In 25th April. 2008, the Korea legislature gave advance notice on the Revision Bill of Commercial Law in Insurance Division in partial, one of which is the principle of utmost good faith to be codified in accordance with the effectuation of the Revision Bill enforcement. For this, even though the disclosure duty is not included in the Revision Bill, it should also be discussed in relation to the principle of utmost good faith because it is based upon the principle of utmost good faith and forms a part of utmost good faith. In Marine Insurance industry in Korea, there are the sections and the clauses in relation to the English governing law included in the Policies and the Clauses used in Korea and, also, they still come into effect for the Korea Courts' judgements. So. we, Korea, should carefully pay attention to the trend of English courts' leading case, academic world and insurance industry on the disclosure duty in U.K. This study is thus based upon sections 17 and 18~20 of the Marine Insurance Act 1906 and sections 651, 652 and 655 of Commercial Law in Insurance Division, which appear throughout this work. The objective of this work is to analyse the duty of disclosure on Korean and English Insurance Laws including cases cited in this work, comparing the differences resulted from the analysis of the two countries‘laws and legal cases.

The milk production of Anglo-Nubian, Barbari and Barbari $\times$ Black Bengal goats were compared. The respective average lactation yield of those genotypes were $171.27\;{\pm}\;16.90$, $88.22\;{\pm}\;8.67$ and $52.31\;{\pm}\;13.51$ kg; mean annual milk yield $208.41\;{\pm}\;24.57$, $117.13\;{\pm}\;12.44$ and $84.19\;{\pm}\;23.45$ kg; per day milk yield $0.82\;{\pm}\;0.07$, $0.61\;{\pm}\;0.05$ and $0.43\;{\pm}\;0.06$ kg and lactation length $207.67\;{\pm}\;7.36$, $143.89\;{\pm}\;6.67$ and $116.75\;{\pm}\;13.86$ days. All traits recorded were influenced significantly (p<0.01) by the genetic group. Introduction of Barbari genes to Black Bengal goats had a positive effect in improving milk yield.

Through the this paper, a conclusion could be derived from CISG PICC MISC made by UNIDROIT, UNCITRAL, ICC of representative system making out a draft for uniform law, convention, trade usages. (1) In short, like most int'l sales rules applicable to commercial contracts, these rules play a supporting role, supplying answers to problems arising from transaction between the parties. (2) Though every one has in its own way a special feature, use of MISC made on the basis of actual facts which the parties are faced with their daily transactions, CISG and Incoterms being now in force, is desirable. (3) In case of use of MISC similar to a system of Incoterms, as PICC, it is necessary for MISC to set forth definitions about important terminology which is possible to give concerned parties confusion. (4) In a sense, PICC has a character complementing problems which CISG can not solve, therefore, if int'l agreement is given, it is desirable to adopt revised PICC adding specials conditions (A) of MISC as appendix of PICC such as Llouyd's Form in an appendix to MIA, as int'l convention.

In IP 7 and LCCP 201, Law Commission considers the insured's duty of good faith after the formation of the contract. This article intends to review and analyse the legal implications of proposals in IP 7 and LCCP 201. The results of analysis are following. First, Law Commission propose to end the remedy of avoidance under MIA 1906 section 17, because avoidance of past claims is unprincipled, impractical and unnecessarily harsh. Secondly, LC proposes that an insured who makes a fraudulent claim should forfeit the whole claim which the fraud relates, but that the fraud should not invalidate previous and legitimate claims. Thirdly, LC proposes to introduce a statutory right for the insurer to claim damages for the reasonable, foreseeable costs of investigate a fraudulent claim in specific circumstances and that damages would be limited to those cases where the insurer can show an actual, net loss. Finally, LC provisionally propose that an express fraud clause should be upheld in business insurance, whereas in consumer insurance, any term which purports to give the insurer greater rights in relation to fraudulent claims that those set out in statute would be of no effect.

To investigate the anti-inflammatory effect on Degenerative Osteoarthritis, Male sprague-Dawley rats were randomized and classified into three different concentration groups. We measured weekly weight change, dietary intake, drinking water intake, blood analysis like TNF-α (tumor necrosis factor-α), IL-6 (interleukin 6), TIMP-1 (tissue inhibitor of metalloprotease-1), MMP-2 (matrix metalloprotease-2), MMP-9 (matrix metalloprotease-9) and micro CT analysis. The results suggest that the treatment with herbal complex HP-04 improved the Monosodium iodoacetate (MIA) induced degenerative osteoarthritis and it could be applicable for the improvement of arthritic symptoms as a new therapeutic agent.

