Issue Analysis on 'Trade Secret Claim' in 「Chemicals Control Act」 and 「Amendment on Occupational Safety and Health Act(1917-227)」 (「화학물질관리법」과 「산업안전보건법」의 영업비밀 사전 허가 제도 도입과 관련한 쟁점 분석)

  • Objectives: The major objectives of this study are to review the issues surrounding trade secret claims in the Chemicals Control Act and Amendment on Occupational Safety and Health Act(1917-227) and to propose a way of improving the reliability of chemical information in MSDSs, labels and National Chemical Survey results. Materials: To review the issues on trade secret claims, we made an analysis frame which was divided into three steps: Value and Problem Recognition; New Regulation Design; and Enforcement and Amendment. We then compared Korean issues with issues from the United States' Hazard Communication Standard and Emergency Planning & Community Right-to-Know Act, Canada's Workplace Hazardous Materials Information System and Hazardous Materials Information Review Act and the European Union's Regulation on Classification, Labelling and Packaging of substances and Mixtures. Results: The stage of right-to-know development in Korea has passed the Value and Problem Recognition phase, so efforts are needed to elaborately design new regulation. Conclusions: We recommend two ways to improve right-to-know in Korea. First, strict examination of the quality of documents for trade secret claims is very important. Second, trade secrets should be limited to less-hazardous substances.

Characteristics of Heavy Metal Emissions from Stationary Sources (고정오염원에서의 중금속 배출특성 연구)

  • The results of HAPs emission data using TRI (Toxic Release Inventory), SODAM (Source Data Management system) were investigated and the emissions of 7 heavy metals from their sources and emission processes were also analyzed. Questionnaire for source data analysis as well as the stack sampling were carried out for 17 factories among 6 selected industrial types. The annual amount of emissions was estimated based on the measured concentration and flow rates. All sources were operated with high efficiency control devices and the concentration levels of all heavy metals were shown to be below 0.1 to of regulation standard. The highest emission source of heavy metals was steel manufacturing industry with the annual emission of 342.9 kg/yr and followed by hazardous waste incinerator, paint manufacturing, nonferrous metal manufacturing, rolling & press goods manufacturing and storage battery manufacturing. In the case of Hg, the emissions were quite significant from electric acros of steel manufacturing industry, although the concentration level was below the emission standard, showing the necessity of specific care for its management.

A brief review on the standards of regulations and compensation in the environmental noise and vibration disputes resolution (환경소음.진동 피해 분쟁 조정을 위한 기준설정에 관한 소고)

  • The standards of acceptable limit and compensation is one of the most important things in environmental noise and vibration disputes resolution. In this paper, review on the present acceptable limit level and compensation standard in National Environmental Dispute Resolution Commission is introduced. Discordance of standards between in the regulation law and in the dispute resolution commission and it's improvement are discussed. Abnormal reasoning for compensation standards is pointed out from a author's private view.

Case Analysis on High Concentration of SO2 and Review on Its Reduction Policy in the Ulsan Metropolitan Area since 2001 (울산 지역에서 2001년 이후 이산화황(SO2)의 고농도 사례 분석과 저감 정책 방안의 검토)

  • Until comparatively lately, the annual time series of the $SO_2$ concentration had been shown in a decreasing trend in Ulsan as well as other Korean cities. However, the high concentration of $SO_2$ was frequently found in the specific countermeasure region including the national industrial complex such as Mipo and Onsan in the Ulsan city for the period of $2001{\sim}2004$. There are many conditions that can influence the high concentration of $SO_2$ at monitoring sites in Ulsan, such as: First, annual usage of the fuel including sulfur increased in comparison with the year before in spite of the fuel conversion policy which wants to use low sulfur oil less than 3% and LNG. Second, point source, such as the power plants and the petroleum and chemistry stacks, was the biggest contributor in $SO_2$ emission, as a analyzed result of both the air quality modeling and the stack tole-monitoring system (TMS) data. And third, the air pollutants that occurred in processes of homing and manufacturing of the fuel including sulfur were transported slow into a special monitoring site by accumulating along the frontal area of see-breeze. It was concluded that Ulsan's current environmental policy together with control methods should be changed into the regulation on total amount of emission, including a market-based emission trading with calculating of atmospheric environmental critical loads, for the $SO_2$ reduction like the specific countermeasure for the $O_3$ and PM10 reduction in the Seoul metropolitan area. And this change should be started in the big point sources of $1{\sim}3$ species because they are big contributors of Ulsan's $SO_2$ pollution. Especially it is necessary to revitalize of the self-regulation environmental management. Other control methods for sustaining the $SO_2$ reduction are as follows: maintenance of the fuel conversion policy, reinforcement of the regional stationary source emission standard, and enlargement of the stack TMS.

