  • 우리나라 관할해역까지 확장된 해상교통 모니터링이 필요하여, 장기적으로는 전 세계 원하는 해역의 선박 모니터링이 요구되는 시점이다. 이를 통해서만 우리의 Sea Line의 확보가 가능하며, 해양 경제영토의 확장이 가능하기 때문이다. 이와 같은 목표를 위한 초기 단계로, 경기만 연안 통합모니터링 시험을 거쳐 2013년 11월에는 이어도해양과학기지에서 실험이 이루어졌으며, 이 결과를 이번 학술대회에서 소개하고자 한다.

  • 최근 국내 여러 지방자치단체들은 해양개발이 활성화됨에 따라 관할해역 확보에 총력을 기울이고 있으며, 인접 지방자치단체간 분쟁의 증가로 인하여 관할해역 구분의 기준이 되는 해상경계의 중요성이 급격히 부각되고 있다. 특히, 해상경계 획정기준의 부재는 인접 지방자치단체들 간 분쟁을 발생시킬 수 있는 요소를 많이 내포함에 따라서 해상경계 획정기준 마련을 위한 노력이 절실히 필요하다고 할 수 있다. 본 논문에서는 과학적이고 합리적인 해상경계 획정기준을 마련하기 위하여 기 고시된 "해상경계 확인을 위한 수로측량업무규정"을 조사 분석하여 개선사항을 도출하였다. 그 결과 첫째, 해상경계 획정의 개념을 수립하였고 둘째, 해상경계 획정기준의 범위와 내용 및 절차를 구체적으로 설정하였으며, 마지막으로 지방자치단체들 간 해상경계 분쟁의 사전예방 및 사후 합법적 해결을 목적으로 해상경계조정위원회의 설치, 구성, 직무, 조정결과의 효력 등과 같은 해상경계 분쟁조정방법을 제시하였다.

공해조업선(公海操業船)에 대한 관할권문제(管轄權問題)와 기국(旗國)의 책임(責任) (A Study on the Jurisdictional Problems for Fishing Vessels Engaging High Sea Fishery and the Responsibility of Flag States)

  • In accordance with the establishment of 200 nautical miles EEZ regime as a customary international law since the mid - 1980s, the area of global high seas became reduced relatively. On the other hand, the importance of high seas fishing ground became serious for the distant-water fishing states like Korea. But it can be expected that international dispute on the jurisdictional problem of the fishing vessels engaging high sea fishery will occur frequently owing to institutional inertia of the UNLOS Convention on this matter. "The Draft Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas" as an international code of conduct for responsible fishing which was adopted by FAO in 1993 is providing the more consolidating and definiting rules for jurisdictional responsibility of flag states to make completion the loophole of the UNLOS Convention. As a precondition for the effective control and enforcement of activities of the fishing vessels engaging high sea fishery, the Draft Agreement is providing some articles allowing the flag states to hold the rights of granting nationality, fishery permission, fishery supervision and control with punishment for the fishing vessels entitled to fly their own flag. Accordingly it can be evaluated that this Draft Agreement does not deviate on the whole from the traditional practice and the basic legal principle of the UNLOS Convention.

우리나라 관할해역내 북한선박 통항통제 제도와 개선방안 (A Study on the Navigation Control System against DPRK Vessels Within the ROK Maritime Jurisdictional Area and it's Improvement)

