해난구조에 있어서 전문잠수인력 개발에 관한 연구 (A Study on the Development of salvage Divers)

  • The amount of Sea Casualty is increased by heavy sea traffic, increasing sea-borne cargoes, and superannuated vessels. This study analyzed the circumstance of ship salvage in Korean Salvage Units and management of Salvage Divers in Korea and other countries in order to make establishment of Ship Salvage Divers. This paper reputed the object, the necessity and the character of Ship Salvage Divers. For the purpose of study two parts are considered in order to analyze the environment of salvage divers(the circumstance of Sea Casulties and Ship Salvage). Under the present circumstance in Korea this development planning study may be restricted, but the effective planning to activate Korean Ship Salvage Diver is abstracted as follows; First, the political assistance of concerned government authority is needed. Second, establishment of new course, grade, certificate and licence for Salvage Diver is a Pre-requisite factor for the successful enactment. Third, establishment of Korean Ship Salvage Diving Center or School is strongly required.

해난구조비의 보험보상에 관한 연구 (A study on Insurance Indemnity of Salvage award.)

  • Sea casualties may happen in ship, cargo and the others concerned with sea transportation. : the shipo-wer, marine insurer and salvage company have been endeavored to compensate salvage award with some rule and regulation such as Marine Insurance Act, York Antwerp Rules and Average adjustment rules. Once sea casualties happened, the salvage contract is established between the owners, marine insurance and salvage company, the contract are divided into so many kinds of them. In this paper, we have an analysis on the character of the salvage contract whether the characteristic contents of them are in benefit to any party or not. In this connection with these positive or negative character of the contract, it is worthwhile to compare the actual salvage expenses contract with no cure no pay contract. LOF 1990 has been revised recently, which is based on no cure no pay, expecially, the special compensation, safety net clause of LOF 1990 could be understood in the view of the prevention of sea pollution and the preservation of sea circumstances in the world. Salvage has the complicated and quality, because the adjustment of almost salvage charges have been treated through the other sea casualties which is accompanied by and mixed with. Besides of the importance of salvage contracts, we are in need to understand that what the diversified character of salvage charges are. Furthermore the owners should carefully select the insured conditions on Hull Insurance according to the type of his company, operating ocean route, loading cargo and etc. In this paper, we would try to analyze the character of the salvage award such as General Average, Sue and Labour Charges and Particular charges. We would like to propose that the uniformed system of the salvage award. Compensation should be built up for the effective and efficient salvage operation and for reducing the claims and conflicts from the concerned parties. To this end, we could expect that the uniformed system for salvage award compensation will come to be the benefit of all owners, insurers, salvage company.

한국의 해난구조 역량 분석 및 발전 방안 연구 (A study on Korean salvage competency analysis and development plan)

  • 본 논문에서는 해난구조 분야에 대한 일반적 정의와 역할을 고찰하고, 한국 해군과 민간의 현황을 조사하여 국내 역량 분석을 하였다. 또한 국내 해난구조 역량을 제고하기 위해 영국 및 미국 등 선진 해양국가의 해난구조 체제를 살펴보았다. 이러한 자료들을 종합 분석한 결과, 한국의 해난구조 저변 확대 및 발전을 위해서는 국가적인 해난구조 자산의 통합 활용과 국제적으로 통용되는 잠수 인증 시스템 도입 및 이를 주도적으로 추진할 수 있는 민 관 군 통합 해난구조 기관 설립이 필요한 것으로 분석되었다.

