The Allocation of Risk under Sale of Goods in American Law - Focused on the Uniform Commercial Code and Cases - (미국법상 물품매매계약에서의 위험의 분배 - 통일상법전(UCC)의 규정 및 사례를 중심으로 -)

  • Risk of loss is a term used in the law of contracts to determine which party should bear the burden of risk for damage occurring to goods after the sale has been completed, but before delivery has occurred. Under the Uniform Commercial Code (UCC), there are four risk of loss rules, in order of application. First, it is agreement that is the agreement of the parties controls. Second, the breaching party is liable for any uninsured loss even though breach is unrelated to the problem. Hence, if the breach is the time of delivery, and the goods show up broken, then the breaching rule applies risk of loss on the seller. Third, the delivery by common carrier other than by seller is necessary: Risk of loss shifts from seller to buyer at the time that seller completes its delivery obligations; If it is a destination contract, then risk of loss is on the seller; If it is a delivery contract, then the risk of loss is on the buyer. Fourth, if the seller is a merchant, then the risk of loss shifts to the buyer upon buyer's receipt of the goods. If the buyer never takes possession, then the seller still has the risk of loss. This paper discusses problems of risk of loss under the American law. Specifically, this paper focuses on the interpretation of UCC sections and analysis of various cases. By comparing, also, UCC and Korean law, the paper proposes some implications of risk of loss issues for Korean law.

Men's Hunting Clothes in the 1920s (1920년대 미국 사냥복에 관한 연구)

  • In the decade of the 1920s in an America, with booming of economy, people had more money. And with the development of transportation, people can afford expensive traveling throughout Europe. With this reason they were exposed to a nobility of European style and liked royalty more than before. American hunting man wanted traditional dress to express their status as a psychological code and the reason of the existing very similar hunting garment in nowadays is based on this belief. The purpose of this study is not merely understanding the styles of American Men's hunting and shooting garments in the 1920s but understanding the psychology of the people. People quite clearly do not dress according to function ore need alone and, in fact the consumption of clothes increasingly serves no other purpose than to fulfill or express psychological or social, rather than practical need.

  • Mechanical splices has been applied in nuclear power plant according to ASME(American Society of Mechanical Engineering) and ACI(American Concrete Institute) Code requirements. In particular sleeve with ferrous filler metal splices and cold roll formed parallel threaded splices have been used in domestic nuclear power plants. The objective of this study is to find out the constructability of the mechanical splices which had been used in Korea nuclear job site and to review the technical trends in the near future.

Comparison between reinforced concrete designs based on the ACI 318 and BS 8110 codes

  • Municipalities in the United Arab Emirates approve reinforced concrete design of building structures to follow either the ACI 318 or the BS 8110 code. Since the requirements of these codes are different from each, there is a need to compare the structural demand in the two codes. The main objective of this study is to compare the design requirements of the ACI 318 code with the BS 8110 code for the flexural, shear and axial compression limit states. The load factors and load combinations in the two codes are also compared. To do so, a large number of cross-sections with different geometries, material properties, and reinforcement ratios are analyzed following the procedures in the two codes. The relevant factored load combinations in the two codes are also investigated for a wide range of live-to-dead load ratios and for various wind-to-dead load ratios. The study showed that the differences between the design capacities in the ACI 318 and BS 8110 codes are minor for flexure, moderate for axial compression, and major for shear. Furthermore, the factored load combinations for dead load, live load and wind in the two codes yield minor-to-moderate differences, depending on the live-to-dead load ratio and intensity of wind.

  • During the last ten years, the need has been increase for reducing maintenance cost for aged equipments are ensuring safety, efficiency and profitability of petrochemical and refinery plants. American Petroleum institute(API) developed a code, API 581 for proposing standard procedures of risk based inspection. Even though the API 581 code covers general RBI procedures, there must be some limitations. In this study, a semi-quantitative assessment algorithm for RBI based on the API 581 code was reconstructed for developing an RBI software. The user-friendly realRBI software is developed with a module for evaluation semi-quantitative risk category using the potential consequence factor and the likelihood factor. Also, inspection planning module for inspection time and inspection method for equipments are included.

  • Librarians long ago proclaimed themselves professionals. Until recently, however, librarians and information professionals gave very little thought to professional ethics, which have corne to play an increasingly important role in all areas in modern society. They have been stimulated to consider their specific domain within an ethical context now. Professional norms express obligations which include prescribing standards, principles of responsibilities, and rules of duties. Professional codes attempt to formulate the norms of professional ethics and are the basis for disciplinary measures of various kinds. This paper discusses professional properties and characteristics of libarianship with a special reference to the code of professional ethics. The codes of ethics of the American Library Association, the Library Association, and of the Japanese Library Association have been reviewed and compared. The arguments on the enforcibility of the professional codes of ethics, therefore, on their effectiveness have been discussed. Author concludes that, despite some doubts on the practical effectiveness of the ethics code expressed by a number of scholars, a code of ethics is very much required in the information professions. Properly disseminated, a code would enhance the status and standing of the profession by demonstrating concerns for the maintenance of the highest possible level of standards of professional services. It would also play an important role in raising consciousness of the clients by communicating the value of the works.

