A Study of the Environmental Dispute Arbitration System in Korea (우리나라의 환경분쟁조정제도에 관한 연구)

  • Environmental disputes not only possess the special characteristics of collectivity and plural value relativity but it also possesses the unique features of difficulty to prove cause and effect as well as the structural maldistribution of evidence and information. Therefore, the positive resolution of an environmental dispute can be brought about more easily with the Alternative Dispute Resolution (ADR) which can take the form of talks, compromises, as well as arbitration or mediation rather than through a trial process. Such being the case, this paper first looks into the problems and effectiveness of the arbitration system of environmental lawsuits and then takes an even closer look at Korea's environmental dispute arbitration system and finally offer some reform methods. In Korea, the environmental dispute arbitration system was implemented in 1991 and has been executed since then. Although this system does have positive features such as the high rate of coming to an agreement between the involved parties but unfortunately, most of the cases rely on decisions based on right and wrong which cannot but be far away from the intentions of the ADR system. It is heavily centered around claims regarding psychological compensation regarding noise and vibrations and the ratio of the actual amount of compensation is comparatively lower than the requested amount. In addition, with the limits in organization and manpower, it leads to a lack of professionalism as well as the problem of low usage with the low awareness rate. As reform measures against the aforementioned problems, this paper suggests the following. First, in order to activate the arbitration process more fully, it proposes aggressive usage of compulsory arbitration as well as submission to arbitration, while at the same time raising ADR professionals to fill in the missing gaps. Secondly, in order to overcome the problem of concentration of related cases, making representative lawsuits of environmental organizations would be a good idea. It also states that in order to make the compensation amount more realistic, it should go out of the across-the-board decision making process and reach a decision about the compensation amount that takes the individual situation's dispute into consideration. In order to boost the professionalism of the environmental dispute arbitration, it is necessary to reform the organization and manpower such as expanding the number of members of full standing, and increasing the professionalism of the examiners. Also, to increase the usage rate of the ADR system, the paper suggests stationing a civilian consultant regarding environment, or activating the compulsory arbitration which is the premise for public participation on the part of the residents.

  • We have studied electro-optic characteristics of reflective $45^{\circ}$ twisted nematic liquid crystal display which implement the new LC orientation using of in-cell retarder film. For the embodiment of reflective liquid crystal display, essentially the optic compensation films was always needed and attached to the outside of glass substrate. In our study, these optic compensation film were not employed in reflective LC cell. On other hand we have employed the in-cell retarder to substitute the optic compensation film and were able to orient the LC molecules using this in-cell retarder. So we have developed the reflective LC cell that has good optical performances without any additional coating process on the in-cell retarder.

Laboratory Test Method for the Forward Motion Compensation of Airborne Camera (항공용 카메라 전방운동 보상기능의 실험실 입증방안)

  • Image blurring in airborne camera can be prevented through timely actuation of LOS(Line of Sight) into the opposite direction to the aircraft advancement, i.e. FMC(Forward motion compensation). Performance verification of FMC requires installation of camera to the aircraft. However, in many ways the verification process has little choice but to be implemented in the laboratory. In this paper verification method of FMC performance in the laboratory is introduced. With collimator target installed in the known reference position image obtained by actual mission plan naturally displays image blurring as well as LOS displacement by FMC effect. Through comparison of the amount of those image blurring and LOS displacement to the equivalent image distortion expected by the application of the FMC reference command can the performance be verified. In this paper we propose a new verification method of FMC performance in laboratory along with generalized solution of FMC reference command, and assess the validity of our proposition.

  • A periodic disturbance canceler is proposed to compensate the periodic disturbance due to cutting process in a CNC machining center. For precision cutting, the combination of a disturbance observer and a periodic disturbance canceler is desirable in order to compensate both the frictional force and the periodic disturbance. This method is implemented in a position control system of a CNC machining center in cutting process and the experimental results are described to show its effectiveness.

Correlation Between Electrical Activity of Type I Neuron and c-Fos Expression in the Medial Vestibular Nuclei Following Unilateral Labyrinthectomy in Rats

  • To search the correlations between electrical activity and c-Fos expression in the process of vestibular compensation, we examined the changes of those two parameters in the medial vestibular nuclei (MVN) of unilaterally labyrinthectomized (ULX) rats. Spontaneous nystagmus with fast component toward the intact side disappeared gradually within 48 hours. Fourty eight hours after ULX, directional preponderance of the eye movement induced by sinusoidal rotation of the whole body which represents the symmetry of bilateral vestibular functions showed less than 20% by rotation of 0.1, 0.2, and 0.5 Hz, indicating the recovery of symmetry in bilateral vestibular functions. Six hours after ULX, spontaneous electrical activity of type I neurons resulted in asymmetry between bilateral MVN, however, the asymmetry of the electrical activity was decreased 48 hours after ULX. Immunocytochemical staining revealed that ULX produced dramatic induction of c-Fos positive cells in the MVN bilaterally. The number of c-Fos immunoreactive cells in the contralateral MVN was significantly higher than those in the ipsilateral MVN (p<0.0001) 2 hours after ULX. Thereafter, the number of c-Fos positive cells decreased bilaterally and was slightly, but not significantly higher in the ipsilateral MVN at 48 hours after ULX. The present results suggest that both electrical activity of type I neurons and c-Fos expression in MVN following ULX will reflect underlying mechanisms of recovery process of vestibular compensation.

