이 사건은 아르헨티나가 적용한 금융 조세 외환 등록에 관한 8개의 조치가 서비스무역에 관한 일반 협정(General Agreement on Trade in Services) 하의 최혜국대우 의무, 내국민대우 의무 및 시장접근 보장 의무의 위반에 해당하는지에 관한 다툼이다. 이들 대상조치는 '조세 투명성에 협력하지 않는 국가'의 서비스 및 서비스 공급자와 '조세 투명성에 협력하는 국가'의 서비스 및 서비스 공급자를 달리 대우하는 조치이다. 아르헨티나는 대상조치가 "조세 목적을 위한 투명성 및 정보교환에 관한 글로벌포럼" 및 "국제자금세탁방지기구" 체제에 부합하며 GATS 제XIV조 및 금융서비스부속서의 예외규정에 의해 정당화된다고 주장하였다. 요컨대 이 사건은 정당한 정책목적을 달성하기 위한 규제를 채택할 국가의 권한과 이로 인해 발생하는 경쟁조건의 변화의 문제이며, GATS 전문에서 밝히고 있는 회원국의 권리와 의무 간 균형을 어떻게 맞추어야 할 것인지의 문제이다. 상소기구는 (i) 서비스 및 서비스 공급자의 동종성 심사, (ii) GATS 제II조 및 제XVII조 하의 불리하지 않은 대우 판정 심사, 그리고 (iii) 금융서비스부속서 제2(a) 항이 적용되는 조치의 범위에 대한 판단을 통하여 이러한 균형을 맞추고 있다. 이 글에서는 이 사건의 대상조치와 패널의 판정을 정리하여 배경을 제시한 후 상소기구 판정을 분석한다. 분석은 앞에서 언급한 주요 쟁점을 중심으로 하며 패널의 판정, 기존의 다른 WTO 판정례 및 연구논문 하에서의 논의와 어떠한 차이를 가지는지를 파악하여 그 의미를 논한다.

Two new species of Leptochelia Dana, 1849 are described from the western coast of Korea. Leptochelia grandidentata n. sp. is similar to L. itoi and L. lusei characterized by pleonites 4 and 5 of subequal lengths and a uropod endopod with 4 articles but differentiated by a cheliped fixed finger longer than the dactylus and with 4 teeth along the incisive margin, a maxilliped basis with 4 distal setae, and pereopod 1 propodus that is much longer than the combined length of unguis and dactylus. Leptochelia suhi n. sp. shares some features of L. myora with the first article of the uropod endopod longer than the second article and a maxilliped endite with 3 spiniform distal setae but can be differentiated by the cephalothorax being longer than the pleon, the relatively longer antennule article 3 compared to article 2, and the cheliped fixed finger with 3 robust teeth along the incisive margin. In this study, full descriptions of L. grandidentata and L. suhi are given, and a comparison with closely related species belonging to the ‘dubia/savignyi group’ is tabulated and discussed.

This article puts forward the opinion of a policy expert, who had been involved in Korea's science and technology policy for 30 years, about technology policy for SMEs. This article first explains why technology policies for SMEs are needed, and from what point of view. The next section looks at the current problems facing Korean SMEs, followed by the introduction of past and current polices to support SMEs. The comparison between current issues facing SMEs and past and current policies leads to lessons that can be learned. There are four lessons for the policy itself and three for the implementation of these policies. As for policy, the first four are about stages of development, concentration, R&D and diffusion, and policy mix. The latter three are policymakers, institutional building, and cooperation between ministries. This article makesfour suggestions for future policy: the importance of startups' culture, cooperation with others, infrastructure to reduce uncertainty, and policy monitoring and evaluation.

The present article is concerned with pitting corrosion of Inconel alloy 600 at elevated solution temperatures. This article first summarized the previous works on the characteristics and the growth models of oxide film grown on alloy 600 at elevated solution temperatures. Thereafter, this article reviewed previous works on the morphological study on pitting corrosion of alloy 600 as functions of solution temperature and such anion additives as thiosulphate, sulphate, nitrate and bicarbonate ions in terms of pit morphology and its fractal dimension.

The present article is concerned with the overview of the chemically/surface modified cubic spinel $LiMn_2O_4$ as a cathode electrode far lithium ion secondary batteries. Firstly, this article presented a comprehensive survey of the cubic spinel structure and its correlated electrochemical behaviour of $LiMn_2O_4$. Subsequently, the various kinds of the chemically/surface modified $LiMn_2O_4$ and their electrochemical characteristics were discussed in detail. Finally, this article reviewed our recent research works published on the mechanism of lithium transport through the chemically/surface modified $Li_{1-\delta}Mn_2O_4$ electrode from the kinetic view point by the analyses of the experimental potentiostatic current transients and ac-impedance spectra.

