The Powers and Interim Measures of the Arbitral Tribunal in International Commercial Arbitration (국제상사중재에서 중재판정부의 권한과 임시적 처분에 관한 연구)

  • This paper is to research the powers and interim measures of the arbitral tribunal in the arbitral proceedings of the international commercial arbitration under arbitration legislation and arbitration rules including the UNCITRAL Model Law and Arbitration Rules. The powers of the arbitral tribunal may be found within the arbitration agreement or any arbitration rules chosen by the parties, or the chosen procedural law. The power of the arbitral tribunal to decide its own jurisdiction is one of the fundamental principles of international commercial arbitration. It is a power which is now found in nearly all modern arbitration and rules of arbitration. Where an arbitral tribunal has been appointed then it will usually have the power to proceed with the arbitration in the event that a party fails to appear. It cannot force a party to attend but it may sanction the failure. While the arbitral tribunal can direct the parties to attend and give evidence the arbitral tribunal has no power to compel a party to give evidence. The arbitral tribunal may continue the arbitration in the absence of the party or its failure to submit evidence and make an award on the evidence before it. Under most of arbitration legislation and arbitration rules, the arbitral tribunal has the power to appoint experts and obtain expert evidence. The power to order a party to disclose documents in its possession is a power given to the arbitral tribunal by many national laws and by most arbitration rules. The arbitral tribunal cannot, however, compel disclosure and in the case where a party refuses to disclosure documents then the sanctions that the arbitral tribunal can impose must be ascertained from the applicable rules or the relevant procedural law. A number of arbitration rules and national laws allow for the arbitral tribunal to correct errors within the award. Most of arbitration legislation and arbitration rules permit the arbitral tribunal to grant orders for interim measure of protection. Article 17(1) of the Revised UNCITRAL Model Law of 2006 states: Unless otherwise agreed by the parties, the arbitral tribunal may, at the request of a party, grant interim measures. Interim measures of protection usually take such forms as (1) conservatory measures intended to prevent irreparable damage and maintain the status quo; (2) conservatory measures intended to preserve evidence or assets. Orders for interim measures by the arbitral tribunal are not self-enforcing. However, the arbitral tribunal must have the powers necessary to make interim measures effective. The Article 17 B of the Revised UNCITRAL Model Law of 2006 provides applications for preliminary orders and conditions for granting preliminary orders. And the Article 17 H provides recognition of enforcement of interim measures. In conclusion, the revised articles with regard to interim measures of the UNCITRAL Model Law of 2006 would contribute significantly to the security of the effectiveness of interim measures in international commercial arbitration. Therefore, Korean Arbitration Law and Arbitration Rules would be desirable to admit such revised articles with regard interim measures.

An Analysis on the Factors Affecting on the Procedures of Becoming a Scientist (과학자들의 진로선택과정에서 나타난 부각요인)

  • This study investigated the factors affecting the procedures of becoming a scientist. Interview was used as a research method for deep understanding of individual career choice procedures. Interviews for individual scientists were conducted for about 60 minutes in their offices and all the interviews were tape-recorded. A total of 34 scientists who received some representative science awards in Korea during 1990 - 2001 were sampled. They were all men. But the interview was conducted with 30 scientists. The investigation was based on the framework that was composed of the following four categories: personal ability, home environment, school environment, and sociocultural environment. And each category had several factors as follows: personal ability consisted of the meta-ability to figure out the aptitude and the self-ability and the achievement; home environment consisted of parents, brothers and sisters, relatives, and hobby; school environment consisted of teachers, friends, club activity; sociocultural environment consisted of event, mass media, social recognition and social prospect. From the analysis of the career choice procedure of the scientists it was appeared that the meta-ability for personal ability, the parental influence particularly by father for home environment, science teacher and professor for school environment, and social prospect for sociocultural environment were important. In conclusion, most of the scientists made an important decision for their future career when they were the 12th grade and 1st year in university, and they considered intrinsic factor such as self-interest and aptitude and extrinsic factor such as social prospect. However intrinsic factor related to science teacher and professor and extrinsic factor related to fathers' advice.

