국회도서관 납본 활성화 방안에 관한 연구 - 디지털 학위논문을 중심으로 - (A Study on the Activation Plan for Legal Deposit in National Assembly Library of South Korea: Focusing on Thesis and Dissertation)

  • 본 연구는 학위논문의 납본과 관련한 대학도서관의 인식 및 실태를 실증적으로 분석하고 학위논문 납본의 저해요인 확인을 통해 국회도서관의 학위논문 납본 활성화 방안을 모색하였다. 분석 결과, 대부분의 대학에서는 학위논문의 납본을 수행하고 있으나, 학위논문을 담당하는 전담부서나 전담인력 배치는 저조한 것으로 나타났다. 사서들은 여러 기관으로의 납본 등 납본업무의 중복으로 인한 어려움에 직면하고 있으며, 납본이 이루어지지 않는 경우 대학도서관의 정책, 납본 절차의 중복 및 번거로움, 저작권 동의서 확보의 한계 등이 주된 이유로 나타났다. 이러한 학위논문 납본에서의 문제를 해결하고 학위논문이 지닌 사회적, 정보적 가치를 극대화하기 위한 방안으로 독립적인 납본법의 제정을 통한 디지털 학위논문 납본 제도의 강화, 디지털 학위논문의 효율적 보존 방안 마련, 통합된 학위논문 납본 시스템 개발, 석박사학위논문 전문 컬렉션 개발을 통한 국회도서관의 위상 강화 등을 제안하였다.

남북 법제분단: 분단을 넘어 법제통합을 위한 과제 (South-North Legal System Division: Challenge for the Integration of Legal Systems beyond the Division of Korea)

  • 올해로 한반도가 남과 북으로 분단된 지 72년이 흘렀다. 1945년 8월, 일제로부터 해방과 동시에 남쪽은 자본주의, 북쪽은 공산주의(사회주의) 이념을 바탕으로 한 체제 갈등과 대립을 해왔다. 이러한 남북분단은 단순히 정치 경제체제에만 머물지 않고 법제도 역시 동질성을 찾기 어려운상황이 되어 버렸다. 그동안의 분단은 법제분단도 함께 동반되는 사회적현상의 결과를 낳게 되었다. 일례로 북한은 해방과 동시에 구 소련군의 주둔 하에 북한지역을 지배하면서 법적 안정을 위한 조치를 빠르게 취했다. 마르크스와 엥겔스의 역사적 유물론을 바탕으로 한 토지사유화 폐지 등 이데올로기적 상부구조의 변화를 가져왔다. 이러한 작업은 구 소련 등 다른 사회주의 국가들의경우와 같이 생산수단인 토지사유화 폐지 절차를 거쳐 국유화 정책을 단행하기에 이르렀다. 북한 정권은 민족적 독립완수와 반제적 반봉건적 관계 청산이라는 미명하에 토지개혁을 실시함으로 인해 분단 이후 남북한체제 간의 현격한 변화를 가져왔다. 본 논문에서는 우선 남북법제를 중점으로 지난 72년간 사회주의의 실험과정에서 자본주의와 대결하면서 단절된 북한 법제의 특성과 법적 환경을 탐구하고자 한다. 한편, 현재 통일을 위해 진행 중인 법제통합 연구의 현황에 대해서도 간략히 진단해 본다. 그리고 법제분단을 극복하기 위해 남북분단에 따른 남과 북 각각의 국가로서 법적 지위를 규명해 보고, 남북관계의 법적 성격과 북한법제가 갖는 한계성에 대해 살펴본다. 아울러 법제통합을 위한 기본방향을 모색해 보고, 법제분단 해소 방안을 제시하고자 한다.

제도적 측면에서 살펴본 도시농업의 현황과 과제 (The Current Status of the Korean Urban Farming Researched from an Institutional Perspective and Tasks for the Future)

  • This study presents the methods to improve the urban farming in Korea by analysing the current circumstances of urban farming in Korea. Specifically, the legal system in association with urban farming, current status of the act on the urban farming, the present situation of the Korean urban farming, and the comprehensive plans for urban farming have been analysed in order to grasp the present situations and seek for solutions. Based on these, the research provides effective supporting methods for sustainable urban farming in Korea. As a result, the essentials to improved urban farming can be summarized with two factors; securing more space for urban farming and improving the supporting system for the urban farmers. Enthusiastic attitudes of local governments, security of budget, and cooperation with the citizens are vital to expand the urban farming in addition to the institutional and systematic urban farming improving methods mentioned above.

Microfinance Institutions and Legal Status: An Overview of the Microfinance Sector in Bangladesh

  • Although the microfinance sector in Bangladesh is mainly driven by Non-Governmental-Organizations (NGOs), there are other types of Microfinance Institutions (MFIs) that also provide financial services to the poor. Despite the criticism of microfinance programs, the current poverty situation in Bangladesh still requires such programs for consistently battling poverty. Hence, the aim of this paper is to profile the microfinance sector based on their legal status and investigate any possible differences (if any) between them in various aspects. After a thorough investigation of the sector, it was found that around 33 million of the clients are being served by the mainstream MFIs (NGO and Grameen Bank) while another 10-15 million clients are served by other types of MFIs (financial cooperatives, credit unions, various ministries etc.), accounting for the one-third of the total population in Bangladesh. While the mainstream MFIs basically works with poor, other categories of MFIs are concerned with relatively wealthy clients. Looking into the financial performance and social intermediation of the MFIs, the NGO-MFIs performed better than other types of MFIs in the sector.