2016년 요크앤트워프규칙상 구조비의 공동해손 인정요건에 관한 연구 (A Study on the Conditions for Salvage to be allowed as General Average under the YAR 2016)

  • Salvage has been allowed as general average since 1974. However, the adoption of YAR 2004 which had reflects cargo interest's position has made salvage unallowable in general average. The YAR do not have the force of a convention and only apply by mutual agreement between the parties to the contract of carriage. Thus, it is important that any changes to the Rules have the consent of major stakeholder. However, shipowners generally refuged to accept the incorporation of the 2004 Rules. The revised 2016 Rules is the result of compromise between the ship and cargo interests. YAR 2016 Rule VI has the premise that salvage is allowable as general average. However, with regard to the types of salvage that are payable independently by ship and cargo such as under Lloyd's Open Form it does not allow these type of salvages as general average and reapportion them, unless causes significantly inequitable result and meets five conditions. In addition, it makes the adjuster's task much easier as it avoids the deduction in respect of salvage payment can readily be calculated by total amount paid to the salvor. The salvage issue to be dealt with in YAR 2016 reduces the complexity, cost and delay in adjusting general average.

비인강암종의 구제치료 (Salvage Treatment of Nasopharyngeal Carcinoma)

  • Nasopharyngeal carcinoma(NPC) is a disease whose primary initial treatment is radiation. Results of radiation therapy in early stage disease is promising; however, in stage IV disease, the best reported five-year survival is only about 30%. In patients with post-radiation recurrent disease, radiation controls only a small portion of patients, as well as being associated with significant radiation injury. In this paper we discuss the use of salvage treatment modalities for post-radiation recurrence. A retrospective chart review and analysis of salvage treatment results were performed for 39 patients with recurrent post-radiation NPC and positive cervical lymph nodes during the period beginning 1985 until 1995. Mean age of these patients was 52.3$\pm$10.37 years and male: female ratio was 1.8 : 1. Twenty patients were treated with salvage treatment, and ten patients were treated by salvage chemotherapy. A total of nine patients underwent surgical salvage treatment, including neck dissection(6), transnasal laser surgery and booster radiotherapy(2), and primary surgery(1). Salvage treatment were effective in reducing patients' pain in twenty patients (51.3%) and prolonging life in nine patients(23.1%); however, recurrence of disease within six months and/or residual disease by clinical or radiologic exam was noted in all patients receiving salvage radiotherapy, chemotherapy, laser surgery with radiotherapy, and primary site surgery. In the group undergoing salvage neck dissection, three patients(50%) were disease free for at least two years. Of the different modalities, radiotherapy was associated with the best quality of life while catastrophic salvage surgery resulting in insignificant prolongation of life was associated with the poorest quality of life. We conclude that salvage surgery is the optimal choice of treatment for regional recurrence such as nodal failure, however palliative salvage therapy could be preferred in other cases with recurrent post-radiation NPC.

국내 해양 구난산업의 현황과 육성방안에 관한 연구 (The Current Status of Domestic Marine Salvage Industry and Measures for its Promotion)

  • 해양사고는 대규모 인명피해와 해양환경 피해를 가져오므로 인명구조와 함께 선박 및 화물에 대한 신속한 구난작업이 중요하다. 우리나라의 경우 국내 구난역량이 미흡하여 대형해양사고 발생 시 구난작업은 대부분 해외 대형구난업체에 의존하고 있다. 본 연구의 목적은 국내 구난산업의 현황과 문제점을 도출하여 민간 구난산업의 육성을 위한 정부의 지원방안을 제시하는 데 있다. 본 연구에서는 국내 구난산업의 현황분석을 위해 산업계 현장조사 및 종사자들과 면담을 실시하였고, 민간 구난산업 육성방안으로 구난산업 지원전담기관의 설치방안과 전담기관에서 수행해야 할 기능을 식별하여 제시하였다. 또한, 구난업의 진흥 및 국가 해양사고 대응역량 강화를 위하여 '구난산업의 육성에 관한 법률안'의 주요 골자를 제시하였다. 법률안 초안 마련을 위해 관련 국내법과 국제협약을 폭넓게 검토하였다. 본 연구의 결과로 제시된 법령 제정방안을 바탕으로 관계부처가 중심이 입법 활동이 추진되어야 하며, 성공적인 입법을 위해서는 관련 학계와 민간업계의 협력이 요구된다. 본 연구가 국내 해양 구난산업의 발전 및 국가의 해양사고 대응역량 향상에 기여할 것으로 기대한다.

