The Value of the Good Faith of the Occupier for Acquiring the Right of Ownership by Limitation of Possession

  • This scientific article is devoted to the study of the legal significance of such a category of legal status of the purchaser of another's thing, as its good faith. The essence of this phenomenon has been studied, it has been established that the criterion of good faith attaches significant importance to the claims of the participants of these relations for the acquisition or preservation of private property rights. The paper emphasizes that, in addition to the importance of good conscience at the time of possession of another's thing, which gives legal certainty the possibility of registration of the title and is part of the actual composition for the acquisition of property or the right of ancient possession, bona fides also characterizes the behavior of the occupier. In this case, good conscience only has some legal consequences when it is opposed to subjective law. Under such conditions, it acquires direct legal significance, including as a condition for the acquisition and protection of rights. Good faith possession of another's property is an internal indicator of the subject's awareness of a certain property status. This sense, the article assesses this status from the standpoint of the scientific concept of the visibility of law. According to this theory, prescription is also considered as a consequence of the appearance of law, however, because it arises and lasts against the will of the parties and despite their awareness of this fact. Therefore, bona fide continuous and open possession of property as one's own, during the acquisition period, was most significantly associated with the appearance of property. Therefore, the concept of good faith, in the sense of personal perception of real values, is closely related to the principle of protection of the appearance of law, as it is aimed at understanding it by third parties. The paper notes certain differences in the application of the theory of the appearance of the right in the acquisition of property by a bona fide purchaser from an unauthorized alienator and the acquisitive prescription. It is emphasized that such a mechanism must be used in presuming the attitude to the thing as its own, by the holder of movable property. But there should be exceptions to the rule, in particular, if the owner has grounds for vindication of the thing.

Correlation Analysis between Safety Evaluation Indices and Load Carrying Capacity in Bridges (교량 안전성 평가 지표와 내하율의 상관관계 분석)

  • In Korea, safety inspections of bridges are conducted periodically in accordance with law. Bridges are classified according to type, length, etdc., and the content and frequency of safety inspections are different. Bridges safety evaluation is performed on relatively large bridges, and safety evaluation of small bridges, which account for the majority of all bridges, is not mandatory. Therefore, in this study, in order to confirm the safety of small-scale bridges, a correlation analysis study was conducted with the common load carrying rate for each safety evaluation indicator. For this purpose, inspection reports of bridges from local goverments were collected, and the values for each bridges for about 50 indicators in the report were converted into data. By performing cleaning on the collected data and analyzing the correlation with the common load carrying rate, the top indicators related to safety for each bridges type were derived.

  • Currently, there are the technologically urgent needs of fabricating the hyper coal (HC) based on the approach to extracting mainly effective organics from low rank coals (LRCs), because some industrial countries pursue global sustainability dealing with hot issues such as local energy supply security as well as global warming. In this study, as of the fabrication of clean HCs via LRCs upgrading, we comprehensively review the R&D status of two solvent extraction technologies, namely, Ohm heating (OH) and microwave irradiation (MI) extraction processes on the basis of the performance indicator such as a HC extraction yield.

A Monitoring System for Working Environments Using Wireless Sensor Networks (무선 센서 네트워크를 이용한 작업환경 모니터링 시스템)

  • A sensor network which is composed of a large number of sensors that perform various sensing is applied in a variety of fields. The sensor networks can be widely used for various application area like as home automation, fire detection and security area. Development of new sensor to have appropriate functions and deployment of networks for suitable application are served actively. In this paper, we design and implement a system that monitors various factory facilities by deploying sensor network at a working place which threatens the worker's safety. A sensor node reports its sensing data like as temperature and humidity to monitor facilities to a sink node. And the server which is connect to the sink node gathers and provides information by user interface. In addition, digital data which are generated at a work place can be transferred via the sensor network to increase the efficiency of works. The proposed sensor network provides the convenience of working, since it is deployed at a garbage collection company to monitor a temperature and humidity of garbage and to transmit data about the weight of trucks which enters the company.

  • The purpose of this study is to present the direction of improving the Korean Government 2.0 services by evaluating the quality of the service and analyzing its effects on user satisfaction. Recently, on the extension of e-government, Government 2.0, which is the government service combined with Web 2.0, has emerged as a new paradigm. However, there are very few studies on the impact of Government 2.0 on general society and industries. Especially, there is little or no practical analysis and evaluation for the quality of Government 2.0 service. Because the service quality is typically used as the leading indicator of user satisfaction, this study applies it to the Government 2.0 for the validation of the existingtheory in a particular subject. The service quality was measured by the tangibles, reliability, responsiveness of revised SERVQUAL, the efficiency and security of the E-S-QUAL. Inconclusion, this study has empirically significant implications for providing a theoretical foundation for measuring the quality of the Government 2.0 service.

  • Recently, due to the development of attack techniques that can circumvent existing information protection systems, continuous threats in a form unrecognized by the user have threatened information assets. Therefore, it is necessary to support the prompt responses to anticipated attempts of APT attacks, bypass access attacks, and encryption packet attacks, which the existing systems have difficulty defending against through a single response, and to continuously monitor information protection systems with a defense strategy based on Indicators of Attack (IOA). In this paper, I suggest a centralized intelligent information protection system to support the intelligent response to a violation by discerning important assets through prevention control in a performance impact assessment about information properties in order to block the attack routes of APT; establishing information control policies through weakness/risk analyses in order to remove the risks in advance; establishing detection control by restricting interior/exterior bypass networks to server access and monitoring encrypted communications; and lastly, performing related corrective control through backup/restoration.

