The Characteristic of Laws on the Kind of Urban Green Spaces and the Legal Requirements for the Green Spaces of Urban Habitat in China (중국의 도시녹지 종류와 도시거주구 녹지의 설치 기준에 관한 법제도의 현황과 특성)

  • This study investigated Chinese Laws on the kind of urban green spaces and the legal requirements for the green spaces of urban habitat and analyzed the specificities of them intending to provide basic data to suggest bringing in or not the relevant Chinese Laws to Korea. This study can be summarized as follows: First, the concept of Chinese urban green spaces(g.s.) classified by 5 kinds(park g.s., production g.s., protection g.s., attachment g.s., the others g.s.) placed the park and green spaces in the same category unlike the Korean urban green spaces that only distinguishes between park and green spaces. The Chinese Urban Park is classified by 4 kinds(composite park, community park, special park, linear park) at the 'Standard for urban green spaces classification' which is below in rank of the legal system. Second, in case of calculation for green spaces ratio of urban green spaces in China, the green rooftop landscaping area should not be included as a green spaces area except the rooftop of a basement or semi basement building to which residents have easy access. The green spaces requirements and compulsory secure ratio by 3 habitat kinds(habitat, small habit, minimum habitat) of when to act as a residential plan is regulated. Third, the green spaces system is obligated to establish at habitat green spaces plan and is specified to conserve and improve existing trees and green spaces. The green spaces ratio on reconstruction for old habitat is relaxed to be lower than for new habitat and a gradient of green spaces is peculiarly clarified. The details and requirements for establishment and the minimum area intending for each classes of the central green spaces(habitat park, children park, minimum habitat's green spaces) are regulated. Especially at a garden style of minimum habitat's green spaces, intervals between the south and north houses and a compulsory security for green spaces area classifying into two groups(closing type green spaces and open type green spaces) by a middle-rise or high-rise building are clarified. System of calculation for green spaces area is presented at a special regulation. Fourth, a general index(area/person) of public green spaces within habitat to achieve by 3 habitat kinds is determined, in this case, the index on reconstruction for a deterioration zone can be relaxed to be lower to the extent of a specified quantity. A location and scale, minimum width and minimum area per place of public green spaces are regulated. A space plot principle including adjacent to a road, greening area ratio against total area, security of open space and the shadow line boundary of sunshine are also regulated to intend for public green spaces. Fifth, the minimum horizontal distance between the underground cables and the surrounding greening trees are regulated as the considerable items for green spaces when setting up the underground cables. The principle to establish green spaces within public service facilities is regulated according to the kind of service contents. It shall be examined in order to import or not the special regulations that only exist in Chinese Laws but not in Korean Laws. The result of this study will contribute to gain the domestic landscape architect's' sympathy of the research related to Chinese urban green spaces laws requiring immediate attention and will be a good chance to advance into the internationalization of Korean Landscape Architectural Laws.

A study on Operation Rules of Korean Air Defence Identification Zone (한국 방공식별구역 운영규칙에 관한 고찰)

  • Declaration of Air Defense and Identification Zones started with the United States in 1950, which was followed by declaration of KADIZ by the Republic of Korea in 1951. Initial ADIZ were solely linked with air defense missions, but their roles have changed as nations around the globe manifested a tendency to expand their influence over maritime resources and rights. In particular, China declared ADIZ over the East China Sea in October 2013 and forced all passing aircraft to submit flight plan to ATC or military authority, saying failure of submission will be followed by armed engagement. China announced it would declare another zone over the South China Sea despite the ongoing conflict in the area, clearly showing ADIZ's direct connection with territorial claim and EEZ and that it serves as a zone within which a nation can execute its rights. The expanded KADIZ, which was expanded in Dec 15, 2013 in response to Chinese actions, overlaps with the Chinese ADIZ over the East China Sea and the Japanese ADIZ. The overlapping zone is an airspace over waters where not only the Republic of Korea but also of China and Japan argue to be covering their continental shelf and EEZ. Military conventions were signed to prevent contingencies among the neighboring nations while conducting identifications in KADIZ, including the overlapping zone. If such military conventions and practice of air defense identification continue to be respected among states, it is under the process of turning into a regional customary law, although ADIZ is not yet recognized by international law or customary law. Moreover, identification within ADIZ is carried out by military authorities of states, and misguided customary procedures may cause serious negative consequences for national security since it may negatively impact neighboring countries in marking the maritime border, which calls for formulation of operation rules that account for other state activities and military talks among regional stake holders. Legal frameworks need to be in place to guarantee freedom of flights over international seas which UN Maritime Law protects, and laws regarding military aircraft operation need to be supplemented to not make it a requirement to submit flight plan if the aircraft does not invade sovereign airspace. Organizational instructions that require approval of Chairman of Joint Chiefs of Staff for entrance and exit of ADIZ for military aircraft need to be amended to change the authority to Minister of National Defense or be promoted to a law to be applicable for commercial aircraft. Moreover, in regards to operation and management of ADIZ, transfer of authority should be prohibited to account for its evolution into a regional customary law in South East Asia. In particular, since ADIZ is set over EEZ, military conventions that yield authority related to national security should never be condoned. Among Korea, China, Japan and Russia, there are military conventions that discuss operation and management of ADIZ in place or under negotiation, meaning that ADIZ is becoming a regional customary law in North East Asia region.