Purpose - This paper studies whether economic sanctions can be used as grounds for a party to an international sales contract to get an exemption if he fails to meet his contractual obligation. Because the answer can differ depending on the governing law of the contract, this study focuses on CISG, the most widely recognized international uniform legal instrument as the governing law of the international sale of goods. Design/methodology - This paper focuses on analyzing the conditions to meet before getting an exemption under CISG. For such analysis, this paper examined various scholarly writings, cases, and hypothetical examples reflecting a wide variety of economic sanction measures. Findings - The findings of this paper are as follows. The main provision for exemption under CISG is Article 79(1), which provides for an exemption for a party that failed to perform if such failure was caused by an impediment that was uncontrollable, unforeseeable, and unavoidable; either a seller or a buyer may rely on the Article for his non-performance, delay, or defective performance. The Article is applicable not only where the economic sanction caused impossibility of performance but also where it caused hardship. The economic sanction will likely be found to be an uncontrollable impediment; however, it will be relatively more difficult to prove it to be unforeseeable or unavoidable. Originality/value - The subject of this paper is whether a party can be exempted from liability under CISG when he fails to perform his contractual obligations due to economic sanctions. Given that this issue is now actually faced by many involved in international trade, it is expected to provide practical help to practitioners and companies alike.

As industrialized countries transition into knowledge economies, there is a rising demand for talent and innovation. Support for start-ups through incubation, acceleration, and venture capital has turned into a key area of investment, with public and private actors searching for the next unicorn. This article examines start-up visas as an emerging policy tool in the global competition for highly innovative entrepreneurs. The study builds on a sample of eight national start-up immigration programs and applies human-capital citizenship (Ellermann, 2020) as a guiding framework. The article first proposes a conceptualization of start-up visas, suggesting that innovation and entrepreneurship also be considered in the theorization of skills. Second, the study examines the implications of start-up visas for international mobility. By focusing on the logic of entry requirements and subsequent benefits accrued through the status as a start-up founder, the findings of this study highlight the role of start-up visas in expanding privileged pathways to cross-border mobility. The article concludes with a discussion of implications for policy and research concerned with the international mobility of start-ups

본 연구에 이용된 편집요인은 뉴스 카테고리, 사진기사, 굵은 활자체의 기사제목, 신문제호, 기사제목의 내용 등으로 구성되었다. 이 같은 요인 중 사진기사, 굵은 활자체의 기사제목, 기사제목의 내용 등 3개 요인만이 뉴스 이용자들의 기사선택에 영향을 미치는 것으로 나타났다. 이들 요인을 포털뉴스 이용시간의 차이에 따른 분석에서는 뉴스 카테고리, 굵은 활자체의 기사제목, 신문제호 등 3개 요인만이 영향을 미치는 것으로 나타났다. 뉴스 장르가 뉴스 이용자들의 기사선택에 미치는 영향에 대한 분석에서는 정치, 경제, 사회, 스포츠, 문화/연예, 국제, IT/과학 장르 중 사회, 문화/연예, 국제 등 3개 요인만이 이용자들의 기사선택에 영향을 미치는 것으로 나타났다. 이들 요인에 대한 남녀집단 간의 분석에서는 경제, 스포츠, 문화/연예, IT/과학 등 4개 장르에서 기사선택에 차이가 있는 것으로 나타났다. 본 연구는 오프라인 신문에 비해 다양한 방식으로 기사를 노출시키는 온라인 매체에서 전통적인 신문편집의 요소가 기사선택에 어떠한 영향을 미치는가를 파악하여 온 오프라인 신문 간 편집요소의 역할에 대한 차이와 온라인 매체에서의 효과적인 편집방안을 수립하는데 기초적인 단서를 제공할 목적으로 수행되었다.

This study focuses on three logistics-related news (Logistics Newspaper, Korea Shipping Gadget, and Korea Shipping Newspaper) in order to present changes in logistics issues, centering on Corona 19, which has recently had the greatest impact in the world. For data collection, two-year news articles in 2019 and 2020 (title, article, content, date, article classification, article URL) were collected through web crawling (using Python's BeautifulSoup, requests module) on the homepages of three representative logistics-related media companies. As for the data analysis methods, fundamental statistical analysis, Latent Dirichlet Allocation (LDA) for topic modeling, and Scattertext were performed. The analysis results were as follows. First, among the three news media related to logistics, the Korea Shipping Newspaper was carrying out the most active media activities. Second, through topic modeling with LDA, eight logistics-related topics were identified, and keywords and significant issues of each topic were presented. Third, the keywords were visually expressed through Scattertext. This is the first study to present changes in the logistics field, focusing on articles from representative logistics-related media in 2019 and 2020. In particular, 2019 and 2020 can be divided into before and after the outbreak of Corona 19, which has had a great impact not only on the logistics field but also on our lives as a whole. For future work, a multi-faceted approach is required, such as comparative studies of logistics issues between countries or presenting implications based on long-term time-series articles.

This study presents a short overview of the researches in connection to the fin-and-tube heat exchangers with and without the influence of dehumidification. Contents of this review article include the data reduction method, performance data, updated correlations, and the influence of hydrophilic coating for various enhanced fin patterns. This study emphasizes on the experimental researches. Performance of both sensible cooling and dehumidifying conditions are reported in this review article.
