  • 온도와 pH 민감성을 갖는 그래프트 공중합체[Pluronic-$g$-poly(NIPAAm-$co$-MMA), Polymer A]와 [Pluronic-$g$-poly(NIPAAm-$co$-MAA), Polymer C]는 $t$-butylperoxybenzoate를 이용하여 Pluronic 공중합체의 주사슬에 $N$-isopropylacrylamide (NIPAAm)/$N,N$-diethylaminoethylmethacrylate (DEAEMA)와 $N$-isopropylacrylamide(NIPAAm)/methacrylic acid (MAA)를 각각 합성하였다. 그래프트 공중합체는 $^1H$ NMR과 젤 투과 크로마토그래피를 통해 공중합체의 화학적 구조와 분자량을 측정하였다. 그래프트 공중합체의 수용액 상에서의 특성은 다른 온도와 pH 조건에서 자외 및 가시선 분광 분석법, 접촉각 측정과 동적 광산란으로 측정되었다. 그래프트 공중합체는 수용액상에서 온도와 pH에 따라 민감한 상 변화를 보인다. 이는 DEAEMA 단량체의 아민 그룹과 MAA 단량체의 카복실 그룹은 각각 Polymer A와 Polymer C에서 하한임계용액온도에 큰 영향을 미친다고 제시한다. 그래프트 공중합체는 온도와 pH 변화에 관련된 다양한 약물 전달과 분자 스위치 적용에 사용될 수 있다.

CMIT/MIT 함유 가습기 살균제 제품의 제조 및 판매기업 형사판결 1심 재판 판결문에 대한 과학적 고찰 (I) - 제품 위험성과 노출평가 측면에서 (A Scientific Critique of a Korean Court's Acquittal for Involuntary Manslaughter Related to 5-chloro-2-methylisothiazol-3(2H)-one/2-methylisothiazol-3(2H)-one (CMIT/MIT), a Humidifier Disinfectant (HD) Part I: Material safety, exposure and delivery to target organ from an HD perspective)

  • Objectives: There was a judgment of acquittal for the manufacturer SK Chemical and the vendor Aekyung regarding humidifier disinfectant (HD) containing 5-chloro-2-methylisothiazol-3(2H)-one/2-methylisothiazol-3(2H)-one (CMIT/MIT). The rationale used in this judgement is discussed here in the light of scientific consideration. Methods: The sentencing document for the judgements was obtained from the Korea Supreme Court Service. In particular, the judgements made by the court related to the risk of HD and external and internal exposure to CMIT/MIT are discussed based on scientific evidence. Results: Rendering a determination in a criminal trial of insufficient evidence of causation, the court dismissed the prosecution's motion that humidifier disinfectant-associated lung injuries (HDLI) and asthma were associated with the utilization of these products. However, CMIT/MIT, a strong sensitizing and corrosive substance, has been reported to be associated with brain toxicity, allergic contact dermatitis, and asthma. Furthermore, the judgment did not consider total consumption amounts or the cumulative dose of CMIT/MIT in the humidifier. Lastly, there are several cases supporting the fact that exposure to water-soluble substances including CMIT/MIT can cause lower respiratory tract diseases. In addition to cases of asthma among the workers exposed to CMIT/MIT, we identified lung injury victims who were exposed to HDs exclusively containing CMIT/MIT. Conclusions: We conclude that there is sufficient evidence supporting the assertion that HDs containing CMIT/MIT cause lung injuries, including asthma, contrary to the court's judgement.

생체모사형 나노포어를 활용한 전기화학 기반 물질전달 조절 시스템 (Electrochemical Mass Transport Control in Biomimetic Solid-State Nanopores)