상법상 선장의 지위와 선박소유자의 대리권의 판례에 관한 연구 (A Study on legal status of shipmaster and precedent of his Authority)

  • The master of ship is always authorised to perform whatever acts are ordinarily necessary for the safe and proper prosecution of the voayge with regard to both ship and cargo. In other words, when a ship is away from her home port, where her business was managed, the master generally carried the owner's authority, and ordinarily he had power to enter into engagements, on their behalf, for carrying goods in the ship, or for letting her service, provided those engagements were consistent with the usual manner of employing her adopted by the owners. Accordingly he has always to decide onboard for an adequate applying of statutory law and cases whenever he acts. But the master would appear to have no such autho-rity where he can communicate with the owners without difficulty as, now-a-days, he nearly always can. This paper, therefore, intend to review some guidance of his authority in accordance with the Korean Code of Commerce as well as precedent based on it. The paper is also simply to place at the disposal of young shipmasters and those who aspire to command some legal information concerning limit of master's authority away from vessel's home port through legal commentation on the precedent, which may assist them to a better understanding of the many problems they may be faced with in the course of their ca-reers. In order to make an efficient study of legal structure concerned for shipmaster's authority, several up-to-date precedents are selected and described herein by writer's opinion for preventing unreasonable legal dispute in this field before courts in future.

독도해양과학기지 건설 관련 법적 쟁점에 관한 고찰 (Legal Issues Relating to Construction of the Dokdo Ocean Research Station)

  • The Korean Government is trying to construct an ocean research station in Dokdo's water. The station would be the third ocean research station following the Ieodo station and the Gageocho station. Although the new station would served as a scientific research base for peaceful and academic purposes, the construction of the station will almost certainly lead to a diplomatic dispute between Japan and Korea in the near future due to the disputed ownership of the island. In light of the diplomatic protests against the construction of the Ieodo station by the Chinese Government, various domestic and international legal issues which could be raised regarding the construction of the Dokdo station need to be reviewed. Therefore, this article reviews the international legal status of the station and the rights and duties pertaining to its construction, investigates the domestic legal grounds relating to the construction and operation of the marine scientific installation, evaluates the international legal impacts of the construction on the expansion of maritime jurisdiction, the effective control on Dokdo and the negotiations on maritime boundary delimitation, and finally draws conclusions on the future activities of the Korean Government for the construction and operation of the Dokdo Ocean Research Station.

기업재난관리표준의 법적성격과 문제점 개선에 관한 연구 (A study on the legal status and problem improvement of enterprise disaster management standard)

  • 연구목적 : 본 연구는 자본주의 경제의 한 축을 이루고 있는 기업 재난을 관리하여 사업연속성(Business Continuity)을 확보하고 더 나아가 리질리언스(Resilence, 복원력)를 보장하기 위한 일환으로 제정된 기업재난관리표준의 법적성격을 규명하고, 기업재난관리표준의 관련 산업분야 적용 시 문제점 개선방향을 제안 목적으로 한다. 연구방법 : 연구를 위해 관련 자료를 수집하여 헌법 및 기업재해경감법 등 법령 및 학술적 체계의 논리적 규명, HLS구조 등에 대한 문헌 연구를 수행하였다. 연구결과 : 기업재해경감법상의 기업재난관리표준이 ISO 22301:2012 국제표준보다 법적인 측면에서 위계가 상위에 있다는 것을 확인하였다. 결론 : 본 연구를 통해 기업재해경감법에 따른 기업재난관리표준의 명확한 해석을 함으로써 현업적용 및 관련규정의 발전적 방향을 수립해야 한다.

위탁승선실습생의 법적지위 -목포해양전문대학생을 중심으로- (A Study on the Legal Status of Apprentice Officers on the Merchant ship)

  • Students of the Mogpo Merchant Marine College must complete one year's shipboard training course according to IMO(International Maritime Organization) regulations as an obtaining matter of Certificate of Competency. The purpose of this shipboard training course lies int he student's acquiring practical knowledge and sill as a part of a course of study and, in the future, fostering essential adaptability and leadership, especially in bad circumstances on the sea. The shipboard training course has two kind that the students can be trained either on the training ship or on a merchant ship of the shipping company. In this paper, I only thought over the legal status of apprentice officers on the merchant ship and analyzed the problems practicably during shipboard training. This paper is made up of five chapters. The first chapter contains the purpose contents and method of this study, in the second, the meaning of shipboard practice education and training, in the third, the legal status of apprentice officers on merchant ship, in the fourth, the analysis of the provisions of the seamen act applied to apprentice officers on a merchant ship. And in the last chapter 5, the contents mentioned is summarized and directions are presented to amend the provisions of the seamen act applied to apprentice officers. The conclusions are as follows. 1.In case of shipboard training on overseas employment ship, the seamen act applied to the manning agent employing the apprentice officers should be reinforced. 2. The provisions of disembarkation in mid course by discipline of the seamen acts Article 24 should be relaxed. And the provisions in relations to seamen's duty to be a reason of discipline applied to apprentice officer among the provisions for ship's public order maintenance should be abolished. 3. The provision of repartriation completely should be applied to apprentice officers and the provisions of a journey expenditure during their embarkation or disembarkation have to be established. 4. The apprentice officers in shipboard training also need securing a basic wages provision to be criterion of an accident compensation. 5. The apprentice officers in shipboard training should not be in charge of third officer's or third engineer' study.
