행정대집행은 행정의 강제집행수단의 하나로 행정법상의 의무를 이행하지 않은 자를 대신하여 행정관청이나 제3자가 대행하고 소요비용을 의무자에게 청구하는 제도로 "강제대집행"이라고도 한다. 법에 의한 행정집행의 현장임에도 불구하고 물리력에 의한 강제집행이 시행됨으로 인하여 시행자와 의무자 사이에 온갖 폭력과 인권유린 행위가 난무하고 인적피해가 발생하여 사회문제화 되고 있으며, 경찰에 고발과 인권위원회에 진정하는 등의 경우가 점차 증가세에 있다. 이런 폭력의 현장에 동원되는 인원은 대부분 용역을 제공하는 민간경비업체가 공급하고 있으며, 경비원 자격이 없는 인원의 동원과 폭력조직과 연계된 소위 용역깡패의 무리한 대집행과 폭력행위가 문제 되고 있다. 이런 폭력의 현장에는 경제적 이권과 주거권, 생계형 투쟁, 외부의 개입 등 구조적으로 복잡한 문제가 내포되어 있다. 본 논문은 민간경비업체의 인원동원에 관심을 가지고 대집행 현장의 폭력의 유형과 폭력이 발생하는 원인을 분석하고 개선대책을 논의하였다. 그 결과로는 법과 제도적 개선으로 대집행의 현장에는 필히 시행청과 경찰관이 입회하여 민간경비업체의 물리적 집행이 합법적으로 이행되도록 통제하여야 하며, 폭력적 충돌양상이 발생하면 즉시 경찰이 개입하도록 명시하여야 한다. 시행청의 대집행에 대한 관행을 탈피하여 신중한 대집행 결정과 성과위주의 용역계약조건의 해소, 문제발생시 시행청의 책임 명시 등 수주과정에서의 폭력유발 요인을 제거해야 한다. 의무자의 집단행동을 통한 민원해결의 타성을 타파하고 공무집행의 방해나 대집행 비용의 청구 등 엄격한 법집행이 이루어져야하고, 제3자의 개입을 차단하여야 한다. 경비업체의 인원동원은 경비업법에 의한 자격과 교육을 이수한 인원으로 사전에 등록된 인원으로 제한하여야하며, 현장투입 전 관할 경찰관서에 근무지와 임무, 근무수칙 등을 명확히 기록한 집행계획서를 제출하도록 의무화하고, 복장, 장비 등 법규를 준수하도록 통제되어야 한다. 또한 폭력행위에 대한 개인의 형사적 책임을 명확히 하고, 사고 경력에 대한 수주의 제한 등 업체의 건전성 확보대책이 요구된다. 재활사업이란 명목의 특수단체의 수주행위가 근절되고, 도급과 하도급의 고리를 차단하여 능력과 법의 준수의지를 가진 업체가 수주하도록 해야 한다. 등이다. 주거권과 환경 등 사회문제, 생계, 보상 등의 개선대책 문제는 논외로 하였다.

Recently, business process management has become an important concept to define and execute business process. During the execution of the collaborative business processes defined by the consensus with manufacturing enterprises, a lot of variations can be occurred by various internal and external factors related to business. From this reason, manufacturing enterprises have tried to seek for a technology to define and execute the collaborative business process systematically under the dynamic situations approving process variation. This study defines the collaborative business process among manufacturing enterprises at first and proposes its execution technology under the dynamic situations. Here, the proposed execution technology includes the authority management of each process, sub-process, and activity for security, the forced execution of the incomplete process containing the undefined sub-process, the re-execution in a certain range of business process for correcting errors, and the dynamic selection of sub-process. Furthermore, this study implements a prototype system to check the validity of its application under the dynamic situations.

Objective : The purpose of this study was to investigate the protective effects of Cheongsimondam-tang(COT) on the animal model of depression induced immobilization stress. Method 1) Male rats were used for this experiment. The subject were divided into 4 groups(1. normal 2. saline solution administered during immobilization stress treatment 3. COT of 100mg/kg administered 4. COT of 400mg/kg administered). 2) Immobilization stress was treated for 1 hours on day. During 2 days of immobilization stress treatment, they were executed forced swimming test, passive avoidance test, elevated plus maze test. Corticosterone in blood were measured Results 1) In EPM test, stress group showed significantly increased anxiety, COT groups showed significantly decreased anxiety. 2) In forced swimming test, COT groups did not show significantly decreased immobilization. 3) In passive avoidance test, stress group showed significantly decreased learning execution, COT groups showed significantly increased learning execution. 4) Stress group showed significantly increase in serum level of corticosterone, COT of 400mg/kg group showed significantly decreased serum level of corticosterone. Conclusion : These results suggest that Cheongsimondam-tang(COT) is effective in the treatment of depression.

Method: The subject were divided into 4 groups(l. normal 2. saline solution administered during immobilization stress treatment 3. SJH of 100mg/kg administered 4. BKJ of 400mg/kg administered). Immobilization stress was treated for 1 hours on day. During 2 days of immobilization stress treatment, they were executed forced swimming test, passive avoidance test, elevated plus maze test. Corticosterone and ACTH in blood were measured. Results: In forced swimming test, SJH of 400mg/kg group showed decreased immobilization. In passive avoidance test, SJH of 400mg/kg group showed increased learning execution. In EPM test, SJH of 400mg/kg group showed decreased anxiety. In locomotor activity test, SJH groups showed significantly increased locomotor activity. Stress group showed significantly increase in serum level of corticosterone, SJH of 400mg/kg group showed decreased serum level of corticosterone. Stress group showed significantly increase in serum level of ACTH, SJH of 400mg/kg group showed decreased serum level of ACTH. Conclusion: These results suggest that Sam-Jeong-Hwan(SJH) is effective in the treatment of depression.