  • 남 북한간 정전협정시 해양경계를 정하지 못했으며, 주변국과 관할해역 경계가 명확하지 않다. 유엔군사령부는 6.25전쟁 이후 정전협정 준수를 위해 북방한계선과 작전구역을 설정해 해 공군 세력의 활동을 통제했고, 우리나라는 작전구역 내에서 북한선박의 통항을 통제해 왔다. 작전구역 내에서 제3국 선박은 항해의 자유를 향유하지만, 북한선박은 교전국으로서 통항이 통제되는 특수한 해양 제도가 유지되고 있다. 그러나, 작전구역이 설정된 이후 유엔해양법협약 발효, 남 북한의 유엔 가입 등 변화가 지속되고 갈등요인이 있어 작전구역의 지리적 범위를 보완할 필요가 있다. 또한 해군의 기능적 역량 강화를 위해 해군함정에게 북한선박 통제를 법적으로 보장하는 조치가 요구된다. 본 논문에서는 6.25 전쟁 이후 한반도 주변해역에서 북한선박을 통제하여 온 실례와 북한선박 통항통제 제도에대한 개선방안을 살펴보았다.

동중국해 중.일 유전 개발 분쟁을 통해 본 양국의 해양경계획정에 대한 입장 연구 (Perspective on Maritime Boundary Delimitation through Oil and Gas Development Dispute between China and Japan in the East China Sea)

  • There are disputes for oil and gas development between China and Japan in the East China Sea. These involve the area where China is already carrying out activities of oil and gas development and where Japan is proclaiming its EEZ. China insists that the Chinese activities on oil and gas development area are being carried out within the Chinese jurisdictional waters even if the median line principle of Japanese proclamation is applied in delimitation. Indeed, the permit for Japanese development is causing disputes between China and Japan because its permit allows development in the waters adjacent to Chinese development area. h the event, the core of this dispute around the oil and gas field in the East China Sea relates to issues of maritime boundary delimitation and issues of resources acquisition with both states. Chinese policy on oil and gas development is to first consider development issues in accordance with a median line principle where waters toward to China from the median line should be developed by China and the area toward Japan from the median line within the Chinese continental shelf should be jointly developed. However, the Japanese position is that the East China Sea should be jointly developed, and Japan hopes to eventually convince China to accept its median line delimitation. With on-going development of such issues, Korea should establish a strategy of negotiation based on analyses of resource distributional conditions and other strategic factors in the Korean delimitation area. In particular, Korea should prepare and make the best use of joint development zone established in an agreement between the ROK and Japan concerning the development of the southern part of continental shelf adjacent to both states.

A Strategic Approach for Regional Fisheries Organization Establishment in Northeast Asia

  • This study considers an approach for subregional fisheries organization in Northeast Asia. The fishery resources in the Northeast Asian waters surrounding Korea are among the most productive in the world because of their extremely high biological productivity and the natural features of the sea. However, the fishery resources of the region have long been subject to heavy fishing pressures, and many stocks are now believed to be seriously depleted or even in danger of extinction because of overfishing. To move to a run sustainable fishery in Northeast Asia waters area, cooperative fisheries management between Korea, China and Japan for common resource is probably necessary. Cooperative fisheries management is likely to be more effective in fishery resources management than individual fisheries management by countries. The effects of fisheries management by regional cooperation can be divided into resource management and economical performance. Cooperative fisheries management as RFO will bring satisfactory results. Currently these jurisdictional extensions and resulting disputes over maritime space and resources were thrust upon an already transitional and unstable political environment. However, They have to have a strategic approach for RFO establishment step by step. Cooperative fisheries management using the RFO can mitigate these disputes, and cooperative bilateral fisheries arrangements have been proliferating over the past 10 years and may provide the basis for possible trust-building multilateral agreements.

통일 한국의 적정 군사력에 관한 연구 - 분쟁 시나리오와 상대적 균형전략을 중심으로 - (A Study on Appropriate Military Strength of Unified Korea (Focused on relative balance strategy and conflict scenario))

