응급환자의 전원과 의사의 설명의무 (Interhospital Transfer of Emergency Patients and Informed Consent)

  • Inter-hospital transfer, depending on its medical and legal appropriateness, affect the prognosis of patients and can even lead to legal disputes. As Emergency Medical Service Act, any physician shall, in case where deemed that pertinent medical service is unavailable for such patient with the capacities of the relevant medical institution, transfer without delay such patient to another medical institution where a pertinent medical service is available. For medico-legally appropriate inter-hospital transfer, the head of a medical institution shall, in case where he transfers an emergency patient provide medical instruments and manpower required for a safe transfer of the emergency patient, and furnish the medical records necessary for a medical examination at the medical institution in receipt of such patient. And transfer process must comply with the requirements prescribed by executive rule such as attachment of the referral, provision of ambulance, fellow riders and informed consent of transfer. Those engaged in emergency medical service shall explain an emergency medical service to an emergency patient and secure his consent. In addition to the duty to inform about emergency medical service to the patient and his or her legally representative, there is also a duty for doctors to sufficiently explain to the patient and his or her legally representative during inter-hospital transfer that the need for the transfer, the medical conditions of the patient to be transferred and emergency treatment that will be provided by the hospital from which the patient is going to transferred. Likewise, the hospital to which the patient is transferred must be thoroughly informed about matters such as the patient's conditions, the treatment the patient was given and reasons for transfer by transferring doctors.

국회의 사회통합기능과 국민의 신뢰: 국회에 대한 기대와 현실의 괴리 (National Assembly as a Representative Institution and Public Trust: Gap between Expectation and Reality)

  • 한국 국회에 대한 낮은 국민신뢰도는 대화와 타협을 중시하는 의회의 구조적 특성에 기인한 독특한 의사결정과정에 일정부분 기인하고 있다는 점은 부인하기 어렵다. 그러나 이보다 더 중요한 요인은 한국의 유권자들이 전반적인 정치상황에 대해 부정적인 인식을 갖고 있고, 높은 정치적 효능감과 정치적 관심에 따른 기대수준을 한국의 국회가 제대로 충족시키지 못하고 있다는 점이다. 특히, 다른 민주주의 국가들과 비교해서 한국 유권자들이 보이는 높은 정치적 효능감과 정치적 관심은 의회와 민주주의에 대해 매우 긍정적인 평가로 연결되며, 이는 현실 정치체제에 대한 높은 기대치로 이어지고 있다. 문제는 높은 정치적 기대치가 현실의 상황에서 충족되지 못할 때 역시 높은 실망감으로 이어지기 쉽다는 점이며, 한국 국회에서 빈번히 관찰되는 파행적인 모습들이 국민들의 국회에 대한 실망감을 낳게 하는 요인이 되고 국회에 대한 낮은 국민신뢰도도 이의 연장선상에서 이해될 수 있다.

탕전실의 시설 기준에 대한 연구 (A Study on the Facility Standard of Herbal Dispensaries)

  • Objectives: Herbal dispensaries can be installed separately from medical institutions. This study was done to suggest directions of regulation on management of externally installed herbal dispensaries. Methods: In this study, we visited and investrigated 7 representative herbal dispensaries to understand current status of herbal dispensaries. After comprehending current domestic regulations on herbal dispensaries, we referred "Management Practice on Dispensary Facility of Traditional Chinese Medicine in Medical Institution", "Enforcement Rule of Decree on Institution Standard of Manufacturing and Importation for Drugs, etc." and "Enforcement Rule of Food Sanitation Act" to suggest improved regulations for herbal dispensaries. Results: We suggested reasonable regulations for facility standards including location of building, dispensary room, water supply facility, lavatory and storage facility, etc.. Conclusions: We hope that results of this study could be baseline data for developing regulations on facility standards of herbal dispensaries.

Development of Quality Management Indicators for Educational Institutions

  • The purpose of this study was to develop indicators for quality management of educational institutions, and to achieve this, literature analysis and expert interviews were conducted. Through literature analysis, the components of TQM were derived focusing on factors to improve the quality of education, engineering education accreditation standards, and a representative education accreditation system, were considered. Additionally, seven areas as well as 32 indicators required for education quality management, were derived by comparing the EFQM excellence model and the MBNQA education model, applied for quality management of companies and institutions. By comparing and synthesizing these results, a draft was developed for the quality management index of educational institution. Next, opinions on correction and supplementation of quality management indicators derived from literature analysis, were collected from five education experts. From the comparisons and integration of these results, eight criteria (leadership, strategy, customers, people, facilities and environment, curriculum management, curriculum improvement, and performance management) and 34 indicators, were proposed for quality management indicators for educational institutions. Curriculum management, people, and performance management criteria were considered more significantly in quality management of educational institutions, and several implications are suggested based on the study results.

