A Study on the Systematization of the Technology Act for Platforming the Fourth Industrial Revolution

  • Korea has the potential to lead the era of the Fourth Industrial Revolution, which succeeded in the information and communication revolution, including the establishment of an e-government. The Go match between humans and computers has led to the realization that humans are starting to live in a new era that they have never experienced before. In 2018, the Federation of Science and Technology Organizations conducted a recognition survey on "what is the most urgent thing?" in the era of the Fourth Industrial Revolution. As a result, it has been shown that the readjustment of the laws of science and technology is most urgent, so it is necessary to analyze the laws of science and technology. According to the research, more than 400 laws are diagnosed, and laws that serve as basic laws cannot lead the Fourth Industrial Revolution. The Framework Act on Science and Technology provides an emphasis on the promotion and management of R&D projects. When analyzing the regulations on 'Development of Science and Technology Innovation System', 'Basic Plan of Science and Technology', and 'Comprehensive Plan for Promotion of Local Science and Technology', there is no suggestion of the Fourth Industrial Revolution. After all, a comprehensive analysis of the current Framework Act on Science and Technology indicates that it is in effect the R&D and Management Act. The "Regulations on the Establishment and Operation of the Fourth Industrial Revolution Committee" poses the problem of defining parliamentary legislation as administrative legislation. 'In addition, if we analyze the Smart City Act, the lack of logical links with the Framework Act on Science and Technology and the Regulations on the Establishment and Operation of the Fourth Industrial Revolution Committee is a major problem. In conclusion, in order to platform the Fourth Industrial Revolution, two improvements can be put forward. First, the Framework Act on Science and Technology shall be abolished to enact the National Research and Development Administration Act, and secondly, the Framework Act on the Fourth Industrial Revolution shall be enacted to absorb the contents of the Regulations on the Establishment and Operation of the Fourth Industrial Revolution Committee.

The Evolution of Korea's Basic Acts on Science and Technology and their Characteristics

  • This study examined the evolution of S&T Basic Acts in Korea from the Science and Technology Promotion Act (1967) through the Special Act on STI (1997) to the Framework Act on Science and Technology (2001) in the following aspects: 1) comprehensive plans, 2) coordination mechanisms for S&T policies, 3) enforcement of R&D programs and performance diffusion, 4) promotion of human resources, 5) and S&T investment and budgeting. Before the Framework Act on S&T was enacted in 2001, critical issues were found in establishing S&T master plans, promotion of R&D programs, comprehensive coordination mechanisms, and R&D budgeting. The three Basic Acts have expanded the scope of regulation over time to cover the entire cycle of the S&T process. They concern a wide range of issues, including creating a basis for scientific and technological development, S&T promotion, disseminating and commercializing research outcomes, and preventing adverse effects from science and technology. The content of the Basic Acts has evolved in response to changes in the political, economic, and social environment of Korean industry during the past five decades.

  • 정부 부처별로 제각각 시행되어온 국가연구개발사업들을 종합적으로 운영할 수 있는 법적 근거를 마련한다는 취지하에 (가칭)국가연구개발특별법의 제정이 최근 논의되고 있다. 본 논문은 이와 유사한 목적으로 2001년에 제정된 과학기술기본법의 입법 과정을 분석한다. 특히 제정 이전에 제안됐던 다양한 법안들이 경쟁하는 과정에서 주요 쟁점은 무엇이었으며, 반대로 논쟁없이 수용된 요소는 무엇이었는지를 주목함으로써, 본 논문은 다음과 같은 두 가지 주장을 제시할 것이다. 첫째, 각 부처별 국가연구개발사업들의 역사를 고려할 때, 범부처적으로 적용될 수 있는 단일 규정을 마련하고자 하는 시도는 자칫 정반대의 결과를 낳을 수 있다. 둘째, 과학기술기본법의 제정은 비록 범부처적 관리 규정의 마련으로 이어지지 못했지만, 제정 과정에서 논쟁없이 도입된 "국가경쟁력(national competitiveness)"과 "국가혁신체제(national innovation system)"라는 개념은 국가연구개발사업들에 어떤 일관적인 방향성을 부여하고 있다. 과학기술기본법의 입법 사례는 (가칭)국가연구개발특별법의 입법을 둘러싸고 진행 중인 현재의 논의들이 앞으로 어떻게 전개될지를 어렴풋하게나마 가늠하고, 더 나아가 우리가 간과했던 논점이 무엇이었는지를 성찰할 수 있는 창이 될 것이다.

