the Applying Differences of Excepted Perils in the Rotterdam Rules (로테르담 규칙하에서의 면책사유의 적용상 특징)

  • International maritime law conventions concerned with cargo liabilities have sought to achieve solutions which will be acceptable to a wide range of states. The Rotterdam Rules was approved by the UN Assembly on 11 December 2008. The Rotterdam Rules are intended to replace The Hague and Hamburg Rules. This paper is comparing The Rotterdam Rules with The Hague and Hamburg Rules for the carrier' liabilities and exceptions in order to find carrier' liability System, the burden of proof and exceptions in the International maritime Rules. The purpose of this paper is considering the carrier's principal recourse for defending himself inmost cargo claims. The first area analyze the transfer of carrier's fundamental Liability system in the International Rules. The second is the matter on the appointment of proof in order to establish liability or to be relieve of liability. And the third is the change of the carrier's possible exclusions from liability in the International maritime Rules. From the result of the said analysis, my paper suggests differences of the exclusions in the Rotterdam Rules comparing with the Hague and Hamburg Rules, and features of the Rotterdam Rules appling exceptions on the basis of the Hague and Hamburg Rules with regard to carrier's liability and burden of proof. The former is the inclusion of three exclusions, the deleted natural fault, and The provision making the carrier responsible for the acts of its servants or agents in the 'fire on the ship' of the Rotterdam Rules. The latter is deleting the principle of overriding obligation related to carrier's obligation of seaworthiness in the Rotterdam Rules, the burden of proof being diverted from the carrier to the carrier and the shipper in the cargo damage caused by two factors(one for which the carrier was liable and the other for which it was excusable) in the new rules.

The feasibility of immediately loading dental implants in edentulous jaws

  • Purpose: Immediate loading of dental implants has been proved to be feasible in partially edentulous jaws. The purpose of this retrospective investigation was to assess the feasibility of immediately loading dental implants in fully edentulous jaws. Methods: A total of 24 patients aged between 53 and 89 years received a total of 154 implants in their edentulous maxillae or mandibles. Among the implants, 45 were set in fresh extracted sockets and 109 in consolidated alveolar bones. The implants were provisionally managed with chair-side made provisional resin bridges and exposed to immediate loading. Implants were followed up for 1-8 years, including radiographic imaging. Marginal bone levels were evaluated based on radiographic imaging. Results: A total of 148 out of the 154 implants survived over the follow-up period of 1 to 8 years, giving a survival rate of 96%. The time or region of the implantation, the pre-implant augmentation, and the length and diameter of the implants had no statistically significant influence on the survival or the success rate. The marginal bone level remained stable with only minimal loss of 0.3 mm after 60 months of loading. Conclusions: Within the limitations of this study, immediate loading is feasible for dental implants in edentulous jaws.

  • Under water wet welding is an economically alternative for the repair of offshore structures. In this paper investigations on the fatigue strength of a wet welded pipe structural member have been reported. For the connection a special sleeve patch design has been developed. The joint was fatigue tested. The evaluation of the test was carried out by means of the hot-spot approach with regard to several extrapolation rules of the hot-spot stress. Obtained results have been compared to actual classfication rules and recommendations.

  • A new concept of collision energy absorbing system for ;he New Oil-tankers with Advanced Double Hull Structure(NOAHS and NOAHS II) are presented through the joint-research pro-gran between Inha and Hamburg-Harburg University. A comparative study on col vision resistance of these proposed side structures with standard double hull structure of 310K DWT class VLCC, is carried out. The fatigue investigation of structural detail parts is also included. It contains a comparative fatigue study based on pertinent regulations of Classification Societies.

  • Cold spraying is a fairly new coating technique, which within the last decade attracted serious attention of research groups and spray companies. As compared to thermal spraying, the low process temperatures in cold spraying result in unique coating properties, which promise new applications. Since particles impact with high kinetic energy in the solid state, new concepts to describe coating formation are requested to enable the full potential of this new technology. The present contribution gives a brief review of current models concerning bonding, supplying a description of the most influential spray parameters and consequences for new developments. With respect to spray forming by cold cold spraying, microstructures and thick, further machineable structures are presented.

  • Aims of the EXCEPT project and tasks and characteristics of the EXCEPT system are presented based on an analysis of urban planning EIAs. The methodology of evaluation in EIAs, which had to be developed in order to program the system, is based on a model of evaluation processes. Evaluation principles, evaluation rates, an environmental model and a model of the projects being planned are presented. The evaluation concern re-unifies the different components of evaluation again.

  • With increasing globalization, a proper policy for global inter-city networking strongly required, which presumes the study on the heterogeneity among regional innovation systems. While surveying the research results of the Evolutionary Economics, 1 stress that regional systems of innovation differ in technological capacities, industrial structures, institutional arrangements and socio-cultural features. 1 make the empirical investigation based on the data of Busan and Hamburg, making clear the regional specificities among regional innovation systems. The results show that regional systems of innovation in Busan and Hamburg are quitely asymmetric. They suggest also the limitation of neo-classical assumption on the ‘homogeneous production function’ and that policy-makers in regions should make the policy for ‘global inter-cities networking’, based on perspectives of regional heterogeneity.

  • The Korean railroads' logistics are facing the important turning points by the connection of. South and North Korean railroads, and the commercial opening of the High Speed Rail. These two factors demand several plans for the development of railroads' logistics, in which intermodal transportation with the others modes is wholly studied. In this respect the case of port of Hamburg, Germany, where railroads are completely integrated in the port, will permit the Koreans some useful lessons for the future of railroads' logistics.

Influences of Neck and/or Wrist Pain on Hand Grip Strength of Industrial Quality Proofing Workers

  • Background: The aim of this study was to analyze the interaction between neck and/or wrist pain and hand grip strength (HGS) and to investigate factors (age, sex, neck disorders, and carpal tunnel syndrome) influencing the HGS of industrial quality proofing workers (N = 145). Methods: Standardized questionnaires [Neck Disability Index (NDI), Boston Carpal Tunnel Questionnaire] were used to evaluate existing neck and/or wrist pain. HGS measurements were performed in different wrist positions. Results: Significant differences between participants with and without neck pain were found in different wrist positions, in neutral wrist position right [without neck pain (n = 48) 46.34 (43.39 - 49.30); with neck pain (n = 97) 38.46 (36.20 - 40.72), F(1,144) = 16.82, p < 0.001, ŋp2 = 0.11] and left [without neck pain 44.06 (41.19 - 46.94); with neck pain 37.36 (35.13 - 39.58), F(1,144) = 12.70, p < 0.001, ŋp2 = 0.08]. A significant difference between participants with and without wrist pain was found for neutral wrist position right [without wrist pain (n = 105) 42.53 (40.37 - 44.70); with wrist pain (n = 40) 37.24 (33.56 - 40.91), F(1,144) = 6.41, p = 0.01, ŋp2 = 0.04]. Regression analysis showed significant results especially for steps two (age and weight, NDI) and three (age and weight, NDI, Boston Carpal Tunnel Questionnaire) for neutral position right (R2 = 0.355, R2 = 0.357, respectively). Conclusion: Neck pain has an impact on HGS but should be evaluated in consideration of age and sex.