선호와 정치제도를 중심으로 한 사회정책 발달이론의 모색 (Explaining the Development of Social Policy: Social Policy Preferences and Political Institution)

  • 이 연구는 사회성원들의 사회정책 선호와 그러한 선호 표출의 제도적 장치인 정치제도에 따라 사회정책이 결정됨을 이론모형으로 제시하려 했다. 우선, 직접 민주주의 정치체제에서는 중위투표자의 사회정책 선호가 집합적 선택의 결과가 된다. 따라서 사회성원들의 사회정책 선호가 사회정책의 결정을 설명하는 핵심적 변수이다. 하지만 현실에서 사회정책의 결정은 직접 민주주의 방식으로 이루어지지 않는다. 이 연구에서는 사회정책에 대한 집합적 선택의 기제인 정치제도를 선거경쟁의 제도화 여부와 선거규칙의 특성에 따라 세 가지로 유형화하였다. 그를 통해 사회성원들의 선호가 동일하다고 할지라도 사회정책에 대한 집합적 선택의 기제인 정치제도에 따라 집합적으로 결정되는 사회정책의 수준은 상이하다는 점을 보이고자 했다. 결론적으로 이 글에서 제시한 이론모형은 현실에 존재하는 다양한 복지체제들이 사회성원들의 선호를 제약하는 제도적 조건들, 그에 따라 나타나는 사회성원들의 사회정책 선호, 그리고 사회성원들의 사회정책 선호를 집합적으로 모으는 정치제도의 차이에 의해 만들어진다는 점을 강조한다.

의약품 임상시험에서 피험자 보호 (A Study on the Protection of Trial Subjects in Clinical Trials of Investigational New Drug)

  • This study focuses on the protection of trial subjects, who participate in clinical trials for new drug. It takes long time to develop new drugs and the clinical trials are required. Usually, pharmaceutical company, which develop new drug, request a research institution(usually, hospital) to investigate the examination of security and side effects of new drug. The institution recruit trial subject to participate in the trials. The contract for clinical research of investigational new drug is concluded between the pharmaceutical company and the institution. This thesis studies the legal regulations for protection of participants of clinical research for new drug. In this respect the first matter of this study is to seek which relation between pharmaceutical firm and participants of clinical trials. Especially, there is a question which the trial subject is entitled to demand the pharmaceutical company which requested clinical trials the institution to supply the investigational new drug, after the contract for clinical trials had terminated or cancelled. This study take into account the liability of the pharmaceutical company to trial subject. Secondly, it is researched the roles and authority of Institutional Review Board(IRB). IRB is Research Ethics Committee of the institution, in which clinical trials for new drug are conducted. According to the rule of Korea good clinical practice(KGCP), IRB is the mandatory organization which is authorized to approve, secure approval or disapprove the clinical trials for investigational new drug in the institution. The important roles are the review of ethical perspective of trial research and the protection of trial subject. Thirdly, this paper focuses if the participants are to be paid for the participation for clinical research. This is ethical aspect of clinical trials. It is resonable that the participant is reimbursed for expenditure such as travels, and other expenses incurred in participation in trials. It is not allowed that the benefit of clinical trials is paid to trial subject. The payment should not function as financial inducements for participations of trials. Finally, the voluntary consent of the trial subject is required. The institution ought to inform the subject, who would like to participate in trials, and it ought to received informed consent in writing for subject. In this regard, it is matter that trial subject has ability of consent. It is principle that the subject as severely psychogeriatric patient has not ability of consent. However, it is required that not only healthy people but also patients are allowed to take part in clinical trials of new drug, in order to confirm which the investigation new drug is secure. Therefore there are cases, in which the legal representative of subject consent the participation of the trials. In addition, it is very important that the regulations concerning clinical trials of new drug is to be systematically well-modified. The approach of legal and political approach is needed to achieve this purpose.