  • Responsible Care는 모든 종업원, 경영자 및 관리자의 환경, 안전, 보건에 대한 사고(mind)를 바꾸는 것이다. Responsible Care는 실행지침(management Practices)을 완전히 실행하는 것이 궁극적인 목표가 아니고 각 개인이나 회사가 자발적으로 지속적으로 환경, 안전, 보건의 Performance을 향상시키고 이에 스스로 약속하는 것이다. Responsible Care는 일회성의 프로그램이나 운동이 아니라, 화학 산업계가 계속해서 사회와 더불어 사업을 지속하기 위해, 화학 산업계가 스스로 만든 환경, 안전, 보건의 Performance을 향상시키기 위한 하나의 도구이며, 약속이다. Responsible Care는 화학산업계가 스스로 만든 도구이고 사회에 대한 약속이므로 환경, 안전, 보건에 대해 신의와 정직을 바탕으로 사회와 더불어 공존하는 마음가짐에 그 기본 정신이다. Responsible Care는 우리자신의 Performance를 향상시키는 것 뿐 아니라 우리의 고객 또는 다른 화학 회사들의 Performance를 향상시켜 궁극적으로 사회나 정부로부터 화학 산업에 대한 선호도를 향상시키는 것이다. Dow Korea는 CMA(American Chemical Manufactures Association)Code를 기본으로 환태평양 문화에 맞게 실행지침(Management Practices, Key Activities)을 수정한 Dow Pacific Area Responsible Care Code를 1993년부터 시작하였다. 시작 초기에 1997년 말에 모든 실행지침이 실행(Practices In Place)되도록 목표를 설정하여 생산 공장 관련 Code(CAER, Distribution, Employee Health and Safety, Pollution Prevention, Process Safety)의 대부분이 목표에 달성되어 생산 공장의 안전 사고 방지, 종업원 건강 증진, 페기물 발생 억제 분야에 상당한 성공을 거두었으며, 지금도 지속적으로 유지 관리 및 미비한 부분(CAER, 등)의 향상에 노력하고 있다. Dow Korea의 수입 판매 부분에 주로 관련된 Product Stewardship 및 Distribution Code는 여러 사업부 및 여러 지역(미국, 유럽, 아시아 등)에 위치한 담당자가 관련된 까닭에 가장 복잡한 부분이어서 많은 인력과 시간을 소비하면서 노력하고 있으나 아직까지 소정의 목표에 도달하지 못했으며, 2000년 말에 모든 실행지침이 실행되도록 목표, 실행 계획 및 조직을 수정하여 노력하고 있다.

Optimum design of steel space frames under earthquake effect using harmony search

  • This paper presents an optimization process using Harmony Search Algorithm for minimum weight of steel space frames under earthquake effects according to Turkish Earthquake Code (2007) specifications. The optimum designs are carried out by selecting suitable sections from a specified list including W profiles taken from American Institute of Steel Construction (AISC). The stress constraints obeying AISC-Load and Resistance Factor Design (LRFD) specifications, lateral displacement constraints and geometric constraints are considered in the optimum designs. A computer program is coded in MATLAB for the purpose to incorporate with SAP2000 OAPI (Open Application Programming Interface) to perform structural analysis of the frames under earthquake loads. Three different steel space frames are carried out for four different seismic earthquake zones defined in Turkish Earthquake Code (2007). Results obtained from the examples show the applicability and robustness of the method.

Teaching Engineering Ethics across National Borders

  • Recently there has arisen an increasing world-wide emphasis on teaching ethics within the engineering curriculum. Much of the teaching has relied on the use of an American model emphasizing autonomy and professional identification. This paper argues that this model is inadequate when engineering is seen in a global perspective, because different cultural values are dominant throughout the world, some of which stand in sharp contrast to traditional Western values based on the primacy of the individual. A new global engineering ethics thus needs to be constructed which takes into account a variety of different cultural values and local circumstances, but which is able to serve as a uniting ethical foundation for engineers throughout the world. The paper suggests that the development of a global code of engineering ethics would be a fruitful way to pursue such a strategy.

  • This paper provides review of research results undertaken on reinforced concrete wall panels in one way and two way. The review also highlights two well accepted code design methods from the American (ACI) and Australia Concrete structures standards. The emphasis is on walls under axial compression only with changes in various parameters. These include the variation of panel dimensions panels (ie. Slenderness, thinness and aspect ratios), steel reinforcement, eccentricities, concrete strength and support conditions. The main purpose of this review is to compile research previous by undertaken to highlight the inadequate in certain research literature. It is envisage that this review will expose areas in wall research required so that inadequate in current methods can be rectified.
