미국 통일전자거래법(UETA)에 관한 고찰 (A study on Uniform Electronic Transactions Act)

  • Uniform Electronic Transactions Act (1999) Drafted by the National Conference of Commissioners on Uniform State Laws. The Act allows the use of electronic records and electronic signatures in any transaction, except transactions subject to the Uniform Commercial Code. The fundamental purpose of this act is to remove perceived barriers to electronic commerce. The Act's a procedural statute. It does not mandate either electronic signatures or records, but provides a means to effectuate transactions when they are used. The primary objective is to establish the legal equivalence of electronic records and signatures with paper writings and manually-signed signatures. With regard to the general scope of the Act, the Act's coverage is inherently limited by the definition of "transaction." The Act does not apply to all writings and signatures, but only to electronic records and signatures relating to a transaction, defined as those interactions between people relating to business, commercial and governmental affairs. The exclusion of specific Articles of the Uniform Commercial Code reflects the recognition that, particularly in the case of Articles 5, 8 and revised Article 9, electronic transactions were addressed in the specific contexts of those revision processes. In the context of Articles 2 and 2A the UETA provides the vehicle for assuring that such transactions may be accomplished and effected via an electronic medium. At such time as Articles 2 and 2A are revised the extent of coverage in those Articles(Acts) may make application of this Act as a gap-filling law desirable. Similar considerations apply to the recently promulgated Uniform Computer Information Transactions Act (UCITA). Another fundamental premise of the Act is that it be minimalist and procedural. The general efficacy of existing law, in an electronic context, so long as biases and barriers to the medium are removed, confirms this approach. The Act defers to existing substantive law. Specific areas of deference to other law in this Act include: i) the meaning and effect of "sign" under existing law, ii) the method and manner of displaying, transmitting and formatting information in section 8, iii) rules of attribution in section 9, and iv) the law of mistake in section 10.

  • Compressed air represents an energy source and an force-transmission medium for brake systems on medium-heavy and heavy-duty commercial vehicles. However, one disadvantage is the tendency of air to absorb moisture in the form of water vapor. This water vapor condenses once the air, which is heated during compression, cools back to ambient temperature upon emerging from the air compressor. The resulting condensation assumes the form of moisture in pneumatic lines, air tanks, cylinders and valve assemblies and can have negative consequences for the brake system and vehicle safety. The pneumatic systems on today's vehicles are equipped with air dryers, in which the supplied air is dried according to the adsorption principle. In the systems, the compressed air flows through a granular desiccant with molecular sieves which captures the water molecules.

  • The Power Flow Finite Element Method(PFFEM) offers very promising results in predicting the vibration responses of system structures, and the first PFFEM software, PFADS has been developed in Seoul National University for the vibration predictions and analysis of coupled system structures in medium-to-high frequency ranges. PFFEM is numerical method which solves energy governing equation using finite element technique for complicated structures where the exact solutions are not available. Through the upgrades, the current version PFADS R3 could cover the general beam and plate structures including various kinds of beam-plate rigid joints, spring-damper connection and rigid body connection within beam and plate in addition. This software is composed of three parts; translator, model converter and solver. The translator makes its own FE-model from bulk data of commercial FE software, and the model converter is used to convert FE-model to PFFE-model automatically. The solver calculates vibrational energy density and intensity for PFFE-model by solving global matrix equations of PFFEM. For the applications of PFADS R3, two vehicle models and a container model are examined with respect to major parameters, and reliable results are obtained.

  • In Rollover crashes, the development of bus structure to ensure the maintenance of survival space for passengers is very important . So, this paper focuses on understanding the possibility of efficient structural development considering rollover strength through computer simulation using the commercial code, LS-DYNA3D at the initial stage of vehicle development structural members, and impact boundary conditions required by ADR59(Australian Design Rule 59)were applied. In order to confirm the validity of the computational results, the test results. After the usefulness of this method of analysis was confirmed , we have proposed the effective modificationfor rollover strength.

주행거리 연장형 청소용 전기자동차에 장착된 상용 디젤엔진의 토크제어를 위한 통신 방안 (Communication Method for Torque Control of Commercial Diesel Engine in Range-Extended Electric Trash Truck)

