The Criminal Liability of Physicians in the Case of Medical Accidents (의료사고에서의 형사책임 -원내감염사고의 해결을 향하여-)

  • Conventionally, there were few cases in which a medical accident became a criminal case in Japan. However, after the serious malpractice such as the Yokohama City University Hospital case, prosecutors came to be less hesitant to prosecute a malpractice. In a medical accident, the attribution of the responsibilities among medical personnel becomes one important element of the proof of negligence. The Supreme Court concluded that, when the attribution of the responsibilities is not established among medical personnel to confirm the identity of the patient like the Yokohama City University Hospital case, all the personnel who were involved bear the responsibilities to identify the patient. For serious cases which requireut most carefulness fortreatment such as the Saitama Medical University Hospital case, not only the chief physician in charge of the case concerned but also the director of the branch at the university hospital bear the responsibilities to confirm the treatment policy of the case. After the acquittal of the Ohno Hospital case, the voice demanding more prudent prosecution of malpractices has become stronger than before. Meanwhile, Ministry of Health, Labour and Welfare introduced Medical Accidents Investigation System for the prevention of medical accident and, has reinforced the third party inspection of medical accidents.

  • 현실화된 기후변화로 인하여 강수패턴 및 강수량의 변화가 발생함에 따라 물 관리의 불확실성이 증가하고 있는 실정이며 또한 2014년부터 시작된 극심한 가뭄은 안정적인 용수공급에 많은 어려움을 주고 있다. 예로 보령댐의 경우 저수율이 2015년 19%, 2017년 8.3%로 역대 최저를 기록한 바 있고 2018년 3월 기준 운문댐과 밀양댐의 경우 저수율이 각각 11%(심각), 26.2%(경계)로 극심한 물부족에 시달리고 있다. 이러한 극심한 가뭄에 대응하기 위해서는 시설간 연계 운영, 급수체계 조정, 도수로 가동 등과 같은 구조적 대책과 더불어 저수용량에 따라 용수공급량을 감축하는 형태의 비구조적 대책의 일환인 용수공급 조정기준이 동시에 이루어져야 한다. 용수공급 조정기준은 국토교통부에서 주기적으로 발생하고 있는 가뭄에 대하여 대응하기 위해 만들어진 기준으로 다목적댐의 저수량을 기준으로 단계별(관심, 주의, 경계, 심각) 공급량을 감축하여 장기간 공급함으로써 국가재난을 사전에 예방하는 것을 목표로 하고 있다. 이러한 용수공급 조정기준을 수립하기 위해서는 최소 20년 이상의 과거 관측된 유입량 자료를 모의 발생하여 이수안전도 95%이상을 만족하는 단계별 용수공급 조정 기준선을 작성하게 된다. 하지만 신규 댐의 경우 관측된 유입량 자료가 전무함에 따라 용수공급 조정 기준을 수립하는데 어려움이 있다. 따라서 본 연구에서는 신뢰할 수 있는 유입량 자료를 생산하기 위해 첫 번째로 물리적 기반인 분포형 강우-유출 모형을 구축하고 검보정을 수행하였으며 이처럼 구축된 강우-유출모형을 이용하여 다수의 유입량 자료를 생산하였다. 두 번째로 SAMS 2007을 이용하여 유입량 자료를 모의 발생시켰으며 이를 저수지 운영에 활용하여 이수안전도 95%를 만족하는 용수공급 조정기준을 수립하였다. 본 연구의 결과는 극심한 가뭄에 대비하여 안정적인 용수공급 및 수자원 확보 등 이수적인 측면에서 크게 활용 가능할 것으로 판단된다.

  • Recently, mobile devices have evolved into small computers with various functions according to user requirements. Careful attention must be paid to the design of the power supply network for the stable operation of the application processor (AP), the wireless communication modem, the high performance camera, and the various interfaces of the mobile device to implement various functions of the mobile device. In this paper, we analyzed and verified the method of optimizing the design parameters such as the position, capacity, and number of decoupling capacitors to meet the target impedance required by the driver IC chip to ensure the stability of the power supply network of mobile devices that should be designed as wiring type due to mounting density limitation. The proposed wired power supply network design method can be applied to various applications including high-speed signal transmission line in addition to mobile applications.

  • The UV hard coating materials are attracting more and more attention to modern industry, in terms of the development of low or non solvent coating materials which will contribute to economizing both materials and energy and to reducing pollution. This study was performed in order to invent UV curable coating materials containing colloidal silica which have actual industrial applications. As results of experiments, the oligomers type and the concentration of colloidal silica acrylate oligomer (SAOC) have an influence on various especially, The properties of UV hardening cooling, such as chemical, abrasion resistance and weatherability, were greatly enhanced, the impact properties of coated polycarbonate substrate were improved compared with the noncoated that. The UV cured films containing 30 wt% SAOC obtained showed the best properties.

