The Legal nature of a contract for supply of a special purpose aircraft -The legitimacy of contract cancellation on the grounds that the performance specification is not satisfied in the purchase specification- (특수 항공기 공급계약의 법적 성질 - 구매규격서상 성능요건 미달을 이유로 한 계약해제의 정당성 -)

  • In the aerospace field, besides special purpose airplanes, contracts for supply of various types of products such as prototypes, unmanned aerial vehicles and space launch vehicles are increasing. In the case of the contractor, it was planned to spend a large amount of money to supply the production, but if the purchase specification that presents the quality and performance standard of the product is poor or lacks the capacity to judge the performance, consuming enormous amounts of time and money. Even if the undertaker does not have the ability to supply the products with the required performance and quality to achieve the purpose of the contract, he/she must pay the cost of burial due to the incompleteness of the work and the compensation for the cancellation of the contract. In this case, the defendant ordered the plaintiff to supply the aircraft by the Happy Box method, which is capable of ILS Offset flight as specified in the Purchase Specification, but the plaintiff attempted to supply the aircraft by the RNAV method. Although the ILS ground signal can be inspected by the RNAV method, the aircraft manufactured in the manner claimed by the plaintiff does not have the ILS Offset flight function required by the purchase specification, so the defendant can not achieve the purpose required by the purchase specification. It was a question of whether a defendant's cancellation of contract was legitimate. The aircraft, which is the object of this contract, is a subordinate substitute, so the case contract is of undertaking. Therefore, in order to complete the work in this contract, the major structural parts of the aircraft must be manufactured as agreed and have the performance generally required in the social sense. However, the aircraft delivered by the plaintiff has serious defects because the defendant can not achieve the purpose required by the purchase specification due to the lack of the ILS Offset flight function required by the purchase specification. This deficiency is impossible for the plaintiff to repair, so the defendant 's cancellation of the contract is legitimate.

The effects of cellular-phone use on driving performance under various driving speed conditions (주행속도를 달리했을 때 운전 중 휴대 전화 사용이 운전 수행에 미치는 효과)

  • The purpose of the present driving simulation study was to examine the effect of cellular-phone use on driving performance when required driving speeds were systematically varied(60, 80, 100, or 120km/h) while either using cellular-phones(experimental condition; Hands-Free or Hands-Held) or not(control condition). Driving performance was measured both by longitudinal vehicle control(i.e., variabilities in driving speed and headway) and lateral vehicle control(variabilities in lane position). The results can be summarized as followings: (1) The significant difference in driving speed variation between the two cellular-phone usage conditions was found only at relatively higher driving speed conditions(i.e., over 80km/h). (2) Only in the experimental condition where cellular-phone was required to be used while driving, the magnitudes of variation in driving speed, headway and lane position were gradually increased as the required driving speeds were increased(this tendency was not found in control condition). And. (3) the dependent measures of this study appeared to suggest that cellular-phone usage itself (rather than the types of cellular-phone) had significant impact on driving performance. Finally, implication and issues related to this study were discussed.

Performance Comparison of Spray-dried Mn-based Oxygen Carriers Prepared with γ-Al2O3, α-Al2O3, and MgAl2O4 as Raw Support Materials

  • In chemical-looping combustion, pure oxygen is transferred to fuel by solid particles called as oxygen carrier. Chemical-looping combustion process usually utilizes a circulating fluidized-bed process for fuel combustion and regeneration of the reduced oxygen carrier. The performance of an oxygen carrier varies with the active metal oxide and the raw support materials used. In this work, spraydried Mn-based oxygen carriers were prepared with different raw support materials and their physical properties and oxygen transfer performance were investigated to determine that the raw support materials used are suitable for spray-dried manganese oxide oxygen carrier. Oxygen carriers composed of 70 wt% $Mn_3O_4$ and 30 wt% support were produced using spray dryer. Two different types of $Al_2O_3$, ${\gamma}-Al_2O_3$ and ${\alpha}-Al_2O_3$, and $MgAl_2O_4$ were applied as starting raw support materials. The oxygen carrier prepared from ${\gamma}-Al_2O_3$ showed high mechanical strength stronger than commercial fluidization catalytic cracking catalyst at calcination temperatures below $1100^{\circ}C$, while the ones prepared from ${\alpha}-Al_2O_3$ and $MgAl_2O_4$ required higher calcination temperatures. Oxygen transfer capacity of the oxygen carrier prepared from ${\gamma}-Al_2O_3$ was less than 3 wt%. In comparison, oxygen carriers prepared from ${\alpha}-Al_2O_3$ and $MgAl_2O_4$ showed higher oxygen transfer capacity, around 3.4 and 4.4 wt%, respectively. Among the prepared Mn-based oxygen carriers, the one made from $MgAl_2O_4$ showed superior oxygen transfer performance in the chemical-looping combustion of $CH_4$, $H_2$, and CO. However, it required a high calcination temperature of $1400^{\circ}C$ to obtain strong mechnical strength. Therefore, further study to develop new support compositions is required to lower the calcination temperature without decline in the oxygen transfer performance.