A Study on Hoslital Nurses' Preferred Duty Shift and Duty Hours (병원 간호사의 선호근무시간대에 관한 연구)

  • The duty shifts of hospital nurses not only affect nurses' physical and mental health but also present various personnel management problems which often result in high turnover rates. In this context a study was carried out from October to November 1995 for a period of two months to find out the status of hospital nurses' duty shift patterns, and preferred duty hours and fixed duty shifts. The study population was 867 RNs working in five general hospitals located in Seoul and its vicinity. The questionnaire developed by the writer was used for data collection. The response rate was 85.9 percent or 745 returns. The SAS program was used for data analysis with the computation of frequencies, percentages and Chi square test. The findings of the study are as follows: 1. General characteristics of the study population: 56 percent of respondents was (25 years group and 76.5 percent were "single": the predominant proportion of respondents was junior nursing college graduates(92.2%) and have less than 5 years nursing experience in hospitals(65.5%). For their future working plan in nursing profession, nearly 50% responded as uncertain The reasons given for their career plan was predominantly 'personal growth and development' rather than financial reasons. 2. The interval for rotations of duty stations was found to be mostly irregular(56.4%) while others reported as weekly(16.1%), monthly(12.9%), and fixed terms(4.6%). 3. The main problems related to duty shifts particularly the evening and night duty nurses reported were "not enough time for the family, " "afraid of security problems after the work when returning home late at night." and "lack of leisure time". "problems in physical and physiological adjustment." "problems in family life." "lack of time for interactions with fellow nurses" etc. 4. The forty percent of respondents reported to have '1-2 times' of duty shift rotations while all others reported that '0 time'. '2-3 times'. 'more than 3 times' etc. which suggest the irregularity in duty shift rotations. 5. The majority(62.8%) of study population found to favor the rotating system of duty stations. The reasons for favoring the rotation system were: the opportunity for "learning new things and personal development." "better human relations are possible. "better understanding in various duty stations." "changes in monotonous routine job" etc. The proportion of those disfavor the rotating 'system was 34.7 percent. giving the reasons of"it impedes development of specialization." "poor job performances." "stress factors" etc. Furthermore. respondents made the following comments in relation to the rotation of duty stations: the nurses should be given the opportunity to participate in the. decision making process: personal interest and aptitudes should be considered: regular intervals for the rotations or it should be planned in advance. etc. 6. For the future career plan. the older. married group with longer nursing experiences appeared to think the nursing as their lifetime career more likely than the younger. single group with shorter nursing experiences ($x^2=61.19.{\;}p=.000;{\;}x^2=41.55.{\;}p=.000$). The reason given for their future career plan regardless of length of future service, was predominantly "personal growth and development" rather than financial reasons. For further analysis, the group those with the shorter career plan appeared to claim "financial reasons" for their future career more readily than the group who consider the nursing job as their lifetime career$(x^2$= 11.73, p=.003) did. This finding suggests the need for careful .considerations in personnel management of nursing administration particularly when dealing with the nurses' career development. The majority of respondents preferred the fixed day shift. However, further analysis of those preferred evening shift by age and civil status, "< 25 years group"(15.1%) and "single group"(13.2) were more likely to favor the fixed evening shift than > 25 years(6.4%) and married(4.8%)groups. This differences were statistically significant ($x^2=14.54, {\;}p=.000;{\;}x^2=8.75, {\;}p=.003$). 7. A great majority of respondents(86.9% or n=647) found to prefer the day shifts. When the four different types of duty shifts(Types A. B. C, D) were presented, 55.0 percent of total respondents preferred the A type or the existing one followed by D type(22.7%). B type(12.4%) and C type(8.2%). 8. When the condition of monetary incentives for the evening(20% of salary) and night shifts(40% of. salary) of the existing duty type was presented. again the day shift appeared to be the most preferred one although the rate was slightly lower(66.4% against 86.9%). In the case of evening shift, with the same incentive, the preference rates for evening and night shifts increased from 11.0 to 22.4 percent and from 0.5 to 3.0 percent respectively. When the age variable was controlled. < 25 yrs group showed higher rates(31.6%. 