Todays, L/C transactions in international trade are governed by UCP 500 and eUCP. But UCP 500 and eUCP do not cover all legal problem of L/C transactions. Therefore choice of laws in international L/C transactions are occurred. U.S.A. has an enacted law (UCC ${\S}5-Letter$ of Credit) to govern L/C transaction. But other countries has no special enacted law to govern L/C transaction. The reason is that there are difference between legal attitude of U.S.A. and other countries. American law considers L/C as a special device made by merchants. Therefore U.S.A. applies UCC ${\S}5-Letter$ of Credit instead of general contract law. UCC ${\S}5-Letter$ of Credit includes provisions of warranties, remedies, and so on that UCP 500 and eUCP do not include. But the liabilities of the Issuing Bank on the wrongful dishonor in L/C transaction is very important legal problem. First, this study is to justify concepts of honor and dishonor, and sufficient conditions for dishonor of the issuing bank. in UCC. Second, this study is to examine closely the liabilities of the Issuing Bank on the wrongful dishonor in L/C transaction. Third, this study is suggest distinctive features on the Liabilities to wrongful dishonor of the issuing bank in UCC ${\S}5-Letter$ of Credit and our trader's matters to be attended to L/C transactions governed by UCC.
본 논문은 우리나라 병원전 응급의료체계의 대부분을 차지하고 있는 119구급대의 법적 지위를 정의하고 직무수행과 관련된 법적책임에 따라 발생할 수 있는 문제들을 검토하여 병원전 응급의료체계의 질향상에 필요한 구급대원의 법적 보호를 위한 대책을 제시하고 나아가 앞으로 발생 가능한 병원전 응급의료체계와 관련된 법적인 소송에 대비한 위험관리와 그 대책에 대하여 검토하였다. 119구급대는 소방법에 근거하여 편성되어 그에 따라 구급대원은 공무원의 법적지위를 갖게 되어 국가배상책임이 일차적이지만, 응급처치와 응급환자 이송이라는 업무의 특성상 민, 형사상 책임이 동시에 발생할 수 있다. 구급대원의 직무수행과 관련된 법적 문제의 발생을 줄이고, 구급대원을 법적으로 보호하기 위한 방법으로 의학적 지도관리를 강화하고 구급대원의 응급의료와 관련된 지침서를 마련하고 지침과 절차에 따라 직무를 수행하여야 하며 현장에서 응급실까지의 응급의료체계와 관련된 출동에 대해서는 정확하고 합법적인 기록을 작성하여 보존하여야 한다. 현재 구급대원의 법적보호규정으로 긴급피난적 응급처치와 형사적 책임의 완화 내지 면제를 위해 응급의료에 관한 법률에 의해 임의적 감면사유를 규정하고 있다. 민사적으로도 긴급피난 외에 착한 사마리아인법 또는 구호자 보호법과 같은 새로운 법제정 및 개정이 필요하다.
The purpose of this paper is to introduce the limitation of liabilities of multimodal transport operators(MTO) in Korea. Also, this paper reviews the revised draft of Korean Commercial Code in 2015. This paper analyzes Korean multimodal transport systemand the limitation of liabilities of MTO by analyzing articles, regulations and practices of Korean Commercial Code and it's the draft in 2015. The paper, also, studies multimodal transport rules by comparing specifically international treaty, rules, or practices. In Korea, Article 816 of Commercial Code treats multimodal transportation adopting the network liability regime. The Article describes only the case of the multimodal transportation where the maritime carriage is engaged. Korea proposed the draft of multimodal transport regulation of Commercial Code in 2015 because present law could not apply for the multimodal transportation involved in the air or land carriage. This paper support the draft of Korean Commercial Code in 2015 because it is necessary to make a predictable legal system of multimodal transport and the limitation of liability reflecting practices or customs.
Clearly there are many legal arguments and criticisms surrounding the proposals for change in the Warsaw Convention and the need for a radical review. The question remains is unlimited liability the answer or should there be some other form of supplemental compensation and if so, what limits should be applicable. Recently the suits for medical malpractice are gradually increasing in this country. The main purpose of this study is to excavate the most suitable theories about civil liabilities on medical malpractice by radiological technologist. To solve the above-mentioned problems in medical malpractice, I have proceeded to make a survey of traditional theories and tried to exvacate the most suitable theories for our medical circumstances among those theories. Both domestic and foreign relevant professional literatures and legal cases were investigated in this study. Several important findings of this study are as follows. First, the nature of legal interrelationship between radiological technologist and physician(or the representative of a hospital) is to define the content of employment. But in the eye of medical law, the interrelationship between radiological technologist and physician is written that radiological technologist should be directed by physician. Second, the nature of legal interrlationship between patient and physician(or the representative of a hospital) is to define the content of legal obligation of physician(or the representative of a hospital), and radiological technoligst execute his obligation as proxy for physician. Therefore, patient can not clame any legal right to radiological technologist. Third, radiological technologist has the obligation of Due Care in medical practice. Fourth, on the medical malpractice by radiological technologist the civil liability can be treated as either tortious liability or contractual liability, and physician(or the representative of hospital) take the responsibility for the damage compensation. In this case, physician has the right of indemnity to radiological technologist. But it should be dinied or extremely limited.
