CISG의 적용에 관한 CIETAC 중재사례 연구 - 중국과 홍콩 당사자간 분쟁을 중심으로 - (A Study on CIETAC Arbitration Case about Applying the CISG - Focus on Dispute between China and HK Parties -)

  • The amount of international trade conducted through Hong Kong (HK) is increasing, thus rendering the legal framework governing contracts of sale between Mainland China (China) and HK is of particular importance. The status of HK under the CISG is currently unclear, however. First, the CISG entered into force in China in 1988. This important development had no legal effect for HK though as China lacked the power to enter into international conventions for HK. Second, the "Letter of Notification" deposited to the Secretary-General of the UN referred a list of treaties to be applied to HK, taking effect from July 1, 1997. This list, however, made no mention of the CISG. Third, China made a reservation in Article 95 of the CISG. Pursuant to Article 1(1)(b) of the CISG, the CISG cannot apply to HK. As a result, the Chinese Arbitral Tribunal apply the Chinese law according to the closest connection principle with the contract. In this case, attention must be given to the different result to which the CISG is applied. Liability for damages pursuant to the Chinese Contract Law (CCL) is just the same as Article 74 CISG, but CCL does not govern the case with substitute transaction and without substitute transaction when the contract is avoided. Therefore, the contract should be governed by the CISG from a business perspective when a contract is concluded between China and HK; otherwise, a promisee could not be fully compensated for all loss incurred.

  • It is a common and prevailing Construction that recent environmental problems such as earth's warmer climate and depletion of ozone layers can never be solved by the efforts of any one nation. That is why the international conventions have been held more often lately in order to discuss the matter of environment protection and there has been increased tendency of using economic activities of any nation especially their international trades as means for achieving the purpose of environment protection. Furthermore, there is an ample possibility for the advanced countries to use the regulatory restrictions for environment protection as an another measure of none-tariff barrier against countries including Korea which has high dependence on international trade with not very high technological capability of environment protection. Some of the developed countries have recently moved toward the creation of a new system of international regulatory measures on world trade in the name of Environment Protection. They Plan to impose strict control over the process and technology of production of good they are importing from other country. However, ever though the international regulatory measures, in a short term, could play a negative role on our trade capability, they could, in the long run, also play a role of helping hands if we usefully work out positive countermeasures as a result of hand-working government supported by industry and all the society as a whole.

  • Religion has a very close relationship with our everyday lives. In particular, religion maintains an absolute and ultimate value system and is deeply associated with all sectors of society such as politics, economy, thought, arts, culture, and science. The original meaning of religion in Buddhism means the teachings that become fundamentals. There are numerous religions around the world, and each religion has its own object of faith, different system, and unique rites and lifestyles. Therefore, evaluating or denouncing other regions based on the doctrines or conventions of a specific religion can lead to conflicts and disputes. The Buddhist Vinaya Pitaka related to alternative dispute resolution (ADR) is a method regarding the operation of a community. Vinaya Pitaka contains Buddha's teachings about individual and organizational ethics and on community life and activities. It is the Buddhist dispute resolution (BDR) of the Vinayata Pitaka that contains knowledge on howto remedy disputes among the four types of disputes that can occur. Vinaya Pitaka contains the principles and systems of BDR, and it is sufficient background for succeeding in the development of harmony today. The messages of laws, ethics, and Buddhist teachings are clear in these characteristics. The systems, progress, and procedures for various rites, events, and disputes as well as for everyday life, etc. display a rational operating system through karma. In particular, when disputes occur, the cause of the dispute is resolved as much as possible through transparent fairness and being unanimous using the seven remedies for disputes. Buddhist priests pursue private autonomy of ADR through karma, repentance, acceptance, etc. to maintain and continue the integrated functions of Buddhist priest harmony.

  • A letter of credit transaction of the preexistence have been raising one's head fraud charge problem as a result of abusing the principles of independence and abstraction. Every society has certain rules and conventions which it regards as important and most of people in any society. The paper document means a document in a traditional paper form. The eUCP credit must specify the formats in which electronic records are to be presented. In these present times, the issuance of documentary credit are performed by the SWIFT(Society for Worldwide Inter bank Financial Telecommunication) system. The eUCP have been written to allow for presentation completely electronically or for a mixture of paper documents and electronic presentation. Presentation is deemed not to have been made if the Beneficiary's notice is not received. An electronic record that cannot be authenticated is deemed not to have been presented. The e-UCP is the supplement of current existing UCP but is superior to UCP under some circumstances. The document shall include an electronic record. The place for presentation of electronic records means an electronic address. The current e-UCP is not clear on this matter. We have to note followings in case of presenting the documents electronically and applying the e-UCP. There are three principles in the letter of credit transaction, that is to say, independence and abstraction, document dealing, strict compliance. IN the electronic letter of credit, these principles are called as independence and abstraction, electronic document dealing, strict compliance.