4.8%) than those of > 25 yrs group(15.5%. 1.3%) respectively preferring the evening and night shifts(p=.000). The civil status also seemed to operate on the preferences of the duty shifts as the single group showed lower rate(69.0%) for day duty against 83. 6% of the married group. and higher rates for evening and night duties(27.2%. 15.1%) respectively against those of the married group(3.8%. 1.8%) while a higher proportion of the married group(83. 6%) preferred the day duties than the single group(69.0%). These differences were found to be statistically all significant(p=.001). 9. The findings on preferences of three different types of fixed duty hours namely, B, C. and D(with additional monetary incentives) are as follows in order of preference: B type(12hrs a day, 3days a wk): day shift(64.1%), evening shift(26.1%). night shift(6.5%) C type(12hrs a day. 4days a wk) : evening shift(49.2%). day shift(32.8%), night shift(11.5%) D type(10hrs a day. 4days a wk): showed the similar trend as B type. The findings of higher preferences on the evening and night duties when the incentives are given. as shown above, suggest the need for the introductions of different patterns of duty hours and incentive measures in order to overcome the difficulties in rostering the nursing duties. However, the interpretation of the above data, particularly the C type, needs cautions as the total number of respondents is very small(n=61). It requires further in-depth study. In conclusion. it seemed to suggest that the patterns of nurses duty hours and shifts in the most hospitals in the country have neither been tried for different duty types nor been flexible. The stereotype rostering system of three shifts and insensitiveness for personal life aspect of nurses seemed to be prevailing. This study seems to support that irregular and frequent rotations of duty shifts may be contributing factors for most nurses' maladjustment problems in physical and mental health. personal and family life which eventually may result in high turnover rates. In order to overcome the increasing problems in personnel management of hospital nurses particularly in rostering of evening and night duty shifts, which may related to eventual high turnover rates, the findings of this study strongly suggest the need for an introduction of new rostering systems including fixed duties and appropriate incentive measures for evenings and nights which the most nurses want to avoid, In considering the nursing care of inpatients is the round-the clock business. the practice of the nursing duty shift system is inevitable. In this context, based on the findings of this study. the following are recommended: 1. The further in-depth studies on duty shifts and hours need to be undertaken for the development of appropriate and effective rostering systems for hospital nurses. 2. An introduction of appropriate incentive measures for evening and night duty shifts along with organizational considerations such as the trials for preferred duty time bands, duty hours, and fixed duty shifts should be considered if good quality of care for the patients be maintained for the round the clock. This may require an initiation of systematic research and development activities in the field of hospital nursing administration as a part of permanent system in the hospital. 3. Planned and regular intervals, orientation and training, and professional and personal growth should be considered for the rotation of different duty stations or units. 4. In considering the higher degree of preferences in the duty type of "10hours a day, 4days a week" shown in this study, it would be worthwhile to undertake the R&D type studies in large hospital settings.

The Status and Prospect of CTL (Coal-to-Liquid) (CTL(Coal-to-Liquid) 기술 현황)

  • During the 2nd World War, several Coal-to-Liquid (CTL) plants were operated in Germany and England to convert coal to large volumes of liquid fuel. Big oil fields discovered in the Middle East after the war supplied crude oil at the low price and all CTL plants were forced to shut down. However, South Africa (Sasol) built a CTL plant in 1955 and 2 more plants afterward and the current production of coal-derived synfuel reached 150,000 bbl/day. Recently, the sustained high crude oil price and the fear of the "peak oil" rejuvenated the interest of CTL and several CTL projects are in progress. China established a plan to build CTL plants with the total capacity of 30 million tons of synfuel per year by 2030. China is building a direct coal liquefaction plant which is scheduled to produce 20,000bbl/day of synfuel in 2008. There are 8 CTL projects in USA either in the planning stage or in the ground-breaking stage. CTL projects are also carried out in Australia, Philippines, New Zealand, Indonesia and India. Korea needs to approach the CTL project in the perspective of the national energy security. In this paper, the history, the status, current activities and the prospect of CTL are described.

