A Study on the Pre-printed Clause of the Bill of Lading (선하증권 인쇄약관에 관한 연구)

  • UCP600 Article 20 (a) (v) states that contents of terms and conditions of carriage will not be examined and Article 34 states that a bank assumes no liability or responsibility for the general or particular conditions stipulated in a document. From this perspective, banks may seem to have no obligation to examine the pre-printed clause of B/L. However, ICC decided that no opinion could be given in relation to the issues surrounding B/Ls that contain delivery clauses. Accordingly, it is agreed by previous cases and some scholars that banks may refuse the B/Ls that contain delivery clauses which are not present in other B/Ls of the same goods and transport routes. Also, ICC published ICC Decision in July 2010 regarding on board notation. In this decision, if a B/L indicates a place of receipt that is different from the port of loading and there is an indication of a means of pre-carriage, then a dated on board notation will be required indicating the name of the vessel and the port of loading. Therefore, banks may,, in some cases, need to scrutinize the pre-printed clauses especially appearing in the front page of B/Ls.

  • As a special topic of the vehicle routing problems (VRP), VRPSDP extends the vehicle routing problem as considering simultaneous pickup and delivery for goods. The past studies have mainly dealt with a only weight constraint of a loading capacity for heterogeneous products. However. this study suggests VRPSDP considering separate loading area according to characteristics of loading species. The objective is to design a set of minimum distance routes for the vehicle routing assignment with independent capacity for heterogeneous species. And then we present a another HVRPSDP model which is easy to utilizes in a unique circumstance that is a guarantee of executing a task simultaneously from the various areas under restricted time and raising an application of vehicles that returns at the depot for the next mission like the military group. The optimal results of the suggested mathematical models are solved by the ILOG CPLEX software ver. 12.4 that is provided by IBM company.

Market goods substitution of housework and the determinants on it in the domain of food: Focused on the married female home-based workers (기혼여성 재택근무자의 식생활영역에서 가사노농 상품대체와 그 영향요인에 관한 연구)

  • The purpose of this study was to describe the levels of market goods substitution of housework and find out the determinants on it in the domain of food among married female home-based workers. The data were collected from 169 married female home-based workers in Pusan and Kyungnam province, by self-administered questionnaires. Frequencies, percentiles, Cronbach's alpha, Pearson's correlations, and multiple regression were used to analyze the data. In the convenience foods, frozen foods had the highest substitution level, whereas prepared stew had the lowest. The substitution level of Korean traditional storage foods was the middle. And in dining-out service, the substitution level was mostly high: the level of delivery service was higher than that of dining-out. Compared to the previous research, these results showed that market goods substitution tended to increase, and its level in the domain of food will promote continually over time. The variables affecting the substitution level of convenience food were the number of family members, occupation, the existence of elderly/disabled person in the family, sex-role attitude, and weekly hours at home-based work. The substitution level of Korean traditional storage foods was influenced by sex-role attitude, occupation, education, monthly household income, and the existence of elderly/disabled person in the family. The significant variables affecting the substitution level of dining-out service were weekly hours at home-based work, the number of family members, occupation, monthly household income, education, and sex-role attitude.

  • Through an examination and analysis of straight bills of lading and sea waybills in the context of English, U.S.A and Korean law, and relevant international conventions on maritime transport, the following results were obtained: Prior to the enactment of U.K.'s the Carriage of Goods by Sea Act in 1992, straight bills of lading had functional differences between countries. However, after the enactment of this law, negotiable bills of lading obtained the same legal status and functionality in both Korea and the United States, as well as in the UK. As for sea waybills, all three countries treated them with the same contractual and legal status. In other words, they serve as receipts for the transported goods and act as evidence of the maritime transportation contract. Nevertheless, they are non-negotiable, and the delivery of goods can be made to the consignee or their agent based on their identity. However, the transfer of ownership rights over the goods or acquisition of legal rights against the carrier cannot be achieved through the transfer or endorsement of Sea Waybills.

  • Unlike continental European legal systems (civil law systems), specific performance in common law refers to an equitable remedy requiring exactly the performance that was specified in a contract. It usually granted only when money damages would be an inadequate remedy and the subject matter of the contract is unique. Thus, under common law specific performance was not a remedy, with the rights of a litigant being limited to the collection of damages. Consistent with the practice in civil law jurisdictions, United Nations Convention on Contracts for the International Sale of Goods (CISG) makes specific performance the normal remedy for breach of a contract for the sale of goods. Therefore, the buyer may require a breaching seller to deliver substitute goods or to make any reasonable repair. Likewise, the sellermay require the buyer to taker delivery of goods and pay for them. Despite this, Article 28 of the CISG restricts the availability of specific performance where it would be unavailable under the domestic law of the jurisdiction in which the court is located. Thus, the CISG's more liberal policy toward specific performance is restricted by common law. There are some legal issues in CISG's specific performance availability by Article 28. This paper analyzes these issues as interpreting Article 28 of CISG, by examining various theories of application to actions for specific performance and comparing CLOUT cases involving CISG Article 28.

