A Longitudinal Study on the Changes to Copyright Policies for Korean KCI Journals (국내 학술지 저작권 정책 변화 의미 분석)

  • This study analyzed changes to copyright policies in KCI journals comparatively using the previous 2 research results published in 2008 and 2016 and then gave insight into the meaning of the changes. The results of the study are as follows: Journals making the subject of copyright public had increased from 34% in 2008 to 67% in 2016. Journals transferring copyright from authors remained almost the same, with only a slight increase from 90% to 91% in the same period. Journals using the term 'publication rights' instead of 'copyright' had decreased; on the other hand, journals using the term 'reproduction right' and 'right of transmission' had increased. Use of copyright transfer agreement had increased from 25% to 50%; on the other hand, self archiving policy remained almost the same, decreasing slightly from 13% to 12%. This study argues that these changes mean the establishment of copyright industrialization for Korean journals and that the publishing bodies appear to be the most powerful main agent among stakeholders participating in scholarly publishing in this process.

  • The role of digital content identification system is being considered as a useful solution for the content management system and service system. Integrated Copyright Number(ICN), only one domestic identifier to the managing of copyright, can provide the service model in the copyright industry, because it include the information of copyright between the creator and the service provider on the digital work. Universal Content Identifier(UCI), has developed on the focus of digital content service, is somewhat lacking on the copyright management, but it is expected that systematical management and distribution system for copyright and digital work to be able to build as that make up for disadvantage with each identifier's advantage by UCI associate with ICN. In this context, This article can suggest the efficiency integrated structure and the service scenario. Therefore it is contribute to the efficient using and the effective running in the digital identification system.

  • In this digital environment, license contracting and technical protection measure are being used by copyright holders as a means to restrict the rights of information users. The study reviewed the conflicting relationship between the copyright law and the contract law for digital resources the use of which is based on license contracting, and investigated the legal interpretations of the conflicting relationship between the two. And then based on the analysis of IF LA's position on copyright in the digital environment, the study suggested the expected role of librarians to cope with the technological overrides of copyright rules and to expand the rights of information users.

  • This paper provides a comprehensive analysis of the implications of the metaverse on the music industry, focusing on copyright issues and potential solutions. It delves into the concept and characteristics of metaverse platforms, describing them as environments that immerse users in a variety of virtual experiences. A significant portion of the paper is dedicated to exploring music use and copyright infringement in the metaverse. It examines how users incorporate existing music into their content, often leading to legal challenges due to copyright infringement. The paper discusses the role of online service providers (OSPs) in this context and the legal implications of their actions. The paper also addresses the 'safe harbor' provisions for OSPs and examines the balance between protecting rights holders and limiting OSP liability. It highlights the challenges and limitations of copyright enforcement in the metaverse, especially given the unique nature of content on platforms such as Roblox. Finally, the article proposes solutions to simplify music licensing in the metaverse, suggesting a shift from property rules to liability rules and the establishment of Collective Management Organizations (CMOs) to streamline the licensing process and better protect copyright holders' interests.

The Intertemporal Enforcement Strategies of Copyright Protection : An Analysis of Information Goods in the Presence of File-Sharing Networks

  • The paper analyzes a copyright owning firm's incentive to enforce its copyright in the presence of file-sharing networks. I devise a two-period model where a copyright owner sells two different versions of a creator's information good, and show that the firm's overall profits are enhanced by a strategy of differential inter-temporal enforcement of the copyright protection, compared to strategies of no enforcement or full enforcement in both periods. If the firm enforces no copyright protection in the first period, the low-valuation consumers may make and consume copies that are imperfect substitutes for the original information good. If there is a significant increase in the willingness-to-pay of some low-valuation consumers after they experience the information good, the firm can extract the increased consumer surplus by enforcing a positive level of copyright protection in the second period. Social welfare, however, is maximized in the case of no enforcement.