  • Magnetite($Fe_3O_4$) is currently one of key materials for applications in magnetic storage and many bioinspired applications because bulk $Fe_3O_4$ has a high Curie temperature($Tc={\sim}850K$) and nearly full spin polarization at room temperature(RT). In this work, $Fe_3O_4$ nanoparticles with different sizes of 12 to 15 nm were prepared in a well-controlled manner by a nonhydrolytic synthetic method. Here, we report the significant intergrain magneto-resistance(MR) of ${\sim}2%$ at RT in $Fe_3O_4$ nanoparticle pellets. The tunneling conductance was also investigated based on the Brinkman model, as well. Our results show clearly that the surface or interfacial property of the particles plays a crucial role in the MR effect.

  • Experimental animation is an independent art animation and a visual art that is integrated with the spirit of experimentation. Norman McLaren pursues original beauty in each piece through scientific exploration of visual expression technology and experiment that transcends common sense with great creativity and sensitivity, and the aesthetic value of animation is very high as the master of experimental animation that has brought innovation of real image media today. Therefore, it is meaningful to analyze the experimental expressions of Norman McLaren, who expanded the field of experimental animation by challenging various techniques and carried out a ceaseless search for motion creation between each frame, and to study the expressions of movement he focused on. The most significant feature of his movement expression was analyzed as repetition of motion and repetition of metamorphosis. I hope that this derivation will be understood as experimental animation of experimental method which requires more specific type of inquiry than simple question about experimental method. Also, I hope that it will be meaningful as a preliminary study to deeply explore the possibility and direction of animation creation in university education.

  • Although there are various cultural events and cultural contents produced in the region, there is a lack of distribution and spread of regional information to expand related economic consumption. This study combined local advertising by local advertisers with the knowledge search method in question and answer format from a location-based service perspective for the purpose of spreading and using local cultural information. The approach looked at domestic and international cases of knowledge search based on region and location-based advertising research, presented community model of location inquiry based information service and revenue model of local advertisement. Through this, this study designed a question and answer based community and operational structure model of local advertising, and developed an information service system in the form of prototyping. By extending the distribution of question and answer data among users to location information, it is meaningful that a business service model was presented that combines local cultural content information and the demand for user access with the revenue model of local advertising.

  • Dangerous cargo in maritime transportation is increasing in international trade. The types and forms of dangerous cargo are very diverse, complex, and the scope is expanding widely. For this reason, it is increase risk of accident threatens the safety of ships and other cargoes, as well as serious damage. Carriers' require special care and handling of dangerous cargo and have a duty of care for safe transport. The shipper is obliged to notify the carrier of the nature and characteristics of the dangerous cargo prior to loading on the ship, the responsibility of the carrier varies depending on the notification or not. This study compares and analyzes the concept and classification of dangerous cargoes, the provisions of the Hague rules, Hamburg Rules and Rotterdam Rules about Carriers' Dangerous Cargo Liability Regulations, after reviewing case studies. We intend to provide information to dangerous cargo handling, the carrier.

  • In this study, we investigated the application of deep learning to the manufacturing process of traffic and road signs which are constituting the road layer in map production with 1 / 1,000 digital topographic map. Automated classification of road traffic sign images was carried out through construction of training data for images acquired by using transfer learning which is used in image classification of deep learning. As a result of the analysis, the signs of attention, regulation, direction and assistance were irregular due to various factors such as the quality of the photographed images and sign shape, but in the case of the guide sign, the accuracy was higher than 97%. In the digital mapping, it is expected that the automatic image classification method using transfer learning will increase the utilization in data acquisition and classification of various layers including traffic safety signs.

  • The purpose of this study is to identify factors affecting the purchase of Fair Trade products and to segment consumer which were typed according to the fair trade consumption competency, attitude and ethical consciousness of the University students. As a result, there are 4 type consumers, general type, indifferent type, individualism type, and fair trade practice type. Factors that directly affect the purchase experience of Fair Trade products are knowledge, willingness and interest in fair trade. In the end, education should be provided through fair education and ethical consumption through systematic education, and outside of school, social effort should be accompanied by the media and various contents to enable college students to promote their knowledge and interest in fair trade. In order to activate the fair trade market, it will be necessary to improve the quality to secure the market value as a commodity and to increase the price acceptance of the consumer.