Analysis of Water Quality Improvement in Downstream River of Heightening Irrigation Dam through the Reservoir Operation (둑높이기 농업용저수지의 운영을 통한 하천 수질개선 효과 분석)

  • In recent years, interest in river environment such as riparian landscape, water quality and ecological conservation has been growing with increasing recreation on agricultural river watershed. That caused the increase of necessity of water resources development, one of solutions for the diversification of agricultural water demand and shortages. In this respects, heightening irrigation dam, as a part of the 4-major river restoration project, is necessary to secure not only additional agricultural water but also instream flow for water quality improvement. However, operation plan of irrigation dam still not be clear. In this study, additional storage which secured through heightening irrigation dam was estimated using SWAT model. And instream flow effects on water quality of downstream were evaluated. The findings show that the additional water supply will contribute positively to water quantity and quality of downstream. The results show a 2~10% water quality improvement effect on nutrients, as well as an 1~8% water quantity increasing effect. In particular, additional storage can be effectively supplied from February to April by the reservoir operation. However, maintaining better water quality in irrigation reservoirs is important because the water quality of irrigation reservoirs can be negatively impacts the water quality in downstream of reservoirs.

Current Status and Tasks of Using the School Affairs System in Elementary Schools (초등학교에서의 교무업무시스템 운영 현황과 과제 - 서울과 경기 지역을 중심으로 -)

  • Along with the development of telecommunication technology, educational role has been considerably changed and NEIS is introduced and operated for the digital educational administration. However, the function of NEIS is so limited when operated in each school. As a result, Korean government prepares the plan to install and operate a new School Affairs System by separating 3 areas from 27 areas of NEIS. School Affairs System has been used in schools since March, 2006. In this regard, this study attempts to analyze the current status and tasks of using the system in elementary schools. The result of the study shows that about 67% teachers use the system once or twice a day. Most of teachers answer that they get help from other teachers if they have any problem in operating the system. Many teachers affirmatively answer to the design and function of the system, and they are satisfied with the convenience and efficiency of the system. However, they feel difficulty to be familiar with the system sue to the frequent change. The importance of electronic certificate and personal information is well recognized and managed in terms of the security of the system. Facilities need to be well equipped, and information exchange system need to be developed to accept each school's request to improve the function of the system. In addition, applicable laws need to be arranged, clear guideline of educational administration agency and principal's strong intention are required to relieve teachers' work load.

A Study on the Concept of Digital Environmental Rights and Reinforcement of Information Subject (디지털 환경권 개념 정립과 정보교과 교육 강화에 대한 연구)

  • This study aims to emphasize the necessity of strengthening the information subject through the introduction of a new concept of rights called 'digital environmental rights' and proposes an improvement in the educational composition model of the information culture section in the information subject. Through the introduction of the concept of digital environmental rights, we intend to provide a logical basis for making the information subject a required subject. In addition, we intend to enhance the competencies required for living in a digital environment by improving the structure of the information culture section in the information subject. As a study on this, the logic of the concept of rights required in the digital environment is analyzed and the concept of digital environmental rights applied to it is established. Furthermore, by analyzing relevant curricula in major countries, including the United States, Australia, and Japan, which provide the main basis for digital environmental rights, an improvement plan for the educational composition in the information and culture education sector is formulated. The results of the study are as follows: First, digital environment rights are 'rights to enjoy a pleasant and safe digital environment'. Second, the components of digital environmental rights include rights for the environment (cyberethics), rights of the environment (cybersafety), and rights about the environment (cybersecurity). Third, in the major countries studied various educational structures are being implemented with regard to information-related education contents on the digital citizenship, code ethics, and new technology security.

