In the UK, the legal principle for the duty of disclosure established in Carter v Boehm case was codified in the Marine Insurance Act 1906("MIA"). The duty of disclosure under the MIA is the pre-contractual duty by the insured and therefore, the insured should disclose the every material circumstance that would influence a prudent insurer's judgement. If the insured violates the duty of disclosure, the insurer is entitled to avoid the insurance contract, regardless of whether there was the deliberate or reckless breach, which is unfavorable to the insured. The Law Commission reviewed the duty of disclosure under the MIA in detail and provided the Insurance Act 2015 for the purpose of enhancing the interests of the insured. The Insurance Act 2015("Act"),while the basic legal structure of the duty of disclosure under the MIA still remains, amends it in respect of non-consumer insurance and furthermore, integrate the duty of disclosure and the duty not to misrepresent into the duty of fair presentation of risk. And according to the Act, the insurer is required to more actively communicate with the insured before entering the contract with the result that, if the insured fails to disclose the material circumstance but provides the sufficient information to put the insurer on notice, the insurer should further inquire for the purpose of the insured's revealing the material circumstance. In addition, the Act details the insured's constructive knowledge of material circumstance by reviewing the current case law and introduces a new system for the insurer's proportionate remedy against the insured's breach of the duty of fair presentation of risk.
The Law has intervened to define rare circumstances in which a person should choose continuing life in United States. On the one hand, the law has traditionally acted to preservelife and to respect the sanctity of life. On the other hand, one's control over one's own body, and the right to determine what kind of medical care one will receive, is equally well respected and historically grounded. The competent patients have the right to forgo life-sustaining treatment, courts in United States have left many unanswered questions about the nature of that right. The right to choose to forgo life-sustaining treatment is a manifestation of a patient's autonomy interest. In United States, The Karen Quilan case gave rise to legislative activity in the host of state capitals, and several states had adopted statutes that formally recognized some forms of written directives describing some circumstances in which certain kinds of medical care could be terminated. These statues were sometimes dominated 'living will' acts, sometimes 'right to die' acts and ocasionally 'natural death' acts. Today virtually every state has produced a living will statue. In Korea, courts do not permit a terminally ill person to withhold or withdraw life-sustaining treatment. Living wills apply in case of terminal illness owing to a defect in legislation. Now In Korea, these lively dispute of legal policy on the preconditions and concrete procedure of living will act and natural death act. Through the legislation of living will act and natural death act, we should prepare some circumstances to respect patient's autonomy on the right to die. We should frame the cultural standard to make a decision of forgoing life-sustainin1g treatment under the discreet procedure.
In 2012, the major jurisdictions regarding medical cases caused the controversial issues towards medical and legal fields by getting the judgments from the Supreme Court, which admitted the exceptional admissibility on discretionary grant. By regarding the serial negligence of medical organizations as a separate tort, the sentences which made up irrationality, were spoken by the court. As a result, if the treatment was made, which did not follow the entered matters in medical documents attached, the court announced the jurisdiction that presumes the negligence, which provided the evidence of negligence; on the other hand, this gave had the burden to medical branch to take great care for medicinal treatment. To be applicable for the Principle of Trust, the doctors have to give and take the necessary information for the treatment process and symptom decisions, which also commented in the court. Thus, this case made it difficult to apply the Principle of Trust and considered all the conditions as tough ones, which eventually induced lesser faults for patients' care. 지난 호에 이어 2018년도 주요 의료판결을 정리하였는데, 특히 설명의무와 관련된 법원의 설시는 그 한계가 어디까지인지 알 수 없을 정도로 다기(多岐)하여 가급적 많은 판결을 소개하기 위하여 노력하였고, 손해배상의 범위와 관련하여 개호비를 다액 인정한 판결과 각서의 효력이 증가된 치료비에도 미치는 것으로 본 판결도 관심을 가져볼 필요가 있다. 진료비상계 및 공제관련 판결은 서술내용에 비하여 가장 많은 토론이 이루어졌다. 의료기관 다중 운영 사례는 중간적 판결이지만, 워낙 의료계에 관심이 많은 사건이고, 임의비급여 관련 재량권 일탈 남용이 인정된 사건도 과거에 비하여 비중이 많이 줄었지만 여전히 의미가 있다고 보았다.
1967년 우주조약은 제1조에서 우주공간의 이용의 자유를 규정하고 있으나, 우주공간의 법적지위는 물론, 우주활동의 개념도 규정하고 있지 않다. 이에 우주공간에서 발생하는 활동에 대해서 우주공간의 이용의 자유가 적용된다는 법 규범은 엄격한 논리에서는 성립되지 않는다. 아울러 우주공간을 이용하는 행위, 즉 동 조약에서 사용하고 있는 우주활동의 개념도 정의되어 있지 않기에 어떠한 활동이 우주공간의 이용의 자유를 향유할 수 있는가에 대한 법 규범도 성립되지 않는다. 다만, 우주활동이 제반국제법 원칙 및 관련 우주법의 규정을 준수하여야 한다는 것만이 동 조약에 규정되어 있다. 이에 우주활동에의 적용 규범의 선택 문제는 법률적인 것이 아니라 정치적인 논리에 의하게 된다. 그 결과 우주공간의 군사적 이용을 규율할 수 있는 법규범은 법적안정성을 결여하고 있다고 판단된다.