과학기술기본법의 체계성 및 정합성 제고를 위한 개정방안 (A Study on the Improvement of Systemicity and Compatibility in The Framework Act On Science And Technology)

  • 최근 과학기술의 사회적 역할이 증대되는 한편 창조경제의 실현 등 혁신주도형 과학기술정책으로의 패러다임 전환에 효율적으로 대응하기 위해서는 과학기술 관련 법제들의 체계적인 정비가 필요하다. 특히, 과학기술기본법은 국가과학기술정책 추진에 관한 기본규범이자 총괄규범으로서 이와 같은 시대 및 환경의 변화에 맞도록 그 체계와 내용을 발전적으로 재정비할 필요가 있다. 현행 과학기술기본법은 2001년 1월 제정된 이후 수차례에 걸쳐 개정되어 현재에 이르고 있다. 그러나 그동안의 개정은 정부조직개편 및 과학기술정책 심의조정기구의 운영체계변화 등에 따른 것이 중심이 되었으며, 변화된 환경 및 시대적 요구에 따른 정책사항들을 종합적으로 반영하는 데는 미흡하였다. 이에 본 연구에서는 현행 과학기술기본법이 시대와 환경의 변화에 적합한 정책총괄규범으로서 역할과 기능을 수행하도록 하기 위하여 필요한 개정 방안을 검토 제시하였다. 연구 결과 현행 과학기술기본법은 법체계적인 측면에서 기본법으로서의 위상에 걸맞도록 장 절 체계를 확대 재정비하고, 규율내용적인 측면에서는 규범내용의 포괄성, 규범집행의 실효성, 총괄규범으로서 개별법령과의 연계성 및 기본법으로서의 정합성이 확보되도록 관련 규정을 신설하거나 보강하는 것이 필요한 것으로 분석되었다.

Korea's Science and Technology Manpower Policy: Focusing on the Special Act on Support for Scientists and Engineers and its Action Plans

  • This paper dealt with the Korean manpower policy in science and technology, focusing on the contents and tools of the Special Act and its Master Plans. After briefly introducing the historical development of the Korean manpower policy from the 1960s to the present, it discussed and analyzed the Special Act and Plans from the framework of personnel development, distribution, utilization and infrastructure. Korea's science and technology manpower policy has focused on fostering and supplying manpower in line with the country's industrial growth strategy. In the early stage of industrial development during the 1960s and 1980s, government research institutes were direct and effective tools for nurturing S&T manpower. Since the 1990s, the importance of university research has increased. The government fostered graduate research manpower through the research-oriented university policy of the BK21 program. After the IMF financial crisis in 1997, the tendency of students to avoid careers in science and technology led to enacting the Special Act (2004) governing the field of S&T human resources. The Special Act has contributed to leveling up the university education system in science and engineering and sophisticated the policy to include entrepreneurship training, spin-off startups, industry-university cooperation, and offering degree programs. The Special Act and the regularly revised Master Plans have been essential tools in systematically managing the science and technology manpower policies of the Korean government.

