Recently the core technology leakage continues to increase. It is critical issue relating to national competitiveness rely on the company's competitiveness as well as both survival and competitiveness of company. So other countries have impyz roved their laws consistently to solve these problems. And recently our country amended the law. In the paper, we will analyze world's various laws and institutions relating industrial core technologies. And this paper will provide the suggestion to settle and to develop our country's industrial core technology's protection by refer to other laws.

정보 기술의 발전과 격상된 국가 경쟁력으로 인하여 기업의 첨단 기술 보유 비율은 증가하고 있는 추세이며, 이로 인하여 기업의 핵심 기술 유출 피해도 꾸준히 증가하고 있는 실정이다. 산업 정보 유출은 한 기업뿐만 아니라 한 나라의 경제에 큰 피해를 주고 있기 때문에 국가차원에서 유출을 방지하기 위한 노력이 이루어져야 한다. 현재 산업 정보 유출을 방지하기 위해서 다양한 관련 법 재정과 여러 유관기관들의 연구가 진행되고 있다. 정보 유출 방지 연구는 크게 데이터 유출방지 기술, 데이터 보호 기술, 사용자 인증 기술로 구분할 수 있다. 본 기고는 현재 국 내외 산업기술 보호 현황을 조사하고 정보 유출을 방지하기 위해 진행되고 있는 연구들을 간략히 소개하도록 한다.

Cause of the technology leakage and trade secrets can be leaked to the lack of infrastructure, lack of coping skills of SMEs. In addition, small businesses can avoid technology outflow and re-experience the same half of the damage, even when the external leak developed after the fact and does not demonstrate such technology leakage time for the technology and situation which did not take any action, security, infrastructure investments difficult, work-related knowledge, lack of security, trade secret protection dedicated staff, inadequate legal and institutional measures have been identified as such complaints to date. For subcontracting, etc. mid-sized transactions, hinder the growth of SMEs, SME cross-technology leakage to the increase in unfair practices, including useful, and this has been accompanied by growth-based business-to-business it weakened.

Achieving high-level technology in fields such as IT-related industry, semiconductors, mobile phones, LCD, automobile, shipbuilding, etc., Korea has become an international market leader in those fields. In results, there are the increasing numbers of technology leakage attempts in various manners. Recently, technology leakages are not limited to illegal industrial espionage, but also occur during usual corporate proceedings such as technology transfer, joint research and M&A. In fact, there was a technology leakage issue in the M&A between Ssangyong Motors of Korea and Shanghai Motors of China. Current M&A regulations of Korea are not independent laws, but are spread over various laws, such as commercial law, Capital Markets and the Financial Investment Services Act, Foreign Trade Act, etc. This paper focuses on whether the current Korean regulations regarding M&A are able to effectively restrict the leakage of major information of corporate during M&A and seeks the complements.

Recently, the leak of domestic core technology of major business in Korea and the subsequent damage, has been increasing every year. Financial losses due to this leak are estimated to be about 220 trillion, which is equivalent to the gross budget of Korea Besides, the majority of the leaks are caused by former and current staff members, cooperated businesses, scientists and invesment companies. This shows that the source of the leaks are internal personnel. In this manner, we can infer that the management and plan of personnel security has not implemented sound practices to prevent technology leak by people. Therefore, this thesis suggests classifying methods of technology leak through clustering, one of the data mining methods about the information of internal personnel to prevent core technology leak from businesses.

지난 2000년 발족한 서울중앙지검 컴퓨터수사부는 그간 사이버범죄에 맞서 기업의 핵심기술을 보호해온 국내 유일무이의 첨단부서이다. 이 수사부는 지난 2월 1일, ‘첨단범죄수사부’로 확대∙개편하여 대한민국 검찰의 과학수사 체계를 더욱 확고히 함은 물론, 빈발하고 있는 기업의 핵심기술유출 방지, 국부유출을 막는 파수꾼 역할을 담당하고 있다.

The country's core technology or industry security crimes going seized state-of-the-art technology firms can threat of damage to the country's economic security. In particular, the defense industry serious crime that is directly related to national security. The company's core technology and trade secrets leaked once the industrial countries must prevent security breaches and offenses of strict punishment measures because it is impossible to recover. Also, some advanced countries directly has been operating industrial security crime for the country's economy and national security. In recent years, Nation core technology infringement cases are rapidly increasing in the country. In addition, industrial security crime threat to national security. Therefore, the industry security crimes damage to the national security that infringe on the business secrets of core technologies and businesses. It is necessary to identify that industry security crime associated with the visibility of the broad scope of intellectual property protection.
