleological Interpretation of a Doctor's "Guidance" for Physical Therapist (물리치료사에 대한 의사의 "지도"의 목적론적 해석)

  • PURPOSE: The law pertaining to medical service technologists does not discuss the scope and limits of doctors' guidelines. My paper aims to discuss these topics. METHODS: This study was based on a review of literature and an analysis of judicial precedents. RESULTS: Physical therapists have often noted the need for independent practitioners in their articles on health care. Their continued discussions on professional and educational differences have centered round this issue, but their ideas have not been accepted. Practitioners have continued to interpret doctors' guidelines in hospitals without discussing their scope. However, the Supreme Court presented a meaningful decision outlining the conceptual limits and the scope of medical practice. The court suggested, basing its interpretation in the goal of clarifying the concept of medical activities smoothly, was to follow a specific judgment on the levels of education, testing, and professionalism. CONCLUSION: The role of physical therapists is expanding in this country, in order to meet the needs of the ultra-aged society. Education is already responding to rising training needs. By dividing the doctors' guidelines into indirect and direct types, if there's no medical risk near or around the health center or hospital, it is a good idea to allow the management of physical therapy partially, while understanding the scope and limitations of these guidelines clearly. A teleological interpretation of the law is especially relevant, and can be implemented immediately by the authoritative interpretation on part of the health authorities without any legal amendments.

Priority Analysis of Criteria for Evaluation of Public Hospital Using Analytic Hierarchy Process (AHP를 이용한 공공병원 평가지표의 우선순위 및 가중치 개발)

  • This study looks at priorities in managing public hospitals by figuring out categories needed to examine the quality of each hospital. In order to analyze priorities and relative importance of valuation indicator in Seoul municipal hospitals, surveys were sent via e-mail to medical professionals who have participated in evaluation of municipal hospitals. The analytic hierarchy process (AHP) was conducted using the Expert Choice 11.5 program. The results show that 'providing public service' is considered to be the most important category for all kinds of public hospitals, followed by 'improving the quality of medical care', 'hospital management and governance', and 'efficient hospital management'. The importance of 'hospital management and governance' and 'efficient hospital management' is different depending on the types of hospitals, but the importance of 'providing public service' and 'improving the quality of care' remains the same regardless of the types of hospitals. Based on these results, the study comes to a conclusion that public hospitals should place high value on certain categories and their management purposes should differ depending on their specific fields and characteristics. This study will help furthering discussions on the identity and roles of public hospitals.

Study of the Behavior of Food-sharing with Personal Utensils in a Restaurant: Use of a Focus Group Interview (식당에서의 공식(共食) 행동에 대한 질적 연구)

  • To identify "Gongsik", defined as food-sharing by picking food from a common plate using personal utensils, we conducted 7 focus group interviews including 47 university students during a 6 month period. Focus group discussions were audio taped, transcribed, and categorized into major themes. We divided Gongsik into the following categories: practical reasons, socio-psychological reasons, boundaries, suppressive situations, emotional characteristics, attitudes towards using different utensils, and future prospects. Gongsik appeared to be useful for fostering quick food sharing, intimacy and solidarity, and a fixed behavior learned at home. If the amount of food was too small to provide individual servings, as in Jjigae, Gongsik was likely to occur spontaneously. Family, close relatives, friends, and lovers sharing common activities and/ or blood ties were composed the boundaries of Gongsik. However, Gongsik was avoided in elegant restaurants or in view of foreigners. Participants showed mixed feelings towards Gongsik. Gongsik conducted with a spoon was considered to increase the degree of suggested intimacy in a food sharing context. Half of the students believed that the practice of Gongsik would be maintained into the future. Gongsik is a culturally-specific behavior that includes both positive and negative meanings. Aside from improving understanding of the cultural aspects of food-sharing, we suggest that the negative aspects of Gongsik related to the issue of hygiene be considered in food and nutrition education.

