The suggestions that follow are about the Qualitative Improvement of private security Industrial. First, in legal and institutional policy, new establishment by law for private security and more support from government is asked. Moreover, the restructuring or M&A between petty companies and the pricing for security service should be performed. Second, in the structural aspect of private security industry, the professional education center for private security guards should be established and the terms of payment and welfare should be improved to the level above standard. In addition, it should be achieved to change the public to have a new and correct understanding of private security and develope the specialized parts suited to the characteristic and ability of each companies. Third, the construction of operating system for private security service should be achieved; recruit system for competent security guards, marketing strategy and enforcement system, widely known confidence to client, normal training system for security guards and post management system for client. This is also to be suited to the characteristic of each companies.

According to the current record of Private Security in Korea, more than 110,231 private security guards and around 2,213 security guard associations are engaged in the private security industries. However, there is no a professional license for the private security. In order to be provided a high quality service from private security industries, the security guard should be required his/her professional qualification which can be upgraded by establishing a professional license system. For introducing the license system the government and security guard associations need to support the suitable training program including curriculum and method, and all associations related to the private security have to require people involved in any kinds of private security matters to complete obligatorily some educational training programs. And also, to complete a college should be the minimum requirement.

주요 선진국에서 민간조사제도는 민간경비업의 하나로 보편화되어 있고 국내에서도 민간조사제도의 필요성은 끊임없이 제기되고 있지만 아직까지 입법화 되지 못하여 불법적으로 운영되는 심부름센터는 그 수요에 따라 업무영역이 세분화되어 증가하고 있다. 이것은 경찰과 민간경비 모두 국민의 치안수요를 만족시키고 있지 못하고 있다는 반증인데 경찰은 수사, 교통, 정보, 방범과 같은 본연의 업무가 있고, 민간경비는 "경비업법"에 따라 시설경비, 호송경비, 신변보호, 기계경비, 특수경비로 업무 영역이 한정되어 있기 때문이다. 이 연구에서는 국내 민간경비 시장에 민간조사업의 접근에 따른 구조적 차이에 대하여 살펴보고자 하였고 이와 같은 질문에 민간경비업과 민간조사업은 매우 다르다(71.2%), 다르다(22.4%), 보통(6.3%), 비슷하다(0.0%), 매우 비슷하다(0.0%)순으로 응답하여 대체적으로 다른 업무로 인식하고 있는 것으로 나타났으며, 비수량분석 결과 그 차이는 업무성격, 비용, 업무수행범위, 공권력 영역, 법제의 유무, 위협대상, 조직규모인 것으로 나타났다. 국내에서 민간조사제도 도입을 위한 노력은 지난 1999년 하순봉의원의 발의 이후 현재 윤재옥의원의 "경비업법전부개정안"과 송영근의원의 "민간조사업에 관한 법률안"이 국회에 계류 중이다. 이 연구결과는 윤재옥의원의 "경비업법전부개정안" 법안과 같이 "경비업법"을 개정하여 민간조사업을 도입할 경우 민간경비업과 민간조사업의 차이점을 탐색적으로 살펴보고 정책적 제언을 하고자 한다.

The basic legislations regulating the private security in Korea are Private Security Business Act and Private Policeman Act. But this dualistic system of private security causes difficulties in unity and efficiency of private security operation and makes it complicated to supervise each personnel with effect. Besides despite similar service and duty, there is all the difference between private security guard and private policeman in regard of social position, pay, authority, and so on. Therefore it is suggested that the two Acts should be unified and the united private security act should be enacted. Legislating new private security act will lead to considering the detail legislative definition on qualification of personnels and business range.

The private security will overcome the limit of public police system and implement a small and efficient government concept. Especially in recent years, this security system has naturally been expanded in its functions from crime prevention to prevention of disasters. To manage the emergency by the private security industry, the private security services to involve some peculiarity and specialty. The policy agenda of private security industry for crisis management are suggested. First of all, to provide quality services for emergency management, the guards from private organizations should receive professional education and training to secure the specialty. Second, we need to improve the quality of security instructors with intensive education system for them. Security instructors should be able to effectively handle lots of different matters in the fields of security, but examination of the current curriculum of education for security instructor indicates that there is not much chance of it. Third, must be natural in light that the private organizations have some limitations in their operational capabilities and scopes. Private security duties are well established in cooperation with related institutions such as the police. Lastly, development of high quality crisis management commodities in the private security becomes even more significant. The government should be determined to make an effort to grow the private industry and foster a political environment for the same purpose.

민간경비원은 특별한 법적 권한이 주어지지 않은 일반인과 동등한 법적 지위를 보유하고 있다. 그러나 민간경비산업은 그동안 업무영역의 확대를 가져와 제한적이지만 일부 법적 권한을 보유할 시기가 되었다는 주장이 있다. 이 연구에서는 일본 미국 등 주요국가의 경비원 법적 지위를 비교 분석하고 우리나라 민간경비원의 법적 지위에 관하여는 현행법인 경비업법상의 경비원의 법적 지위를 분석함으로써 우리나라의 민간경비원 법적 지위의 문제점을 도출하고 그에 대한 대안을 제안하는데 목적이 있다.

