The revelations made possible by Edward Snowden, a contractor of the US intelligence service NSA, are a sobering reminder that the Internet is not an 'anonymous' means of communication. In fact, the Internet has never been conceived with anonymity in mind. If anything, the Internet and networking technologies provide far more detailed and traceable information about where, when, with whom we communicate. The content of the communication can also be made available to third parties who obtain encryption keys or have the means of exploiting vulnerabilities (either by design or by oversight) of encryption software. Irrebuttable evidence has emerged that the US and the UK intelligence services have had an indiscriminate access to the meta-data of communications and, in some cases, the content of the communications in the name of security and protection of the public. The conventional means of judicial scrutiny of such an access turned out to be ineffectual. The most alarming attitude of the public and some politicians is "If you have nothing to hide, you need not be concerned." Where individuals have nothing to hide, intelligence services have no business in the first place to have a peek. If the public espouses the groundless assumption that State organs are benevolent "( they will have a look only to find out whether there are probable grounds to form a reasonable suspicion"), then the achievements of several hundred years of struggle to have the constitutional guarantees against invasion into privacy and liberty will quickly evaporate. This is an opportune moment to review some of the basic points about the protection of privacy and freedom of individuals. First, if one should hold a view that security can override liberty, one is most likely to lose both liberty and security. Civilized societies have developed the rule of law as the least damaging and most practicable arrangement to strike a balance between security and liberty. Whether we wish to give up the rule of law in the name of security requires a thorough scrutiny and an informed decision of the body politic. It is not a decision which can secretly be made in a closed chamber. Second, protection of privacy has always depended on human being's compliance with the rules rather than technical guarantees or robustness of technical means. It is easy to tear apart an envelope and have a look inside. It was, and still is, the normative prohibition (and our compliance) which provided us with protection of privacy. The same applies to electronic communications. With sufficient resources, surreptitiously undermining technical means of protecting privacy (such as encryption) is certainly 'possible'. But that does not mean that it is permissible. Third, although the Internet is clearly not an 'anonymous' means of communication, many users have a 'false sense of anonymity' which make them more vulnerable to prying eyes. More effort should be made to educate the general public about the technical nature of the Internet and encourage them to adopt user behaviour which is mindful of the possibilities of unwanted surveillance. Fourth, the US and the UK intelligence services have demonstrated that an international cooperation is possible and worked well in running the mechanism of massive surveillance and infiltration into data which travels globally. If that is possible, it should equally be possible to put in place a global mechanism of judicial scrutiny over a global attempt at surveillance.
In today’s era of advanced technological developments, the threats to the authenticity and integrity of digital images, in a nutshell, the threats to the Image Forensics Research communities have also increased proportionately. This happened as even for the ‘non-expert’ forgers, the availability of image processing tools has become a cakewalk. This image forgery poses a great problem for judicial authorities in any context of trade and commerce. Block matching based image cloning detection system is widely researched over the last 2-3 decades but this was discouraged by higher computational complexity and more time requirement at the algorithm level. Thus, for reducing time need, various dimension reduction techniques have been employed. Since a single technique cannot cope up with all the transformations like addition of noise, blurring, intensity variation, etc. we employ multiple techniques to a single image. In this paper, we have used Fuzzy logic approach for decision making and getting a global response of all the techniques, since their individual outputs depend on various parameters. Experimental results have given enthusiastic elicitations as regards various transformations to the digital image. Hence this paper proposes Fuzzy based cloning detection and classification system. Experimental results have shown that our detection system achieves classification accuracy of 94.12%. Detection accuracy (DAR) while in case of 81×81 sized copied portion the maximum accuracy achieved is 99.17% as regards subjection to transformations like Blurring, Intensity Variation and Gaussian Noise Addition.
Arbitration is one of alternative dispute resolution systems which settle a dispute by arbitrators(private persons) based on a contract between contracting parties without a judicial litigation system involved. As a valid arbitration agreement is an essential requirement for commencement of arbitration, the first thing to be determined is whether there is a valid arbitration agreement or not when a dispute is submitted. A consumer arbitration agreement usually exists as an arbitration clause in an adhesive contract between consumers and a seller. When consumers buy a product from a seller, they are requested to agree on a general terms and conditions which are unilaterally drafted by a seller in advance. These terms and conditions are not negotiable because it is an adhesive contract and consumers are placed in "take-it-or-leave-it" position. Therefore, even though there is an arbitration agreement between consumers and a seller, it has to be carefully considered whether it has a legal effect or not. In this respect, a court will examine if an arbitration agreement has procedural unconscionability and substantive unconscionability. Therefore, as U.S is a well-advanced and arbitration-friendly country, this paper analyzes four U.S cases to find out (i) what a court considers, (ii) how a court examines and interprets procedural and substantive unconscionability and (iii) if there has been a change in regard to a court's decision. By doing so, it will provide some suggestions and guidelines for a consumer arbitration in Korea.