Gaines depicts the process of transformation of a black young who accepts his execution with dignity in A Lesson Before Dying. There two personas of the protagonist, Jefferson, appear in this novel. The former seen in the black and white community is the persona of falsehood and submission, and the latter appeared in the black community is the true persona. The former, the pig persona in black-and-white community is created, forced onto them by whites and the human persona in the black community is made by their own standards without being forced. Jefferson has been depersonalized by his pig persona. He implements their false persona by mimicking pigs to confront its reality. And then he retrospects the pleasure of relationship throughout his own life. Grant's expensive gift, the radio, becomes a trigger to realize the significance of his existence and the social solidarity. Moreover, many black visitors look at him with expectant eyes of fulfilling their historical burden. After all, Jefferson is executed as a human being with dignity, and the transformation of Jefferson from a pig to a human is getting rid of the white values and standing on the black values. In other words, it is the procedure of creating the new myth out of the false myth, from meaningless life to meaningful death.

The "arbitration" system resolves disputes through judgments on rights relations or claims between disputed parties by judging by private trial, but it does not have organizational and material bases to execute the contents of these judgments. Therefore, unless the parties succeed in voluntarily surrendering to the results of the arbitration award, the implementation of the award will be accomplished by the enforcement of the assistance of the National Court. However, unlike the court's ruling, the arbitration tribunal does not generate enforcement power from the judgment itself, and it must be filed with the court for execution. In this regard, Germany provides for arbitration proceedings in the Civil Procedure Act Volume 10. In particular, Article 1060 governs the approval and enforcement of domestic arbitral awards. Accordingly, the procedure for declaring the feasibility of domestic arbitration proceedings and the execution of forced execution are commenced. Regarding the enforceable declaration of a domestic arbitral award, it differs from the simpler process requirements compared to the procedure in a foreign arbitral award, and usually has the same effect as a final judgment between the parties without a separate approval procedure. However, the arbitration award does not constitute an enforceable power that can be implemented, but is enforced through the national court's declaration procedure. However, if there is a ground for cancellation as provided for in Article 1059 (2) of the German Civil Procedure Act, the arbitral award is canceled and the application for enforcement is dismissed.

The Tuned Pendulum Slab Damper(TPSD)system is mainly composed of suspended pendulum slab which was hanging with cable wire from the top floor of building without any extra loads structurally, and can be helpful to reduce vibration with effect of tuned mass damper function by the principle of pendulum movement. The experiment was performed with miniatures of the 30stories of steel structure building by the forced vibration test using shaking table, and the result was reduced about 42% of vibration. The purpose of this study was to make analysis of application of the TPSD system to new building and exist building against strong wind or seismic wave. The result of this study was that the TPSD system shall be satisfactory in field of execution, process control, safety and economical efficiency with saving up to 70% of construction cost.

본 논문은 커패시터와 에너지 하베스터의 특성이 적용된 최적의 실시간 스케줄링 알고리즘인 ED-H 알고리즘을 적용할 때 적용되는 지능형 전원 관리 유닛에 의한 의도적인 전원 공급 차단 상태인 블랙아웃에서 시간 제약성을 만족하도록 알고리즘을 확장한다. 전원 공급 시스템에서 생산되는 에너지가 충분하지 않은 경우 회로와 커패시터를 보호하기 위해 전력 공급을 일시적으로 차단하고 커패시터가 충분히 충전되었을 때 다시 공급을 재개하므로 이러한 블랙아윳 시간 동안 태스크의 수행이 지연될 수 있으므로 해당 이벤트의 발생에 따른 시간을 계산하였다. 이러한 문제점을 극복하기 위해 원형 ED-H 알고리즘에 의해 태스크 수행이 지연되는 경우라 하더라도 본 논문에서 제안된 알고리즘은 뒤에 이어지는 시간 유닛 중에서 더 이상 태스크의 수행을 지연시킬 여력이 없는 경우, 즉 태스크를 이번 시간 유닛에 수행하지 않으면 시간 제약성을 위배하게 되는 경우의 잔여 시간을 계산하여 잔여 시간이 부족한 경우 시간 제약성을 만족하도록 강제로 스케줄링한다. 시뮬레이션을 통해 본 눈문에서 제안한 알고리즘이 ED-H 알고리즘에 대해 태스크 집합의 유형 특성에 따라 0.4%~7.7%까지 스케줄링 성능이 높은 것을 확인하였다.

This paper is written following an analysis of occurrence trend of industrial disaster in manufacturing industry. One of major reason of industrial accident is unsafe action caused by lack of work supervision. so we have surveyed the understanding level of supervisors for industrial safety and their education of industrial safety which is forced by industrial law. We have got the result that the supervisor's education is necessary to prevent industrial disaster but it's not fit for their own workplace for various reasons from the survey and analysis. I would like to suggest effective solutions. The institute of education should train that they can execute safety and health works themselves by classification of the industrial category, company scale and located region. Also, government should endow supervisors with authority and responsibility for the activation of education system. Finally, government should support the expense of education to medium and small-sized enterprises especially, and they should be interested in the attendance and execution of education. They will achieve the goal to prevent industrial disasters in manufacturing industry through the enforcement of effective supervisor system as per the remark mentioned above.