  • 나노포어와 같은 다공성 나노구조물은 물질전달 기초연구뿐만 아니라 수처리, 에너지 변환, 바이오센서 등 다양한 응용 가능성으로 현재 큰 주목을 받고 있다. 초기연구는 수백 나노미터 지름의 포어를 이용한 양/음전하 선택성 물질전달에 주로 집중되었고 현재는 수 나노미터 또는 그 이하의 나노포어를 통한 다기능성 물질전달 시스템이 보고되고 있다. 대표적으로 특정 표적물질(target)과 특이적 결합을 할 수 있는 수용체(receptor)를 포어 내벽에 고정하여 바이러스, 분자, 이온까지 다양한 크기와 성질을 가지는 물질을 선택적으로 수송, 검출할 수 있는 생체모사형 스마트 나노포어 구현 사례가 증가하고 있다. 이와 더불어 생체채널 메커니즘에 기인하여 소수성 나노포어에 전기장, 빛과 같은 외부 자극을 통해 물질전달을 on-off 밸브 형태로 흐름을 능동적으로 제어하는 나노포어도 최근 특히 주목을 받고 있다. 이번 총설에서는 나노포어의 크기(지름, 길이, 구조형태 등), 포어 내벽의 물리화학적 성질을 조절하여 특정 전하, 분자, 이온을 선택적으로 수송 및 제어할 수 있는 나노포어 기반 물질전달 조절 시스템에 관한 동향을 알아본다. 더불어 이를 기반으로 최근 보고된 응용 연구 사례도 함께 소개한다.

  • The objectives of this study was to analyze the major causes of decreasing utilization rate of health care institutios in pilot-project area of regional medical insurance, Kwang-hwa and Kun-wi country. After the implementation of medical insurance, utilization rate of health institutions turned out' to be lower than it was estimated, when the pilot-project of regional medical insurance was planned. It might be due to changes in inhabitant's behavioral attitude toward medical insurance. So this study was made to find measures for financial stability by increasing utilization rate of health care institutions and to be available for basic demand-supply program of medical care. The hypothesis of this study was as follows; First. there is difference in understanding health care institutions between Kun-wi and Kwang-hwa. Second. respondesnts of inquiry survey have exact knowledge of their past experience of treatment taken prior to enforcement of medical insurance, Questionaire survey was made as to each 700 household among total 11, 884 households in Kun-wi and 20,919 households in Kwang-hwa. In case of Kun-wi, 70% of inquired households (491) gave their answers. In Kwang-hwa, the number was 560 households (80% of inquireds). Dollected data was processed and analyzed by way of using SPSS batch system. To evaluate facto rs distribution aspects of data and to make comparison between two area, percentage and $X^2$ distribution were applied. The results were as follows; L The utilization rate of health care institutions in Kun-wi and Kwang-hwa was lower than it was estimated. when pilot-project of medical insurance was planned. 2. Prior to the implementation of medical insurance. inhabitants in two area chose the medical institutions considering such factors. First was medical care fee cheap. second in habitant's residence, Third was the institutions conveniently easy of access. 3. After the implementation of medical insurance. 26.1% of inqurieds in Kun-wi and 41.6% in Kwang-hwa, changed medical institutions. In case of Kwn-wi, from health care institution (p 0.05), and in case of Kwang-hwa, vice versa, from general medical institutions to health care institutions. 4. Evaluation by factors were made such as follows. Inquired gave high marks to following facts: In case of Kun-wi, general medical institutions were difficult of access and relation between patients: was not friendly, but burden of medical expenditure was light. Effects of treatment and facilities was good. In case of Kwang-hwa, inquired gave high evaluation marks to the follow ing facts; facilities of medical institutions was not good, but the burden of medical expenditure was light. 5. After the implementation of medical insurance, the services was evaluated as good, but inquired hopec for lessening the burden of medical expenditure. 6. In case of exact understanding of cost-sharing, the evaluation rate in Kwang-hwa was higher than that of Kun-wi (p < 0.005). And positive attitude toward necessity of medical insurance was also good in Kwang-hwa (p < 0.05). 7. In case of inquired's attitude toward medical institutions, Kwang-hwa showed positive response (p < 0.05) 8. In the case of comparison between general medical institution and health care institution, two area showed similar positive response; medical manpower, facilities of medical institutions and effest: of treatement was good. 9. In comprehensive evaluation of benefit-service; the general medical institution's positiveness was higher than that of health care institutions in Kun-wi. But in Kwang-hwa vice-versa. 10. If the medical expenditure of general medical institution and health care institutions was equal 77% of inquireds in Kun-wi and 59.1% in Kwang-hwa answered that they chose general medical insurance. Considering results above mentioned, the conclusion of this study was made as follows. 1. In Kwang-hwa county, where the understanding of health care institutions's was good, the utilization's of health care institutions was shown high. Therefore, in case of Kwang-hwa, betterment: should be made to induce increasing utilization rate for negative factors of health care institutions. 2. In case of Kun-wi, where the understanding of health care institutions was on the decrease, measures for changing such negative factors should be taken by way of strengthening public relations. And cases of Kwang-hwa should also be studied. 3. On the side of financial stabilization and establishing health care delivery system, primary health care should be available. Therefore, the major cause of inhabitant's avoiding health care institutions should be known. And measures for activating that institutions have to be taken. So, the facilities of health care institution have to be improved up to the level of clinic. And supportive measures for securing equipment and improving health care services should also be taken. It is necessary that strategy for public relations should be employed with policy considerations and supports.

