A Study on software patent claim of computer related invention (컴퓨터 관련 발명의 소프트웨어의 특허 클레임에 관한 연구)

  • This paper relates to a software patent of a computer related invention, explains a describing method of software patent claim which can be registered software patent of computer related invention instead of computer program copyright which is the Intellectual Property about software since 1998 in the Korea Intellectual Patent Office(KIPO) by developing an information communication infrastructure technology and WWW technology. Also, it introduces an international and domestic trends of the software patent for computer related invention and related database for the software patent of the world and mentions advantage and disadvantage of software patent regime of each nation and the facing software patent problems as the Intellectual Property.

Software Industry and Patents : Legal Evolution and Economic Arguments (소프트웨어 산업과 특허: 법적 진화와 경제적 쟁점)

  • Beyond the rapid normalization process of patents in software industry, complex legal evolution and rigorous economic arguments underlie the crucial environmental transformation of the industry. In this article, we trace the evolutionary history for the theory and practice of patents in software industry from both legal and economic perspectives. First, we study the legal disputes and cases in light with the underpinnings of patent policy transformation, and then delve into the economic backrounds of the pros and cons for software patents, with special focus on the generic economic peculiarities of software industry. The fact that historical and practical policy and law in Korea have been largely affected from those of USA, and relative deficiency in the law, economics and management literature are the main motivation of the study, and we hope this study to contribute to the decision making of policymakers as well as law and business practitioners.

  • Software is not only control and operational technology of computer, various system, and machines, but also knowledge handling and service technology for production, storage, and utilization of digital information. Many nations invest enormous budget in SW R&D to acquire core and original technology, and commercialize. To select and concentrate on SW R&D investment by segmenting diverse functions and element technologies consisting of sw technology, introduction of evaluation and analysis methodology on technology level utilizing reliable patent and bibliometrics is demanded these days. The purpose of this paper is to suggest some analysis frameworks of national technology level in the field of sw technology. Another practical purpose is to verify sw technology policy using qualitative and quantative indicators of patent and bibliometrics.

  • Purpose: In the period of international integration, how is the implementation of intellectual property regulation in developing countries? Do intellectual property rights help attract more Foreign direct investment (FDI)? This study aims to show the effect of intellectual property rights, reflect in the number of patent registered (Patent distribution into two components: Patent_residents and Patent_non-residents) on FDI attraction in Vietnam. Research design, data and methodology: Using Autoregressive distributed lag (ARDL) model for the data collected from 1990 to 2018 with EViews version 9 software. Conclusions: The results indicate that the number of patent protection has a positive effect on FDI in both short term and long term. In particular, only patent registration of foreign individuals and organizations has a significant positive effect on attracting FDI, while that of Vietnamese patents is not statistically significant. From the results of this study, we provide some recommendations to help attract FDI based on raising awareness of intellectual property rights: Increase international cooperation for innovation to learn and encourage patent; Improve the capac ity of inventing as well as the ability to register patents of Vietnamese people; Government agencies are tasked to support a nd review registration procedures; Encouraging patent registration based on the patent.

The Patentability of a Computer Program as a Function of Its Relational Characteristic with Hardware

  • The patentability of computer program has been discussed because of its deviation from the traditional definition of a patent. The relativities of computer programs to hardware are classified to measure the relative patentability of computer programs in this paper. It can be seen through the patentability analysis that the change in patentability basically follows an exponent part of the function is a damping factor that determines a patentability degree or trend. The basic patentability of computer programs is revealed when the damping factor value is 1, and a statistical patent specification, an appropriate expression of applicability and substantiality of computer programs is needed to acquire a patent right.

  • There have been studies to evaluate valuation of firms by using patents in various ways. Also, the theory that value of patents helps enterprise's growth is valid in economics. However, when evaluating the value of the company, through the patent evaluation has not been used. Because of previous studies researched relation between patents and firms only at certain points. To solve this problem, this study intends to analyze lag between patent and profitability of the firms. In this study, we classified top 100 software firms in the United States through PBR, PER and value of intangible assets by using cluster analysis. And we applied Almon's distributed lag model to each cluster to find out lag between patent and profitability of the firms. As a result, in the cluster of more valuable companies, patents have an effect on profitability of the firms at regular lags. This study indicates that the patents are an important indicator to assess companies.

Construction of English-Korean Automatic Translation System for Patent Documents Based on Domain Customizing Method (도메인 특화 방법에 의한 영한 특허 자동 번역 시스템의 구축)

  • This paper describes an English-to-Korean automatic translation system for patent documents which is constructed by a method customizing from a general domain to a specific domain. The customizing method consists of following steps: 1) linguistically studying about characteristics of patent documents, 2) extracting unknown words from large patent documents and terminologically constructing, 3) customizing the target language words of existing terms, 4) extracting and constructing patent translation patterns peculiar to patent documents, 5) customizing existing translation engine modules according to linguistic study about characteristics of patent documents, 6) evaluation of automatic translation results. The English-to-Korean patent machine translation system implemented by these customization steps shows a translation accuracy of 81.03% and is improving.

  • MRC (Machine reading comprehension) is the AI NLP task that predict the answer for user's query by understanding of the relevant document and which can be used in automated consult services such as chatbots. Recently, the BERT (Pre-training of Deep Bidirectional Transformers for Language Understanding) model, which shows high performance in various fields of natural language processing, have two phases. First phase is Pre-training the big data of each domain. And second phase is fine-tuning the model for solving each NLP tasks as a prediction. In this paper, we have made the Patent MRC dataset and shown that how to build the patent consultation training data for MRC task. And we propose the method to improve the performance of the MRC task using the Pre-trained Patent-BERT model by the patent consultation corpus and the language processing algorithm suitable for the machine learning of the patent counseling data. As a result of experiment, we show that the performance of the method proposed in this paper is improved to answer the patent counseling query.

Curriculum of IoT by IPC Code Analysis of Patents (특허문헌의 IPC 코드 분석에 의한 사물인터넷 분야 교육과정에 관한 연구)

  • We analyzes representative technologies of IoT patents and reflects these results in the curriculum of IoT. In order to identify the representative technologies, the IPC codes of the patents were analyzed. Among the main category IPC codes, the most used IPC codes were H04L in Single IPC Patent with 974 cases(32.0%) and G06Q in Multiple IPC Patent with 710 cases(29.2%). As a result of classifying the IPC code into the WIPO technology classification system, the most emphasized technologies are Digital Communication, accounting for about 60.5% in the Single IPC Patent and IT Methods for Management(710 cases, 29.2%) in Multiple IPC Patent. The main points to be considered when organizing the curriculum of IoT are: ∇Emphasis on Digital Communication, ∇Expansion of Education related to IT Methods for Management(Including entrepreneurship and patent application), and ∇Consideration of subjects related to the Convergence of IoT. This research can contribute to the curriculum design of new industrial technologies such as AI and Fintech.

  • This paper is to explore the direction of international software protection laws, either copyright or patent right, by examining the current situations in the United States, European countries, Asia including Korea and the WTO/TRIPs Agreement. According to the comparative legal systems, each court and office gives both copyrightability and patentability of software by a stronger and appropriate intellectual property protection system.
