내항상선 승선 외국인선원의 관리에 관한 연구 (A Study on the Management of Foreign Crew in Domestic Merchant Vessel)

  • 카보타지는 동일한 국가 내의 두 지점간 화물이나 여객을 다른 국가에 등록한 선박이나 항공기가 수송하는 것을 말한다. 카보타지규제는 경제적으로는 보호주의 측면에서, 국방의 관점에서는 국가안전보장 측면에서 정당화되어 왔으며, 미국, 일본, EU(역외(域外)국가간) 등 세계 주요국가들이 카보타지를 실시하고 있다. 우리나라는 세계 5위의 지배선단을 가진 해운국으로 성장하였으나, 선원공급 부족과 내항선선원의 고령화는 내항선박의 정상적인 운항을 저해하는 요인으로 대두되고 있다. 이에 따라 정부는 카보타지라는 기본적인 원칙을 고수하면서도 2004년부터 외국인선원들의 내항상선 승선을 허용하여 2011년 8월 현재 530명의 미얀마 및 인도네시아 부원선원이 국적 내항선박에 승선하고 있다. 우리나라 법적으로는 내항선에 외국인선원을 승선시키는 것이 가능하나, 카보타지규제를 받는 선박에 외국인선원을 승선시키는 것은 카보타지 본래의 취지를 훼손시킨다고 볼 수 있으므로, 그로 인해 발생할 수 있는 내항해운의 문제점을 해소하기 위한 조치가 필요하다. 외국인선원 승선으로 인한 문제점을 최소화하기 위해서는 첫째, 의사소통과 문화적차이를 극복할 수 있는 외국인선원 관리기법의 도입이 필요하며, 둘째, 외국인 선원의 고충상담을 위한 외국인선원지원센터의 설립이 필요하고, 셋째, 적정 관리능력을 갖춘 외국인선원관리회사를 육성하며, 넷째, 외국인선원의 근로조건 개선을 통하여 안정적인 선원공급을 가능하게 할 필요가 있다. 마지막으로 송출국가의 행정당국과의 무단이탈자 행정제재에 대한 협정체결이 필요하다.

우리나라 해운산업의 경쟁력 실태분석 (A Study on the Situation Analysis for Competitive Advantage Power of Korean Shipping Industry)

  • The development of Korean shipping industry is maybe defined into three development stages-industry fixing stage, industry coordinating stage, industry development stage-. The development of shipping industry has been depended on the geovernment/authority role such as shipping policy, system, law, rules and regulations. In 1983, Korean shipping industry reorganization and coordination by shipping authority have made our shipping industry on the stable condition together with each company's efforts. Today's world economic environment such WTO/UR negotiation results get this government role limited. According to the being reduced government role, each company's competitive advantage power becomes more important. Besides, korean shipping industry is exposed into the entire and bitter world competition. In order to win and prevent the world shipping competition, it is necessary to look out the competitive advantage power of Korean shipping industry. The first purpose of this study is the situation analysis for competitive advantage power of Korean shipping industry. The second is to compare with our shipping policies with foreign ones concerned with ship, cargo, crew, tax and others. But in order to compare with foreign shipping, this study need their shipping statistics data, this study has some limit of the foreign data. This study has been carried on the basis of the following items. 1. Shipping environment, 2. Ships and ship acquirement(shipbuilding/purchasing), 3. Oceangoing cargo and ship's stowage rate, 4. Human factor in shipping-crew, 5. The incomes and costs in finacial statements. We have some conclusions as following through the this study. First, Korean shipping industry environment-competitive disadvantage situation- has changed rapidly due to the shipping market opening, free market entering of foreign shipping. Second, Korean shipping is disadvantageous due to the high tax rate and financing conditions in connection with ship acquirement. In order to improve the competitive advantage power, the shipping tax system and ship financing conditions should be reviewed to profitable for owners. Third, but both world and Korean oceangoing cargoes quantity have been increased annualy, Korean ship's cargo stowage rate is being decreased. This is serious situation but Korean shipping take well use of foreign vessel with hire. It is recommended to take use of owner's vessel and hired ones in the long range view, considering the world shipping management. But the number of crew has been decreased by 2, 000~3, 000 annualy, it is desirable that the long sea-experienced crew have been increased. Almost of owners usauly complain the crew cost is the main obstacles to competitive advantage power. Human factor is the most important firm's asset. All owners should pay attention to this though, and invest the proper budget to training, education, welfare as much as possible. In the long run this effects could be feedback to owners. Fifth, We must improve the financial statements structure, that is, the first step is to increase income, the second is to decrease cost, the third is to increase income on the same cost, the fourth is to decrease cost on the same income. It is essential to find out what the urgent investment is and what unnecessary cost is. At last, in order to competite world shipping race, each shipping firm must try for himself to retain the power. The government/authority is no longer dependable. I believe that each firm's power will be the industry's power, the industry's power will be the nations's power.