Government-funded Projects' Effects in Revitalizing the Urban Commercial District for Small and Medium Retail Merchants (도심지 상업지역의 정부 지원사업 효과 분석)

  • Purpose - This study reviews the achievements of a pilot project for the revitalization of a commercial district performed for three years after its establishment in 2011. The project for the revitalization of the commercial district was performed to create a new local community space in connection with the traditional market and nearby districts. Although it was a pilot project, the project for the revitalization of the commercial district has been performed for almost three years. Therefore, this seems a proper time to conduct an interim evaluation of the project. This study aims to review and evaluate how the government support policy is influential for the revitalization of the commercial district. In other words, this research aims to identify what projects positively affected consumers' intention to revisit the downtown commercial area among the commercial district revitalization projects-promotion events, promotion activities, education, merchants cooperation system, IT projects, cultural events, and residents' communication. Research design, data, and methodology - This study designated seven management improvement projects affecting commercial district revitalization based on preceding studies. The survey of the degree of satisfaction on seven management improvement projects was executed targeting consumers who visited the commercial areas. Additionally, visitors' revisit intentions regarding currently visited commercial areas were also investigated. Therefore, revisit intention was set as a dependent variable and the satisfaction degrees of the respective management improvement projects were set as the independent variables. A total of 1,209 consumers were examined in six districts in the country. Result - Multiple regression analysis results showed that cultural events, education, the merchants' cooperation system, and IT projects brought statistically significant effects to the revisit intentions of consumers. In contrast, promotion events, resident communication projects, and promotion activities did not affect the revisit intentions of consumers. Particularly, the residents' communication project did not show significant influence because of consumers' recognition that it is similar to a cultural event. Conclusion - The following implications for the revitalization of business districts in the urban central area are drawn. From a general perspective, the businesses of culture, education, and cooperative system among seven businesses play positive roles regarding the intention to revisit so that the project is required to be promoted periodically through unique performances differentiated for each district, the merchant training reinforced for professionalism, and the expansion of joint events of merchants. Moreover, the sales promotion project and public relations activity are shown to be not influential to the intention to revisit. Therefore, while short-term sales promotion such as one-time gift events are required, sales promotion and public relation activities to induce revisits by mileage savings and accumulated gift presentation to attract long-term customers are required. The IT business is positively influential to the intention of revisit. Therefore, detailed information on the revitalized commercial district should be provided and additional functions such as discount coupons for continuous utilization should be included in the mobile app and the website.

Developing Maker Competency Model and Exploring Maker Education Plan in the Field of Elementary and Secondary Education (메이커 역량 모델 개발 및 초·중등 교육 현장에서의 메이커 교육 방안 탐색)

  • In this study, we extracted the core competencies of makers through the analysis of critical incident technique and behavioral event interview to explore the nature and attributes of maker education, and then we developed a maker competency model based on these core competencies. As a result, six competency groups and 23 sub-competencies were extracted. In other words, we were able to confirm the existence of integrated thinking competency group consisting of four competencies made up of 'analytic thinking', 'intuitive thinking', 'visual thinking', and 'empirical thinking' and that of collaborative competency group with four competencies of 'sharing', 'communication', 'conflict management', and 'scrupulosity'. In addition, we could also confirm the existence of making mind competency group, which is composed of four competencies namely 'interest in various areas', 'challenge consciousness', 'failure management', and 'pleasure of the making process'. We could also confirm that human-centered competence group consisting of two competencies of 'humanity' and 'user-oriented' and the problem-finding competence group consisting of two competencies of 'observation' and 'recognition of discomfort in daily life'. Lastly, the making practice competency group is composed of seven competencies: 'understanding making tool', 'understanding electricity', 'understanding programming', 'planning', 'hand knowledge', 'information search', and 'direct execution'. We discussed educational implications of these findings.