  • This article is concerned with the comment on "Some New Problems of International Aviation Security-Considerations Forcused on its Legal Aspects". Ever since 1970, in addition to the problem of failure to accept the Tokyo, Hague and Montreal Conventions, there has been also the problem of parties to them, failing to comply with their obligations under the respective treaties, in the form especially of nominal penalties or the lack of any effort to prosecute after blank refusals to extradite. There have also been cases of prolonged detention of aircraft, passengers and hostages. In this regard, all three conventions contain identical clauses which submit disputes between two or more contracting States concerning the interpretation or application of the respective conventions to arbitration or failing agreement on the organization of the arbitration, to the International Court of Justice. To the extent to which contracting States have not contracted out of this undertaking, as I fear they are expressly allowed to do, this promision can be used by contracting States to ensure compliance. But to date, this avenue does not appear to have been used. From this point of view, it may be worth mentioning that there appears to be an alarming trend towards the view that the defeat of terrorism is such an overriding imperative that all means of doing so become, in international law, automatically lawful. In addition, in as far as aviation security is concerned, as in fact it has long been suggested, what is required is the "application of the strictest security measures by all concerned."In this regard, mention should be made of Annex 17 to the Chicago Convention on Security-Safeguarding International Civil Aviation against Acts of Unlawful Intereference. ICAO has, moreover, compiled, for restricted distribution, a Security Manual for Safeguarding Civil Aviation Against Acts of Unlawful Interference, which is highly useful. In this regard, it may well be argued that, unless States members of ICAO notify the ICAO Council of their inability to comply with opecific standards in Annex 17 or any of the related Annexes in accordance with Article 38 of the 1944 Chicago Convention on International Civil Aviation, their failure to do so can involve State responsibility and, if damage were to insure, their liability. The same applies to breaches of any other treaty obligation. I hope to demonstrate that although modes of international violence may change, their underlying characteristics remain broadly similar, necessitating not simply the adoption of an adequate body of domestic legislation, firm in its content and fairly administered, but also an international network of communication, of cooperation and of coordination of policies. Afurther legal instrument is now being developed by the Legal Committee of ICAO with respect to unlawful acts at International airports. These instruments, however, are not very effective, because of the absence of universal acceptance and the deficiency I have already pointed out. Therefore, States, airports and international airlines have to concentrate on prevention. If the development of policies is important at the international level, it is equally important in the domestic setting. For example, the recent experiences of France have prompted many changes in the State's legislation and in its policies towards terrorism, with higher penalties for terrorist offences and incentives which encourage accused terrorists to pass informations to the authorities. And our government has to tighten furthermore security measures. Particularly, in the case an unarmed hijacker who boards having no instrument in his possession with which to promote the hoax, a plaintiff-passenger would be hard-pressed to show that the airline was negligent in screening the hijacker prior to boarding. In light of the airline's duty to exercise a high degree of care to provide for the safety of all the passengers on board, an acquiescence to a hijacker's demands on the part of the air carrier could constitute a breach of duty only when it is clearly shown that the carrier's employees knew or plainly should have known that the hijacker was unarmed. The general opinion is that the legal oystem could be sufficient, provided that the political will is there to use and apply it effectively. All agreed that the main responsibility for security has to be borne by the governments. A state that supports aviation terrorism is responsible for violation of International Aviation Law. Generally speaking, terrorism is a violation of international law. It violates the sovereign rights of states, and the human rights of the individuals. We have to contribute more to the creation of a general consensus amongst all states about the need to combat the threat of aviation terrorism. I think that aviation terrorism as becoming an ever more serious issue, has to be solved by internationally agreed and closely co - ordinated measures.

해외 소재 불법 문화재의 환수를 위한 법정책적 연구 (Study on the Legal Policy for Restitution of Illegally Exported Cultural Properties in Foreign Countries)

  • 2011년 프랑스로부터 병인양요 당시 약탈되었던 외규장각 도서가 반환된 것을 계기로 해외에 소재하는 우리 문화재에 대한 국민적 관심은 폭발적으로 늘어났으며, 이들 문화재를 국내로 환수해야 한다는 여론 또한 매우 높아졌다. 국외소재문화재재단의 통계자료에 의하면 해외에 소재하는 우리 문화재는 총 20개국 160,342점에 이른다. 그 가운데 약 절반가량이 불법 반출된 문화재로 추정되며, 이들 문화재가 환수의 대상이다. 그런데 현실적으로 불법 반출되어 해외에 소재하는 문화재를 환수한다는 것은 그리 쉬운 일이 아니며, 이를 위해서는 장기적이고 체계적인 문화재 환수 방안이 정립되어 있어야 한다. 본 논문은 이러한 문제의식을 가지고 해외에 소재하는 불법 반출된 우리 문화재의 환수를 위한 법정책적 방안을 탐구한 것이다. 이를 위해 필자는 우선 I에서 본 연구를 하게 된 계기와 목적을 서술하고, II에서는 문화재의 반출에 관한 기본적인 이해와 현황 및 문화재 환수에 관한 방식과 방법에 관해서 개관하고, III에서는 문화재 환수 문제를 둘러싼 분쟁에 간여되는 국제규범과 국내규범을 살펴보았다. 이러한 고찰을 기반으로 본 논문의 핵심 부분이라고 할 수 있는 IV에서는 문화재 환수를 위한 9가지 법정책적 방안을 제시하였다. 즉 해외 소재 문화재에 대한 실태조사, 문화재의 통일적인 관리와 반출 증명서 제도의 도입, 문화재 환수 방법의 다양화를 위한 재원 마련, 문화재의 현지 활용, 다자 협약의 가입과 양자 협약의 확대, 국제기관을 통한 환수와 공조, 소송과 중재를 통한 환수, 문화재 환수 전문가의 양성, 외국 전문가들과의 네트워크 구축 등이다. 마지막으로 V에서는 이상의 내용을 탐구하면서 체득하게 된 필자의 의견을 정리하였다.
