인터넷 사용자의 개인정보보호 행동의 차이에 관한 연구 (Differences in Privacy-Protective Behaviors by Internet Users in Korea and China)

  • Privacy-protective behavior can be classified into passive behavior and active behavior. Passive behavior includes refusal, misrepresentation, and removal, while word-of-mouth, complaint, and seeking for help belong to active behavior. Internet users in different countries may take different types of privacy-protective behavior because of cultural and social differences. This study analyzes the differences in Internet users' privacy-protective behavior between Korea and China. Korean Internet users take refusal, complaint, and seeking to protect their privacy information, while misrepresentation is not an option for Korean Internet users. Chinese Internet users take refusal, complaint, seeking, and misrepresentation to protect their privacy information. In Korea, passive behavior (refusal) is chosen more often than active behavior (complaint and seeking for help), while in China active behavior(complaint and seeking for help) is preferred to passive behavior (refusal and misrepresentation). The differences of privacy-protective behavior in the two countries may provide some implications for online companies, if they want to avoid the business risk due to privacy concerns and to take appropriate steps to deal with privacy-protective behavior by Internet users.

매체 풍요도, 사회적 존재감 및 생활 만족도가 상대적 박탈감을 통해 SNS 이용자의 이용 지속 의도 또는 이탈 의도에 미치는 영향 (The Effect of Media Richness, Social Presence, and Life Satisfaction on Continuance Usage Intention or Withdrawal Intention of SNS Users via Relative Deprivation)

  • Purpose - This study aims to empirically verify the impact of media richness, social presence, and prior life satisfaction on various continual usage or withdrawal behaviors of SNS users via both a positive path of satisfaction and a negative path of relative deprivation. By identifying these causal paths, we observe dynamic interactions of SNS user psychology in a balanced view, and provide some implications about design principles for SNS providers. Research design, data, and methodology - We developed 16 hypothesis based on media richness theory, social presence theory, social comparison theory, the literature about relative deprivation, and the literature about the various reactions of IS users. The rich SNS media, social presence recognition among peer SNS users, and prior life satisfaction could generate positive experience, attitude, and virtuous behavioral intentions among SNS users. At the same time, rich media, low social presence, and low prior life satisfaction could generate relative deprivation and could increase withdrawal behavioral intentions such as refusal to provide information, misrepresentation of information, and removal of uploaded information in SNS. Scenario surveys were conducted to collect data from potential SNS users. Data from 357 surveys were collected and analyzed through a PLS algorithm to test the hypotheses. Results - Media richness, social presence, and prior life satisfaction could significantly increase perceived enjoyment, satisfaction, and behavioral intention of continual usage and knowledge sharing. They also could significantly decrease refusal and misrepresentation intention. Relative deprivation is significantly decreased only by prior life satisfaction. Relative deprivation could not significantly decrease satisfaction, but it could significantly increase misrepresentation and removal intention, which could be regarded as information distortion intention. Conclusions - SNS providers should focus on developing rich media and social presence support because these two variables could impact the positive experiences of SNS users. Moreover, the positive experiences could heavily influence SNS user behavior. Some management is needed to prevent relative deprivation and its consequences of misrepresentation and removal intention. SNS providers should prevent SNS users from excessive image misrepresentation and removal as this information distortion could be the source of relative deprivation.

Representation of Disabled Community in Mainstream Media

  • There are limited research questioning the relationship between the disabled community and media, particularly in Malaysia. The lack of awareness and common assumption of specialty towards the disabled community have caused a small amount of local disability researches that question the relationship between the disabled community and the media. This research aims to find out the types of representation of disability in the Malaysian mainstream media, particularly press. Interview with visual disabled personnel and content analysis from news coverage of mainstream press are deployed in the study. The findings indicated the invalidity of disability culture as the misrepresentation of disabled community in Malaysia is not as severe as depicted by scholars because the news coverage focusing on them is getting more positive. Besides that, disabled people are not defensive towards the terms used to refer them as long as media practitioners do not over amplify their disability. The application of charity approach is still common in news coverage to portray the disabled community as victim, and therefore they are partially marginalized due to the misrepresentation in Malaysian mainstream press.