Recently many controversies originate for varies reasons, ranging from normal market competition to honest disagreements about rights. Disputes also arise from the clash between institutions and individuals. A free society should provide many systems for resolving controversies. We think of the courts as being primary, but, of course, they are not. In Korea, and in most other parts of the world, disagreements are resolved informally, without the need for judicial intervention. Settlements are worked out privately, usually without lawyers and certainly without judges. Most of judges are finding it difficult to cope with the needs and demands of society. Many businessmen who no longer want to get involved in lawsuits, are looking for alternative methods for resolving their disputes. However, there are actually two systems, litigation and arbitration only, to resolve disputes with binding both parties concerned. Litigation emphasizes on the equity and the justice with allowing three time's judgment for the resonable resolution, and arbitration, which is not subject to appeal, stress on the economic settlement rather than justice. Arbitration process results in a final and binding decisions. Although arbitration is a voluntary procedures that is created by the parties themselves, arbitration differs from mediation and conciliation because of its binding power. Arbitration is today coming into fashion as our primary methods for settling disputes. No company wants to have its funds tied up for long periods. Many parties prefer that the decision be final, rather than facing the prospect of extended appellate litigation. Therefore, government must encourage parties to settle their disputes by arbitration instead of litigation.
Persons who are waiting for decision of the court concerning whether they are guilty or not after they are involved in the criminal case and detained in the special institution isolated from society, will desire to de found innocent and acquited or to be slightly punished. Inmates are the suspected persons and the accused persons who are detained in the correctional institution. They have the right to de assisted by lawyes in order to receive the favorable verdict in the court. However, the right of the poor and the ignorant, in reality, cannot be perfectly protected due to the imperfection and defect of the defense counsel system itself and its application. Therefore, as a means to guarantee the so-called access to the court, the fundamental constitutional right, the law libraries are established and the legal information services are provided to the inmates within the correctional institution in the advanced country such as the United States. In addition, the judicial precedent and the various kinds of professional organizations provide the managerial guide-lines for such libraries to enoughly collect materials and to provide the effective information services to the inmates. In order to furnish the management of the correctional institution of Korea with useful information, the legal information services, materials collected, and information service personnel of the law libraries within the correctional institution are minutely examined in this paper.
Objective : The purpose of this study is to describe the characteristics of medical malpractice related to pediatric ophthalmology and to identify the causes and potential preventability of medical litigation in Korean medicine. Methods : A study was performed by analysing 8 cases of lawsuit in the year between 1968 and 2011, which were selected among the medical dispute cases involving pediatric ophthalmology. Results : The eight closed claims occurring in the field of pediatric ophthalmology were founded in the data for medical malpractice. One claim was supreme court decision, two claims were high court decisions and five claims were district court decisions. Conclusions : While malpractice claims occurring in the field of pediatric ophthalmology were uncommon, they resulted in a high rate and amount of indemnity payments. For reduction of medical disputes, improvement of clinical trials and clinical medical cares is emphasized, and informed consent is also important.

Bankruptcy is one of the major areas that have attracted the interest of many researchers in the American system, particularly in terms of the laws that oversee it. It provides a plan of reorganization that enables the debtor or the proprietor to discharge liabilities to the creditors through dividing the assets to settle debts. This activity is carried out under supervision to fairly protect the interests of the creditors. Bankruptcy protection systems are dynamic and complex in nature, in line with the economic sector, ensuring the protection of affected individuals from falling into huge losses. Some bankruptcy procedures give the debtor the opportunity to stay in operation or business activity and benefit from revenues until the debt is settled. This law allows some debtors to be relived from any financial burden after the distribution of assets, even if the debt is not paid in full. In light of the above information, this research paper seeks to explore the nature of the complexity of bankruptcy protection laws, their characteristics, and the justice system that regulate them. It also sheds more light on the decision-making powers on bankruptcy cases. There are specialized courts that cover bankruptcy cases located in district courts in every state.
