A Study on the Right to Housing in International Human Rights Laws and Instruments (국제인권법 및 인권규범의 주거권 규정에 대한 연구)

  • Today human rights are the most complex and prominent issue in the system of international law, and the right to housing(housing right) is also recognized as a basic human right in the international human right instruments including the Universal Declaration of Human Rights. This study targets to comprehensive review of the housing rights provisions with 85 international human rights laws and instruments. And the contents and characteristics of housing rights are analyzed with categorization based on housing rights in general, housing rights of workers, socially vulnerable groups, international regional organizations. Housing right takes also the features of universality, indivisibility, interdependence, and right to adequate housing should be interpreted with holistic view including legal security of tenure, accessibility, affordability, location beyond ensuring just a physical housing space. Approaches to the housing right comprehensively reflect the view of the right to development, the perspective of gender equality, the principle of non-discrimination, the participation rights, and orient the housing right should be seen as the right to live somewhere in security(safety), peace and dignity.

  • The purposes of this study are to define 'housing welfare' which constitutes an important theme of discussion today and to present some future policy issues. Recently, the expression 'housing welfare' is widely used in our daily life and written in some laws, but its concept is still ambiguous. Housing welfare can be defined as 'the situation in which citizens gain access to a decent housing and adapt themselves well to the community life. In this context, the goals of housing welfare policy should be as follows: reduction of the number of households living below the minimum standard in housing, promotion of the right to housing, housing provision and management based on housing needs, linkage of housing and other welfare measures, realization of social integration and social justice. But, there are still some controversies on such questions as target group, moral hazard of beneficiaries, social equity, etc. To get all the policy alternatives more effective, efforts should be made to improve the general infrastructure of welfare policies, to prevent NIMBY phenomenon of local actors, and so on.

  • Recently, the point of view about housing environment in the city has changed from the traditional point of view of the center of housing to the subject of land- utilization-control for interaction of buildings. Right of light is the center of this issue in other words. Also many interests about the beauties of the city have increasing centering around Europe etc. This is to change a city design into the characteristic design from the exiting uniform design. As if reflect this situation, recently we are setting up the night illumination and constructing a building which acted as Land Mark like the Jong-Ro Tower. And Apartment Housing was being built various form deviate from a existing standardized form and skyline. Existing studies about sunshine of Apartment Housing have dealt with just about a standardized Apartment Housing form. So this study analyzed a recently increasing interest for Right of light and change of sunshine environment on Apartment Housing which have a various skyline form.

  • The Preferred Right that recognized in Housing Lease Protection Act Article 8 Paragraph 1 is a legal security right. The case of a small tenant whose security deposit is less than a specific sum of money to lease housing, he can get preferential payment about his a specific sum of money of security deposit in an auction procedure. Like this the Preferred Right can protect the homeless commoner also it ignores the existing legal system. But the Preferred Right has the right function that contribute to stability of homeless people's housing, on the other hand, it has the adverse function that damages to several interested parties in an auction procedure by using legal preferential protection. So, about these problems, the improvement way will propose in this study.

  • This study is to search for the characteristics of spatial structure and elements of architectural composition on the housing and village in Nampeong Moon's Bonli Ma-Yul which formed. from the late nineteenth century to the the early twentieth century. This village had as many as characters of spatial and architectural structures of traditional clan villages previous to the late nineteenth century, but showed housing alternations on social changes of late Cho-Sun dynasty. Main points of these were as follows; 1) As the main doors of the housing were located on the right of Sa-Rang-Chae, men and women's moving lines of coming in and out were not nearly divided. 2)As korean veranda on the right and left, and the front and rear of those were set up, the demand on extension of room area coping with changes of life was satisfied.

  • As a factor of housing environment, right of light became a subject of discussion as a social issue. Cases on the right of light in properties have been increased. Also many interests in the scape of the city have been increased. This study aims to show the possibility of variation of the shape of the apartment buildings considering the right of light. Reflecting this recent situation, we are setting up the night illumination and constructing a building which acts as Land Mark like the Jong-Ro Tower. And In case of the apartment building, various forms are deviated from an existing standardized form and skyline Existing studies on the sunshine of apartment buildings have dealt with just a standardized apartment building form.   • The purpose of this study is to develop a automation for decision of the optimum stories in apartment buildings in order to assure the solar access right for neighboring areas. Compared to the results of the optimum stories by manual process through applying a legal case over solar access right, the proposed method provides more improved and expanded information by automating the computing process of decision of the optimum stories in apartment buildings. With the result of this research, it would be possible to furnish with advanced information for an amicable settlement against the civil petition and disputes, to reduce waste of the time and cost and to improve the efficiency of solar access right analysis works.

  • In various urban renewal projects related to real estate, developer in order to conduct the business, must get real estate inside project section directly or receive the consent for project from the owners. It must be carried out by consultation. When it fails, developer, in order to get ownership, adopts 'the Right of Claim for the sale' which has forcibleness. However, because the procedure for implementation of the right of claim for the sale is not clear, conflict between stakeholders is caused and it causes extension of period. Therefore, after examining judgments and references of judicial power for administrative litigation of the Right of Claim for the sale, by researching stakeholders of the housing rebuilding project and based on the results, finding out differences of stakeholders' recognition according to their position and problems of exercising procedure of the Right of Claim for the sale, and by presenting improvement plans of the system of the Right of Claim for the sale, contributing the success of the housing rebuilding project is the purpose of it.

  • This study discussed the change of housing environmental problems from the early 1900s to the present.The reason is to find the solution of serious housing environment problems. The documentary research method was used for this study.Articles of content analysis(N= 1129)were published in 1920(the first edition)to December. 31, 1990 which were The Dong - A daily news article about housing environment. The main content of this study was examined the change, such as the number of whole article by time series and importance of article(column number of article), classification of article subject, and the number of article by subject. On the basis of this data, was made by chronological classification of the change of housing environment problems for 70 years. Since overall results will become supply of right information about housing environment to fur peoples, will provide the oppronment that oneself ran participate the protection of housing environment, and further will take a part solution of housing environment problems.At the future, I am going to design deep analysis of article content by subject.

A Study on the Housing Values and Life Style of High School Students (고등학생의 주거가치관과 생활양식에 관한 연구)

  • The purpose of this study was to clarify tile tendency of differences in housing values and life style of high school students in Chonbuk province. Data were collected through questionnaires from 1015 high school students living in Chonbuk province, and were analyzed by SPSS program using percentage, mean and standard deviation. Data were verified by t-test, One-way Anova, Scheffe's multiple range test, Pearson's correlation coefficient as well. The findings of this study were as follows; There were more significant differences in housing values and life style by demographic variables than housing characteristic variables. And correlation between housing values and life style differed significantly Most of students showed higher value in location of housing, while as life style showed higher value in type of life style along with PC. On the basis of this result,. it can be suggested that it is necessary to have the right understanding about housing values and life style of high school students for correct guidance of housing education.