Reconsideration of the Public Diplomacy Act in Korea and a Few Suggestions

  • The Korean government has recently invigorated the activities of public diplomacy. It is based on the Public Diplomacy Act enacted in 2016. However, there is a widespread concern that it was belatedly enacted and showed necessity to a revision. We believe that this paper contains three contributions which were not sufficiently addressed before. First, we identify the current state of public diplomacy-related legislation in Korea. Second, we argue the necessity to critically review the legal adequacy of Public Diplomacy Act with a consideration of rapidly changing external environment. Lastly, we propose several ways of revision for the future development of public diplomacy in Korea. When revising the Act, it is necessary to make clear a legal connection between the general law and the special law as in the case of the Korea Foundation Act and the Public Diplomacy Act. In this regard, it is worth examining the relationship between the Framework Act on International Development Cooperation and related norms. In addition, the role of the private sector and subnational governments should be expanded. For this purpose, a method and level of cooperation with the private sector should be clearly defined.

BandBlock: Bandwidth allocation in blockchain-empowered UAV-based heterogeneous networks

  • The 5G mobile network is promising to handle the dynamic traffic demands of user equipment (UE). Unmanned aerial vehicles (UAVs) equipped with wireless transceivers can act as flying base stations in heterogeneous networks to ensure the quality of service of UE. However, it is challenging to efficiently allocate limited bandwidth to UE due to dynamic traffic demands and low network coverage. In this study, a blockchain-enabled bandwidth allocation framework is proposed for secure bandwidth trading. Furthermore, the proposed framework is based on the Cournot oligopoly game theoretical model to provide the optimal solution; that is, bandwidth is allocated to different UE based on the available bandwidth at UAV-assisted-based stations (UBSs) with optimal profit. The Cournot oligopoly game is performed between UBSs and cellular base stations (CBSs). Utility functions for both UBSs and CBSs are introduced on the basis of the available bandwidth, total demand of CSBs, and cost of providing cellular services. The proposed framework prevents security attacks and maximizes the utility functions of UBSs and CBSs.

ISO 45001과 중대재해처벌법상 안전보건관리체계에 대한 비교 연구 (A Comparative Study ISO 45001 and the Safety and Health Management System under the Serious Accident Punishment Act)

  • Objectives: OHSMS, which was introduced by Serious Accident Punishment Act as a means for safety and health management at work place, but it is not effective according to recent statistical data. Therefore, I intend to compare the OHSMS regulations of SAPA based on ISO 45001, the international standard of OHSMS, and examine the differences and problems. Methods: The OHSMS regulation of Serious Accident Punishment Act was compared and analyzed using the content standard of ISO 45001, the international standard of OHSMS. The construction and operation aspects and differences in key concept definitions of OHSMS were analyzed in depth. Results: ISO 45001 aims to provide OHSMS with an autonomous framework to manage risks and opportunities in safety and health management, whereas Serious Accident Punishment Act aims for safety and health management through an interest and effort in safety and health management on the premise of legal responsibilities of corporations and CEO. As a result, comparing to ISO 45001 in construction and operation aspects and differences in key concept definitions of OHSMS, the OHSMS of Serious Accident Punishment Act do not cover the entire business in concept definition and construction. Conclusions: In order for Serious Accident Punishment Act to achieve its original purpose of preventing serious accidents through systemic safety and health management, it is necessary to correctly understand the contents of ISO 45001 and to revise the OHSMS regulations in a direction that can ensure predictability and feasibility.

Electrochemical Characterization of Nanosized Electrode Arrays Prepared from Nanoporous Self-Assembled Monolayers

  • We characterized nanoelectrode arrays prepared from self-assembled monolayers (SAMs) by adsorption from a solution containing thiolated $\beta$-cyclodextrin ($\beta$-CD) and n-alkanethiol on the gold electrode surface, using electrochemical methods. While the framework, the n-hexadecanethiol SAM, effectively blocked electron transfer between the electrode surface and solution-phase redox probe molecules, the $\beta$-CD cavities isolated in the forests of n-hexadecanethiol molecules were shown to act as an ultramicroelectrode array. The shapes of cyclic voltammograms of probe molecules were related to the number densities of $\beta$-CD molecules within the monolayer films. Probe molecules that have the correct combination of physical and chemical characteristics were shown to effectively penetrate the framework through the $\beta$-CD pores and exchange electrons with the electrode surface.