  • 본 연구는 해양환경 및 해양안전과 관련하여 우리나라의 대표적 학술지라고 할 수 있는 "해양환경안전학회지"의 게재 논문을 대상으로 해양환경 및 해양안전에 관한 연구들의 경향을 분석하고자 하였다. 그리고 연구경향을 분석하기 위한 분석기준으로 해양환경안전학회의 학문적 구성을 고려하여 연구자의 소속, 연구자의 지역성, 연구 참여형태, 논문의 학제성, 논문의 연구방법, 논문의 연구영역 등으로 한정하여 연구경향을 분석하였다.

  • This study wished to inspect about certificate of origin issuance authorities subject in certificate of origin issuance mode by spread of FTA, and investigate about improvement plan of current certificate of origin issuance authorities choice for smoothness trade business our country in FTA age to be expanded gradually. Fundamental purpose and meaning of FTA strengthen industry competitive power of two countries because expand trade and investment between the agreement conclusion country, and is expected to esteem agreement target department's estimation at FTA certificate of origin issuance subject choice because is meaning that strengthen trade competitive power, and raise trade company's convenience. Therefore, our country FTA representative authorities is recognized authoritativeness and stability from trade company and trade connection authorities, and is suitable in legal application or institution that can propel with consistency about policy propelled hereafter has to be chosen, FTA agreement country is representative authorities that recognize, and to issue from customs services which is a government agency which can progress business is place of origin issuance business and the place of origin examination, is expected to become more and more effective.

해양동물 보전을 위한 서식지외 보전기관에 대한 대중의 인식조사에 관한 연구 - 국립해양박물관사례를 중심으로 (A Study on Public Perception of the Ex-suit Conservation Institution for Conserving Marine Animals: Case of the Korea National Maritime Museum)

  • 해양에 대한 인간의 이용과 활동의 증가는 해양오염, 해양생태계 및 서식지 파괴로 이어지고 있다. 이러한 결과, 특히 생애주기가 길고 개체수가 적은 해양동물은 멸종위기에 내몰리고 있는 실정이다. 따라서, 우리나라 정부는 2010년부터 수족관이나 해양박물관과 같이 인공적인 서식장소 11개를 서식지외 보전기관으로 지정하여 멸종위기에 처한 해양생물들을 보전하기 위해 노력하고 있다. 그러나, 해양생물의 보전 서비스를 제공하는 서식지외 보전기관에 대한 중요성과 그 경제적 가치를 추정한 연구는 아직 이루어지지 않고 있다. 따라서 본 연구의 목적은 우리나라 해양동물의 보호와 증식을 위한 관리방안인 서식지외 보전기관의 운영정책에 대한 일반시민들의 정량적 지지도를 추정하는 것이다. 이를 위해 우리나라 푸른바다거북의 보전을 위해 시식지외 보전기관으로 운영되고 국립해양박물관의 해양동물 보전역할에 대한 경제적 가치를 추정하였다. 연구의 결과, 서식지외 보전기관과 같은 비시장재인 공공재에 대한 대표적인 가치추정법인 조건부가치추정법을 적용하여 추정된 서식지외 보전기관(국립해양박물관)의 경제적 가치는 약 418억원에서 최대 약 781억원으로 나타났다. 이러한 본 연구의 결과는 해양동물관리 정책자들에게 우리나라 연안해역에 서식하는 멸종위기에 처한 해양동물의 효율적인 관리방안 수립에 유용한 기초자료로 활용될 수 있을 것이다.

Generating Cooperative Behavior by Multi-Agent Profit Sharing on the Soccer Game

  • Reinforcement learning if a kind of machine learning. It aims to adapt an agent to a given environment with a clue to a reward and a penalty. Q-learning [8] that is a representative reinforcement learning system treats a reward and a penalty at the same time. There is a problem how to decide an appropriate reward and penalty values. We know the Penalty Avoiding Rational Policy Making algorithm (PARP) [4] and the Penalty Avoiding Profit Sharing (PAPS) [2] as reinforcement learning systems to treat a reward and a penalty independently. though PAPS is a descendant algorithm of PARP, both PARP and PAPS tend to learn a local optimal policy. To overcome it, ion this paper, we propose the Multi Best method (MB) that is PAPS with the multi-start method[5]. MB selects the best policy in several policies that are learned by PAPS agents. By applying PS, PAPS and MB to a soccer game environment based on the SoccerBots[9], we show that MB is the best solution for the soccer game environment.
