The Development Process and Spatial Characteristics of Sino-South Korean Cross-border Small-scale Trade (한.중 소무역의 변화 과정과 공간적 특성)

  • The subject of this research is the small-scale trade between South Korea and China (this trade is a so-called shuttle trade.) This research attempts to find the background to the emergence of the Sino-South Korean (cross-border) small-scale trade and the role of travel routes between the two countries. This research also aims to identify the development process of the bilateral small-scale trade by studying the scale of the small-scale trade and the organization of small-scale traders. Moreover, this research tries to discover the spatial characteristics of the interregional small-scale trade by reviewing the characteristics of traded goods; process of export and import and nodes of small-scale trade. To accomplish aforementioned purposes, the author discussed the relations between small-scale traders and maritime companies. The author also studied the internal change in the small-scale trade by focusing on the reinforcement of the regulation against the small-scale trade. Lastly, the author cited the case of the Soviet Union and middle-eastern Europe, which tremendously expanded the small-scale trades in the 1980s, in order to explain the growth of the Sino-South Korean small-scale trade.

  • This study aims to discover the characteristics of Sino-South Korean cross-border small-scale trade, which involves various players. Through this characteristics, this study ultimately intends to identify an operational mechanism of Sino-South Korean cross-border small-scale trade by investigating social capital as mobilized by small-scale traders. The results of this study can be expected to help understand how small-scale merchants address the uncertainty or risks surrounding their trade. Although it is an informal economic activity, the cross-border small-scale trade between South Korea and China is related to issues of the formal economy, such as job creation, benefits for local economies, and profit-seeking. Owing to this characteristics, small-scale trade is being conducted with the connivance of, or even with the tacit support from formal organizations, including municipal governments, customs, corporations, and shipping companies. Like trade in other countries, Sino-South Korean cross-border small-scale trade also requires different types of social capital, such as family networks, ethnic networks, social networks, and trust.

Payment Refusal against Discrepancy in Transport Document under L/C Transaction (신용장거래에서 운송서류 불일치에 대한 지급거절)

  • The study attempts to verify the case related to the notice of payment refusal by issuing bank regarding discrepancy in transport document under L/C(Letter of Credit) transaction. Considering the high portion of trade between Korea and China, Korean companies and banks in L/C transaction should be careful about many unpredictable situations. The case of this study is that Chinese seller(beneficiary) initiated a civil suit against Industrial Bank of Korea to Chinese court and Chinese courts in the first and second trials judged that the notice of payment refusal by Industrial bank of Korea doesn't satisfy Article 16, (c) (ii) (iii) in UCP 600. However, Industrial Bank of Korea implements the judgement even though the judgement is highly biased to Chinese seller. Considering the judgement by Chinese courts, the study suggests some countermeasures to Korean companies and banks which opened L/C. First, the issuing bank should describe the contents of discrepancy specifically based on Article 16, (c) in UCP 600. Second, it is necessary to insert a clause regarding governing law in the L/C contract like sales contract. Third, considering the biased judgement by Chinese court and difficulty in execution of foreign judgement in China, it is recommended to using arbitration as a method of dispute resolution such as ICLOCA and DOCDEX Rules which are international system operated by international instruments because it has legal effects to parties in L/C contracts if the issuing bank inserts arbitration clause in L/C.

  • 최근의 통상환경중 "Logistics" 혁명을 통한 컨테이너 운송의 신속화, 인터넷혁명을 통한 전자상거래 활성화는 EDI, EC등을 통해 "Paperless trade"가 실현을 앞당기고 있다. 본 논고는 이러한 물류혁명과 인터넷 정보기술의 발달로 대두되는 문제중 기존의 종이서류로서의 운송서류를 전자식 운송서류로 대체하는데 따른 문제점과 이의 활성화 방안에 대해서 살펴보고자 한다. 인터넷 전자거래가 활성화되어지면 기존의 종이서류들은 전자메시지로 대체될 것으로 여겨진다. 이에 따라 전자계약서, 전자송장, 전자보험증권, 전자선하증권 등이 출현할 것이지만 이중 무엇보다도 전자식 운송서류중 유통성 운송서류의 전자화는 그간 전자화의 핵심부문으로 여겨서 상당한 중요성을 두어왔다. 현재 이용되는 유통성 운송서류는 그간 선하증권의 지연도착문제와 이에 따른 추가 경비의 소요, 또한 선하증권 발급에 따른 부대경비의 과다소비, 종이서류로서의 선하증권의 위조에 따른 사기문제 등에 제기되어 졌고 이에 따라 선취화물보상장 등의 현실적 대안이 제시되었지만 이 또한 여러 문제점을 야기시켜왔다. 전자식 운송서류는 이러한 문제점을 다소 해소할 수 있는 방안으로 알려져 왔다. 전자거래가 활성활 될 미래에는 운송서류의 전자화는 필연적으로 대두되게 될 것이고, 이러한 전자화에 있어 해상운송장의 사용은 바람직한 모델로 여겨지고 있다. 그렇지만 전매가 잦은 산업에 있어 해상운송장은 자체의 유통성의 미비로 인해 그 사용에 문제점이 있고, 실제 상관행에서 많은 이점을 가진 선하증권의 발행 욕구를 충족시켜 줄 수 있어야 할 것이다. 본 논고에서는 전자식 운송서류의 활성화 방안으로 첫째, 전자식 운송서류에 관한 법률정비가 필요할 것으로 여겨지며 둘째, 유통성 전자식 운송서류에 있어 관리기관의 안정성이 확보되어야 할 것으로 여겨지며 셋째, UCP에서 전자식 운송서류에 관한 조항이 삽입되어져야 할것으로 여겨지며 넷째, 여러 측면에서 우위성을 지닌 전자무역거래의 활성화는 점차적으로 운송서류의 전자화를 활성화시키는데 반드시 필요한 명제로 등장할 것으로 여겨진다.

A Study on the Relative Operational Efficiency of Foreign Port Transportation Industry (외항운송업의 상대적 운영효율성 분석)

  • In Korea, which achieved economic growth due to export industries, the economic importance of the foreign port transportation industry is very great. The government took the initiative in fostering the foreign port transportation industry, and as a result, it developed into one of the top 10 foreign port transport countries in the world. However, due to the poor management of the small and medium-sized foreign port transport business and the trade dispute between countries, the foreign port transportation industry has faced a long-term invasion. Therefore, in order for these companies to recover again, they will, among other things, have to reorganize their operational inefficiency to carry out efficient production activities. In this study, we want to analyze the management efficiency of the top 10% companies in the unlisted domestic outbound shipping industry, present the project value of inefficient enterprises, and confirm the reference collection of companies that may be subject to benchmarking. For this purpose, a total of 10 foreign port transportation industry were analysed for efficiency and scale profitability (RTS) of the CCR and BCC models. The analysis showed that there were a total of six entities with BCC efficiency and five entities with CCR efficiency. In addition, there were a total of five entities with both BCC and CCR efficiency.
