Healthcare Legislation Cases in the National Assembly Petition System: Focused on Petitions to the Health and Welfare Committee of the 13th National Assembly through the 20th Assembly (국회 청원제도를 통한 보건의료 입법사례 연구: 13-20대 보건복지위원회 청원을 중심으로)

  • The right to petition is a classical right of the people in constitutional states, and in Korea, it is a statutory right in the Constitution, the National Assembly Law, the Petition Law, and the Local Autonomy Act. The healthcare community first made a successful petition to the National Assembly when it achieved the amendment of the Government Organization Act through a petition to the National Assembly for the independence of the Ministry of Health, and this achievement served as the basis for further petitions. Since then, the healthcare community has successfully achieved the enactment and amendment of related occupational laws through National Assembly petitions, such as the amendment of Article 41, Paragraph 7 of the former Medical Insurance Act (Korean Medical Association, 14th Assembly), enactment of the Dental Health Act (Korean Dental Association, 15th Assembly), and amendment of the Health Functional Foods Act (Korea Pharmaceutical Association, 16th Assembly). Its petition accomplishment rate is higher than the total petition accomplishment rate of the Health and Welfare Committee of the National Assembly. However, along with the overall decrease in the number of National Assembly petitions, the Korean Medical Association and Korea Pharmaceutical Association have not achieved any results through petitioning since the 16th Assembly (June 2000), and the Korean Hospital Association and Korean Nurses Association have not achieved any results through petitioning since the 17th Assembly (April 2004). Furthermore, no National Assembly petitions have been made at all for 5 years (2014-2018). The Korean Medical Association and Korea Pharmaceutical Association previously showed a high petition accomplishment rate through their accumulated experience with National Assembly petitions and vigorous policy assistance from doctors/pharmacists/nurses turned lawmakers. More specifically, healthcare organizations have achieved results by actively conducting organized activities with the National Assembly, as implemented by a national assembly director and employees, and in case of petitions for legislation, each group has established infrastructure for reviewing the relevant laws by appointing a legislative director, as well as a legal advisor and advisory counsel. Although the organization that has submitted the most petitions to the National Assembly is the Korean Hospital Association, the group with the highest petition success rate is the Korean Medical Association, which may be linked to the relatively high proportion of doctors who have become lawmakers. Furthermore, the fact that other healthcare organizations were highly interested in petitioning the National Assembly has had major implications for the petition activities of healthcare organizations.

  • Soldiers can petition. You can file an action within the military to take action, but you are not satisfied and file a petition outside. However, if you try to resolve the petition with public opinion in mind, there are also side effects of defrauding and losing trust in the military. Military petitions must be organized and operated on legal grounds and experts, and results must be transparent and fair. Institutional efforts are needed to resolve petitions so that external petitions are not easily used as a pathway for smartphones to use in the territory.

  • The purpose of this study is to analyze people's motivations to use the National Petition service of CheongWaDae, the Presidential Office of Korea. The online space has been used as a testbed of deliberative democracy. In fact, a wide variety of public opinions are being formed and gaining sympathy through the E-Petitions and Daum's Agora. In this regard, President Moon's government launched a petition site to gather public opinions. For any petition agreed on by more than 20,000 people within 30 days, the relevant ministry or the President's office must provide answers or feedback. This study wants to figure out how this National Petition is different from previous platforms like Agora or E-Petitions and why it is so well-received by people. This study uses a mix of both qualitative and quantitative methods. First, we conducted a focus group interview to factorize experiences of using the National Petition into measurable constructs. Second, we did a survey o 156 Koreans who had experienced the National Petition. Results show that symbolism, usefulness, gratification, and trust have positive impact on continuous usage intention. This study argues that symbolism, usefulness, gratification, and trust factors should be in place rather than technical aspects in order to increase the actual participation of users on the online platform of deliberative democracy. In addition, this study is meaningful in that it examined how different the CheongWaDae's National Petition is from the existing platforms for collecting public opinions and analyzed factors that encourage continuous use.

A study about the petition to the king of Doam(陶菴) Leejae(李縡) (도암(陶菴) 이재(李縡)의 상소문(上疏文) 연구)

  • This paper examines the petition to the king of Doam(陶菴) Leejae(李縡), one of the key figures of 18th century. He wrote a total of 49 he petition to the king, mostly resignation petition to the king. He emphasized the genuine feelings and emphasized the accurate persuasion logic when he was writing a petition to the king. It is not contradictory to these elements, looking at his actual situation he wrote. He wrote the resignation petition to the king three times to resign Daejehak (大提學), he changed his persuasion logic in each of the resignation petition to the king. We can look at the aspect of transforming persuasion logic on the same topic. His resignation petition to the king, for the first time, was particularly well structured in terms of composition, and used a proper accent method. His resignation petition to the king has the beautiful literary art of gomun(古文), such as the expression of the so-called munjongjasoon(文從字順) and the composition of paragraph organically corresponding. The best work of his resignation petition to the king is Maneonso(萬言疏). The contents criticized Yeongjo(英祖)'s tangpyeongchaek(蕩平策) while evaluating Sinimoksa(辛壬獄事). It consists of a total of 5,300 letters. This work repeatedly used the irony, the method of seolui(設疑), and the incremental method to criticize the tangpyeongchaek(蕩平策), and put Yeongjo(英祖)'s position to the corner. This work is an example of other the resignation petition to the king.

