The meaning of Good faith is honest intent to act without taking an unfair advantage over another person or to fulfill a promise to act, even when some legal technicality is not fulfilled. The term is applied to all kinds of transactions. According to the CISG only regulated Art. 7. that is in the interpretation of this Convention, regard is to be had to its international character and to the need to promote uniformity in its application and the observance of good faith in international trade (1) and questions concerning matters governed by this Convention which are not expressly settled in it are to be settled in conformity with the general principles on which it is based or, in the absence of such principles, in conformity with the law applicable by virtue of the rules of private international law (2). In the other hand PICC is related to the good faith and fair dealing, each party must act in accordance with good faith and fair dealing in international trade (1) and the parties may not exclude or limit this duty (2). Good faith of PECL is these principles should be interpreted and developed in accordance with their purposes. In particular, regard should be had to the need to promote good faith and fair dealing, certainty in contractual relationships and uniformity of application. Further more regarding to the good faith and fair dealing, same to the PICC regulations.
It is fair to say that there are many ethical issues concerning the publication of medical papers. To define the best practice in the ethics of scientific publishing and a proper understanding of appropriate reporting in medical papers, this review should be useful for authors dealing with ethical issues which involve the protection of human and animal rights, the protection of confidentiality and informed consent, fabrication, falsification, plagiarism, author and authorship, copy right transfer, duplicate publication, conflict of interest, and dealing with misconduct cases.
본고(本稿)에서 필자(筆者)는 우리나라의 가전유통시장(家電流通市場)의 현황 정리 및 분석을 통하여 가전유통시장에 존재하는 문제점(問題點)을 파악하고 후생증진(厚生增進)을 기할 수 있는 정책대안을 찾아보고자 하였다. 본고(本稿)에서 밝혀진 주요내용은 다음과 같다. 가전유통시장(家電流通市場)이 가지고 있는 가장 큰 문제점은 가전(家電) 3사(社)에 의한 배타적(排他的) 대리점제(代理店制)이다. 가전(家電) 3사(社)의 배타적(排他的) 대리점제(代理店制)는 제조단계(製造段階)의 경쟁을 제한하고 제조단계에의 진입(進入)을 봉쇄(封鎖)하는 진입장벽이 되고 있을 뿐 아니라 중소기업(中小企業)의 성장과 전문화를 저해하고 있으며, 가전(家電) 양판점(量販店)의 성장을 가로막는 요인이 되고 있다. 따라서 가전(家電) 3사(社)의 배타적 거래는 공정거래법(公正去來法)의 '부당한 구속조건부 거래'에 해당하며 이에 대한 공정거래규제(公正去來規制)가 필요하다. 효과적인 규제를 위해서 공정거래위원회(公正去來委員會)는 차별적 대우 등 암묵적인 배타적 거래의 유지수단에 조사의 초점을 맞추어야 할 것이며, 손해배상제도(損害賠償制度)의 적극적 이용을 유도하는 것이 필요하다고 판단된다.
Purpose - The purpose of this paper is to discuss success factors behind ATO distribution channels by examining successful partnerships between producers and alternative trading organizations (ATOs). Research design, data, and methodology - This is a case study, an analytical approach, which illustrates how the partnership between producers and ATOs has strengthened the fair trade and the performance of participants in the trade based on the example of the trading relationship between Beautiful Coffee, an alternative trading organization dealing coffee related products, and the coffee cooperative union (CCU), a coffee producing cooperative in Gulmi, Nepal. Results - Beautiful Coffee in the partnership with HELVETAS empowered small coffee farmers by a successful institutionalization of CCU that consolidated the distribution channel to be more efficient. Also, Beautiful Coffee and its partnership with KOICA have tried to increase productivity and quality of coffee beans. Conclusions - The case of Beautiful Coffee demonstrates that the partnership between producers and alternative trading organizations (ATOs) has benefited the fair trade partners. In other words, Beautiful Coffee's partnerships with a NGO working in the local producing area, HELVETAS, and a government aid agency, KOICA could strengthen the relationship between the producers and the ATO, and thus contributes to the whole distribution channel.
방송시장에서 지상파 재전송 제도의 개선과 PAR 등의 도입이 거론되는 이유는 방송 콘텐츠가 주요 경쟁수단으로 인식되고 있기 때문이다. 특히 유료방송시장에서 SO와 PP의 전략적 제휴는 경쟁 사업자에 대한 콘텐츠의 배타적 거래로 이어져 상대 사업자의 정상적인 경쟁을 저해하고 시청자의 접근권을 제한하는 결과를 초래하고 있다. 이로 인해 방송시장에도 필수설비 이론이 도입되어야 한다는 주장이 제기되고 있으며, IPTV법의 콘텐츠동등접근조항과 방송법상 금지행위 도입도 이와 같은 맥락에서 이해될 수 있다. 그러나 방송 시장에 대한 필수설비 이론의 적용은 일반 설비와 콘텐츠가 기반하는 철학적 경제적 법체계적 차이로 인해 부작용을 초래할 것으로 예상된다. 따라서 필수설비의 개념과 필수설비의 거래거절에 대한 기본적인 개념과 이것이 경쟁 시장에서 구현되는 구체적인 심결례 및 판례를 검토하는 기초작업이 필요한 시점이다. 본 연구는 이러한 검토를 통해 방송 콘텐츠에 필수설비 이론의 적용이 타당한 것인지 사전적인 제언을 하는데 그 목적이 있다.