CISG하에서 매수인의 물품대금지급 의무에 관한 법적 기준과 판결례에 관한 고찰 (A Study on the Legal Explanation and Cases of the Buyer's Obligation to Pay the Price for the Goods under CISG)

  • 본고의 연구범위로서 '국제물품매매계약에 관한 UN협약'(CISG) 제3편 제3장 제1절은 총 7개의 조문으로 구성되어 있다. 본고의 연구결과로서 개별조항의 법적 기준에 관한 요지와 그 시사점 내지 유의점은 다음과 같다. 제53조는 본절의 개요임과 동시에 매수인의 주된 의무를 일괄하여 다루고 있는 규정이다. 본조는 CISG가 물품매매의 요건을 언급하고 있지 않음을 고려하여 제30조와 연계하여 다루어야 한다. 제54조는 계약이나 또는 적용법규에 따라 물품대금지급을 위한 매수인의 준비조치를 다루고 있는 규정으로서 본조의 의무를 위반할 경우 매도인은 제61조에 따라 구제수단을 행사할 수 있다. 다만 이러한 절차는 제71조 (1)에서 규정하고 있는 이행준비 또는 계약의 이행을 위한 행위가 아님을 유의하여야 한다. 제55조는 적용함에 있어서는 반드시 양당사자의 의사가 고려되어야 한다. 계약당사자가 물품가격을 결정하고 있는 경우 제7조의 적용순위에 따라 일반원칙 내지 국제사법이 적용될 수 있음을 유의하여야 한다. 제56조는 당사자가 물품중량의 기준을 합의해 두고 있지 않다면 포장중량을 제외한 물품의 순중량으로 물품대금을 결정하도록 규정하고 있다. 본조는 당사자 의사나 관행 또는 관습이 없는 경우에 적용되는 일반원칙이다. 제57조에 의거 당사자가 달리 합의한 바가 없다면 물품대금은 매도인의 영업소에서, 당사자가 물품의 인도 또는 서류의 교부 시에 대금을 지급하기로 합의한 경우 물품 또는 서류가 인도되는 장소에서 대금이 지급되어야 한다. 계약체결 후 영업소의 변경과 관련하여 발생한 물품대금지급에 관한 추가비용은 매도인이 부담하여야 한다. 제58조는 그 어떠한 특정한 시기에 물품대금을 지급하여야 할 의무가 없는 경우 매수인의 대금지급의 시기를 규정하고 있는 조문으로서 이 경우 본조는 제78조에 언급된 이자의 누적의 시기의 기산시점이 된다. 제59조에 따라 매수인은 그 어떠한 조건에도 구애됨이 없이 예정대로 물품대금을 지급하여야 한다. 당해 의무를 위반할 경우 매도인은 모든 구제권을 행사할 수 있다. 당해 시점 이후로 연체된 금액의 이자가 적용된다.

농촌 일차 보건사업에 있어서 마을건강원 업무량 및 업적에 관한 연구 (A Study on Performance and Achievement of Village Health Workers in Rural Primary Health Care Program)