  • Import Agency Service Mall, which provide customers not only with convenient shopping experiences but also with purchasing, warehousing, shipping, and customs clearance services, have been playing a significant role in rapidly transforming Korean consumers into global consumers. The consumers' great demand for foreign goods(services) created Import Agency Service Mall(referred to hereafter as IASM) as a new business model of distribution and consumption, which seems to grow rapidly. Accordingly, this study examined the e-Trust by analyzing the characteristics of IASM, determinants of trust, risk perception and its association with e-Trust in IASM, and finally applying the result to general internet shopping mall(referred to hereafter as GISM). The following results came out from the analysis: First, from the result of checking these two types of internet shopping mall consumers have different determinants of trust. Second, from the question if two types perceive different risk, purchasing the foreign goods, it came out that they showed critical difference in variable relevant to goods delivery and customer service. IASM perceived risk from those two variables more than GISM Third, from the review of the relationships between determinants of trust and risk perception variables, IASM showed interrelation among all the variables except between customer service and perceived risk. Fourth, the researcher examined how the risk perceived in the course of purchasing goods has an effect on consumers e-Trust. In case of IASM, risk perception relevant to customer service had an effect on consumer e-Trust. To the contrary, incase of GISM, risk perception didn't have any effect on e-Trust. Finally, from the review of interrelation between determinants of trust and consumer e-Trust, it came out that for IASM capability had an effect on consumer e-Trust and for GISM consumer service had an effect on consumer e-Trust.

  • The purpose of this paper is to clarify the distribution system and the spatial characteristics of sales for the internet shopping mall on the basis of its off-line presence. The distribution system of this internet shopping mall is divided into the goods selection process and the product delivery process to consumers according to the function and role of the distribution center which is performed by cooperative companies. The internet shopping mall uses a different distribution system from the off-line department store, outsourcing the delivery process to door-to-door delivery companies in order to reduce costs and to increase the speed of delivery. Sales in the internet shopping mall are concentrated in the delivery unit area where the main office is located. Accordingly, in the case of the internet shopping mall based on an off-line presence, the mail-order business does not fully overcome the limitations arising from space. Also, the main factors influencing the value of sales, according to the area, are the number of women aged 20 to 49 and the distances involved.

  • This study aims to explore the characteristics of platform for social service delivery and the electronic voucher system as an instrument for the delivery. The paper discusses the concept and characteristics of platform and reviews the factors by which firms migrate to platform. Social service e-vouchers are an example of a government platform that pays e-vouchers to consumers and gives them the choice of services. Then it analyzes the case of platform establishment to deliver social services. The demand on welfare services has changed with demographic structure. The change in demand requires innovation in the social service delivery system and adoption of strategies to move to the platform. Factors that enabled the social service delivery platform to build both demand and supply sides include access to employment policies, industrial connection, workforce training, and requirements for social service eligibilities.

Trade Practice of Surrender Bill of Lading and Prevention of Its Disputes (권리포기 선화증권의 실무관행과 분쟁예방)

  • Two solution approaches have been suggested globally to solve the crisis of bill of lading; that is to say, electronic bill of lading and sea waybill. Electronic bill of lading is not unsettled as a solution to solve the crisis of bill of lading but sea waybill is used on a global basis to do so. The surrendered bill of lading is applied for practical usage instead of sea waybill in a short voyage among Korea, China, and Japan, owing to faster delivery at destination and lower cost than bill of lading. To surrender the original bill of lading, the consignor should submit all originals with a request letter to the carrier of goods with necessary surrender charges, if any, in doing so. Once after receiving the original bills of lading consisting of normally three originals but in some cases five, the carrier stamped "Surrendered" on the front of original bills of lading and sent a message to his counterpart at the port of destination, stating that the original bill of lading surrendered at the port of shipment and the consignee can take delivery of the goods without production of the original bill of lading at destination. The legal regime of the surrendered bill of lading is not settled as it is not considered legally as bill of lading, and the decisions rendered by each nation's courts are different according to the usages of the surrendered bill of lading. The purpose of this paper is to prevent the disputes between parties with regard to the surrendered bill of lading by studying the causes and precautions of disputes in relation to the surrendered bill of lading.

  • Mobility is an essential human need. Human survival and societal interaction depend on the ability to move people and goods. Efficient mobility systems are essential facilitators of economic development. Cities could not exist and global trade could not occur without systems to transport people and goods cheaply and efficiently. Rail has been considered as one of the important components of the transportation infrastructure required to service and improve the performance and productivity of an economy. In Nigeria, the rail infrastructure built by the colonial master several decades ago has been left in a state of total deterioration. This long neglect was occasioned by the failure of the government to pay adequate attention to infrastructure development. There is a vital and urgent need for rail infrastructure development in Nigeria. This study presents a systematic review of the evolution of rail, the current nature of railway infrastructure delivery in Nigeria, and offers possible suggestions on how to achieve an effective and sustainable rail infrastructure delivery in Nigeria. A thorough literature search of academic databases was conducted on current research trends on the subject of railway infrastructure by systematically reviewing selected published articles from reputable research domains. The analysis of the selected articles revealed the following among others (1) the existing railway infrastructure is in a state of mess and not sustainable, and (2), Government's investment/commitment in rail infrastructure seems inadequate compared to what is obtainable in other developed countries. Rail infrastructure development cannot be left to the Federal government of Nigeria to solve on its own; collaboration and participation are required. Government as a matter of priority should devote considerable attention to the development of rail infrastructure to harness the economic potential and transformation that sustainable rail infrastructural projects will provide.