  • Objectives: Among the regulations that have recently attracted a lot of social attention in Regulation on Occupational Safety and Health Standards, we would like to specifically present the reasons why even companies with strong will to comply with regulations that are not effective or entail a number of legal problems, and suggest ways to improve them. Methods: The facts were confirmed and identified through various methods such as interviews and meetings with labor inspectors who enforce the Regulation on Occupational Safety and Health Standards and safety officials at industrial sites experiencing them. Results: Due to the lack of effectiveness in Regulation on Occupational Safety and Health Standards, there are not a few areas that do not function properly as a preventive standard. Although operating the regulatory nature of punishment as an administrative guideline without basing it on Regulation on Occupational Safety and Health Standards is a direct violation of the principles of the administration of the rule of law, there are many expedient ways to replace what should be placed in this rule as just an administrative guideline. Conclusions: It should be prioritized to explicitly stipulate effective regulations within the Regulation on Occupational Safety and Health Standards. In addition, as regulations on occupational safety and health standards play a large part in preventing industrial accidents, comprehensive and practical measures are indispensable rather than fragmented and formal measures to ensure that these rules function properly in the prevention industrial accidents.

Study on the methods of risk assessment of human exposure by using of PVC flooring (PVC 바닥재 인체 노출에 따른 위해성 평가 연구)

  • In advanced countries, a variety of consumer exposure assessment models including CONSEXPO, are developed to manage risks of consumer products containing hazardous materials. The models are used to assess the risks of exposure to hazardous chemicals in consumer products, which serves as a foundation for regulation standards. In this study, exposure assessment models applicable for various scenarios were reviewed and a proper model was applied for the selected products and risk assessment was conducted at each stage to establish a risk assessment procedure for different types of products. Based on the exposure scenario, exposure factor was selected and according to the algorithm produced based on CONSEXPO exposure model, some level of phthalates were detected from some types of PVC flooring. However, a correlation between phthalate content and migration rate showed r-square 0.0065, little correlation, which is inadequate for estimating standard value. For this reason, it seems valid that the current standard be in place. Additionally, any new standard was not suggested as VOCs were not found harmful to human health, allowing the existing standard to be continuously applied. No migration rate was found for heavy metals and risk assessment was not performed accordingly. In this aspect, it is presumed that hazards to health through dermal exposure would be very little.

Comparison of compost product quality with nature soil standard (국내생산퇴비의 부숙토 기준에 대한 적합성 검토)

  • As construction and expansion of wastewater treatment works is continuing, generation of sludge is increasing. Bur most sludge is not used appropriately but disposed by landfill dumping to sea. Furthermore direct landfilling of sludge cake containing moisture content over 75% has been legally prohibited since 2001 that's enforcement will be more strict in 2003. Such a situation means nowadays recycling of organic waste such as sludge and food waste is necessary. Composting is one of recycling methods commonly and used as an effective means of stabilizing organic waste and then compost can be used as fertilizer. However fertilizer law management which include standard of compost products and other fertilizers applied all sludge products indiscriminiately and was not flexible. So MOE has graded organic composts according to land applications to improve recycle of organic wastes. The classified organic compost which contains low contaminants has been possible to use as various purpose. This study enalyzed 30 samples which were raw materials for compost and compost products management well and to estimate the quality of compost products. Heavy metals were measured in Raw materials and OM/N, NaCl and VS were tested in compost products as well as heavy metals. As a result, approximate 10% of raw materials was not suitable to the grade A and 6.7% over the grade B of the regulation on raw materials for compost. In the case of 30 produced compost propducts approximate, 57% of composts was not compatible with the grade A and B of the regulation on composting product. The qualities of compost products were worse than raw materials, because the compost products have more regulation item raw materials have.

