In this paper, we explain Production Liability(PL) law and research method of protection and defence of PL law. In introduction, we give some examples of PL law In main issue, we explain more detail PL law. We survey several country PL law, specially U.S.A., EU, Japan whose are deeply related with us as important export country We discuss our country PL status, our country don't legislate PL law until now We have consumer protection law(소비자보호법) which is weaker than PL law but stronger than civil law(민법), We believe that PL law will be legislated within not long time. At last we discuss protection and defence of PL law inside of company and outside of company as PL insurance.

현 화재 감식 및 조사에서는 일반적으로 화재 조사관의 경험이나 지식으로 판단하는 사례가 있다. 그러나 PL법 및 실화책임법에 따라 국내에서도 과학적 화재조사방법론이 필요시되고 있으며 이에 따라 본 연구에서는 과학적 화재감식 및 화재조사방법론의 일환으로 FDS를 이용한 화재조사매뉴얼의 필요성에 대해서 조사하였다. 그러나 현재 FDS를 화재조사 및 감식에 무분별하게 이용하기에는 어려움이 있으며 이를 활용하기 위한 기초적 화재데이터의 수집이 필요하다고 판단된다.

최근 국내의 경우 FDS를 이용한 성능설계, 화재영향평가 및 피난안전성평가등 다양한 분야에서 활발하게 사용되고 있으며 더불어 제조물책임법(PL법)과 실화책임에 대한 법률등이 새롭게 제정됨에 따라 화재조사 및 감정분야에 화재시물레이션이 적용될것으로 예상됨으로서 이러한 분야에 대한 화재시물레이션의 적용이 큰 이슈로 등장하고 있으며 이에 따라 소방방재청에서도 차세대소방기술에 대한 R&D로서 수행중에 있다. 본 연구는 이러한 상황에서 FDS를 화재조사에 활용함에 따른 문제점과 개선대책을 검토한 것이다.

우리나라는 비약적인 산업기술발전을 통해 선진국 진입을 눈앞에 두고 있다. 하지만 선진국 진입에 있어 크게 세 가지의 걸림돌이 있다. 첫째로는 세계시장 진입의 장벽, 둘째로 제조물책임법(PL법) 대응방안 미흡, 셋째로는 고객신뢰 및 자원의 한계 이다. 이러한 한계점으로 인하여 신뢰성경영시스템의 필요성이 대두되고 있으며 국내의 신뢰성경영시스템의 활성화는 필수 요소로 다가오고 있다. 본 논문에서는 신뢰성경영시스템의 활성화와 이를 위한 지표개발의 필요성 및 개발 방향성을 제시해보고자 한다.

PL(product Liability, 제조물 책임)이란 제품의 결함에 의하여 소비자에게 생긴 손해를 배상할 의무를 부담하는 것을 말한다. 선진국에서는 제조자에게 엄격 책임(Strict Liability)을 인정하는 민사 책임 법을 시행하고 있으며, 우리 나라에서도 2002년 7월부터 PL 법의 시행을 앞두고 있어 그 방어대책이 절실한 시점이다. 제품의 안전성, 신뢰성 문제의 80%이상인 대부분의 요인이 설계에 있으며, 문제 해결의 근원은 단적인 의미로 설계품질을 높이는 것이라 할 수 있다. 본 발표에서는 PL법 시행에 대비한 제조물 책임 예방대책을 알아 보고, QFD, 신뢰성 전개, FTA, FMEA를 단계별로 연결하여 신뢰성, 안전성 평가의 결과를 정확히 분석할 수 있는 QDRD 기법을 소개하고자 한다.

This paper introduces experimental investigates of an accident pattern for the distributing cross linking-polyethylene(XLPE) cable terminations considering product liability(PL) law environment. The influence of defects such as thickness and length decrease of XLPE, an impurity on XLPE and the gap between stress-con of housing and semi-conductor on insulating properties of the termination have been studied. The thickness and length decrease of XLPE decrease ac breakdown strengths. Breakdown traces of XLPE that is damaged by knife displayed ellipse shape. The gap of between stress-con and semiconductor deteriorates dielectric strength of XLPE seriously.

It is impossible to database(DB) the patterns of power cable events and cause analysis of faulted cable because the product liability(PL) law have been enforced in Korea, since 2002. In additions, simulation and pattern of power cable events are needed for DB system under accelerated deterioration. In this paper, we tested for resistance to cracking of cable below the 22.9kV class due to thermal stresses. This method of exam is following IEC 60811-3-1(Common test methods for insulating and sheathing materials of electric cables). From the results, The 22.9kV calss A power cable was discolored on the surface and significantly reduced in the longitudinal direction. As the thermal weight properties of A power cable was definitely varied, we are able to guess the problem of manufacture. If the cable was defect by the manufacture, the victims would be able to claim for damage in the PL system.

PL has been developed centering around England and America. Recently many countries are introducing PL system changing the world a single economic bloc based on the rapid development of Technology and Economy. This paper is studied with related literatures and theses, organizational consulting cases within the framework of the firm as the central operating bodies of PL system. In the past, Some papers about System Integration which was operated as a same Certificate System and enacted in a single organization, was studied and presented. But most of papers was a theoretical study related model and conception. In this situation Government supports PSMS of a single system at government expense to 100­200 companies for improving organizational confrontation ability of PL this year. This paper proposed a design and effect of Integration system model based on the analysis of ISO 9001：2000, KS, PSMS and ISO 14001. The integrated system has the following three distinctions. Firstly, KS is a national establishment, national leading certification and forcing standard. Secondly, ISO 9001：2000 and ISO 14001 are an international organization's establishment, non­official certification and optional standard. Finally, PSMS isn't a national law and forcing matter. And it isn't the concept of certification but the operational system by itself. Also if a lawsuit by defect is happened, it is very dangerous. This paper, which is integrated by four management systems and has many consulting cases, is the first in this department and is different from others. Also If people has the basic knowledge about management system, they can directly connect it to the organizational system according to this paper's guidance. It is very good result in this study because the law of PL is executed now.

2002년 제조물책임법(PL)을 시행하여 소비자가 제조물을 생산하고 판매하는 기업에 대하여 제품의 결함에 따른 손해배상을 청구할 수 있도록 하는 제도적 장치를 마련하였다. 그러나 최근 가습기 살균제 사건 등으로 인해 기업의 제조물책임 강화와 소비자 피해구제를 위한 집단소송제도, 징벌적배상제 도입을 위하여 제조물책임법 개정안 등 현재, 12여건의 관련 법안이 국회에 발의되어 있으나 정작 법안의 이해 당사자인 중소기업의 62.6%는 이에 대해 잘 알고 있지 못한 것으로 나타났다고 하고 있다. 많은 기업들이 PL 방어대책(Product Liability Defense : PLD)으로 문서작성 보관의 적정화, 관련업자와의 책임관계의 명확화, PL 보험의 가입 또는 배상자금의 확보 등으로 대비하고 있으나 이와 같은 대비책은 제품의 설계와 제품의 안전성을 고려한 부분에 대하여 한계점을 느끼게 한다. 이에 본 연구는 먼저 PL의 명확한 개념과 대응방안에 대해 살펴보고 PL 시스템과 개별 경영시스템 간의 관련성을 파악하고 제조물책임법에 대비한 PL 대응시스템을 기업의 개별경영시스템에 통합하고 보다 제품의 안전에 중점을 둔 개별경영시스템 모델을 제시하고자한다. 이 같은 연구목적에 따른 결과는 중소기업의 PL법 대응을 위한 합리적 대응방안으로 평가 받을 것으로 기대된다.