  • To prepare for the complicated international relationship regarding Korean Peninsula after reunification, this thesis started off with the awareness that Unified Korea should build its international posture and national security at an early stage by determining its appropriate military strength for independent defense and military strategies that Unified Korea should aim. The main theme of this thesis is 'The research on appropriate military strength of the Unified Korean military'. To derive appropriate military strength of Unified Korea, this research focuses on conflict scenario and relative balance strategy based on potential threats posed by neighboring countries, and this is the part that differentiates this research from other researches. First of all, the main objective of the research is to decide appropriate military strength for Unified Korea to secure defense sufficiency. For this, this research will decide efficient military strategy that Unified Korea should aim. Than by presuming the most possible military conflict scenario, this research will judge the most appropriate military strength for Unified Korea to overcome the dispute. Second, after deciding appropriate military strength, this research will suggest how to operate presumed military strength in each armed force. The result of this thesis is as in the following. First, Unified Korea should aim 'relative balance strategy'. 'Relative balance strategy' is a military strategy which Unified Korea can independently secure defense sufficiency by maintaining relative balance when conflicts occur between neighboring countries. This strategy deters conflicts in advance by relative balance of power in certain time and place. Even if conflict occurs inevitably, this strategy secures initiative. Second, when analyzing neighboring countries interest and strategic environment after unification, the possibility of all-out war will be low in the Korean Peninsula because no other nation wants the Korean Peninsula to be subordinated to one single country. Therefore appropriate military strength of the Unified Korean military would be enough when Unified Korea can achieve relative balance in regional war or limited war. Third, Northeast Asia is a region where economic power and military strength is concentrated. Despite increasing mutual cooperation in the region, conflicts and competition to expand each countries influence is inherent. Japan is constantly enhancing their military strength as they aim for normal statehood. China is modernizing their military strength as they aspire to become global central nation. Russia is also enhancing their military strength in order to hold on to their past glory of Soviet Union as a world power. As a result, both in quality and quantity, the gap between military strength of Unified Korea and each neighboring countries is enlarged at an alarming rate. Especially in the field of air-sea power, arms race is occurring between each nation. Therefore Unified Korea should be equipped with appropriate military strength in order to achieve relative balance with each threats posed by neighboring countries. Fourth, the most possible conflicts between Unified Korea and neighboring countries could be summarized into four, which are Dokdo territorial dispute with Japan, Leodo jurisdictional dispute with China, territorial dispute concerning northern part of the Korea Peninsula with China and disputes regarding marine resources and sea routes with Russia. Based on those conflict scenarios, appropriate military strength for Unified Korea is as in the following. When conflict occurs with Japan regarding Dokdo, Japan is expected to put JMSDF Escort Flotilla 3, one out of four of its Japan Maritime Self-Defense Force Escort Fleet, which is based in Maizuru and JMSDF Maizuru District. To counterbalance this military strength, Unified Korea needs one task fleet, comprised with three task flotilla. In case of jurisdictional conflict with China concerning Leodo, China is expected to dispatch its North Sea fleet, one out of three of its naval fleet, which is in charge of the Yellow Sea. To response to this military action, Unified Korea needs one task fleet, comprised with three task flotilla. In case of territorial dispute concerning northern part of the Korean Peninsula with China, it is estimated that out of seven Military Region troops, China will dispatch two Military Region troops, including three Army Groups from Shenyang Military Region, where it faces boarder with the Korean Peninsula. To handle with this military strength, Unified Korea needs six corps size ground force strength, including three corps of ground forces, two operational reserve corps(maneuver corps), and one strategic reserve corps(maneuver corps). When conflict occurs with Russia regarding marine resources and sea routes, Russia is expected to send a warfare group of a size that includes two destroyers, which is part of the Pacific Fleet. In order to balance this strength, Unified Korea naval power requires one warfare group including two destroyers. Fifth, management direction for the Unified Korean military is as in the following. Regarding the ground force management, it would be most efficient to deploy troops in the border area with china for regional and counter-amphibious defense. For the defense except the border line with china, the most efficient form of force management would be maintaining strategic reserve corps. The naval force should achieve relative balance with neighboring countries when there is maritime dispute and build 'task fleet' which can independently handle long-range maritime mission. Of the three 'task fleet', one task fleet should be deployed at Jeju base to prepare for Dokdo territorial dispute and Leodo jurisdictional dispute. Also in case of regional conflict with china, one task fleet should be positioned at Yellow Sea and for regional conflict with Japan and Russia, one task fleet should be deployed at East Sea. Realistically, Unified Korea cannot possess an air force equal to neither Japan nor China in quantity. Therefore, although Unified Korea's air force might be inferior in quantity, they should possess the systematic level which Japan or China has. For this Unified Korea should build air base in island areas like Jeju Island or Ullenong Island to increase combat radius. Also to block off infiltration of enemy attack plane, air force needs to build and manage air bases near coastal areas. For landing operation forces, Marine Corps should be managed in the size of two divisions. For island defense force, which is in charge of Jeju Island, Ulleung Island, Dokdo Island and five northwestern boarder island defenses, it should be in the size of one brigade. Also for standing international peace keeping operation, it requires one brigade. Therefore Marine Corps should be organized into three divisions. The result of the research yields a few policy implications when building appropriate military strength for Unified Korea. First, Unified Korea requires lower number of ground troops compared to that of current ROK(Republic of Korea) force. Second, air-sea forces should be drastically reinforced. Third, appropriate military strength of the Unified Korean military should be based on current ROK military system. Forth, building appropriate military strength for Unified Korea should start from today, not after reunification. Because of this, South Korea should build a military power that can simultaneously prepare for current North Korea's provocations and future threats from neighboring countries after reunification. The core of this research is to decide appropriate military strength for Unified Korea to realize relative balance that will ensure defense sufficiency from neighboring countries threats. In other words, this research should precisely be aware of threats posed by neighboring countries and decide minimum level of military strength that could realize relative balance in conflict situation. Moreover this research will show the path for building appropriate military strength in each armed force.