Maritime Interdiction against the DPRK's Illicit Maritime Practices (북한의 불법 해상활동에 대한 해양차단에 관한 연구)

  • Despite the deep concerns against the DPRK and the harsh sanctions imposed on it, the country renders the sanctions futile by facilitating various illegal trades such as the ship-to-ship transfers of petroleum or coal. Recently, the international community went into paying attention to solve this matter. Among the measures the community can take, "reinforcing the search and inspection of the DPRK related vessels transiting in the high and territorial seas" is the best policy approach to reduce the sanction evasion and provide the international community with considerable bargaining advantages. This measure requires the forceful action by legal enforcement agencies, also known as VBSS. (Visit, Board, Search, and Seizure) It would make the deals prohibited by the UNSCRs (United Nation Security Council Resolutions) less profitable by reducing the expected return on the deals and increasing the cost for them. So, it would make the illegal deals under the table less attractive. The DPRK has been able to render the sanctions futile by exploiting the limitations of the current maritime sanctions. The resolutions are short of being specific about law enforcement, and the PSI (Proliferation Security Initiative) is legally nonbinding. However, if the UNSCRs and the PSI are combined, they can generate a new source of power and exploit the weakness of the DPRK. Noting that the recent UNSCRs stipulated all the legal discussions in the resolutions are confined and applied only to the DPRK, the PSI can target the commercial trade as well as the WMD-related materials in the case of the DPRK's illegal maritime practices. Therefore, the PSI endorsing partners should go beyond mere commitments. They should discuss action plans to implement the maritime interdictions to the extent that they discourage the DPRK and its business partners continuing the illegal activities.

Necessity of Intent for Defense in Case of Legitimate Self-defense (정당방위에 있어서 방위의사의 필요성)

  • Self-defense is defined as 'an act which is performed in order to prevent impending and unjust infringement of one's own or another person's legal interest'(Article 21, the Criminal Act). To establish such a self-defense, it is generally suggested that it requires an intent for defense as subjective element as well as objective precondition of impending and unjust infringement of one's own or another person's legal interest' and considerable reason. Intent for defense which means an awareness for objective circumstance of self-defense is recognized as objective justification element for self-defense. With regard to intent for defense, there are various discussions on not only necessity of such an intent for defense but whether it is necessary for both actor's recognition of circumstance and specific purpose or motive and which should be applied for its punishment in case of lack of the intent for defense: consummated, unconsummated or semi-consummated. However, there is no clear regulations. This article reviews the contents of intent for defense based on opinion that it is necessary for intent for defense and then examines contents on criminal effect in case of lack of intent and intent for defense in case of criminal negligence.

Successful strategy of treatment used to rhBMP-2 and LFA-collagen scaffold for BRONJ (임상가를 위한 특집 3 - rhBMP-2와 LFA-collagen scaffold를 이용한 BRONJ의 성공적인 치료 전략)

  • Bispbosphonates are a class of pharmaceutic agents, which induce apoptosis of osteoclast as well as impair osteoclastic activity to suppress bone resorption. Thus, bisphophonates are effectively used to treat osteoporosis, multiple myeloma and to prevent bone metastases of malignant cancer. However, recently dental disease have been reported associated with Bisphosphonates. Thus, there are a number of discussions about proper prevention and treatment of bisphosphonate-related osteonecrosis of jaw(BRONJ). Marshall R. Urist in 1965 made the seminal discovery that a specific protein, BMP(bone morphogenetic protein), found in the extracellular matrix of demineralized bone could induce bone formation newly when implanted in extraosseous tissues in a host. BMPs are multi-functional growth factors which are members of the transforming growth factor-beta super family and their ability is that plays a pivotal roll in inducing bone. About 18 BMP family members have been identified and characterized. Among of them, BMP-2 and BMP-7 have significant importance in bone development. In this study, patients of BRONJ were recieved who visited Department of oral and maxillofacial surgery, school of dentistry, Wonkwang university for past 3 years from 2011 to 2013. We focused on the results of the surgical intervention. We suggest that new strategy of treatment used to rhBMP-2 and LFA(Lidocaine-Fibrinogen-Aprotinin)-collagen scaffold for patients of BRONJ. The purpose of this paper is to give a brief overview of BMPs and to critically review the clinical data currently available on rhBMP-2 and LFA collage scaffold.