As in any engineering application, the problem of structural assessment should face the different uncertainties present in real world. The main source of uncertainty in Health Monitoring System (HMS) applications are those related to the sensor accuracy, the theoretical models and the variability in structural parameters and applied loads. In present work, two methodologies have been developed to deal with these uncertainties in order to adopt reliable decisions related to the presence of damage. A simple example, a steel beam analysis, is considered in order to establish a liable comparison between them. Also, such methodologies are used with a developed structural assessment algorithm that consists in a direct and consistent comparison between sensor data and numerical model results, both affected by uncertainty. Such algorithm is applied to a simple concrete laboratory beam, tested till rupture, to show it feasibility and operational process. From these applications several conclusions are derived with a high value, regarding the final objective of the work, which is the implementation of this algorithm within a HMS, developed and applied into a prototype structure.

The long terminal repeats (LTRs) of human endogenous retrovirus (HERV) have been found to be coexpressed with sequences of closely located genes. It has been suggested that the LTR elements have contributed to the structural change or genetic variation of human genome connected to various diseases and evolution. We examined the HERV-W LTR elements in various cancer cells (2F7, A43l , A549, HepG2, MIA-PaCa-2, PC-3, RT4, SiHa, U-937, and UO-31). Using genomic DNA from the cancer cells, we performed PCR amplification and identified twelve new HERV-W LTR elements. Those LTR elements showed a high degree of sequence similarity (88-99％) with HERV-W LTR (AF072500). A phylogenetic tree obtained by the neighbor-joining method revealed that HERV-W LTR elements could be mainly divided into two groups through evolutionary divergence. Three HERV-W LTR elements (RT4-2, A43l-1, and UO3l-2) belonged to Group 1, whereas nine LTR elements (2F7-2, A549-1, A549-3, HepG2-3, MP2-2, PC3-1, SiHa-8, SiHa-10, and U937-1) belonged to Group 11. Taken together, our new sequence data of the HERV-W LTR elements may contribute to an understanding of tissue-specific cancer by genomic instability of LTR integration.

Recently with making of 'The Consumer Insurance (Disclosure and Representations) Act 2012(hereunder CIA)', the UK revised the duty of disclosure especially with the consumer insurance contract. According to the CIA, if the misrepresentation was careless, the insurer may have the three options based upon what the insurer would have done had the consumer taken care to answer the question accurately; a compensatory remedy, avoidance of the insurance contract or, amendment of the contract. I realized that the establishment of CIA has been exposed to pro-actively relieve the breach of Warranty and Disclosure, Representations as far as required by the Global Insurance market. It was found that it is expected to bring significant changes in UK Insurance Act system of the 21st century, and prepares competition from neighboring countries. On the other hand, in the common law system, countries under MIA(1906) are trying to address the breach of warranty and Disclosure, Representations, except the UK cannot completely adhere with a positive attitude.

This study aims to examine the level of students' satisfaction toward the services (i.e. accommodation facilities, transportation facilities, and recreation and sports facilities) provided by the public universities in Bangladesh. The study also aims to identify the major service factors that influence students' satisfaction in public universities in the country. A cross-sectional survey was conducted at six public universities to obtain primary data. A standardized questionnaire was distributed to a total of 500 randomly selected students to collect the data. Several statistical tools, namely, reliability analysis, descriptive statistics, correlation analysis and multiple regression analysis were employed to analyze the data. The findings revealed that recreation and sports facilities have the strongest impact on students' satisfaction in the public universities in Bangladesh. Transportation facilities also have positive and significant impact on student's satisfaction. However, the study found a negative correlation between accommodation facilities and students' satisfaction indicating that students are not satisfied with the accommodation facilities provided by the public universities. The findings of this study provide an insight about students' satisfaction that might be useful to authorities of the public universities and other higher educational institutions in designing policies for various services and facilities to be provided to their students.

Purpose: This study tries to analyze the differences of memory performance and the metamemory of the elderly women according to degree of depression. And also it attempts to find the correlations among the sub-concepts of metamemory which have close relationships to the memory performance followed by the depression. Methods: The subjects of this study are 60 the elderly women who are older than sixty years in Busan city, Korea. We use the MIA(Dixon, et al., 1988) to measure metamemory and measure the memory performances such as the immeadiate word recall, the delayed word recall, the word recognition task, and face recognition. Results: 1. The average point of deprssed elderly womens' metamemory was significantly lower than non-depressed womens' point(t=10.86 p<.0017). Looking into subconcept of metamemory, depressed elderly womens' strategy, capacity, change, achievement point were significantly lower than non-depressed women. 2. In terms of immediate word recall and delayed word recall performances, depressed elderly women are significantly lower than non-depressed elderly women. 3. The degree of depressed elderly womens' metamemory(strategy, achievement, change, capacity) has significant correlations with immediate word recall performances. Conclusion: Metamemory has close relationship with the memory performance of elderly women. And also depressed elderly's sub-concepts of metamemory which have influences on their memory performance are different from non-depressed elderly's sub-concepts. Therefore, when we try to develop some programs to prevent memory decrease of elderly women, we should take these point into consideration.