선박 대기오염물질 배출 현황 및 저감을 위한 국가 관리 대책 연구: 해양경찰 업무를 중심으로 (National Management Measures for Reducing Air Pollutant Emissions from Vessels Focusing on KCG Services)

  • 미세먼지 등 대기오염이 일상화되고 국민 건강을 위협하면서 육상뿐만 아니라 해상 선박에서 발생하는 대기오염물질에 대한 관리 필요성이 대두되고 있다. 이에 본 연구는 선박 배출량 현황을 바탕으로 해양경찰 업무 중심의 선박 대기오염물질 점검 실태를 진단하고 배출 저감을 위한 국가 관리 대책을 제안한다. 최근 국립환경과학원(NIER, 2018)에 따르면 선박에서 배출된 총량(CO, NOx, SOx, TSP, PM10, PM2.5, VOCs, NH3, BC)은 국내 전체 발생량의 6.4 %로 나타났고, 이 중 NOx는 13.1 %, SOx는 10.9 %, 미세먼지(PM10/PM2.5)는 9.6 %를 차지하고 있다. 선박 발생량 중에서는 국내외 입출항 화물선이 50.6 %로 가장 많은 배출을 보였고, 어선의 배출 비율도 42.6 %로 적지 않음을 알 수 있었다. 지역적으로 해양경찰 관할 5개 권역을 기준으로는 부산항, 울산항을 포함한 남해권 44.1 %와 광양항, 여수항을 포함한 서해권 24.8 % 순으로 배출이 많았다. 해양경찰은 대기오염물질 관리를 위해 승선 점검을 통한 선박 배출 상황을 관리하고 있지만, 각종 배출 장치의 가동이나 연료유 기준 등의 실측에는 많은 시간과 노력이 필요하고, 또한 선박의 바쁜 운항스케줄에 따른 제약으로 대부분 서류상의 점검으로 진행됨으로써 관리에 한계가 있다. 따라서 선박 대기오염물질 관리를 위해서는 대기오염물질 발생을 실측 점검으로 바꾸도록 규제를 강화하고 해경 함정 등을 활용한 해역별 모니터링 시스템을 구축하여 실질적 현장 데이터에 기초한 관리가 이뤄지도록 하는 한편, 장단기적으로 환경친화적 선박 도입을 위한 기술 개발과 법·제도적 지원이 필요하다.

