A Study on Improvement of the investigation procedure for the National Security Violators - Focused on the Rights to Counsel - (안보사범에 대한 수사절차 개선방안 검토 - 피의자 신문시 변호인 참여권 문제를 중심으로 -)

  • Right to counsel means a defendant has a right to have the assistance of counsel (i.e., lawyers), and if the defendant cannot afford a lawyer, requires that the government appoint one or pay the defendant's legal expenses. The right to counsel is generally regarded as a constituent of the right to a fair trial. Historically, however, not all countries have always recognized the right to counsel. The right is often included in criminal law and constitutional law etc. First, any person who is arrested or detained shall have the right to prompt assistance of counsel. When a criminal defendant is unable to secure counsel by his own efforts, the State shall assign counsel for the defendant as prescribed by act in article 12(4) of the constitutional law. Second, the defense counsel or a person who desires to be a defense counsel may have an interview with the defendant or the suspect who is placed under physical restraint, deliver or receive any documents or things and have any doctor examine and treat the defendant or the suspect in article 34 of the criminal law. Nonetheless, problems about guarantee of the rights to counsel to the national security violators like spy terrorist and etc will be important for Koreans to consider. That is because national security violators's cases are qualitatively different from general criminal offense's cases and historically, lawyer obstruct a investigation in the process of examination of a suspect for national security violators. Therefore, this study suggest a way that a restriction the rights to counsel with an attorney in cases of the national security violators. To this end, in this paper, I touch on restriction of right to counsel during interrogation in the England and Germany etc in comparison to that of Korea and review Korea's Supreme Court decision and Constitution Court decision to understand the prospective and trends for Korean investigation procedure improvement.

  • This study aims to investigate the actual conditions of housing consumer problems through analyzing the counseling cases of Consumer Union of Korea at Jeonnam Province. During 5 years between 1998 and 2002, about 500 counseling cases of every year were analyzed for this study. Housing consumer counseling cases were categorized by 5. And five years' transition of housing counseling problems was analyzed by 5 categories. The reason of a call for consumer counsel and the result of counsel were analyzed by time serial. This study suggested some ideas for a resolution of housing consumer problems.

  • In the course of insurance claim administration, medical experts' opinions are called medical claim reviews. They are classified into two main categories: medical verification and counsel for claim staff. Medical verification compare between product coverage and the insured's physical condition. Medical counsel for claim staff is advice for claim staff when they have a question about medical knowledge to make a claim decision. A common example of medical verification is insurance coding of pituitary apoplexy. Some clinicians have insisted that the ICD coding of pituitary apoplexy is l63 of cerebral infarction, but the exclusion criteria of I code show that neoplasm is coded as C00 to D48. Thus, pituitary apoplexy must be coded as D33. An example of medical counsel for claim staff is interpretation of some medical conditions. It is divided into UCR(usual, customary, and reasonable) assessment, assessment of causality, and so on. Disability evaluation is another subject of medical counsel for claim staff. The final claim decision must be made by claim staff because only the claim staff have the authority of claim decision. Medical claims review is only an expert's opinion.

This system built of administrator module and user module. And also this system designed that help effectively counsel guidance through several leacher's experience who has counsel guidance. User module is adjust io teachers example, so we can user counsel specifics search, input, PDS. And administrator module offer function that counsel guidance data manager and member manager. After this system apply to leachers who is at the front. And I make an analyze effect and present result.

  • According to the statistics, Korea is expected to reach a super-aged society in 2025. In preparation for an aging society, The government is making efforts to improve in social activity and welfare for the elderly people. But in case of people who live in urban-rural mixed cities, They can not benefit from traffic convenience that is essential in social activities. For example, surveys and interviews show that, The dwellers(65+ of some urban-rural mixed cities) have many restrictions on social activities because of mobility disadvantage. Therefore, We propose that expansion for the people who need to use the voucher taxi, Increase of the public bus service and rebuilding of the bus stop terminal. We are looking forward to this study will be used as basic data for transportation policy of urban-rural mixed cities across the country.

  • The Judgement on a certain maritime accident accompany with punishment or recommendation to the examinee who was connected with that accident. It also gives quite a consequence to the Civil Trial relating with the maritime accident. In the Maritime Safety Tribunal System, the examinees can get assistance from Maritime Counselor. As it requires a lot of costs, it should be limited by economic condition of the examinees. In this Paper, with the consideration of the several kinds of Free Counsel System, Free Counsel System for Maritime Safety Tribunal was studied. The proposals are as follows; 1. To introduce the Mandatory Counselling and Court-designated Counselor System. The costs to be paid by government. 2. The same as above but the counselor to be designated among the staffs of the maritime organizations, then the costs to be paid by the organization which they belonged. 3. To establish Maritime Safety Tribunal Association which performs Monetary Assistance same as Korean Legal Aid Corporation.

Level of Nutrition Knowledge, Diet Practice and Education Demands in Dialysis Patients with Chronic Renal Failure (투석치료 중인 만성신부전 환자의 영양지식 수준과 식사요법 실천 정도 및 교육요구도)

  • The number of patients is increasing and their mean age is also increasing. Proper dietary adjustments are necessary to prevent protein-calorie malnutrition or complications but it is difficult for dialysis patients to adapt to diet therapy due to stress or anorexia. Education does not consider the individual characteristics, knowledge, dietary inhabit education demands, and initial education. The purpose of this study was to identify dialysis patient's nutrition knowledge and, dietary practice and compare those with nutrition education or counseling demands for providing basic data of desirable nutrition management. The data were collected by a survey consisting of the general characteristics, disease related characteristics, nutrition education and counsel characteristics, level of nutrition knowledge, diet therapy, and nutrition education and counsel demands from the 28th March to 22th July 2017. The total number of subjects were 33 patients among dialysis patients at two tertiary medical institutions and an artificial kidney room at a private hospital in Incheon Gyeonggi. The data collected were analyzed statistically using the SPSS program 23.0, followed by further analyses using frequency analysis, one-way ANOVA, cross analysis, and correlation analysis. The results of the dialysis patients showed that younger (P<0.05), female (P<0.05), abnormal high school diploma (P<0.001) groups had high nutrition scores. In addition, dietary practice and nutrition education and counsel demands showed a positive correlation (P<0.05, P<0.01). In particular, females were higher than males in nutrition knowledge, dietary practice, nutrition education, and counseling demand scores.

Survey Analysis of Guardians' Understanding on The Antibiotic use for Their Children Under Elementary School Age (초등학생 이하 자녀의 항생제 복용에 대한 보호자 인식조사)

  • The objective of this study was to find out guardians' understanding on the antibiotic use for their children under elementary school age. Survey analysis was performed on 671 questionnaire response sheets from the guardians for children ($\leq$13 years old) attending daycare centers, kindergartens, or elementary schools located in eastern part and vicinity of Seoul, Korea. Result showed that majority of the guardians did not follow right direction for the use of antibiotic medications. About 80% of the guardians discontinued or reduced dosage of the antibiotic medications if symptoms relieved, and about 66% of them administered the drug always after meal although interval was not consistent. Furthermore, only one-fifth of the guardians understood right indication of antibiotic medications that it is of no use to take antibiotics for the treatment of common cold. About 65% of the guardians participated in this study responded that they received drug information for antibiotic medications from doctors or pharmacists. However, in terms of knowledge score regarding antibiotic drug use, their score was significantly lower than that of guardians who received the information from internet or mass media. This result suggests that patients counsel is not efficiently being practiced among healthcare professionals in the region surveyed in this study. Therefore, in conclusion, it appears that community pharmacists need to be more interactive in patients counsel when they dispense antibiotic medications.