The traditional name given to the insurance of third party liabilities and certain contractual liabilities which arise in connection with the operation of ships is protection and indemnity(P & I) insurance. P & I insurance is very different from traditional hull and machinery insurance in that shipowners' hull and machinery insurance is designed primarily to protect the assured against losses to his vessel, whereas P & I insurance seeks to indemnify an shipowner in respect of the discharge of legal liabilities he has incurred in operating his own vessels. This study is to examine the background of establishment of British P & I clubs md, therefore, the identity of P & I insurance. The present British P & I clubs are the remote descendants of the many small and local hull mutual insurance clubs that were formed by British shipowners in the end of 18th century. At that time, British shipowners were dissatified with the state of marine insurance market and, therefore, established clubs together in mutual hull insurance clubs. After the removal of the company monopoly in 1824, greater competition had a good effect on the rates, terms of cover and service offered by the commercial marine insurance market and by Lloyd's underwriters, and the hull clubs became less necessary and went into decline. The burden of British shipowners on liabilities to third parties was steadily increased after the middle of the 19th century, but the amount insured under hull policy was limited in the insured value of the ship. Eventually, the first protection club, that is, the Shipowners' Mutual Protection Society was formed in 1855. It was designed to like past mutual hull clubs, but to cover liabilities for loss of life and personal injury and also the collision risks excluded from the current marine policies, particularly the excess above the limits in hull policies. In 1870, the risks of liability for loss of or damage to cargo carried on board the insured ship was first awarded by the British shipowners. After 1874, many protection clubs formed indemnity club to cover the risk of liability for loss or damage to cargo. As mentioned above, British P & I clubs have been steadily changed according to the response of shipowners under the rapidly changing law of British shipowners' liability, and so on in the future.
P & I Clubs are mutual and non-profit making insurers which offer shipowners cover for the contractual and third-party liabilities. Whereas most shipowners obtain P & I insurance to cover for their legal liabilities, they also obtain hull insurance to cover against damages to the hull of their vessels from commercial hull insurers. P & I insurance was distinguished from hull insurance in respect that it offered non-limited cover to shipowner member, but there was a serious debate between P & I Clubs in respect of the non-limited cover. A compromise by International Group of P & I Clubs eventually emerged under which, with effect from 20 February 1997, a financial cap was placed on the obligation of each shipowner to pay catasrophe calls to his club(20% of each ship's property limitation fund under 1976 Limitation Convention). Nevertheless many shipowners felt that this new cap on their potential catastrophe call had been set still too high, while others resisted any reduction in the figure established by the compromise. In the Meantime, the European Commission issued a Statement of Objections in June 1997, in which it indicated its objections with a compulsory single limit common th all the Group clubs as high as the 1997 compromise. Eventually the board of all the Group clubs decided that the figure of 20% of the Limitation Convention per ship property funds should be dropped down to 2.5% from 20 February 1999.
본 연구에서는 제4차 산업혁명의 핵심 요소인 인공지능 기술의 발전에 불가피하게 수반될 수 있는 부작용을 최소화하기 위한 제도적 보완점을 도출하기 위한 선행 연구로서, 인공지능 기술 적용의 대표적인 유형에 해당하는 로보어드바이저가 해킹되어 시세조종 행위를 범하는 구체적인 경우에 있어서 현행 법체계에 따른 책임관계가 어떠한지 검토하고자 하였다. 현행 법체계가 기본적으로 해킹 행위 및 시세조종 행위를 엄격히 금지하는 입장을 취하고 있으나, 로보어드바이저 운용사는 평소 해킹 방지를 위한 보호조치 의무를 준수할 경우 해킹에 따른 시세조종 행위로 일반 투자자들에게 대규모 피해가 발생하여도 이에 대한 법적 책임을 면할 수 있는 등 피해자 보호에 미흡한 것으로 확인되었다. 본 연구를 바탕으로 이러한 문제를 극복하기 위한 제도적 보완점 도출에 관한 후속 연구가 필요하다.