피해자양형진술권은 2007년 형사소송법에 규정되어 시행되고 있다. 피해자의 재판과정 참여를 통해 피해 자의 권리행사 확대 및 피해의 치유를 유도한다는 점에서 도입의 필요성이 인정된다. 그러나 피고인의 절차적 권리의 침해 가능성에 따른 피해진술의 합리적 제한방안에 대한 연구는 대부분 법학적 관점에서 도입에 대한 찬반론과 관련하여 진행되었을 뿐이고, 심리학적 측면에서 피해진술이 재판의 의사결정에 미치는 영향에 대한 논의는 부족하였다. 따라서 피해자가 받은 범죄피해가 법정에서 표현될 때 과연 정확히 측정되고 전달되어 법률적 판단의 합리성에 기여할 수 있는지에 대한 연구가 필요하다. 본 연구는 이와 같은 필요성에 기초하여 심리학적 측면에서 피해자양형진술을 통한 범죄피해 측정의 오류가능성 및 전달과정에서 발생하는 과대평가 등의 문제점과 피해자치유의 측면의 불완전성 등의 쟁점을 검토하였다. 이를 토대로 피해자 양형진술의 실무에 있어 진술내용의 제한 및 필요절차 도입 등의 개선을 위한 대안을 제시하였다.
Since 1855, the federal courts of the United States have been empowered to assist in the gathering of evidence for use before foreign tribunals. Today, the source of that authority is 28 U.S.C. ${\S}1782$ which permits the courts to order a person "to give [ ] testimony... or to produce a document ... for use in a proceeding in a foreign or international tribunal${\cdots}$ ." It was generally assumed, until the United States Supreme Court's decision of Intel Corp. v. Advanced Micro Devices, Inc. in 2004, that arbitration tribunals were not "foreign tribunals" for purposes of 28 U.S.C. ${\S}1782$. While the issue in Intel did not involve an arbitration tribunal, a statement by the Supreme Court in dicta has called into question the exact parameters of the words "foreign tribunal," resulting in a split of opinion among the federal courts of the United States. This article explores the legislative history of 28 U.S.C. ${\S}1782$, examines the United States Supreme Court decision in Intel, and discusses the split among the courts of the United States regarding the interpretation of "foreign tribunal." The article further surveys emerging issues: is an arbitration tribunal in a case involving foreign parties and seated in the United States a "foreign tribunal"; does agreeing to the use of the IBA Rules on the Taking of Evidence in International Arbitration circumscribe the use of 28 U.S.C. ${\S}1782$; can a party be ordered to produce documents located outside the United States; and is there a role for judicial estoppel in determining whether an application pursuant to 28 U.S.C. ${\S}1782$ should be granted?
Because the treatment of a physician generally pertains to the intrusion into body of a patient, his/her consent is a must in order for such conduct to be justifiable. To ensure effective consent of a patient, the physician should fully inform him/her of kind and details of the disease and way of treatment and risks associated with it. The patient can, then, make a decision whether he/she should accept any treatment or operation, if necessary, on the basis of such information. The obligation of physicians to explain has since long been recognized as important in view of guaranteeing the rights of patients for self-decision and protecting them from arbitrary assessment of physicians for treatment. Progress has been made in this respect even to the extent that physicians treat patients on equal terms and think first of all much of establishing trustworthy relationships with patients. Lots of studies in Korea and foreign countries have tried to explore the issues concerning the obligation of physicians to explain in the meantime but seem to have failed to make concrete and versatile approaches from the standpoint of protecting the rights of patients. Wouldn't it be really possible for patients to perceive their own rights and cope actively with the medical treatments? If physicians have full understanding to the rights of patients, they will be put in a better situation to protect themselves and patients, in turn, can identify their own responsibility correctly, which will eventually contribute to fulfilling the goal of treatment. With this background, the present paper examines briefly the obligations of physicians for explanation based mainly on the preceding theories and judicial precedents in the first place and then deals with the status quo and contents of the German medical laws, with a focus on the treaty of European Law 1997 and its working document on the applications of genetics for health purposes that stipulate the detailed criteria on the medical treatment and rights of patients and Germany's $\ulcorner$Charter of Rights for Patients$\lrcorner$ promulgated in 2003.