In this case, although the victim died due to the defect of the cold medicine, 'CONTAC 600', the drug company's responsibility to cover damages was not recognized because a defect could not be found in the then-manufacturing process. Thus, while pharmaceutical companies are gaining economic profits by producing and selling a medical supplies, if they do not take any remedy measures for the victims of their products' side effects, the victims have to use medical supplies under their own responsibility of taking a risk, and they have to accept the full damage of the potential consequence. Therefore, to remove such absurdity and contradiction, and to practically remedy the victim of medical supplies' side effects, the pharmaceutical side effects remedy project pending in the the Drugs, Cosmetics and Medical Instruments Lawneeds to be actively implemented.
우리나라의 의료전달체계는 의료법과 국민건강보험법에 근거하고 있으며, 한정된 의료자원을 효율적으로 운영하기 위하여 질환의 중증도에 따라 의료기관을 이용하도록 구분되어 있다. 상급종합병원에서 이미 중증 질환에 대한 치료가 이루어져 병원급 의료기관으로 전원 또는 자택으로 퇴원이 가능한 경우 의료기관에서 환자에 대하여 의료계약을 해지할 수 있는지가 문제된다. 우리나라 법원의 입장으로는 해당 의료기관에서 더 이상의 입원치료가 불필요한 경우 의료기관의 의료계약 해지권을 인정하는 판결과 그러한 경우에도 의료기관의 의료계약 해지권을 부정하는 판결이 병존하고 있다. 한편 미국 판결 중에는 급성 치료를 담당하는 의료기관에서 입원 중인 환자에게 더 이상 급성 치료가 필요하지 않는 경우에 전문간호시설 등으로 전원을 인정하는 판결들이 있다. 의료자원이 한정되어 있고 의료기관의 계약 해지권이 제한된 취지가 국민의 생명권, 건강권에 대한 위험을 방지하기 위한 목적임을 고려할 때 해당 의료기관에서 치료가 종결되어 환자에게 더 이상 신체적 위해가 없음이 확인된 경우에는 다시 원칙으로 돌아가 의료기관의 계약 해지권을 인정할 필요가 있다.

The review of known decision-making support systems and technologies regarding the possibility of donation and transplantation showed that currently there are no systems and technologies of decision-making support regarding the possibility of donation and transplantation considering civil law. The paper models the decision-making support process regarding the possibility of donation and transplantation, which is a theoretical basis for the development of rules, methods and technology of decision-making support regarding the possibility of donation and transplantation considering civil law. The paper also developed the technology of decision-making support regarding the possibility of donation and transplantation considering civil law as a component of the Unified State Information System for Organ and Tissue Transplantation, which automatically and free of charge determines the possibility/impossibility of donation and transplantation. In the case of the possibility of donation, the admissible type of donation is also determined - over-life or after-life donation - and data about potential donor is entered in the relevant Donor Register. In the case of the possibility of transplantation, if the recipient needs a transplant of one of the paired organs or a part of the organ/tissue, then data about potential recipient are entered in the Transplantation List from both over-life and after-life donor, otherwise, if the recipient needs a transplant of a non-paired organ or both paired organs, then data about potential recipient are entered only in the Transplantation List from after-life donor.
This Comment explores the ICSID case of CMS Gas Transmission Company v. Argentine Republic, awarded on May 12, 2005. The Part II of this Comment first describes the relevant facts of the case including the some background for readers' understanding and the Part III summaries the claimant's requests and the decisions rendered by the Arbitral Tribunal in the Award. At Part IV, the Comment addresses the issue of determinating laws applicable to the merits of dispute in case that the parties of the case have not chosen a governing law, and at Part V, takes a close look into three main issues of (i) the indirect expropriation of the investment, (ii) the breach of fair and equitable treatment and (iii) the protections under umbrella clauses. In this CMS case, we see first that while the Tribunal affirmed that any indirect expropriation can occur from incidental interference depriving the foreign investor of the use or reasonable-to-be-expected economic benefit even if not necessarily to the obvious benefit of the host State, the Tribunal denied the occurrence of indirect expropriation in this case by holding that the Government of Argentina has not breached the standard of protection laid down in the Treaty. Secondly, however, regarding the issue of fair and equitable treatment, we see that the Tribunal, finding Argentina's breach of obligations, affirmed that the foreign investor can expect the host State to act in a consistent manner, free from ambiguity and totally transparently in its relations with the foreign investor, which can give the foreign investor certain degree of foreseeability. Thirdly and finally, we see that, on base of the effect of the umbrella clause, the Tribunal recognized the obligation of the host State undertaken not to freeze the tariff regime or subject it to price controls and not to alter the basic rules governing contracts between the foreign investor and the host State without the first's written consent. However, the protection under the umbrella clause is available only when there is a specific breach of rights and obligations under BIT or a violation of contract rights protected under BIT.
In this research the remaining service life of the concrete due to the steel corrosion was predicted by three cases; causing carbonation, using sea sand, using deicing salts. In case of deterioration by carbonation, effective carbonation depth, effective coverage depth and relative humidity are considered for predicting method. In case of using sea sand, predicting method is made of rust growth equation from polarization resistance method. In case of using deicing salts, predicting method is made of transformation of Fick's law. Three methods are very useful in predicting service life of concrete.