해양사고는 민사법상의 손해배상, 형법상의 책임의 귀속 및 행정상의 제재와 같은 여러 가지 법적 책임 문제를 야기한다. 어떠한 행위에 의하여 결과가 발생하였다고 하여 바로 책임귀속이 되는 것은 아니다. 이러한 책임의 전제로서 해양사고를 야기한 행위와 그 결과 발생사이에 인과관계가 문제된다. 해양사고에 있어서 그 원인 규명은 해양이라는 사고 발생 장소, 증거확보의 어려움, 사고 발생시와 조사 시점과의 시간차 등으로 어려움이 많다. 그러나 정확한 원인 규명은 유사 사고 방지와 책임 소재를 가리는데 매우 중요한 요소이다. 인과관계를 논리학적으로 보면 무한히 확산 가능한 개념이지만 책임귀속에 있어서는 이를 제한할 필요성이 있다. 따라서 이 논문에서는 인과관계 이론을 바탕으로 해양사고에서의 인과관계를 검토하여 책임귀속의 합리적인 판단 기준을 논증한 것이다.
항공법과 우주법은 상호 관련성이 많으면서도 각자의 영역에서 꾸준하게 발전하여 왔다. 특히 국제법분야에서 두 분야의 발전은 괄목할 만하다. 항공법은 '항공공법'(public air law)과 '항공형법'(criminal air law) 그리고 '항공사법'(private air law)을 총칭하는 분야이다. 간혹 '항공운송법'(air transportation law)이라는 용어가 항공법을 대신하는 것처럼 사용되기도 하나 이것은 항공시점의 일부이다. 항공법 분야를 이해하기 위해서는 일반적인 법이론, 국내법, 유럽연합(EU)법, 학자들의 이론과 사례를 연구해야 하는 반면, 우주법의 경우는 우주조약을 비롯한 우주관련협약의 연구에만 제한되는 한계가 있다. 최근에 와서야 우주에 관한 국내법들이 제정되기 시작하였고, 우주법관련 사례들도 항공법에 비해 매우 적은 편이다. 본 연구는 이러한 두영역을 상호 비교하면서 차이점을 발견하고 21세기 항공법과 우주법의 발전과제들을 점검하고자 하는데 그 의의가 있다. 항공법과 우주법의 몇 가지 주제별 차이점에 관하여 다음과 같은 결론을 얻을 수 있다. 첫째, 항공분야에서는 공기구인 ICAO뿐만 아니라 사기구인 IATA도 제반 항공업무를 원활하게 하도록 하고 있는데 반해, 우주법은 COPUOS라고 하는 일종의 UN내의 위원회를 통하여 주로 법제정이 이루어지는 면에서 항공법보다는 매우 미흡한 단계에 있다. 우주활동이 활발해짐에 따라서 우주문제를 보편적으로 다룰 국제우주기구(International Space Organization)의 설립을 준비할 필요가 제기된다. 둘째, 항공법이 국가항공기 내지는 군용항공기를 제외하고 민간항공기에만 적용되고 있는 반면, 우주법은 모든 우주활동에 적용시키므로 민간우주선 뿐만 아니라 국가 우주선에 모두 적용되고 있다는 점에 큰 차이점이 발견된다. 이 문제도 우주활동이 점차 상업화함에 따라 민간우주선에만 적용되는 우주법제정이 필요한 시기가 도래할 것이다. 셋째, 국가주권면에서 볼 때 항공법에서는 영공주권이 매우 배타적으로 행사되고 있는 반면에 우주법에서는 국가들이 달과 모든 천체에 관한 우주활동에 관하여 자유를 가질 뿐만 아니라 천체를 전유할 수 없음을 천명하고 있고, 심지어는 1979년 달조약에서는 달과 다른 천체를 인류공동유산영역으로 선언하고 있다. 그러나 영공과 우주의 경계획정은 아직 확립되지 못한 상황은 서로 다른 법영역을 이해하는데 상당한 혼선을 빚고 있다. 마지막으로 책임문제에 관한 항공법과 우주법의 접근법은 항공법의 경우 항공운송이 활발해지고 발전됨에 따라 승객을 보호하는 법체제가 점차 발전되고 있고 지상손해에 관한 법규도 점차 발전되어 가고 있는 반면에 우주법에서는 우주운송법이 탄생되기에는 아직도 멀다고 할 수 있는데, 최근 러시아와 미국에서 우주관광객을 모집하여 우주산업을 마케팅화하고 현 시점에서 우주승객보호를 위한 국제법제정준비를 할 단계라고 생각한다. 우주활동에서의 책임문제는 항공법에서 절대책임원칙을 적용하는 지상손해에 대한 책임문제에 상당히 접근하고 있다.