  • It is utmostly important to establish the efficient fitable way of peoples' active participation in primary health care especially in the areas where the public or governmental service input for the basic health care is insufficient like as in rural areas of Korea. In light of above reason, this study focused mainly on the evaluation of roles and activities of village health workers (VHWs) who were selected from grass- root level of village people in order to derive further motivation for active participation. This is believed to be a sort of feedback mechanisms. Actually, the authors collected the activity reports of VHWs who had been devoting themselves in the primary health care services of Jeomdong Area, of Yeoju Gun one of Korea University Community Health Action Programmes and survey record on the VHWs activity from correspondent people. 1 hose data were analyzed through computer programmed package. The activities performed by VHWs were limited to the performance in 1985 for conveniance. The summarized results were as follows; 1) General characteristics of VHWs. Among a total of 28 VHWs in the area, about 39.3g of them have been replaced up to the date since the implementation in 1983, because of moving out, occupational employment and of others. The age of majority (75.0%) lied between the range of 30-50, and educational background of 67.9% belonged to category of primary school graduation, about 50% of them experienced to be or were also entiled "chief of women club" of corresponding villages. 2) Work-load of VHWs. Each VHW was assigned for tasks of health care for average 55 households of 248 persons. They shared approximately 6 days a month for the activity in average and it covered 17 cases of basic health care in a month. A half of the VHWs performed home visits irregularly without solidified schedule. 3) Work performance analysis. Informations collected through VHWs were compared with data from official vital registration at local administration center "Myon Office" in 1985. VHWs collected 100.8 of new born, 116.2 of death, 58.3 of move in and 74.8 of move out in comparison with 100.0 of official registration each. Pregnant women of 79.8% of mothers among the total pregnancy of 94 which were confirmed as normally delivered or aborted cases by all means afterwards had been detected by VHWs as being pregnant and all of them received some of antenatal cares by VHWs. All(100%) of delivered women were detected by VHWs through home visits and they were cared postnatally. Whereas, according to the records of birth registration, the places of delivery were clinic in 33.7%, and mother's home in 66.3%, VHWs reported them to be clinic in 48.9%, midwifery in 20.2%. It was cleared that most of misinformation was caused by uncautious filling of birth registration at notification. Among the total of 717 eligible women under age 44 years, family planning status of 92.6% was reported by VHWs confirming practice of control to be 70.8% of reported fertile women. 4) Attitude of VHW on the roles and functions. Although 92.0% of VHWs expressed VHWs to be worthwhile, only 52.0% of them had dignity and satisfaction in their activity and 44.0% of them had passive attitude of working saying they followed direction regardlessly. Concerning difficulties in performance as a VHW, 60.7% of them pointed out lacking of medical and health related knowledge by themselves. Still, 64.0% of them thought visiting unfamilier house to be awful and 40.0% complained forms of activity to be difficult and hard. It was also revealed that 56.6% confessed lack of interest on community health service itself. Most of VHWs needed more educational training especially on clinical fields such as cares of gynecological diseases, hypertension, diabetes, and other chronic diseaes of the aged. Regular on-the-job basic trainings were said to be needed twice a year.

농촌지역의 일차보건사업 개발을 위한 기초조사 연구 - 경기도 여주군 금사면 산북부락을 중심으로 - (A Baseline Survey on Development of Primary Health Care in the Rural Korea -Sanpuk Village, Kumsa-Myun, Yuju- Gun, Kyunggi-Do-)

  • It is widely recognized that primary health care in the community is one of the most important and effective health measures in these days. However, it is reality that unsatisfactory health care system, ineffective utilization of health care by the community people in the rural area are hampering better understanding for primary health care. Therefore promoting health for the rural people and increasing understanding about primary health care, the baseline survey in the community focused in examination for safe community water supply was carried out. The survey was conducted through August 25-31, 1986 in order to find out health problems and relevant factors and to define the demographic characteristics of $^*$Sanpuk village, Kumsa-Myun, Yuju-Gun, Kyunggi-Do, Korea. Household survey was carried out for every home by trained interviewers. The major results are found out as follows : 1) 84.2%(400 houses) of total households were surveyed because 15.8%(75 houses) were unable to survey due to either refusal against interview or absence of family. These 400 households were composed of 1,697 residents(male:830, female 867). Educational level of respondents showed 34.1% as elementary school graduated. Religion distribution showed Buddism(23.8%) as the most dominant. 50.7% of respondents married in the area. 2) Most households(91.5%) have lived in their own house in Sanpuk area. Average family size showed 4.3. More than half of residents(64.2%) have used public supplied water tap. Only 1.5% of the households had a flush toliet. The rest of households have still used primitive insanitary latrines. 3) 32.5% of residents have used gas burner for cooking and for heating in the house, and the coal briquet were used for boiler. Lack of convenient public transportation was the chief complaint for their day life. 4) Each household occupied 1,990 pyungs of rice paddy and 1,170 pyungs of ordinary field in average. Beside farming products, mushroom was the highest product. 5) Sixth percent of households in the survey area regularly participated in community meeting one hand and on the other hand 39.5% never participated. Most of respondents closely contacted with their neighbours and they seemed very friendly each other. 6) The prevalence rate of illness and injury during recent 15 days showed 48.3 per 1,000. The prevalence rate of chronic illnesses during the past one year showed 74 per 1,000. Injury and accident lead the higher portion(22.0%) in the former and in the latter pain(arthritis, back-pain) showed 27.0% as the dominant sickness. 87.8% of the ill residents in the former received medical treatment. As the most frequently utilized medical facility, the clinic or hospital were counted. Among the residents suffering from chronic illnesses, 77.3% in Sanpuk area get some kind of medical treatments and they rarely utilized the clinic or hospital. The reason why the patient did not receive any medical care was found out the fact that symptoms of illness was light or mild and economic problems was serious. 7) Average age of marriage showed 21.6 years old in the women and the average duration of marital period was shown for 15.1 years. The married woman in reproductive age in Sanpuk area had experienced pregnancies 4 times in the aver-age including 0.7 time of pregnancy in average were interrupted by induced abortion and 0.3 time by spontaneous abortion respectively. The practicing rate of the family planning of the married woman during reproductive ages showed 70.7% and the tuballigation was found out as the most frequently used contraceptives. 8) Among woman who has children under 2 years old, 70.0% had received the prenatal care for the last pregnancy. However, the average number of prenatal care visitis per woman showed 3.3 times. Fifty-two % of woman who received the postnatal care for the last delivery showed only 37.5%. 9) Immunization rate of the children under 2 years old showed relatively high and looked successful. The breast feeding for these children showed dominantly in the most. Most of the mothers in Sanpuk area had started the supplementary diet during weaning period of their infants of 6th and 7th month after birth. * : Sanpuk area is a demstration area for community development which has been supported by the Community Development Foundation during the part 10 years. The village is relatively closer to urban area such as Seoul, However, it has a similar characteristics shown as a remote village because of geographical location and inconvenient transportation at present.