Suhomlinsky's Theory on School Education (수호믈린스키의 학교교육론)

  • The research examines the discussions on school education depicted in Suhomlinsky's works. After that, their implications upon our education are discussed. The results of this research are as follows: Suhomlinsky considered the enrichment of the learners mental life as a primary goal of education. Therefore, school education must ensure that children's learning be a part of their abundant mental life, and that it must contribute to the building of children's wisdom and their becoming a whole being as humans. In this perspective, Suhomlinsky emphasized the importance of education that enriches the mental life through reading books. He insists that education through reading books is a valuable course in lifelong education, and suggests specific ways to put it into practice. He points out the need for the students' liberty to think freely in schools, and claimed that providing students with breaks and free times is a way to obtain invaluable treasures. His experinences in educational practices may provide implications that will help solve the problems our education faces today.

A Study on the Development of Korean Film Technology in the Era of the 4th Industrial Revolution (4 산업혁명 시대의 한국영화기술 발전방안에 관한 연구)

  • This study aims to establish the direction of development of Korean cinematography technology in the era of the 4th Industrial Revolution and present future development plan. First, in order to diagnose the current status, supporting policies of various countries and film technology research trends were analyzed. Each country is expanding the support for film technology including tax credits. Through the analysis of patents and research papers, recent issues have shown that Virtual Reality, HMD, Artificial Intelligence, and Big Data are applied to film technology. Next, the survey results of Korean film technology level for filmmakers were 70% for production, 47.5% for distribution, and 60.3% for screening comparing to the level of the leading country. The gap was caused by the lack of funds for research and development and insufficient government support policies. In addition, interviews with film makers revealed the need to support filmmaking that combines technologies such as localized film technology, artificial intelligence, and deep learning. Finally, it is suggested that technology sharing platform should be developed in the future through the discussions of technology, science and academic experts', and technology development should be carried out in the field. As a result, film technology R&D should be promoted in order to develop technologies specific to movies. Advanced technology foundation for the growth of film technology should be developed to systematically equip the infrastructures such as education and human resources. In addition, technology development that links standardization should be carried out. In this study, we propose the development of Korean film technology to prepare for the 4th Industrial Revolution, and it is expected that the 2022 film technology power nation will be realized.

A Study on Work Safety and Standard Contract for Popular Culture Production Staff (대중문화예술제작물스태프의 작업 안전과 표준계약에 관한 소고)

  • A series of recent events have laid the groundwork for discussions on the safety issues regarding production staff in the popular culture industry. In Korea, the standard contract has been pursued as a means of dealing with issues involving popular culture production staff. However, the existing standard contract failed to incorporate the characteristics and requirements in today's market, which greatly restricted its efficacy in real-world cases. Therefore, this study seeks to significantly improve the provisions in the standard contract that govern obligations between contractual parties, and the work safety of the production staff. To this end, considering the main causes of safety accidents and actual contracts, this study groups contractual provisions into several categories: the removal of adverse factors affecting optimal competency, factors causing individual staff's negligence, and external factors causing negligence. Then, this study proposes specific provisions to be included in each category.

A study on the effect of non-face-to-face online education according to the type of learner motivation (학습자 동기 유형에 따른 비대면 온라인 교육의 효과 연구)

  • This study aims to expand the effect of online education into the aspect of active exploration and sharing of class-related issues by learners. Based on theoretical discussions, Two types of motivation (personal and social) to explore issues, engagement, attitude toward issue content, and eWOM model were verified. As a result of the study, it was found that the impact of personal and social motivations that online education has on engagement on specific issues, and the positive(+) influence on attitudes toward issue content and word of mouth intentions on SNS, considering engagement as a parameter. In this study, the role of engagement in inducing the next learning by oneself was confirmed, and it can be seen that social and personal motives for issues and class content should be utilized to increase engagement.