Cooperation and Development Plan of Inter-Korean Logistics on through the Case between China and Taiwan (중국-대만 사례를 통해 본 남북한 물류협력 및 발전 방안)

  • On June 29th, 2010, a cross-straits "Economic and Cooperation Framework Agreement" (ECFA) is signed between China and Taiwan. This pact seems to be the greatest step forward on cooperation between the two sides, reflecting China-Taiwan thaw. As these countries are especially economically interdependent, great economic incomes and security benefits are expected for both sides after cooperation. this development of enlightened cooperation between China and Taiwan, gives many implications for Korea, the two divided countries. Recently, relation between north and south Korea is developing in an entirely different situation compared to the former Kim Dae-Jung or Roh Moo-hyun administrations. But exchange between north and south Korea has not been stopped, though reduced. This reflects the necessity of exchange of the north and the south, and this means that making preparation for the efficient conduct of exchange is needed. So in this study, we consider the China-Taiwan exchange and cooperation development carefully as a model for exchange and cooperation of the north and south Korea, and sought realizable ways to exchange and cooperate between the north and south Korea, which is also a win-win strategy for northeast Asia.

An Analysis of Contribution Rates of Irrigation Water and Investment for Farmland Base Development Project to Rice Production (농업용수(農業用水)와 농업생산기반조성사업투자(農業生産基盤造成事業投資)의 미곡생산기여도(米穀生産寄與度) 분석(分析))

  • Rice is not only main food but also key farm income source of Korean farmers. In spite of the above facts, rice productivity was decreased on account of drought in every 2 or 3 years interval owing to the vulnerability of irrigation facilities throughout Korea in the past decades. As an context of the first five year economic development plan, all weather farming programme including 4 big river basin comprehensive development projects and large and medium sized irrigation water development projects were carried out successfully. Therefore the area of irrigated paddy were increased from 58% in 1970 to 76.2% in 1999. In the past decades, the Government had invested heavy financial funds to develop irrigation water but as an factor share analysis, the contribution rates of irrigation water and investment for farmland base development project have not been identified yet in national agricultural economic level. It is very scarce to find out the papers concerned to macro-economic factor share analysis or contribution rates of water and investment cost to rice production value in Korea considering the production function of the quantity of irrigation water and investment cost as independent variables. Accordingly this paper covered and aimed at identifying (1) derivation of rice production function with the time serial data from 1965 to 1999 and the contribution rates of irrigation water and total investment cost for farmland base development project. The analytical model of the contribution rates was adapted the famous Cobb-Douglass production function. According to the model analysis, the contribution rate of irrigation water to rice production in Korea was shown 37.8% which was equivalent to 0.28 of the production elasticity of water. The contribution rate of farmland base development project cost was revealed 22% and direct production cost of rice was contributed 60% in the growth of rice production and farm mechanization costs contributed to 18% of it respectively. The two contribution rates comparing with the direct production cost were small but without irrigation water and farmland base development, application of high-pay off inputs and farm mechanization might be impossible. Considering the food security and to cope with the frequent drought, rice farming and investment for the irrigation water development should be continued even in WTO system.

Estimation of Parking Lot Planning and, Suggestion of Parking Planning Methods Considering Vehicle Types (차종을 고려한 주차 계획단위 산정 및 주차계획 방법 제시)

  • At the present, planning and installation of parking space sections and lane width are implemented in accordance with the installation standard and parking lot structure by the enforcement regulations of the Parking Act. While large and RV (Recreational Vehicle) vehicles have increased in number recently, parking is complex with improper installation standards. It causes serious problems, including vehicle vandalism, increased civil complaints, travel inconveniences for parking lot users, management and maintenance issues for parking lots, and so forth. The study, therefore, determined that the practical and appropriate realignment of parking unit adjustment and lane width regulations are essential. The study conducted prior review on domestic parking sections and change cases of composition by vehicle types, including the component ratio of domestic and foreign vehicles, width of vehicle by types in order to examine the parking problems that account for a increasing social issues, and provided parking plan methods by types of vehicle, as well as reform and reaction plans for parking unit adjustment and lane width considering security and smooth traffic flow. After comparing and analyzing between estimated installation of parking space and lane width and internal and external cases, the study suggests the improvement that considers expenses and convenience of a driver. Also, it shows installation of parking space that considers traffic safety, improvement of lane width, and parking way depends on vehicle types. By providing estimation for parking planning and parking planning methods that secure safe and smooth traffic flow within a parking lot, the study will contribute to the development of improved alternatives for cost-effective traffic safety and set-up structure, including installation standards of parking lots.