A study on the improvement plan of fire simulation training for the improvement of fire response ability : Focusing on the fire simulation training of business facility (화재대응능력 향상을 위한 화재모의훈련의 개선방안에 관한 연구 : 업무시설의 화재모의훈련 중심으로)

  • In this study, in order to propose an improvement plan for fire simulation training to improve fire response capability, fire simulation training is conducted for three business facilities, and changes according to whether training materials are used and whether the response time for each response stage is reflected in the training evaluation. The response posture and response ability of the training participants were observed and analyzed. As a result of the analysis, it was analyzed that most of the training participants improved their participation in training, response posture, and response ability when the use of training textbooks and response time for each response stage were reflected in the training evaluation. In the event of a fire simulation training, a number of training materials that can similarly implement the fire situation are used to improve and maintain the fire response capabilities (fire notification and fire report, initial extinguishing, and evacuation) of the training participants, and the target time for each response step. The result was that it can be used as a useful index for improving fire response capability and improving fire simulation training in the future and feedback only when quantitative training evaluation is conducted based on this setting.

A Study on the Recognition of Swimsuit Brand Image Using IPA Technique (IPA기법을 활용한 수영복 브랜드이미지에 대한 인식연구)

  • The purpose of this study is to present the ranking and difference of the importance and satisfaction of the swimsuit brand image that the swimsuit consumers perceive through the IPA and to provide the implications for the activation of the swimsuit industry market by diagramming it with the IPA matrix. To do this, we analyzed 298 questionnaire data for university students and graduate students and the following conclusions were drawn through the ranking of importance, satisfaction, and the corresponding sample t-test and IPA matrix. First, as a result of examining the ranking through the average of the importance and satisfaction of the swimsuit brand image, the importance showed average 4.0 or more in order of 'quality', 'functionality', 'price', 'design', 'trust', 'color', and the satisfaction showed average 3.5 or more in order of 'trust', 'quality', 'functionality' and 'awareness'. Second, as a result of difference verification in swimsuit brand image, it showed a significant difference in order of 'quality', 'price', 'functionality', 'design', 'color', 'trust', 'sophistication'. On the other hand, it showed no significant difference of cognitive images. Third, as a result of IPA of swimsuit brand image, the factors of 'design', 'functional', 'quality' and 'trust' were included in I quadrant, 'price' 'color' in II quadrant, 'advertising image', 'event', 'popularity', 'originality' in III quadrant, and 'awareness', 'sophistication' in IV quadrant.

Velocity-based decision of water quality measurement locations for the identification of water quality problems in water supply systems (상수도시스템 수질사고 인지를 위한 유속기반 수질계측기 위치 결정)

  • Recently, water pollution accidents have continued to occur in pipelines such as red water Incheon and Seoul. In order to recognize this water quality problem, it is necessary to install a water quality sensor in an appropriate location and measure it in advance to detect or block the water supply to the water faucet of the shelter. However, there are limitations, such as maintenance costs, to installing multiple water meters in all pipelines. Therefore, this study proposed a methodology for determining and prioritizing the installation location of flow-based water quality sensor for the recognition of water quality problems in pipelines. We applied the proposed procedure to the pipe break scenario. The results of the determination of the location of the water quality sensor were presented by applying it to the pipe network that actually operates the emergency pipe in Korea. The result of the decision showed that in the event of abnormal situation caused by the destruction of individual pipes, the flow rate of the pipes around the aqueduct and the tank may change rapidly, resulting in water quality accidents caused by turbidity. In the future, it is expected that the water quality monitoring point selection method, such as establishing an external pipe operation plan for pipe cleaning, will utilize the procedure for determining the location of the water quality sensor according to the velocity.