  • 본 논문은 주행거리 연장형 전기자동차에서 발전량을 결정하는 차량 제어기와 이를 수행하는 엔진 제어기 간 토크 명령을 전달하기 위한 새로운 통신방법을 설명한 것이다. 일반적으로 자동차는 CAN 통신방식을 사용하지만, 이 경우 기존 엔진 제어기의 하드웨어 및 소프프웨어를 수정해야만 한다. 이러한 이유로 중소 자동차 개조업체는 발전용 엔진이 탑재된 주행거리 연장형 전기자동차에 대한 개발 및 개조 작업 시 CAN통신방식의 적용이 쉽지 않다. 따라서 본 연구과정에서는 기존의 양산용 엔진 제어기를 주행거리 연장형 전기자동차에 적용하기 위한 핀-핀 통신방안를 제시하였다. 핀-핀 통신방안은 기존 양산용 엔진 제어기내에 탑재된 운전자요구토크 제어 맵을 엔진의 목표속도와 목표토크에 따른 가상 엑셀 열림량으로 변환하는 과정과 이를 기존 양산 엔진제어기가 인식 할 수 있도록 해당 엑셀페달 전압신호로 변환하는 과정으로 구성된다. 가상 엑셀 열림량은 오프라인 환경에서 역 변환 과정을 통하여 차량 최상위제어기에 제어 맵 형태로 탑재되고, 엔진 발전요구량과 엔진 최적 운전점 알고리즘을 통하여 결정된다. 이렇게 결정된 가상엑셀 열림량은 DA신호 변환기를 통하여 기존 엔진제어기가 인식할 수 있는 전압신호로 최종적으로 변환된다. 엔진토크 전달을 위한 이러한 알고리즘과 신호변환 회로는 차량제어기(VCU)에 탑재되어 엔진목표토크에 따른 가상엑셀페달 열림량 변환과정과 신호변환기를 이용한 가상 엑셀페달 전압신호에 대한 통신시험을 실시하여 이러한 통신방식의 실현 가능성을 입증하였다.

중형 버스의 브레이크 저더 현상 개선에 대한 해석적 고찰 (Analytical Study in Brake Judder Reduction of Medium Bus)

  • Brake judder, one of low Sequency vibrations in brake system is determined by the excitation of Brake Torque Variation (BTV). The largest contributor to BTV is disc thickness variation. In this study, the static loads of brake torque at Suspension Mounting Points (SW) are obtained by the quasi-static analysis using DADS. The dynamic loads with frequency of BTV at SW are derived from correlation between forced vibration analysis with static loads and brake test results. And the accelerations at steering wheel were analyzed by forced vibration analysis with dynamic loads using commercial finite element program MSC/NASTRAN so that vibration characteristics of vehicle due to brake judder were investigated. Reliability of analysis results was verified through comparing the brake test results. Also, a parametric study with natural frequencies of frame, such as the 1st torsional mode and 1st bending mode, was conducted to reduce vibration amplitudes. As a result we could detect frame natural frequency conditions to improve vibration characteristics and obtained the frame model to reduce vibration amplitude.

전기자동차용 Ni/MH 전지 Module의 열관리기술 (Thermal Management of a Ni/MH Battery Module for Electric Vehicle)

  • 전기자동차의 동력원으로 사용되는 90Ah급 Nickel/Metal hydride 전지 11개로 구성된 module의 온도특성을 상용 software인 NISA II를 사용하여 해석하였다. 전지 module에 대한 element수를 감축하기 위하여 열전도도가 다른 여러 층을 통하여 전달되는 열흐름에 대한 해석을 전기저항 등가식을 사용하여 단순화하였으며, Cartesian coordinate의 축별로 다른 열전도도를 삽입하는 orthotropic model을 사용하였다. 전지 module의 온도를 낮추기 위하여 알루미늄 재질의 cooling fin을 전지와 전지사이에 삽입하여 실험을 수행하였고, 전지 module 최외곽에 위치한 fin에 의한 최고온도의 강하 효과는 미미하다는 결과를 얻었다. 전지 module내 전지별 온도차이를 극소화하기 위하여 cooling fin의 개수와 두께 그리고 측면 fin의 복합적인 영향에 대한 실험을 수행하였으며, 1mm 두께의 알루미늄 fin을 4개 사용하여 module내 전지별 최고온도의 차이를 $3^{\circ}C$ 이내로 줄일 수 있었다.

  • Many historical research and facet about modern art in Indonesia which formulating background of contemporary Indonesian Art. Indonesian art critic Sanento Yuliman states that Modern art has been rapidly developing in Indonesia since the Indonesian Independence in 1945. Modern Art is a part of the super culture of the Indonesian metropolitan and is closely related to the contact between the Indonesian and Western Cultures. Its birth was part of the nationalism project, when the Indonesian people consists of various ethnics were determined to become a new nation, the Indonesian nation, and they wished for a new culture, and therefore, a new art. The period 1960s, which was the beginning of the creation and development of the painters and the painters associations, was the first stage of the development of modern art in Indonesia. The second stage showed the important role of the higher education institutes for art. These institutes have developed since the 1950s and in the 1970s they were the main education institutes for painters and other artists. The artists awareness of the medium, forms or the organization of shapes were encouraged more intensely and these encouraged the exploring and experimental attitudes. Meanwhile, the information about the world's modern art, particularly Western Art; was widely and rapidly spread. The 1960s and 1970s were marked by the development of various abstractions and abstract art and the great number of explorations in various new media, like the experiment with collage, assemblage, mixed media. The works of the Neo Art Movement-group in the second half of the 1970s and in the 1980s shows environmental art and installations, influenced by the elements of popular art, from the commercial world and mass media, as well as the involvement of art in the social and environmental affairs. The issues about the environment, frequently launched by the intellectuals in the period of economic development starting in the 1970s, echoed among the artists, and they were widened in the social, art and cultural circles. The Indonesian economic development following the important change in the 1970s has caused a change in the life of the middle and upper class society, as has the change in various aspects of a big city, particularly Jakarta. The new genre emerged in 1975 which indicates contemporary art in Indonesia, when a group of young artists organized a movement, which was widely known as the Indonesian New Art Movement. This movement criticized international style, universalism and the long standing debate on an east-west-dichotomy. As far as the actual practice of the arts was concerned the movement criticized the domination of the art of painting and saw this as a sign of stagnation in Indonesian art development. Based on this criticism 'the movement' introduced ready-mades and installations (Jim Supangkat). Takes almost two decades that the New Art Movement activists were establishing Indonesian Installation art genre as contemporary paradigm and influenced the 1980's gene ration like, FX Harsono, Dadang Christanto, Arahmaiani, Tisna Sanjaya, Diyanto, Andarmanik, entering the 1990's decade as "rebellion period" ; reject towards established aesthetic mainstream i.e. painting, sculpture, graphic art which are insufficient to express "new language" and artistic needs especially to mediate social politic and cultural situation. Installation Art which contains open possibilities of creation become a vehicle for aesthetic establishment rejection and social politics stagnant expression in 1990s. Installation art accommodates two major field; first, the rejection of aesthetic establishment has a consequences an artists quest for medium; deconstruction models and cross disciplines into multi and intermedia i.e. performance, music, video etc. Second aspect is artists' social politic intention for changes, both conclude as characteristics of Indonesian Installation Art and establishing the freedom of expression in contemporary Indonesian Art until today.