  • Conventional brake system was used for passenger cars and SUV for a long time. However, the high performance brake system has strongly required because of increase of engine power and customer's favorites etc. In this paper, a new high performance brake system for Europe was proposed. For this system, the high performance caliper and disc were newly developed. The superiorities of the developed high performance brake system were verified via heat capacity, hydraulic stiffness, corrosion and harsh braking mode test. Also, the high performance caliper and disc for the light-weight were applied to AL-Alloy and can obtain the weight reduction effect of 2.9 kg per vehicle. Finally, a developed high performance brake system is expected to be used for realization of the high performance at the same platforms.

  • A Robot Performance Evaluation System(RPES) with the laser tracker Leica LTD 500 was developed according to the ISO 9283 robot performance criteria. The developed system is set up a test robot to continuously move the prescribed cyclic trajectories without a human intervention and the laser tracker to simultaneously measure the robot's movement. And then, the system automatically extracts the required data from the tremendous measured data, and computes the various performance criteria which represents the present state of the test robot's performance. This paper explains how ISO 9283 robot performance criteria was used for the developed system, and suggests a automatic data extraction algorithm from the mass of measured data. And also, a user-friendly Robot Performance Evaluation System(RPES) Software was developed with Visual Basic satisfying the need of Hyundai Motor Company. The developed system was implemented on NACHI 8608 AM 11 robot. The resulted output shows the effectiveness of the developed system.

  • Performance analysis results are limited to of network level, because network level transmission parameters are used for performance measure and analysis of network design, construction and operation on underwater MANET, With this way of performance analysis based on network level, it is not easy to analyze transmission performance related with user level transmission quality. In this paper, transmission performance focused on application traffic be required by user is investigated to supplement weakness of performance analysis based on network level. Voice traffic, which is expected to be increasingly used on underwater MANET, is considered as application service, Some conditions for underwater MANET will be proposed to support transmission quality, MOS, CCR and EED, etc.. A computer simulation based on NS-2 is used for performance measure, voice traffic is generated as VoIP specification.

  • Purpose: The purpose of this study is to suggest strategic implications about empirical analysis with mediation effects of corporate image in terms of that relations between logistics culture safety, safety compliance and logistics performance of logistics companies. Research design, data and methodology: The structure and method of this research is organized with, first establishing hypothesis and research model based on previous study related to safety culture, safety compliance, corporate image, logistics safety and logistics performance, which has been carried out survey questionnaire to those who got involved in logistics businesses. Results: It is well justified that safety culture and safety compliance have significantly influenced to logistics performance as well as corporate images that is also revealed to have positive impact to logistics performance. With results verifying into mediation effects of corporate image, it is found that corporate image has partial mediation effects between logistics safety culture and logistics performance, and corporate image has full mediation effects between logistics safety compliance and logistics performance. Conclusions: In conclusion, it is strongly asked to make an aggressive efforts to safety compliance with necessity for spread of safety culture in level of enterprise. Planning the strategy and its implementation is required to secure safety in logistics process because both logistics performance and corporate image has positive influences by logistics safety.

  • We study empirically analyzes the relationship between the leadership styles and management strategies of executives perceived by members of small and medium venture companies through organizational performance through SPSS 24.0. The empirical results are as follows. First, the hypothesis that the strategic leadership of the one-level management team had a significant influence on the management strategy showed that strategic leadership (strategic direction, strategic control, maintaining effective organizational culture, ethical management, human resource development, competency development) The relationship between positive cost, strategy of differentiation, and strategy of concentration was positive. Second, the hypothesis 2 management strategy (cost advantage strategy, differentiation strategy, centralization strategy) was statistically significant for both organizational performance (financial performance and non-financial performance). Therefore, management strategy implemented by management acts as a factor to improve organizational performance. Therefore, the execution ability of management strategy should be strengthened. Third, hypothesis 3 (Strategic Direction, Strategic Control, Maintaining Effective Organizational Culture, Ethical Management, Human Resource Development, Competency Development) could be identified as an important role factor for financial and non-financial performance. The organizational performance of SMEs has been a key factor in the strategic leadership and management strategy implemented by management. Therefore, the establishment and implementation of various practical measures to upgrade this were continuously required.

  • In this paper, we propose an efficient Robot Performance System (RPS). For the proposed system, a soundboard was developed and inserted into the body of a humanoid robot to enable audio playback without an external playback device; the hardware required to enable the external storage device within the soundboard to remember the sound sources necessary for performances was developed. Furthermore, a specialized performance scenario planning software called Robot Performance Planning Development Program (RPPDP) was developed to allow users to search through a motion database for the robot's default motions, applied motions, and motions for special circumstances, allowing anyone to plan a robot performance at a low cost in a short amount of time.

A performance-based design method for chloride-induced cover cracking of RC structures

  • Chloride-induced cover cracking will aggravate the performance deterioration for RC structures under the chlorideladen environment, which may endanger the safety of structures and occupants. Traditional design method cannot ensure that a definite performance is satisfied. To overcome the defects, a study on the performance-based design method was carried out in this paper. Firstly, the limit state functions were established for the corrosion initiation and cover cracking. Thereafter, the uncertainty analysis was performed to study the effects of random factors on the time-dependent performances. Partial factor formulae were deduced through the first-order reliability method for performance verification. Finally, an illustrative example was presented and the sensitivity of cover depth to other parameters was carried out. It is found that the uncertainties of the random variables have great effects on the required cover depth. It is demonstrated that the performance-based design method can ensure that the target performance can be satisfied and support to formulate a rational maintenance and repair strategy for RC structures under the chloride environment.