A theoretical review on the limitations of applying copyright law in the arts (예술창작에서 저작권법 적용의 한계에 대한 이론적 고찰)

  • Copyright law has functioned to certify the authorship and artistic identity of an artist as well as to remunerate the artist's labor in monetary terms. However, the legal stability of copyright law may be questioned and even challenged because it shares the ground with unfixed notions of the concept of art. This study is an attempt to find theoretical argument where such instability of copyright law stems from, by looking into the theories of Aesthetics and history of arts. The first argument builds up on the ambiguity of discriminating between the Aesthetic concept of expression and idea. The second argument illuminates how new conventions of creating art work and emerging ideals of making art prevents to accommodate copyright law in the fields of art. New art forms such as conceptual art and place specific art are such examples. Increasing role of public arts projects also questions the conventional adoptions of copyright law. Arts management is closely related with this phenomena since their job is to administer the complex situation of introducing artists to the knowledge of copyright law.

  • This paper examines copyright problems of government works which take up a considerable part of public records. The provisions related to government works of the copyright laws of United States and United Kingdom are examined for the purpose of comparison with similar provisions in copyright act of Korea. The copyright act of Korea protects more strongly government works than U.K and U.S. therefore is an obstacle for use of the works. Also websites of governments and national archives are examined for their copyright policies in the process of service of government works. This paper found that the copyright policies of korean governments' official websites and the National Archives and Records Service limits free use of government works. This study proposed that the provision of definition for government works need to be added to the copyright act of Korea and the provision 7 should be revised. And open access license V.2 which was developed by Korean government should be applied to government works.

An Evaluation Study on the Copyright Protection Environment for Digital Libraries (디지털도서관의 저작권보호 환경 평가 연구)

  • This study is to analyze and evaluate copyright protection environment in digital reproduction and transmission, find out problems involved. and suggest recommendations for improvement. Data was collected 50 libraries to which digital reproduction and transmission is permitted under the Copyright Act were surveyed to examine the present states of digitalization and the systems employed. Also, library users, sampled from 5 libraries carrying out all the 6 technical measures obliged by the Copyright Act, were surveyed to examine their use of digital materials and perception on the copyright. After reviewing descriptive statistics, frequency and cross-tabulation analysis were made. The results of the analysis are most of the libraries. except for the industry university libraries, have implemented digital library systems, but the introduction rate of both digital reproduction system and transmission system are high (68.0% and 84.0%. respectively), while that of copyright protection system was low (26.0%). 84.0% of the libraries surveyed digitalize the full text, but the Libraries have digital collection less than 5,000 items, and only 33.3% of them digitalize materials with securing the copyrights. Regulations on copyright protections are not obliged properly. and it appeared that not only users' perception and perception of copyright as well as their use of electronic books are relatively low.

The Smart Contract based Copyright Protection Model for Wisdom Contents Distribution (지혜콘텐츠 유통에 적합한 스마트계약 기반 저작권 보호 모델)

  • Wisdom contents is made by an ordinary person and contains life tips helpful in general. As the existing copyright management systems are designed for the corporate or professional authors, it's not easy to use and requires high cost for the ordinary person to get the copyright. Blockchain based system can notarize the block of transactions without help of trustful third party such as existing copyright protection center. Thus, blockchain based copyright protection model is needed to protect the ordinary author's copyright. In this study, we propose the smart contract based copyright protection model which run on the blockchain network. The proposed model consists of smart contract creation, contents purchase and profit sharing stages. The digital signature scheme is used to get the contract agreed by the seller and the author. The smart contract stores the author information, contents information and the percentage of the share as states. If the contents is sold, the sales tokens are redistributed to the author and the seller according to the share. The proposed model can be applied to the ordinary person's copyright registration and management for Wisdom contents distributed in cafe, blog, YouTube, etc.

An Analysis on the Copyright Issues Using Cinematographic Works in Libraries (영상저작물 활용에 관한 도서관의 저작권 쟁점 분석)

  • This study investigated the present situation of the use of cinematographic works and the problems of copyright. Surveys were conducted in public and university libraries for these. Also, content analyses were conducted to make sense of copyright problems in libraries. As a result, this study found that problems of copyright had occurred in various aspects related to public performance, lending, digitization and internet services according to the diversity of facilities for watching cinematographic works and library services. Also, the librarians' questions to the copyright were very various from the primary level to specific level. This study suggested that regular courses of study in library schools need to be opened to primitive understanding to copyright law and occupational training programs for librarians need to be opened to complementary education as revisions of copyright law. This study also suggested that the online Q&A services need to be started for librarians who have detailed copyright problems.