국가연구개발사업 및 국방연구개발사업 간 비교법적 검토 - 항공기산업 진흥을 위한 기술료 제도 개선에 관한 연구 - (Comparative legal review between national R&D projects and defence R&D programs - A study on improvement of royalty system for the promotion of aircraft industry -)

  • 본 연구는 우리나라의 자동차산업, 조선업 등 일부 중공업이 세계적으로 높은 수준의 생산규모와 기술수준을 달성한 것에 비해 상대적으로 발전이 저조한 항공기산업을 육성하기 위해서는 어떠한 법적, 정책적 사안의 개선이 필요한지에 대해 알아보는데 그 의의가 있다. 우리나라의 항공기산업이 여타 산업에 비해 저조한 성장세를 보이고 있는데 국가 경제규모를 비롯하여 관련 산업의 발달 수준, 항공기 기술 수준, 항공기 제조 수요 등의 변수를 적절히 사용할 수 있는 시장구조를 구축하지 못했기 때문이라고 볼 수 있다. 대부분의 산업은 경쟁체제의 시장구조 하에 민간이 주도하여 성장하지만, 항공기산업과 같은 중공업은 막대한 규모의 초기 투자비용과 높은 기술력, 충분한 양의 수요를 확보하여야만 최소한의 경제성을 유지할 수 있기에 불완전경쟁체제의 시장구조 하에 정부가 주도하여 성장하는 것이 일반적이다. 이에 우리나라의 항공기산업은 군 수요를 중심으로 하는 군용 항공기를 개발하고 양산하는 것에 집중되어 있었으나, 미국과의 BASA(Bilateral Aviation Safety Agreement; 상호항공안전협정)를 체결함으로써 분위기의 반전을 도모하였다. 이에 차세대 중형항공기 개발 사업을 추진하기 위한 예비타당성 조사까지 2010년에 수행되었으나 컨소시움 대상인 캐나다의 Bombardier사와 입장 차이로 인해 무산되고, 현재는 한국항공우주산업(KAI)이 단독으로 Bombardier사의 Q400 면허생산을 추진 중이며 그마저도 순탄치 않다. 이처럼 개발에 난항을 겪고 있는 중대형 민간 항공기에 비해 KAI와 항우연 등에서 민수용 헬기를 비롯하여 무인항공기, 유인항공기의 무인화 기술을 성공적으로 개발하고 있다. 또한 무인항공기 분야는 세계적으로 독점적인 영향력을 행사하고 있는 제조사가 아직까지 마땅하지 않으므로 향후 항공기산업 육성을 위해 민간용 헬기 및 무인항공기 분야에 초점을 맞추어 정부 주도의 연구개발사업을 추진할 필요가 있다고 본다. 또한 KT-1과 T-50과 같은 군용항공기도 순조롭게 수출되고 있는 추세이며, 대한민국 내 항공기 제조에 관한 최대 수요자는 군이라는 점을 간과할 수 없으므로 민군겸용 개발(spin-up), 군용기술 개발 후 민간이전(spin-off), 민간기술 개발 후 국방 분야 활용(spin-on)이 가능하도록 국가연구개발사업과 국방연구개발 사업을 동시에 추진할 필요가 있다. 그러나 양 사업은 사업추진 방식과 전담부서, 기술료 제도에 있어 여러 차이점이 있다. 이에 본 연구를 통해 국가연구개발사업과 국방연구개발사업의 기술 소유권과 실시권, 그리고 기술료 제도에 대해 알아보았다. 그리고 해당 제도의 문제점을 확인하고 개선방안을 도출하였다.