Actual Condition and Reliability Monitoring of Material Safety Data Sheets for the Organic Solvents (일부 유기용제의 물질안전보건자료의 실태와 신뢰성 조사)

  • The regulation of Material safety data sheets(MSDS) was required for the chemicals in use in the workplace from July 1976. Under the provisions of the workplace hazardous materials information system, employers in Korea must be provided with accurate and comprehensive MSDS. To examine the reliability of MSDS for organic solvents, 63 organic solvents and MSDS were collected from the workplace of 39 companies located in Kyonggi province. Manufacture\`s MSDS were compared with the actual composition of the collected samples, and further examined the reliability by checking whether the chemicals analyzed were included in the MSDS correctly. 38 solvents were able to analyze their composition by gas chromatography-mass selective detector(GC-MSD). Among them, 28 solvents were incorrect in their composition and contents. In some case, health hazardous or carcinogenic chemicals which were not included in the MSDS were detected from samples. As a result of evaluating whether the MSDS correspond to the regulation required by Industrial Safety and Health Act (ISHA), the information in the MSDS including hazard classification, occupational exposure level, toxicity, regulatory information were incorrectly provided, and some MSDS did not disclose carcinogenic in their MSDS, and some MSDS were not written in the standard format. From this survey, continuous monitoring and promoting correct MSDS, and analyzing the components of the solvents were required to endure the reliability of MSDS for organic solvents.

The Study on the Enzyme Activities in Korean Bee Honey (한국산 벌꿀의 효소활성에 관한 연구)

  • This report is intended to describe as brief as possible the result of study on purity of the Korean Bee Honey. Purity of bee honey was measured by scaling the enzyme activities of two different honey groups: such as, the standard group and control group each including the samples of honey originated from the resource of acarcia, chestnut or miscellaneous origin. The samples of honey were collected from different sources: to wit, honey belonging to the standard group were collected from the township of Seoboo, Yangju county, Kyunggido province, Korea, while honey belonging to the control group were collected from the street side shops, market or the companies producing the secondary food from honey. The results of this study were summarized as follow: 1. It was found that honey belonging to the standard group contained less moisture than those belonging to the control group. Republic of Korea Ministry of Health and Social Affairs Food Control Regulation stipulates that honey must contain moisture less than 20%. The samples of' both groups contained moisture more than 20%, although honey belonging to the control group were relatively more so than honey belonging to the standard group. 2. Honey belonging to the standard group were found stronger in sugar reduction activities than those belonging to the control group. It was also noted that honey of acracia origin was strongest in reduction activities of the three different origin in the same group. 3. $\alpha$-Amylase and $\beta$-amylase were discovered to have activated more strongly in honey belonging to the standard group than those belonging to the control group. The enzyme activitie, varied depending on the origin of plant where honey comes from. For instance, honey of miscellaneous origin indicated the strongest activities in $\alpha$-amylase while honey of chestnut origirt indicated strongest in $\beta$-amylase.

Role and Contaminant Selection Methods of Soil Quality Standards in Developed Countries (선진국 토양오염 기준의 역할과 기준항목 설정방법)

  • Many countries have recently established legal regulations and soil quality standards for soil protection, This study investigated the role of soil quality standards in soil protection policy and methods of selecting standard substances from various types of chemicals. In most countries, soil quality standards act as guidance for further detail surveyor risk assessment from comparing soil concentration with the soil quality standards. Soil quality standards of Switzerland, Demark and Japan were used as enforcement tools. Priority substances for the standards were first selected from frequently detected chemicals in contaminated sites. Those substances were extensively evaluated for toxic effects, exposure potential and availability in chemical analysis.
