  • Recently, there has been rapid and spectacular increase in world wide counterfeiting and other forms of piracy. According to the World Customs Organization(WCO), counterfeiting accounts for 5 to 7 percent of global merchandise trade, equivalent to lost sales of as much as US$512 billion last year. Also Korean firms' damages arising from the infringement of intellectual property rights in global markets, especially in China market, are increasing. However, the existing studies on the intellectual property rights(IRP) protection have mainly focused on legal protection. Because the law is often not the best defense against theft of intellectual property rights, we must develop more effective defensive weapons for protection of IRP. Given this troublesome trend, the intention of this paper is to discuss strategic and tactical efforts, including legal protection, that can serve as proactive measures to deter counterfeiting and thus to assure the protection of Korean firms' intellectual property rights.

  • An issue of human rights abuse in business emerged as a serious social problem recently not only in Korea, but also worldwide. However, the stipulations in 'UNGPs' and 'OECD Guidelines' do not provide a legally binding dispute settlement mechanism. Under these circumstances, it is very well timed that the Working Group on International Arbitration of Business and Human Rights recently published the Draft Hague Rules on Business and Human Rights Arbitration, which will be launched in December 2019 as an effective and efficient alternative to mediation or court litigation. This paper examines the purpose, the structure, and the unique features of the Draft Hague Rules, among other provisions, including 1) Inequality of Arms between the Parties, 2) Appointing Authority, 3) Presiding Arbitrator's Qualification, 4) Evidentiary Procedures, 5) Remedy, and 6) Governing Law.

  • In China, the government has aggressively led the construction and expansion of airports across China. Upon this opportunity, "Korea-China" network is expected to expand. Therefore this study tried to deduce implications for Incheon International Airport by expansion of "Korea-China" traffic rights. As a result of analyzing the exchange values of traffic rights on the "Incheon~Beijing/Chengdu" routes, it was found that there is a concern that Chinese airlines could make inroads into Korean airline's market. In both routes, Korean airline's market share and passenger demand increased while the sales decreased after expanding traffic rights. On the other hand, Chinese airlines showed an increase in sales and a larger passenger growth than Korean airlines. Therefore it is necessary for the government to expand the traffic rights through detailed route value analysis.

  • This article is based on a research conducted from 2009 to 2012, on the political disputes in Thailand. During the data collections periods, it was common to hear the frustration, bitterness and anger, expressed by the Redshirts, especially those who lived in the northeast and northern regions. Coming from the said research, this paper will examine the relationship between emotions and rights. According to the sociology of emotions, there are connections between macrolevel social processes and the arousal of emotions. Emotions arising from macrostructural processes may affect individuals at the microlevel, prompting them into actions collectively. In addition, expressions of resentment and articulation for vengeance can be interpreted as the emotions related to the awareness of rights, which may include the rights to one's needs and the access to resources that fulfill such needs. It will demonstrate how emotions, political demonstrations and the increasing awareness of rights, are related.

  • This article presents an overview of the Native Customary Rights to forests and its role in protecting the future of native people of Sarawak, Malaysia. The native people have had a long history and strong relationship with their forests. Existing documents and studies have been critically reviewed and analyzed in order to elaborate the Native Customary Rights which are critical to the native people of this region. To have a better understanding on Native Customary Rights, it is important to answer three related questions: (i) Who is a native of Sarawak, (ii) What is 'custom', and (iii) What is the nature of 'rights'? The roles of Native Customary Rights for economic, political or social reasons, operate through informal rules embedded in the natives' customs and traditions. These rules have never been codified into formal laws because the adat system merely functions to manage the human relations which are tied to culture thus making it difficult to codify the culture into laws. It is evident that there are several issues underlying the development of Native Customary Rights: (i) Native Customary Rights are considered as inferiority to those of the State, (ii) the issue of over-shadowing of traditional laws by the colonial rule and the current statutory laws and, (iii) projects and land schemes involving the Native Land. It is understood that the challenges of promoting Native Customary Rights are daunting task; however, the constitutional laws need to carefully revise to provide a better future for the natives.
