Russian and Foreign Experience in Implementing Departmental Control and Prosecutor's Supervision when Verifying Crime Reports

  • The article examines the stage of verification of a crime report from the standpoint of the need for its legislative regulation. Moreover, it investigates the international experience in this field. The existing procedural models are described in detail on the example of the neighboring and faraway countries. An analysis of the provisions of the current criminal procedure law of Russia and foreign experience allowed the authors to identify existing problems in the implementation of departmental control and prosecutorial supervision at the stage of verifying a crime report. The aim of the study is to develop theoretical provisions and recommendations regarding the implementation of departmental procedural control and prosecutorial supervision over the activities of the investigator during the verification of reports of crimes, based on the study of experience, both in Russia and in a number of countries of the near and far abroad, which could find their reflection in law enforcement practice, as well as aimed at improving the current criminal procedure legislation. The authors substantiated the theory that a detailed examination of the foreign procedural foundations of checking a crime report will allow us to form the most suitable model for checking a crime report for our state, taking into account all possible features and successfully implement it into the current criminal procedural law of the Russian Federation.

Personalized mobile Healthcare Service Analysis by IPA (IPA를 활용한 맞춤형 모바일 헬스케어 서비스 분석)

  • Recently, as people's interest in health care has been rising, the health care service awareness and utilization has been increasing. However, the existing healthcare services have problems such as inconvenience of mobility, the low reliability of input for information and low accuracy of information provided as well. in this study, we developed the m-Health application by utilizing smart phone with improvement of these problems. This application provided the total of 5 services such as notification for risk of cardiovascular disease, personalized dietary recommendations targeted to 20s and 30s who do not properly manage their health care by bad habits. In addition, the benefits and problems of these services were found out through the analysis for the general importance and satisfaction of these services by Importance-Performance Analysis (IPA) technique. In result of IPA analysis, The six items such as 'input accuracy and reliability of information', 'content reliability', 'proper health service recommendations', etc. among 12 of the items needed to receive the effective services on m-Health were belonged to importance and satisfaction area with high level. And, in the 'information security', the importance is high but the satisfaction was low. In conclusion, the further study for strengthening security of information, service update provided with PHR to consistently keep the advantage of these services will be conducted.

New Approaches to Quality Monitoring of Higher Education in the Process of Distance Learning

  • The article identifies the problem of monitoring the quality of higher education in three main areas, which are comparative pedagogical systems of education. The first direction is determined by dissertation works, the second - monographs and textbooks, and the third reveals scientific periodicals. According to its internal structure, monitoring the quality of education combines important management components identified in the article (analysis, evaluation and forecasting of processes in education; a set of methods for tracking processes in education; collecting and processing information to prepare recommendations for research processes and make necessary adjustments). Depending on the objectives, three areas of monitoring are identified: informational (involves the accumulation, structuring and dissemination of information), basic (aimed at identifying new problems and threats before they are realized at the management level), problematic (clarification of patterns, processes, hazards, those problems that are known and significant from the point of view of management). According to its internal structure, monitoring the quality of education combines the following important management components: analysis, evaluation and forecasting of processes in education; a set of techniques for tracking processes in education; collection and processing of information in order to prepare recommendations for the development of the studied processes and make the necessary adjustments. One of the priorities of the higher education modernization program during the COVID-19 pandemic is distance learning, which is possible due to the existence of information and educational technologies and communication systems, especially for effective education and its monitoring in higher education. The conditions under which the effectiveness of pedagogical support of monitoring activities in the process of distance learning is achieved are highlighted. According to the results of the survey, the problems faced by higher education seekers are revealed. A survey of students was conducted, which had a certain level of subjectivity in personal assessments, but the sample was quite representative.