오늘날 국민들의 삶을 질을 위협하는 범죄문제에 효과적으로 대처하기 위해서는 지역사회의 다양한 자원의 도움이 필수적이다. 왜냐하면 경찰의 힘만으로 범죄를 예방하고 계속적으로 증가하는 범죄를 해결할 수 없고, 국민들의 치안서비스에 대한 높아진 욕구를 충족할 수 없기 때문이다. 경찰이 지역사회 자원들과 연합하여 범죄에 대응하는데 있어 가장 전문적인 민간영역은 민간경비라 할 수 있다. 그러나 한국에서 협력치안을 위한 민간경비의 역할은 미국이나 일본에 비해 상당한 미흡한 수준에 머물고 있다. 그래서 본 연구에서는 협력치안 구축을 위한 한국 민간경비의 역할방향에 대해 다음과 같이 4가지를 제시하였다. 첫째, 미국이나 일본처럼 민간경비의 업무분야 다양화되고 전문화되어야 한다. 단순인력 위주의 시설경비 수준을 벗어나 최첨단 범죄 영역이나 특정 산업단지 등을 전담하는 전문화된 조직으로 탈바꿈해야 할 것이다. 둘째, 경찰과 민간경비와의 상호접촉을 증가시켜야 한다. 경찰과 민간경비 간의 정기적인 모임을 통해 상호관심과 필요에 대해 공감대를 형성할 필요가 있다. 이러한 역할에 민간경비업체들을 대표할 수 있는 한국경비협회의 적극적 역할이 중요하다. 셋째, 민간경비 활동에 대한 이미지 개선노력과 민간경비 활동에 대한 홍보가 필요하다. 민간경비에 대한 일부 부정적인 이미지를 씻어 내도록 자체 정화노력과 긍정적 이미지를 국민들에게 적극적 홍보할 필요가 있다. 마지막으로 한국 수준에 적합한 경찰과 민간경비 간의 협력치안체제 모형을 개발할 필요가 있다. 우선적으로 일선 치안현장에서 경찰과 민간경비 간에 상호이해와 긍정적 인식을 갖도록 하기 위한 노력이 필요하다. 특히 경찰이 민간경비를 대등한 동반자 인식을 갖도록 하기 위해 민간경비업체 스스로 전문 인력의 충원과 교육훈련을 강화하여 전문성을 향상시켜야 한다.

본 논문은 경비원 권리보호의 경비업법 수용제고 방안을 도출하는데 목적을 두고 있다. 이를 위해 민간경비원과 동일한 업무특성을 지니고 있는 청원경찰의 권리보호 양태와의 비교고찰을 통해 접근해 보았다. 분석결과, 경비원의 권리보호를 위한 경비업법의 수용내용을 제시하면 다음과 같다. 첫째, 경비원의 경제적 지위를 보장하는 기본적인 조항을 경비업법에 신설하여야 한다. 둘째, 경비원의 권한범위를 명확히 규정할 필요가 있다. 셋째, 경비원의 의무규정에서 위력이나 물리력의 범위를 명확히 할 필요가 있다. 본 규정 중 물리력 행사는 존치시키고 '위력과시' 부분은 삭제하여야 한다. 넷째, 경비원의 폭행에 대한 가중처벌 조항을 신설해야 한다. 끝으로 경비업법과 청원경찰법은 제정목적이나 성격 면에서는 상당히 차이를 갖기 때문에 단순한 법조항 도입 보다는 보호이익에 초점을 맞추어 도입하는 것이 바람직하다.

본 논문은 경비원의 임금 및 복리후생제도의 고찰을 통해 경비원복리증진 방안을 도출하는데 목적이 있다. 이를 위해 경비원 임금제도와 복리후생제도 실태를 조사 분석하였다. 분석결과 현재의 경비원 임금 및 복리후생제도에 영향을 미치는 가장 중요한 요인은 도급액 수준, 최저임금 수준, 경비업의 전문성 등이었다. 특히 현재 경비원은 한국표준직업분류상 단순노무직으로 분류되어 가장 전문성이 낮은 수준의 직무로 분류되고 있다. 이러한 인식에 따라 경비원의 임금수준은 대기업 평균의 약 47%, 중소기업 평균의 약 80% 수준에 불과하다. 이를 토대로 향후 개선방안을 제시하면 첫째, 경비업의 전문성 향상을 위한 노력, 둘째, 복리후생 관련 공제사업 신설, 셋째, 표준임금의 경비업법 수용, 넷째, 선택적 복지제도 도입 등을 제시하였다.

In Korea, Private security companies has steadily grown and amounts to 2,051 places as of November 30, 2002. Private security in korea is carrying out firm name role assignment to have held the police and public peace environment change factors for a standard faithfully, and protects social a little property that is a basic purpose, and it is spare no efforts in loss prevention. In spite of numeral increase of private security companies, private security companies have many problem. Moreover, they mostly did not have any remarkable in-house expertises in their own business under tough conditions. Under the unfavorable circumstances including insufficient investment and education in private security guard, there have been actually little further studies on private security business in practices. So this study mainly focused on addressing the installation security business managed by authorized companies, which amount to 96%(1,963 companies) of total 2,051 domestic security companies. Furthermore, the study formulated and modeled a series of business procedures in private security companies.