본 연구는 정책평가방법에 따라 표시 광고규제의 정책성과에 대한 평가결과를 비교분석하였다. 이를 위해 우리나라 표시 광고규제의 주요정책인 중요정보고시제도, 표시광고실증제도, 임시중지명령제도, 정정광고제도를 평가대상으로 선정하였다. 그리고 소비자 관점의 전문가와 기업의 표시 광고업무 실무자, 공정거래위원회에서 소비자정책을 담당하는 전 현직 공무원 등 총 76명을 직접 방문하여 구조화된 설문지와 병행하여 면접법으로 자료를 수집하였다. 본 연구의 결과 정책성과에 대한 평가방법에 따라 기업의 표시 광고업무 실무자들과 정책담당자들의 정책별 평가순위에 소폭의 변동이 있었으며, 기존의 일반적인 단순평가 결과는 '문항의 중요도'를 반영한 가중평가와 '판단에 대한 확신성'을 고려한 퍼지평가에 비해 상향된 평가점수가 산출되었다. 이는 정책성과 평가에 있어 어떠한 평가방법을 사용하는가에 따라 평가결과가 다르게 나타날 수 있음을 시사한다.
The Uniform Commercial Code (UCC) sets the standards of good faith in a commercial transaction for the sale of goods. With every sales contract, there is an implied obligation for both the seller and the buyer to negotiate the contract and perform under the terms of the contract in good faith. The agreement between both parties and the customs in the industry determine how the good faith standard should be applied to a particular transaction. Generally, the meaning of good faith, though always based on honesty, may vary depending on the specific context in which it is used. A person is said to buy in good faith when he or she holds an honest belief in his or her right or title to the property and has no knowledge or reason to know of any defect in the title. In section 1-201 of the UCC good faith is defined generally as "honesty in fact in the conduct or transaction concerned." Article 2 of the UCC says "good faith in the case of a merchant means honesty in fact and the observance of reasonable commercial standards of fair dealing in the trade." The sales contract will generally determine which party is required to perform first. This provision helps to determine if the buyer or the seller is in breach of the agreement due to failing to perform as stated by the contract. Either the seller must deliver the items before the buyer is required to accept and pay or the buyer must pay for the items before the seller has the duty to act in good faith and deliver the items in a reasonable manner. If the contract does not specifically define who is required to perform, industry customs and fair trade may determine what is acceptable for the transaction. Under the UCC, the buyer is required to pay for the goods when they are delivered, unless the contract states otherwise. Therefore, the UCC imposes an obligation of good faith on the performance of every contract or duty under its purview. The law also generally requires good faith of fiduciaries and agents acting on behalf of their principals. This article discusses problems of the principles of good faith under the UCC. Specifically, this paper focuses on the interpretation of UCC sections and analysis of various cases. By comparing, also, UCC and Korean law, the paper proposes some implications of good faith issues for Korean law.
The purpose of this study was to examine the needs of high school students on foodservice. A survey from 8 high school foodservice operations in Seoul was undertaken and detailed information was collected from 538 high school students. Completed questionnaires were received from 3 self-operated and 5 contracted school foodservice operations. Statistical analyses were performed by SPSS including descriptive analysis and t-test. The 49.8% of the respondent students were male and 50.2% female. The whole students assessed the importance and performance of school foodservice as 4.18 and 2.83 out of 5 respectively, which suggests that the school foodservice needs to be improved. The Importance-Performance Analysis(IPA) used for obtaining information on high school foodservice management suggested that foodservice attributes with fair to poor performance but with high importance were sanitation of food, service of foodservice personnel, dealing with complaints and the reflection of students'opinion in menu.
최근 들어 고유가 상황이 지속되면서 정부는 연일 유가 안정 대책을 내놓고 있다. 특히 공정거래위원회는 혼합판매 허용을 골자로 하는 거래기준을 제시하였다. 본 연구는 혼합판매 도입과 활성화를 위한 정책적 방안을 제시하는 데 목적이 있다. 이를 위해 혼합판매와 관련된 국내 제도의 변천 과정을 기술한다. 또한 혼합판매 현황과 혼합판매 활성화를 위해 검토되어야 할 주요 사항들에 대해서도 논의한다. 혼합판매도입과 활성화를 위해서는 공급자별 구분저장 요건과 전량구매조건의 완화 내지 폐지가 선결될 필요가 있다. 이들 방안은 정유사 단계의 공급가격과 주유소 단계의 소비자가격 인하를 유도할 수 있는 긍정적인 효과를 발생시킬 수 있다. 또한 현행 법률 개정이 수반되어야 한다는 현실적인 제약을 고려할 때 중장기적으로 시장에서 대형마트 주유소, 독립형 자가폴, 프랜차이즈 독립폴 주유소를 육성하는 방안을 동시에 검토할 필요가 있다.
본시험은 공정거래를 기할 수 있도록 진섬유량으로부터 생사의 거래중량을 산정할 수 있는 정량거래방법 을 구명하기 위한한 연구로서 다음과 같은 결과를 얻었다. 1. 거래중량인 정량은 원량에서 연감후무수량을 감한 연감수분량의 원량에 대한 백분률인 연감수분률로 부터 산정하면 생사의 진섬유량을 잘 나타낼 수 있고 재현성이 있어 현행검사보다 합리적이다. 2. 연감수분률로부터 정량을 산정함에 있어서 연감후무수량에 대한 공정가산률은 44%로 함이 적당하다고 판단된다. 3. 섬도검사 잔사인 섬도사의 연감률과 하구의 연감률을 대표할 수 있을 것으로 생각되는 시료사(24타래) 의 연감률 사이에 통계적인 유의차가 없었으므로 섬도사의 연감률은 하구의 연감률을 대표할 수 있다. 4. 우리나라는 연감수분율검사에 의한 정량검사를 실시하면 약 2억원의 이득을 얻을 수 있다.