Analysis of Demand-Supply Status for Improving the Effectiveness of Plans for Supply and Demand of Reginal Patient Beds (지역병상수급계획 실효성 제고를 위한 수요공급 현황 분석)

  • Background: The purpose of this study was to analyze the demand and supply status of patient beds by type of medical institution, categorized into 70 clinical privilege, in order to understand the regional bed supply situation. Methods: Utilizing the 70 clinical privilege defined by the Ministry of Health and Welfare, we calculated bed demand and supply quantities from 2019 to 2021 using data from Statistics Korea and the Health Insurance Statistical Yearbook. The bed demand calculation formula was based on the detailed guidelines for the medical sector by the Korea Development Institute and the 3rd edition of bed supply basic policies announced by the Ministry of Health and Welfare. Additionally, to mitigate distorted bed supply situations caused by factors such as regional levels and patient outflows, we classified bed supply types using the population decrease index indicator published by the Ministry of Public Administration and Security. Results: Among the 70 clinical privilege, it was analyzed that a relatively balanced bed supply situation exists overall, irrespective of the type of healthcare institution. However, in medical institutions at or above the level of hospitals, regions with bed supply ratios exceeding 20% compared to demand, particularly in institutions at or above the level of general hospitals, showed a relatively high rate of demand diversion. Conclusion: We have identified the bed supply types in the 70 clinical privilege in South Korea. Based on the results of this study, we emphasize the need for bed supply policies that consider regional characteristics. It is expected that this research can serve as fundamental data for future efforts aimed at managing or rectifying bed supply imbalances on a regional basis.

Composition of Federal R&D Spending, and Regional Economy : The Case of the U.S.A

  • In this study, the significant and enduring concentration of federal R&D spending in metro-scale clusters across the nation is treated as evidence of the operation of a distinct industrial infrastructure defined by the ability of R&D performers to attract external funding and pursue the sophisticated project work demanded. It follows, then, that the agglomerative potential of these R&D concentrations -- performers and their support infrastructures -- requires a search for economic impacts guided by a different stimulative effects attributable to federal R&D spending may be that substantial subnational economic impacts are routinely obscured and diluted by research designs that seek to discover impacts either at the level of nation-scale economic aggregates or on firms or specific industries organized spatially. Therefore, this study proceeds by seeking to link the locational clustering of federal contract R&D spending to more localized economic impacts. It tests a series of models(X-IV) designed to trace federal contract R&D spending flows to economic impacts registered at the level of metro-regional economies. By shifting the focus from funding sources to recipient types and then to sector-specific impacts, the patterns of consistent results become increasingly compelling. In general, these results indicated that federal R&D spending does indeed nurture the development of an important nation-spanning advanced industrial production and R&D infrastructure anchored primarily by two dozed or so metro-regions. However, dominated as it is by a strong defense-industrial orientation, federal contract R&D spending would appear to constitute a relatively inefficient national economic development policy, at least as registered on conventional indicators. Federal contract R&D destined for the support of nondefense/civilian(Model I), nonprofit(Model II), and educational/research(Mode III) R&D agendas is associated with substantially greater regional employment and income impacts than is R&D funding disbursed by the Department of Defense. While federal R&D support from DOD(Model I) and for-profit(Model II) and industrial performer(Model III) contract R&D agendas are associated with positive regional economic impacts, they are substantially smaller than those associated with performers operating outside the defense industrial base. Moreover, evidence that the large-business sector mediates a small business sector(Model VI) justifies closer scrutiny of the relative contribution to economic growth and development made by these two sectors, as well as of the primacy typically accorded employment change as a conventional economic performance indicator. Ultimately, those regions receiving federal R&D spending have experienced measurable employment and income gains as a result. However, whether or not those gains could be improved by changing the composition -- and therefore the primary missions -- of federal R&D spending cannot be decided by merely citing evidence of its economic impacts of the kind reported here. Rather, that decision turns on a prior public choice relating to the trade-offs deemed acceptable between conventional employment and income gains, the strength of a nation's industrial base not reflected in such indicators, and the reigning conception of what constitutes national security -- military might or a competitive civilian economy.

Development of Web Credibility Evaluation Model Using AHP (AHP를 이용한 웹 사이트 신뢰성 평가 모델 개발)

  • This study tired to develop the web credibility evaluation model by calculating weighted values and sensitivities of indicators which presented on preceding researches using Analytic Hierarchy Process. "Expert Choice 2000" was used as the tool for analysing AHP. 25 experts are answered for this questionnaire who are selected by judgement sampling method, one of the non-probability sampling method. Also, sensitivity analyses was performed to graphically see how the alternatives change with respect to the importance of the indicators or sub-indicators. The main results are summarized as followings; i) importance analysis in first level factors: trust-worthiness(0,606), expertness(0.222), safety(0.173), ii) importance analysis in second level factors: trustfulness (0.519), reputation(0.087), usefulness (0.102), timeliness(0,093), competency(0.027), security(0.115), reliability(0,058). iii) some of the importance analysis in third level factors: the site provides comprehensive information that is attributed to a specific source(0.252), the site has articles that list citations and references(0.153), the site contains user opinions and reviews(0.072), etc. iv) sensitivity analyses showed that the importance of the indicators or sub-indicators are slightly changed with respect to the alternatives change.