입자충전형 이중벽 온실에 관한 연구 (A Study on the Double-Wall Greenhouse Filled with Styrene Pellets)

  • 자동단열온실시스템을 개발할 목적으로 실험용 온실의 천정과 벽체를 이중벽으로 제작하여 이중벽 내부에 단열입자를 자동으로 충전 회수할 수 있도록 시스템을 구성하여, 입자의 송풍성능, 투광성, 입자의 마모실험, 온실의 단열성능 및 차광효과를 분석한 결과를 요약하면 다음과 같다. 1. 약 2㎥의 입자를 충전 회수하는데 약 1시간 15분이 소요되었으나, 온실의 규모에 적합한 송풍기의 용량, 배기구의 면적, 충전관 및 회수관의 조절로 소요시간을 감소시킬 수 있을 것으로 판단되었다. 2. 단열입자의 회수 직후에 이중벽온실의 투광성을 객관성 있게 평가할 수 있는 10시에서 15시까지의 평균 투광율은 67%로 나타났다. 3. 입자의 충전 및 회수를 직송방식으로 하였을 때, 입자마모율이 연속 5개월 사용시 20%로 나타나, 입자의 충전 및 회수를 간접방식으로 수행하는 것이 타당한 것으로 분석되었다. 4. 겨울철 야간에 단열입자를 회수한 이중벽 온실의 내부온도는 외기온보다 평균 3.4$^{\circ}C$ 높았으나, 입자를 충전한 단열온실의 내부온도는 단열면적비가 73%일때 외기온보다 평균 6.6$^{\circ}C$ 높았고, 단열면적비가 100%일때 외기온보다 평균 13.5$^{\circ}C$ 높게 나타나 단열온실의 야간단열성능이 우수함을 알 수 있었다. 5. 일사가 양호하고 외기온이 높은 주간에 입자를 충전한 단열온실(단열면적비 100%)의 차광성능을 분석한 결과, 외기온의 평균이 36.9$^{\circ}C$일 때 온실내부온도의 평균은 3$0^{\circ}C$로 외기온보다 평균 7$^{\circ}C$ 낮게 나타나 차광효과가 크다는 사실을 알 수 있었다.