지방어항개발의 투자결정요인 분석 - 충청남도 어항 중심으로 - (A Study on Decisions on Investment Factors in the Development of Local Fishing Harbors)

  • In the recent WTO/DDA negotiations, discussions are progressing to forbid fishery subsidies which have negative effect on the natural environment and the fishery resources and to lower or to eliminate the tariff/non-tariff barriers that distort trade liberalization. As a result, linking to the weak structural environment of Korea's fishing villages; such a scheme has jeopardized the livelihood of fishermen who settle down in local fishing harbors. Against this backdrop, the government is attempting to positively respond to changes in the fishing environment in a number of different ways: promotion of fishing tourism, fishing harbor reinforcement in function, developing fishing villages, and harbors. With respect to investment by priority in fishing harbor development, it is very important to appropriately select investment targets based on objective criteria. A small number of harbors are chosen and investment plans by harbor are systematically devised, economic feasibility and the effects of investment are analyzed and reviewed in relation to each target harbor. This paper is designed to review and assess objective evaluation methods and the degree of importance for the designation of target harbors, dealing with local harbors in Chung Nam Do as a model. Each local government has tried to reorganize existing harbors and develop new harbors, considering a fall in the number of fishing vessels and the expansion of maritime leisure activities. In order to overcome the limit of existing harbors in function, to raise the income of fishermen, and to activate tourism, they have shifted their focus from simple functions such as vessel evacuation and anchoring to harbor beautification, which can work as a basis for fishing tourism. This paper points out that the AHP analysis method for prioritizing local harbors in Chung Nam Do should help to be chosen target harbors in other cities and provinces. Each local government has attempted to reorganize existing harbors and to develop new harbors, taking into consideration the decline in the number of fishing vessels and the expansion of maritime leisure activities. In order to overcome the limited number of functional harbors, to raise the income of fishermen, and to boost tourism, they have shifted their focus from simple functions, such as vessel evacuation and anchoring, to harbor beautification, which can work as a basis for fishing tourism. This paper shows that the AHP analysis method for prioritizing local harbors in Chungcheongnam-do could aid in the effective selection of target harbors in other cities and provinces.

  • 본 연구는 제주해협의 통항문제를 유엔해양법협약을 기초로 검토하여 제주해협의 국제법상 지위 및 이에 상응하는 통항제도를 구체적으로 제시하고자 한다. 이를 위하여 제주해협의 지리적 특성, 유엔해양법협약상의 통항제도, 제주해협의 통항문제 및 북한상선의 제주해협문제 등을 고찰한다.

불법어업 단속제도에 관한 연구 (A Study on the Unlawful Fishery Control System)

  • The fisheries resource in waters under the jurisdiction of Korea is being endangered by unlawful fishery. The Korean government exerted great efforts to establish the public order of water, but the number of the exposed unlawful fishing violations has increased for last 10 years. The system to guide fisheries regulatory noncompliance of Korea is limited to the use of fishing guidance patrol boats. For strength of monitoring and surveillance systems, the government needs to phase in Vessel Monitoring System. But there are some studies for that. The defects of present monitoring practice can be drawn from the facts described above. The qualification of the fishery control official one of most important element of fishing control system, is defined as any officer who is charging on fishing. For clear law enforcement the qualification should require considerable experience and knowledge. Korean coast guards have problems on guiding unlawful fishing violations because of the absence of administrative authority by comparison with the fisheries guiding officer, who has both authorities on administration and jurisdiction. To draw some judicial problems this research presents a analysis on the fishing control system. The research suggests the improvements to compensate the defects.

'내자(內子)'명(銘)으로 본 조선 전기 분청사기의 동음오자(同音誤字) 명문 사례와 의의 (Cases and Significance of Inscriptions with Homophonic yet Misspelled Words on Buncheong Ware from the Early Joseon Dynasty: Buncheong Bowl with Inscription of "Naeja")