우리나라 해난구조기업의 실태분석에 관한 연구 (A Study on the situation analysis of Korean Salvage Company)

  • The amount and quantity of sea casualities are increased by both an increasing sea-borne cargoes and heavy sea traffic. This paper analyzed the situation of Korean salvage company in order to activate on civilbasis, compared with the nature of common enterprises, and reported the object, the necessity, and the cha-racter of salvage company. For the purpose of this study, three parts are considered in order to analyze the environment of salvage company(the trend of sea casualties, sea-borne cargoes-passengers, ship tonnage/age) the effective planning to activate Korean salvage company are abstracted as follows : 1.the political assistance of concerned government authority. 2.the cooperation system of concerned business field. 3.the self-developing management of salvage company.

Salvage System Using Location Based Services

  • In the salvage area, the location of the incident vessel and diver to rescue the victim are very important. But there are no ways but to rely on the GPS satellites to obtain the location in the salvage sites. Because the positioning using GPS satellites has a measurement error of up to 50 meters caused by the status of the atmosphere, a new positioning method with more accuracy should be devised. So if studies on measuring the position of the ships and divers accurately in the sea are performed, it will be helpful in the field of the salvage positioning. In this paper, a high precision positioning system in salvage using DGPS signal through mobile broadcasting is proposed with positioning error of up to 1 meter.

해양구난 활성화를 위한 법제도적 연구 (A Legal and Institutional Study on the Activation of Marine Salvage)

  • 해양에서 발생하는 사고는 선박, 선원 및 해운기업뿐만 아니라 사회 전반에도 매우 큰 영향을 미치며, 따라서 해양사고가 발생하였을 경우, 이를 신속하고 효율적으로 구난하는 것은 매우 중요하다. 특히, 대규모 해양오염이나 인명사고를 수반하는 해양사고는 매우 심각한 피해를 발생시킬 수 있기 때문에 해양사고를 당한 인명, 선박 및 재산을 효율적이고, 신속하게 구난하는 것은 특히 중요하다. 그러나 국내의 해양구난을 위한 역량은 매우 빈약한 상황이며, 비교적 좋은 장비 등을 갖추고 있는 해양경찰 또는 해군 등 공공부문과는 달리 민간구난업은 매우 열악한 기술적 및 경제적 상황에 처해 있다. 해양구난은 단순히 경제적 측면의 중요성뿐만 아니라 국가 안보적 측면에서의 중요성도 있기 때문에 이를 활성화하는 것은 매우 중요한 문제이다. 이에 본고에서 해양구난을 활성화하기 위한 방안을 법제도적 측면에서 검토하고 관련 개선방안을 제시하고자 한다. 개선안은 민간 및 공공부문을 포함한 전체적 활성화 방안과 민간부문의 활성화 방안을 제시하였다.

경골 및 비골 원위부 골육종의 종양삽입물을 이용한 사지구제술 (Limb Salvage with Tumor prosthesis for Osteosarcoma of Distal Tibia and Fibula)

  • Recently limb-salvage operation is widely used for the treatment of malignant bone tumor. But distal leg is out of range of limb-salvage operation due to its technical problem. We report satisfactory limb-salvage operation with tumor prosthesis in 3 cases of osteosarcoma of the distal tibia and fibula. Two cases involved in the tibia and 1 case in the fibula. Average age at operation was 23 years. Neoadjuvant and adjuvant chemotherapy were performed in all 3 cases. We used custom made tumor prosthesis which is designed by Seoul National University Orthopaedic Department. Overall Functional Evaluations by Enneking rating system were good in all 3 cases. All cases are CDF(continuosly disease free since the surgical procedure) state at mean follow-up 2 year and 9 months. In conclusion limb-salvage with tumor prosthesis is useful treatment modality for malignant bone tumor of distal tibia and fibula. Good functional results and few complications suggests limb salvage of distal lower leg may be replaceable with B-K amputation.