  • 최근 많은 선진국들에서 보호가 필요한 사람들에게 직접 서비스를 제공하는 대신 현금급여를 새로이 도입하거나 확대함으로써, 서비스 수요자가 자신에게 필요한 보호방식 및 보호내용을 스스로 선택할 수 있는 권한을 강화하는 방향으로 정책을 변화시키고 있다. 이러한 현금급여는 현대복지국가가 공통적으로 직면하고 있는 국가복지의 재정적 한계와 다양한 욕구에 반응하기 어려운 경직성의 한계에 대응하여, 보다 경제적이고 효율적인 방법으로 서비스 이용자의 선택권 확대 및 수요자 중심의 서비스 전달체계 구축이 가능한 정책대안이라는 특징을 가진다. 그러나 각 국가에서 채택하고 있는 현금급여는 그 제도적 설계 및 운영면에서 상당한 변이를 보이고 있다. 이러한 현금급여 정책의 변이는 장기요양서비스 시장내에 내재되어 있는 자유시장적 가치에 기반한 소비자주의 및 시장주의와 사회연대적 가치에 기반한 시민권 및 사죄보호주의간의 배합에 영향을 미치고, 결국 장기요양에 있어서 가족, 국가, 시장간의 책임과 역할의 균형, 즉 복지혼합의 균형에 영향을 미치게 된다. 본 논문에서는 네덜란드, 프랑스, 독일, 이탈리아 4개국의 사례를 통하여 각 국가의 현금급여 정책의 특성과 장기요양시장에 미치는 영창을 살펴봄으로써, 현대복지국가에서 현금급여 정책이 가지는 보편적 의미와 특수성을 발견해 보고자 하였다. 비교분석 결과, 각 국가의 사회문화적 정향과 노동시장 규제 등의 사회적 맥락내에 현금급여 정책이 이식되는 과정에서, 비용억제보다는 서비스 이용자, 가족수발자, 서비스 제공자의 시민권이 강조되기도 하고, 비용억제적 노력이 보다 강조되기도 하는 것으로 나타났다.

분만관련 불가항력적 의료사고 보상제도에 있어 분담금부과에 관한 연구 -헌법재판소 2018. 4. 26. 선고 2015헌가13 사건을 중심으로- (A Study on Imposing Contribution in the Compensation for Uncontrollable Medical Malpractice during Delivery)

  • 「의료사고 피해구제 및 의료분쟁 조정 등에 관한 법률」(이하 '의료분쟁조정법'이라 한다)에서는 보건의료인이 충분한 주의의무를 다하였음에도 불구하고 분만 중 불가항력적으로 발생한 의료사고에 대하여 국가가 예산의 범위 안에서 그 피해자에게 보상하도록 하고 있다(의료분쟁조정법 제46조). 지금까지 의료사고 피해자가 소송을 통해서만 피해회복을 기대할 수 있었던 것에 비한다면 획기적인 법률이라 할 수 있다. 그런데, 이러한 의료사고보상사업에 드는 비용의 100분의 30은 보건의료기관개설자 중 분만 실적이 있는 자가 부담하고 있는 바(의료분쟁조정법 시행령 제21조), 이 분담금 부과 조항이 분만 과정에서의 산모·신생아 사망 등의 사고가 의사의 과실이 없이 불가항력적으로 발생했음에도, 의사들에게 책임을 묻는 것은 아닌지 문제가 되어 왔다. 그러나 최근 헌법재판소에서 분담금 부과와 관련한 의료분쟁조정법법 제46조 제3항 중 '보건의료기관개설자의 범위' 및 '보상재원의 분담비율' 부분에 대하여 합헌 결정을 내린 바 있다(헌법재판소 2018. 4. 26. 선고 2015헌가13 결정, 이하 '이 사건 결정'이라 한다). 이 사건 결정에서는 법률유보원칙 및 포괄위임입법금지원칙에 의하여만 판단하였으나, 본고에서는 실질적인 판단도 가미하였다. 이 사건 분담금운 과잉금지원칙에 비추어 보더라도 보건의료기관개설자들의 재산권을 침해하지 않는 점을 논증하였다. 불가항력 의료보상제도의 분담금 부과가 민사책임의 중요 원칙인 과실책임원칙에 거스르는 측면이 존재한다. 그러나 의료사고보상사업은 의료사고 피해자를 위한 국가정책으로 합리성이 있으며, 동시에 의료분쟁의 조기종결 효과로 의료계 역시 이익을 얻는 측면이 분명 존재한다. 분담금의 납부를 통한 보상재원의 확충은 이러한 의료사고보상제도를 빠르게 정착시킴으로서 분만과정에서 발생한 의료사고 피해자의 고통과 오해를 경감시키고 의료인의 안정적 진료환경 구축에 큰 도움이 될 것이다.