선화증권 상의 Retla 약관의 유효성에 관한 연구 (A Study on the Validity of the Retla Clauses in Bills of Lading)

  • In this article, I have reviewed the validity of the Retla Clauses in bills of lading. In Tokio Marine(1970), US courts have permitted carriers to include Retla Clauses in their bills of lading that essentially disclaim all responsibility for the required statement. Simon J in The Saga Explorer(2012) disagreed with the decision of no representation in Tokio Marine and held that the statement with the Retla Clauses made on the bills of lading as to the cargo's apparent condition was a fraudulent misrepresentation. Simon J also requested a strong carriers' honest conduct. However, because the shippers always request the clean bill of lading for trade purpose and never call for a substitute bill of lading showing the true condition of goods, carriers will inevitably continue to clause bills of lading if they have no other better way of protecting themselves in the situation of Tokio Marine or The Saga Explorer. For the present, the decision of misrepresentation in The Saga Explorer might be helpless to change the position of the assignees of the bills of lading. And it seems that the debate on the validity of the Retla Clauses in bills of lading will be continued for the time being. In these circumstances, if the buyers hope to void the potential dispute, they may have a special agreement in the sale of goods contract, for example, requiring a pre-shipment inspection of the goods so as to know the actual condition of the goods on shipment.

And keeping the principle of equity and the homogeneity of risk in the group of the insured, you are able to manage the company reasonably and realize the orginal ideal of life insurance, namely, the mutual assistance. And yet, the cases of the misrepresentation have been occurred frequently so far. As a result of them, the development of life insurance industry has been obstructed, and public criticism has been caused. The Crisis of British Imperialism in Southeast Asia: The (Mis)Representation of the Indigenous in Clifford and Conrad

  • In the late nineteenth century, British colonial activities became aggressive and annexationist in the tropics, including the Southeast Asian Archipelago, which reflected the historical circumstances of both increasing resistance from the indigenous and severe competition among European powers. Interestingly, the change in English colonial policy toward an annexationist or imperialist vision adopted the motto of a civilizing mission, which was founded on the anthropological assumption that the white English were civilized, while the non-white indigenous were savage. The assumption developed into colonial discourse through systematic gathering of anthropological knowledge about the peripheries of the Empire. The knowledge system was flawed, which stressed the differences of the peripheral populations from the English and served as an inverted discourse on the Imperial Self rather than the description of the Other. Furthermore, the natives were heterogeneous, which rendered indistinct the racial and cultural differences between the English and the natives. Still, the aboriginals called Malays, who were comprised of many ethnic subgroups, needed to be deemed savage or inferior by the English in order to justify the English civilizing work or imperial ambition. Put differently, the representation of the English as civilized necessitated the (mis)representation of the natives as savage. In this context, Clifford's works contribute to systematic misrepresentation of the Malays, on which colonial discourse is founded, though not without self-contradiction. On the other hand, Conrad's novels that are set in the Malay Archipelago resort to a strategic misrepresentation that reveals the relativity of the discourse. Exploring the dilemma of denationalization to various degrees, Conrad's Malay texts problematize the (mis)representation of the indigenous as inferior, which is the basis of English claim to superiority.

  • Freshwater algae make up a very important portion of the autotrophic component of the aquatic food web. Therefore, the study of freshwater algal structure and biomass is central to aquatic ecosystem studies. Due to variations in cell shape and size for each species (or taxon) and survey site, cell abundance (or cell numbers per chosen volume) often leads to misrepresentation of the true importance of some species because of the great differences in size of various algae. Thus, it is necessary to investigate the freshwater algal species of a site in order to calculate the cell volume. Although direct cell counting, species volume measurement, as well as biomass calculation are time-consuming and requiring specialists in taxonomy.

중재합의의 당사자자치에 관한 미국계약법상 해석 (Party Autonomy in Arbitration Agreement: The U.S. Laws)

  • This paper reviews and analyzes the U.S. cases and statutes on the issue of party autonomy in arbitration agreement. Arbitration agreement has been interpreted somewhat differently from general contracts because its legal characteristics are not purely contractual by nature. For example, some legal scholars insist that an arbitration contract is more about an agreement on a process of dispute resolution than a creation of rights and obligations to avoid litigation. Party autonomy was discussed in diverse legal perspectives including contract of adhesion, VKI principle, and separability of arbitration clause. These three legal perspectives are discussed to set the legal relationship between party autonomy and protection of consumers in consumer arbitration. In addition, it was discussed how legal defects in the formation of an arbitration contract can influence the party autonomy. The legal defects that were discussed to analyze the relationship between arbitration agreement and party autonomy included misrepresentation, fraud, mistake, duress, and undue influence.