  • The strain measurement of the panel in the sheet metal forming is essential work which provides experimental data needed to die design, process design, and product inspection. To measure efficiently the complex geometry strain, the 3-dimensional automative strain measurement system, which has high accuracy in theory, but has some 3∼5% errors in practice, is often used. The object of this study is to develop the error compensation technology to eliminate the strain, errors resulted when formed panels are measured using an automated strain measurement system. To achieve the study object, the position error calibration method correcting coordinates of the grid node recognized by a camera using error functions is suggested. Then the position errors were found by calculating the difference in the position of the cube node between real coordinates and measured coordinates in toms of node coordinates and the error calibration equations were derived by regressing the position errors. In order to show the validation of the suggested position error calibration method, finite element analysis and current calibration method was performed for the initial-blankformed.

  • Employment in enterprises is a consecutive decision-making process based on the results of their innovative activities and it is necessary to consider this relationship as well explicitly in an analysis of the employment performance through technological innovation. Based on this critical mind, this study would analyze the structural relationships among enterprises' innovative activities, the performance of technological innovation, a compensation system and the creation of employment, reflecting the correlation of the process of the actual technology management performed simultaneously, utilizing the seemingly unrelated regression(SUR) model to estimate a simultaneous equation in addition to analyzing the relationship between technological innovation and the effect on employment with the ordered logit model to estimate a single equation as in the preceding studies. As a result of the analysis, a structural relationship could be found out, in which the execution of the compensation system would increase the performances of technical development and technology commercialization, which in turn, accelerates enterprises' employment. Especially, it is judged that enterprises' employment performance increases when technological innovation is managed from a process perspective in that the commercialization performance, as well as technical development, acts as a kind of hurdle in the effect on employment.

Analysis of Reward and Royalty Programs Affecting Customer Satisfaction and Recommendations in the Purchase Process in Luxury Goods (명품 구매과정에서 고객만족과 추천의향에 영향을 미치는 보상 및 로열티 프로그램의 분석 - 고급 수입차 매장을 중심으로 -)

  • This study analyzed what premium features significantly affect customer satisfaction and their recommendation, and what factors significantly affect product attributes. In the process, first, the loyalty program and the customer compensation program were studied to determine the impact of the customer satisfaction and recommendation. The study analyzed that quality and design of product properties had significant effects on all factors, but the brand was not significantly affected. Second, while superiority, differentiation and scarcity of luxury items are significant to customer satisfaction but superiority is only significant in relation to recommendation intention. Third, the preceding study shows that the customer compensation program has a significant impact on sales growth, but the study found that it was not for imported luxury car customers. Fourth, if the royalties program is low in awareness, it has been analyzed that the scarcity and customer satisfaction relationships among luxury goods have been adjusted. On the contrary, if there is a high level of awareness, it is analyzed that there is a control effect customer satisfaction and differentiation among luxury brands. In the conclusion, in order to satisfy customers at the import luxury car market, the differentiation of luxury goods by standard index must be strengthened and the brand must be strengthened among the attributes of the product. In addition, by raising awareness of the royalties program, the relationship between differentiation and customer satisfaction can be enhanced.

Exposure Assessment of Tile Manufacturing Workers to Crystalline Silica (타일 제조 작업자의 결정형 유리규산 노출평가 사례)

  • Objectives: An epidemiological investigation was requested for a worker who developed COPD and IPF after long-term molding and firing at a domestic tile manufacturing site. We would like to share the results of the exposure assessment and the estimation of past work. Methods: The content of crystalline silica in four raw materials was analyzed, and the respirable fraction of crystalline silica and dust generated in the air from molding and firing workers and other processes were measured. The measurement and analysis method referred to the NIOSH method. Results: The crystalline silica content of the raw material was 24~47%. The concentration of crystalline silica in the molding and firing process workers and the surrounding area was at the level of the exposure standards set by the Ministry of Employment and Labor and ACGIH, and the respirable and total dust exposure levels were generally low. The crystalline silica concentration of the area samples measured to estimate past work was about twice as high as the exposure standard of the Ministry of Employment and Labor (0.05 mg/m3), and the exposure levels of respirable dust were also quite high at 0.903 and 1.332 mg/m3. Conclusions: It was confirmed that tile molding and firing workers are currently exposed to a fairly high level of crystalline silica, and a high level is also confirmed in area samples to estimate past work. In the past, it is judged that the level of exposure would have been much higher due to differences in production volume, working method, presence/absence of local ventilation facilities, and process layout. When working in such a working environment for a long time, respiratory diseases such as lung cancer, COPD, and IPF can occur.

Factors Affecting the Satisfaction of the Hospital Services among Injured Workers (산재근로자의 의료기관 서비스 만족에 영향을 미치는 요인)

  • Purpose: The purpose of this study was to determine factors that affect satisfaction of the hospital services among injured workers. Methods: The subjects of this study were 532 injured workers. The questionnaires were selected as literature suggested for explaining satisfaction of the hospital services, general characteristics of injured workers, characteristics of the hospital services. The data were analyzed with descriptive statistics, t-test, ANOVA, multiple regression analysis by SPSS 19.0. Results: There were significant differences in satisfaction scores, depending on the types of disease, health status and possibility to return to work among the injured workers. Also, there were significant differences in satisfaction scores, in terms of medical facilities, food service, specialization of doctors and nurses, cleanliness of hospital, convenience of hospital teaching and counselling of doctors and nurses, supporting workers' compensation process, counselling of workers' compensation and unfair treatment. In the results of the standard multiple regression analysis, food service, medical facilities, specialization of doctors and nurses, health status and hospital cleanliness were significant factors for satisfaction scores of the hospital services. Conclusion: It is necessary to promote food service, medical facilities, specialization of doctors and nurses, hospital cleanliness, health status of injured workers for developing hospital services.