Librarians' Intention and Behaviors for Providing Podcasts and YouTube Services: An Application of Extended Technology Acceptance Model (도서관 팟캐스트와 유튜브 서비스에 대한 사서의 제공 의도와 제공 행위 연구 - 확장된 기술수용모델의 적용 -)

  • This study investigated the perceptions of librarians about Podcast and YouTube services in libraries. The study was designed by applying the Extended Technology Acceptance Model. Librarian's personal, organizational, and social awareness of library Podcast or YouTube services and the degree of understanding of users and their needs on services were mediated by perceived usefulness or ease of services= and influenced to having intentions and providing the services. First, we investigated the types of Podcast and YouTueb services provided by 39 libraries in Korea. Also, we collected data using an online survey method from 181 librarians and conducted hierarchical multiple regression analysis. Findings showed that libraries are using Podcast and YouTube appropriately considering features and functions of media, mainly for library event information/promotion, library programs, book recommendations, and author (librarian) lectures or interviews. Organizational or social awareness of librarians, i.e., library educational support, human resource supports, librarian recognition, job-related features, and understanding of user perceptions and needs, influenced the intention to provide library services. Also, there was a difference in perceived usefulness and ease of services between librarians who provided Podcast and YouTube services and those who did not. We expect that findings could be used as references to understand and support various aspects of librarians in charge of developing and providing Podcast or YouTube services in libraries.

A Review of the Legal Responsibility of Dog Owners regarding Dog Bite Accidents - Focused on a Comparison with American Dog Bite Legislation - (개물림 사고에 대한 소유자의 법적 책임에 관한 소고 - 미국의 개물림 법제와의 비교를 중심으로 -)

  • In South Korea, the number of households that rear companion animal has been gradually increasing. With the rise of household dogs, the frequency of humans that are being bitten by another's dog has also increased. This type of accident, which is known as a dog bite accident throughout the United States. It can cause significant physical and emotional damage to the victims and may result in grave injuries or death. Dog bite accidents are serious public health problems and can cause immeasurable hidden costs to the community. South Korea has enacted several laws to address dog bite accidents, which include the Animal Protection Act, the Civil Act, and the Criminal Act. On March 20, 2018, the Animal Protection Act was amended to reinforce the current legislation. These amendments addressed the duty of care owed by a companion dog owner to society members and the punishment that an owner of a fierce dog would face in the event of a dog bite accident. Conversely, several states in the United States have enacted a single law that regulates the details regarding dog bite accidents, such as the type of dog or animal, the type of damage, the scope of compensation for damages, and the scope of recognition of liabilities. This paper is intended to review the present situation of dog bite legislation in several states in the United States, which have a variety of laws that address dog bite accidents, and compare them with current South Korean dog bite legislation. Through this research, this paper will discuss what issues may exist in South Korean's current dog bite laws, analyze the responsibility of companion dog owners, and provide solutions to any issues that are discovered.

A Study on the Cognizance of Hospital and oriental Hospital Workers for Medical Device Safety Information Monitoring (의료기기 안전성 정보 모니터링에 대한 한병병원 및 병원 종사자의 인지도 조사연구)

  • Purpose: The purpose of this study is to find out the cognizance of medical device safety information (MDSI) monitoring in the hospital and oriental hospital workers, and the different aspect of MDSI between oriental medical devices and medical devices. Methods: The survey was performed both in the oriental medicine hospital and general hospital. The survey had 16 items; 2 items basic questions, 5 items in the awareness of MDSI, 5 items in the education of MDSI, 4 items in the necessity of defining oriental medical devices and differences between general and oriental medical devices. A total of 120 hospital worker were participated; 60 oriental medicine hospital workers and 60 general hospital workers. They had worked in the oriental medicine or general hospital associated with 'Medical Device Safety Monitoring Center, Dongguk University Ilsan Hospital' in 2019 and 2020. Results: The cognizance of MDSI was high both in oriental medicine hospital and general hospital workers and there were no significant differences between oriental medicine and general hospital workers. When we divided the hospital workers into the senior workers who had worked for over 3 years and junior workers for less than 3 years, the senior workers had higher awareness of MDSI than junior workers. However, the cognizance of education of MDSI was high which was not different between senior and junior workers. Both hospital workers thought that it was necessary to define oriental medicine device legally and the oriental medical device might have low risk and less side effect than medical device. Conclusion: The cognizance of MDSI was high and there was no significant differences between oriental medicine and general hospital workers. Because the senior hospital workers had higher recognition of MDSI, we need to provide the continuous education program for junior hospital workers. Although oriental medical device are thought to be safer than medical device, we need to have a legal definition.