선박자동식별장치(AIS)를 이용한 이어도 종합해양과학기지 주변 통항 선박의 분류: 2013년 11월 21일~30일 (Classification of Passing Vessels Around the Ieodo Ocean Research Station Using Automatic Identification System (AIS): November 21-30, 2013)

  • 본 연구에서는 2013년 11월 21일부터 30일까지 9일간 이어도 종합해양과학기지에 선박자동식별장치(AIS)를 설치하여 관할해역과 한 중 잠정조치수역의 항행 선박 및 어업활동을 모니터링하기 위해 선박정보를 수집하였다. 수집된 AIS 원시자료는 자체적으로 개발된 프로그램을 이용해 선박의 고유정보(해상이동업무식별번호, IMO 번호, 호출 부호, 선명 등)와 위치정보(위치, 속력, 침로 등)를 추출하고, 국적과 선종 정보만을 이용해 선박을 분류하였다. 선박의 국적 정보는 해상식별부호(MID)로 파악되는데, 소형선박에서 많이 탑재하고 있고 기능이 보다 간소화된 소출력의 Class B AIS는 국제해사기구(IMO)의 탑재 요건을 따르고 있지 않아 국적을 알 수 없는 선박이 다수 존재함을 확인하였다. 국적 정보를 가지고 있는 선박 중에서는 중국선박과 한국선박이 많았으며, 선종정보를 가지고 있는 선박 중에서는 화물선, 어선 순으로 많았다. 또한 국적을 알 수 없는 선박의 특성을 파악하기 위해 이어도해양과학기지 주변의 항행빈도수가 높은 중국선박과 한국선박의 항적과 비교하였으며, 이를 통해 국적미상 선박이 중국선박의 항행경로와 높은 유사성을 보이는 것을 확인하였다. 따라서 이 해역에서 중국어선은 선단의 형태로 자주 출몰하는 것으로 판단된다.

소형어선의 좌초사고 분석과 사고 저감을 위한 제언 (Analysis of Grounding Accidents in Small Fishing Vessels and Suggestions to Reduce Them)

  • 최근 5년간 발생한 해양사고를 분석한 결과, 소형선박은 전체 좌초사고의 77.0 %를 차지하고, 인명사상도 66.1%로서 매우 높았다. 목포지방해양안전심판원은 2021년 72건을 재결하였고, 이중 좌초사건은 10건이었다. 그리고 좌초사건 중 8건은 소형어선에서 발생하였다. 본 논문은 2021년 목포지방해양안전심판원에서 재결하였던 소형어선에서 발생한 8건의 좌초사고에 대해 분석하였다. 이 소형어선의 좌초사고는 맑은 날씨에 시정이 2~4마일로 양호하고, 파고 1미터 이내로 양호한 해상상태에서 발생한 것을 파악되었다. 그리고 좌초사고의 주요 원인은 피로에 따른 졸음 운항, 경계 소홀, 선위확인 소홀, GPS Plotter 과신, 해도도식 및 조석간만의 차에 대한 이해부족 등인 것으로 나타났다. 이에 소형어선의 좌초사고 저감을 위해 다음의 방안을 제시하였다. 첫째, 갑판부 항해당직 부원교육을 이수한 선원이 선장을 보좌하도록 하여야 한다. 둘째, 졸음 방지용 경보장치는 조타실에 설치하여야 한다. 셋째, GPS Plotter의 성능기준과 최신화를 위해 제도는 마련되어야 한다. 마지막으로, 소형어선 선장은 주기적으로 해도도식과 기초 지문항법을 숙지할 수 있도록 교육을 받아야 한다.