State Information Based Recommendation Algorithm for Minimizing the Malicious User's Influence (상태 정보를 활용하여 악의적 사용자의 영향력을 최소화 하는 추천 알고리즘)

  • With the extreme development of Internet, recently most users refer the sites with the various Recommendation Systems (RSs) when they want to buy some stuff, movie and music. However, the possibilities of the Sybils with the malicious behaviors may exists in these RSs sites in which Sybils intentionally increase or decrease the rating values. The RSs cannot play an accurate role of the proper recommendations to the general normal users. In this paper, we divide the given rating values into the stable or unstable states and propose a system information based recommendation algorithm that minimizes the malicious user's influence. To evaluate the performance of the proposed scheme, we directly crawl the real trace data from the famous movie site and analyze the performance. After that, we showed proposed scheme performs well compared to existing algorithms.

  • Integrated disaster management system in Korea is recently concerned due to incompletion and inadequacy in establishment of the system. In this regards, this study aims to examine improvement of the domestic integrated disaster management system considering sustainability and resilience concept, which are recently considered in disaster and safety management. To do this, the authors examined the integrated disaster management system with representative principles to enhance sustainability and resilience in community based on diversity and redundancy, connectivity, slow variable, systematic approach, learning and feedback, and active participation. It is believed that the improvements and recommendations proposed by sustainability and resilience principles in this study can contribute to establishment of strategies, policies, and R&D for enhancing domestic integrated disaster management and sustainability and resilience in community.

Modern Technology and Military Technological Surprise (현대 과학기술과 군사 기술적 기습)

  • The military technological surprise has been delivered in many warfares as a surprise tactic. It can be used both strategic and tactical level. As the weapon systems have been escalated their capabilities by the modern science and technology advancement, the possibility of technological surprise has been increased. Technological surprise can spring from sources like scientific breakthrough in the laboratory, rapid fielding of known technology, and new operational use of an existing weapon and technology. There are 2 types of surprise, known surprises are those which the nation should have known but did not adequately prepare, and surprising surprises are those which the nation might have known but which were buried among other possibilities. The nine cases of modern technological surprises are presented and the sources and types are analyzed. The recommendations for the ROK MND to prepare for the future technological surprises are proposed.

The Tax Structure of Welfare States - Recommendations for Universal Welfare States - (복지국가의 조세체계와 함의 - 보편적 복지국가 친화적인 조세구조는 있는 것일까 -)

  • The current study analyzed the tax structure in the welfare states. The appropriate tax structure of universal welfare state should be based on expanding all taxes, rather than choosing between direct and indirect, progressive and regressive, or mobile and immobile tax. The revenue for the universal welfare payment should be raised by levying tax on all people provided that the welfare payment is made available to all people. The analysis led to classification of tax structure into the high tax European model and the low tax English and East Asian model. The high tax European model was further classified into the balance tax model and the high social security model. The low tax English and East Asian model was classified into the low social security model and the high property tax model. Based on the results, the study maintained that the universal welfare states need not only to expand welfare resources but to develop tax system that corresponds to the universal welfare system.

Long-term Policy Development for the Aged on Medical and Health Care Security (노인의료보장 및 건강관리를 위한 장$cdot$단기 대책)

  • The ageing problem of the population has been emerging in Korea since 1970's so that it is expecting the elderly 65 years and over among the total population from $4.5\%$ in 1988 to be $6.3\%$ in year 2000. This study was conducted to provide secure policy development in coming years for the aged on medical and health care aspects based on the examining current status of the aged problems and health care policies and systems. The study divided into four parts; The first part examined the medical insurance program and public assistance program of the health services in relation to the aged. The second part emphasized on reduction of medical care cost for the aged. The third part studied the regular health check-up program and health education for the aged. The fourth part examined the chronic disease management programs for the aged and strategies of the health care service quality improvement and specialized programs. The following recommendations made as the results of the study. 1. At present, the medical insurance program and public assistance program for the medically indigent is not appropriate to the elderly because it is a part of general medical insurance program so that Health Security Law for the Aged is proposed. 2. Medical cost will be increased due to the high occupancy rate of hospital beds and long stay of the elderly so that it is recommended to develop an early discharge program, home health care program, Health hospice and an althernative programs. 3. At present, a regular health check-ups for the elderly is not included in medical insurance program so that it is recommended to be included in the insurance program and at the same time health education program thoroughly developed for the aged. 4. To make proper medical and nursing services on chronic diseases for the elderly, it is recommended manpower development, specialized clinics or hospitals, nursing homes and an equivalent long term care facilitices should be established on the community based and a research institutions also to be related to supper the care programs.