  • 분청사기의 명문은 그릇에 대한 정보이자 관물(官物)의 공납(貢納)과 출납(出納)을 통제하기 위한 장치다. 명문은 당시 그릇을 관리하는 사람들이 뚜렷하게 인식할 수 있어야 했다. 국립중앙박물관 소장 <분청사기 인화문 '능성내자(綾城內子)'명 발>(본관13808)은 명문이 뚜렷한 그릇이지만 명문의 내용이 일반적인 분청사기와 다르다. 분청사기에 표시한 명문은 대부분 그릇이 속한 관사명(官司名)이거나 그릇을 만든 지명(地名)이다. 그러나 국립중앙박물관 소장품에 표시된 '내자(內子)'명은 해당하는 관청이 없다. 그릇의 새긴 명문의 구성으로 볼 때 내자(內子)는 내자(內資)의 오자(誤字)인 것이다. '내자(內子)'명은 내자시의 그릇이라는 뜻이다. '내자(內子)'명은 내자(內資)의 틀린 글자이지만 음(音)이 같아 오자임에도 여전히 명문의 기능을 다할 수 있었다. 이처럼 글자가 다르지만 음이 같은 동음오자(同音誤字) 명문이 최근 서울시내 발굴 조사에서 조금씩 출토되고 있다. 내자(內資)를 '내자(內子)'로 표시하고 인수(仁壽)를 '인수(仁守)'로 새긴 동음오자 명문의 분청사기는 작업자가 의도한 것이든 무지(無知)의 결과이든지 간에 실제 관물(官物)로 통용되었으므로 소비지인 서울의 유적에서 출토된 것이다. 동음오자 명문은 음은 같지만 획수가 적고 간단한 글자를 사용했고 글자의 엉성한 필획이 특징이다. '내자(內子)'와 '인수(仁守)'명을 표시한 그릇들 역시 일반 관사명 분청사기처럼 서울시내 유적에서 출토된다. 동음오자 명문은 조선 전기 공납 분청사기들에 명문을 필각하는 과정에 생긴 오류와 또 그러한 오류가 실제 유통되었음을 파악할 수 있는 사례이다.

  • Global warming issues due to the $CO_2$(Carbon Dioxide) become increasing since the Industrial Revolution. After the Kyoto protocol at 1997, nations which have the prearranged quota drives their national project for the reduction of $CO_2$. Korean Government start to the related big projects in the view of three concepts which have consist of the $CO_2$ exhaust reduction on land, $CO_2$ capture and $CO_2$ storage. Furthermore, the storage method putting into depleted region underground is accepted by the London Convention while the ocean diluted method discharging the liquid $CO_2$ into the deep ocean using the long pipe which is towed by the surface vessel is underway for the research steps which means that there are many potentials for the R&Ds that need for the breakthrough. In this paper, the role and example of the Computational Fluid Dynamics for the feasibility study of the $CO_2$ ocean sequestration is mentioned.

유류오염 리스크와 보험담보의 문제 (A Study on the Insurance System for Oil Pollution Risk)

  • With the rapid development of oil and chemical industry in the late 20C, massive transportation of oil by oil tanker vessel has grown and it caused the big oil pollution accidents. When oil spill from the oil tanker, damages reach into the astronomical figures in economically and damages affect wide area and many people with break the balance of ecosystem. Recently in Korea, the oil pollution accidents has occurred frequently as growing of oil consumption and it caused large-scale damages to the victim. Oil pollution in Korea offshore takes not only Korean fisherman from their life ground and break the ecosystem but it takes too much time and money to recover. To minimize oil pollution damages, it is necessary to make pre-caution effort as a ship owner and relevant government bodies should endeavor to prevent from more damages. But once oil pollution accidents occurs in territorial sea, compensation for victim is very important. But it is true that compensation is not paid to victim smoothly. So this study aims at the problems of oil pollution compensation to the Korean victim and find the best way to get reasonable compensation.

해양오염방지를 위한 행정역량 제고 (Enhancing Implementation Capability of National Maritime Administration for Preventing Marine Pollution)

  • Almost of all impediments to enhancing ship safety and preventing vessel-source marine pollution arise from the interaction between direct and indirect factors. The direct factors come from human errors and failure in compliance with the international convention standards for the operation of cessel. The indirect factors derive from the will and attitudes of the countries taking little responsibilities with appropriate seriousness for policing their fleets. By focusing on these aspects, this paper reviews the effectiveness of existing countermasures adopted by IMO and intends to propose a new paradigm to improve the implementation capability of each nation by suggesting frameworks of maritime administration models.

  • 침몰선박은 침몰 당시뿐만 아니라 오랜 시간이 경과된 후에도 선체 내에 잔존하고 있는 연료유 등 유해물질의 지속적 혹은 일시적 유출로 2차 해양오염사고를 발생시킬 수 있다. 정부에서는 1999년부터 침몰선박에 대한 관리업무를 수행하고, 침몰선박의 잠재적 위해도를 정량적으로 평가할 수 있는 위해도 평가표를 개발하여 운영함으로써 침몰선박에 대한 국가적 관리체계를 구축하고 있다. 그러나 현재의 침몰선박의 위해도 평가는 침몰선박에 잔존하고 있는 연료유 등의 양에 의해 평가점수가 판이하게 달라짐에도 불구하고, 침몰선박 현황보고자료 중 상당수가 연료유 잔존량 항목이 누락되고 있는 실정이다. 이에 본 연구에서는 선박 연료유 잔존량에 대한 추정모델을 개발하여, 현행 침몰선박 위해도 평가에 적용함으로써 보다 정확한 평가를 수행할 수 있는 방안을 마련하였다.