  • Container terminals can maximize operational efficiency when appropriate berths (lengths) and yard capacity are secured. However, some container ports, such as Busan New Port, are separated and operated individually, which limits the efficiency of logistics. In this study, it was analyzed that the efficiency of the overall terminal operation (logistics) can be greatly improved when the yard co-petition area is used for two adjacent container terminals.

  • The purpose of this paper is to develop the web-based apartment flaw-repairing petition system which can be operated under the internet environments. The developed system mainly consists of administrator, constructor and apartment resident section. The administrator can administrate all of the actions which will be occurred during the operation. Constructor must be enrolled before resident can use this system. All of the resident member must enroll before they petition the company. All of the processing is monitored and accumulated at the database to calculate the statistics and finally will be shown by the graphical results. This system which is programmed by the PERL and PHP and MySQL will be easily transformed into the similar kind of request system.

Kim Bok-han's Petition Movement to Paris Peace Conference and Its Idealogical Background (지산(志山) 김복한(金福漢)의 파리장서운동과 그 사상적 배경 - 화서학파(華西學派)와의 관계를 중심으로 -)

  • The petition movement to Paris peace conference was the movement for 137 Neo-Confucian scholars including Kwak Jong-seok to ask for Korean independence in March, 1919. Kim Bok-han had led all the course of Ho-seo version. Although we don't know the exact contents on the both of Yeong-nam and Ho-seo versions, but Ho-seo version might be more conservative than Yeong-nam version in comparison with other versions. This was because Ho-seo version basically represented the conservative stance of the Neo-Confucian scholars in Ho-seo (Southern Chung-cheong province). However although Ho-seo version had conservative characteristic, the projecting and practicing of petition movement to Paris peace conference shows Kim Bok-han's active attitude. What I would like to explain in this paper is the background of how spontaneously Kim led the movement. Especially I tried to make Kim's historical status be revealed through talking the idealogical history of Neo-Confucianism ignored until now. Although Kim received blames he behaved with barbarians when he led the petition movement from the conservatives, Kim never submitted on those blames. Kim's tolerant attitude was prominent in relation with Hwa-seo school against which Nam-dang school(Kim's party) was a rival, especially from also after 'the problem of Choe Ik-hyeon' in 1903. This attitude was connected to the petition movement in tolerant manner. The tolerant attitude like this was revealed from Kim's historical consciousness attached importance to 'the completion of work'.

  • This paper aims to draw practical measures for the Protection of the Rights of the private security guards. The results of the analysis, and presents the legal definition if need be introduced for the protection of private security guards right, are as follows. First, it must be established in Private Security Act the basic provisions that assure the economic status of the private security guards. Secondly, there is a need to clearly define the scope of authority of private security guards. Third, there is a need to clarify the scope of physical force or power in the regulations relating to the duty of the private security guards. This provision during the "displayed its power", there is a possibility that is too arbitrary interpretation, it must be deleted. Fourth, it must be established by weighting penalties for assault of a private security guards. Finally, Private Security Act and the Petition Police Act has a difference in personality and the purpose of the enactment. So it is not desirable to be directly applied to private security guards the provisions that apply to the petition police.

Topic Analysis of the National Petition Site and Prediction of Answerable Petitions Based on Deep Learning (국민청원 주제 분석 및 딥러닝 기반 답변 가능 청원 예측)

  • Since the opening of the national petition site, it has attracted much attention. In this paper, we perform topic analysis of the national petition site and propose a prediction model for answerable petitions based on deep learning. First, 1,500 petitions are collected, topics are extracted based on the petitions' contents. Main subjects are defined using K-means clustering algorithm, and detailed subjects are defined using topic modeling of petitions belonging to the main subjects. Also, long short-term memory (LSTM) is used for prediction of answerable petitions. Not only title and contents but also categories, length of text, and ratio of part of speech such as noun, adjective, adverb, verb are also used for the proposed model. Our experimental results show that the type 2 model using other features such as ratio of part of speech, length of text, and categories outperforms the type 1 model without other features.

Study on Improvement in Operation and Management of Ultra-light flying device Civil Complaints Management System for Ultralight Aircraft (초경량비행장치의 민원처리시스템 운용 및 관리 효율성 개선을 위한 연구)

  • The background of the research is the following: As a result of ultra-light flying device industry development, the utilization of drones and their efficiency have been increasing. However, problems regarding flight permission·approval procedure have not been improved, resulting in increased number of civil complaints. Thus, the purpose of this research is to minimize such civil petition according to the required standards of the two government organizations through enhancing the procedure for managing and employing the system. The research methods entail pinpointing the problems by analysing ultra-light flying device related literature review and by holding focus-interviews with field experts, thereby verifying and providing improved solutions. Under (MLIT) Ministry of Land, Infrastructure and Transport supervision and in accordance with aviation security law, the research provides various updated functions such as improved civil petition processing system's employment and management system, flight approval, integration of names, process, format regarding aviation photographing approval, tool buttons such as the 'Main' button in the system's homepage. This research has the following expected effects : Firstly in the law and regulations section, the clear distinction in the missions and roles of each organization enhances cooperations in tackling civil petition. Secondly the integration of civil petition process reduces time and improves efficiency. And lastly, the improvement of supplementary tools for the public is expected to minimize civil petitions. Future research needs to be conducted under the supervision of the Ministry of National Defense(MND). Factors such as systematic infrastructure for flight photography approval, related unit's reorganization following the defense reform 2.0, and guaranteed conditions for field security action units need to be ameliorated.