A Study on First Demand Guarantees in International Construction Projects -Disputes arising from the DG and Recommendations for their Drafting- (해외건설공사에서 독립보증에 관한 분쟁과 그 대책)

  • Since the 1970s, international construction employers have commonly requested first demand guarantees upon their contractors as a form of security for due performance of their works. Contractors prefer the greater protection offered by more traditional forms of security requiring presentation of an arbitral award or other evidence of the caller's entitlement to compensation. Many contractors nonetheless feel that they have no alternative but to provide these unconditional guarantees in order to compete. However, these unconditional first demand guarantees are controversial and have given rise to numerous disputes both in arbitration and litigation. Disputes arising from first demand guarantees can be broken down into a) applications to prevent a perceived fraudulent or otherwise unfair or improper calling of a guarantee, b) claims arising from such abusive calls and c) claims relating to the consequences of such calls even if the call itself may not be abusive as such. The contractors should carefully assess the risk of an abusive call being made bearing in mind the difficulties he may face in seeking to prevent such a call. He should also bear in mind the difficulties, delays and cost he is likely to encounter in seeking to recover any monies wrongfully called. One option would be to provide that the call can only be made once and to the extent that the employer's damages have been assessed or even incurred or even for the default to have been established by an arbitral tribunal or court. Another option would be to provide that any call be accompanied by a decision of a competent and impartial third party stating that the contractor is in breach. For example, such a requirement could be incorporated into a construction contract based on the FIDIC Conditions by submitting this decision to a Dispute Adjudication Board. Another option would be to provide for the "ICC Counter-Guarantee Scheme". In sum, there would appear to be room for compromise between the employer and the contractor in respect of first demand guarantees by conditioning the entitlement to call such guarantees to the determination of a competent and impartial third party.

THE ACTIVITIES OF AMALGAMATED TERRITORIAL COMMUNITIES IN THE CONTEXT OF SUSTAINABLE DEVELOPMENT OF THE ENVIRONMENT: THE EXPERIENCE OF UKRAINE AND THE EU STATES

  • The relevance of the study implies the need to explain the main determinants of environmental policy, allowing countries to converge on a common working basis. The purpose of the research is to explore ways in which the environmental aspects of EU regions and territories can be shaped to apply to domestic environmental policy. A total of 997 representatives from the Ukrainian UTCs, who are involved in local environmental policy, participated in the survey. Results of the research. A hierarchy of regional environmental policy objectives has been identified. Three key principles of eco-policy development have been distinguished. The means of the innovative approach strategy implementation have been outlined (formation of the regional market of environmental services; organization of interaction between environmental agencies and market structures; establishment of environmental funds which finance environmental activities; implementation of the "collateral return" system; formation of a system of benefits and loans to enterprises that successfully implement the environmental policy). The means of the prognostic approach implementation strategy to the development of the region's environmental policy have been determined (the use of an orderly and successful long-term strategy of economic development of the region; obligatory consideration in the mechanisms strategy aimed at improvement of environmental management system of the region, interbranch impact of the projects implemented on the region's ecological situation; taking into consideration the economic and geographical peculiarities of the region, the necessary infrastructure, issues of the territorial location of the large enterprises in the region and their impact on the environment). The means of the traditional approach strategy implementation have been outlined (activity programs focused on solution of specific problems, rather than on the implementation of measures for environmental restoration and enhancement; nature conservation problems have interbranch, interdepartmental character due to unity of the region's ecosystem; tracking complexity of changing conditions (water basins, woodlands, air-mass transport), regional boundaries generally do not coincide with natural ecosystems boundaries). The practical significance of the study lies in providing recommendations for the implementation of certain aspects of Ukrainian UTC's environmental policy.
