A Study on the Rights of Transport Terminal Operators;An Analysis of the Korean Supreme Court's Judgment of 27 April 2007, Case No. 2007Da4943 (항만터미널운영자의 권리에 관한 고찰;대법원 2007.4.27.선고 2007다4943 판결 평석)

  • According to the trend of a large-sized vessel and a industrial carrier, the role of the independent contractors such as transport terminal operators, stevedores and warehousemen is increasing the base of cargo distribution that include the function of storage, warehousing, loading, unloading, trimming, dunnaging and lashing. But the common law doctrine of privity of contract has been a perennial source of difficulty for litigants seeking to enforce rights and obligations arising under a bill of lading contract. When carriage contract is negotiated, the concerned parties will be aware that some portion of obligations arising from the contract will be performed by the independent contractors engaged to carry out a particular function. It is reasonable for the independent contractors to be allowed the benefit of the carrier under the contract of carriage. As a part of the alleviating measures for the liability of independent contractors has been allowed various schemes, specially including 'Himalaya Clause'. Therefore, this study performed the validity of 'Himalaya Clause' by means of a recent judicial precedent by the Supreme Court and analyzed the rights of third parties, specially transport terminal operators, under the contract of carriage.

  • This paper presents the results of a study that looks into the different operating structures of terminals in the United States and attempts to find the type of terminal management scheme (All-Comers Common User Facilities, Programmed Common User Facilities, and Program-Tied User Facilities) that is most efficient with regard to crane usage. The paper uses gross and net crane moves per hour to develop an efficiency ratio that is then used to compare terminals. A total of thirty-one terminals were compared in an attempted to find the most efficient management scheme. While the hypothesis that Program-Tied User Facilities are the most efficient operating scheme was accepted, the sample was too small to provide conclusive results pertinent to the terminals in the United States.

  • This Paper aims to develop container terminal simulation models for medium and long term decision makings. It first undertakes in-depth survey of literature. finds its shortcomings and suggests some directions for improvement. It then proposes detailed design for the simulation models. Based on this it finally developes several simulation models and applies them to a hypothetical situation of a container terminal development. The results reveal that basic design questions such as length of quay, number of quay crane, size of storage area are well produced through the models.

  • The objective of this study is to analyze the efficiency of marshalling work using ATC(automated transfer crane) for ACT(automated container terminal). It is important fact to assignment of containers, because the character of ACT which block layout is vertical for berth and there are four other works which are inbound, oubound, loading and unloading in one block. And then there is need which assignment of containers with remarshaling work using ATCs in one block.   • 세계 항만환경은 초대형 컨테이너선의 등장이후, 허브 & 스포크(Hub & Spoke)의 형태로 급속히 변화하고 있다. 이에 해외 선진항만들은 중심항만으로서 자리매김하기 위해 자동화 컨테이너터미널을 구축하는 등 생산성 향상을 위한 노력을 하고 있으나, 국내의 경우 자동화 컨테이너터미널에 관한 연구, 그중 자동화 게이트시스템에 대한 연구는 상대적으로 미흡한 실정이다. 본 연구에서는 자동화 게이트시스템을 구축 시, 최적 기술 대안을 선정하기 위해 국내 외 게이트 운영현황과 관련 기술들의 분석함으로써 자동화 게이트시스템 구축 시 필요한 기술을 도출하다. 그 결과를 컨테이너터미널 운영사의 기술 담당자들을 대상으로 현재 게이트시스템의 만족도와 문제점 그리고 향후 게이트시스템 구축 시 사용하고자 하는 기술과 기대효과를 찾고자 하였다. 하지만 1차 설문결과 내용만으로는 어떤 요소 기술이 사용자가 요구하는 기대효과를 만족시킬 수 있는 최적 기술 대안인지 제시하기 힘들었다. 이를 보완하기 위한 방법으로 정성적인 주관적 평가요소를 객관화하여 각 평가기준에서 나타나는 적용상의 한계를 해결할 수 있는 방법인 AHP 기법을 활용하였으며, 최종적으로 생산성 보안성, 경제성 3가지 평가 기준을 고려하여 최적 기술 대안을 선정한 결과 RFID가 최적의 기술대안으로 평가되었다.

  • To correspond actively to international economy, shipping and port environment change, world main ports have converged in competitiveness raising. However, existing researches have been intensively analyzed port competitiveness on among ports. So, this study analyzes the relations between the main factors of port selection and port competition players: central government, port authority, terminal operators, shipping companies, etc. This paper has a purpose that each port competition player makes a competitive strategy in accordance with this study. First, this study reviewed shipping and port market's environment change and port selection decision factors to correspond to these environment changes and on the basis of this review analyzed relativity between component port competition players and port competition factors. However, port authorities and terminal operators appeared high relevance about in side of expense, service, facilities etc. Because port authorities offered incentive to pull many shipping companies to their ports and terminal operators managed port authorities' ports. But we could deduce high relevance according to other market players' properties without port authorities and terminal operators. Port marketing strategy establishment among port competition players is available on the basis of these factors.

  • Most domestic container terminals are lack of container storage capacity compared to the throughput of container. The main reason is the difference between the theoretical capacity applied to the development of terminals and the real capacity of a berth Another reason seems to be the increase of the container crane in number per berth to match the need for the getting larger vessel, which is resulted from the increase of the berth capacity from the start. This study, therefore, aims to suggest the economic size of container yard by comparing the existing one. For this the berth capacity was recalculated, the required yard size derived considering up to 10,000TEU vessel and then cost comparison done.

  • It's important to operate the yard for improving to the productivity in container terminal effectively. Because the automated container terminal(ACT) has storage yard of automation and horizon, it's character is different from conventional terminal. As the automation yard in ACT is operated by the automated equipments, it needs to an efficient storage plan which is connected the automated equipment, the external truck, the shipment etc.. Hut the traditional method of storage plan is the space assignment problem. The efficiency of yard decreases and it is brought about increase of shipment time, because real-time automated equipments and present yard status is not reflected in. In order to solve this problems, we propose the algorithm for real-time storage location of container considering shipment plan, yard status and the state of ATC.

  • With the recent port environment, the integration of the separated berth is being actively progressed and the necessity of integration has been strengthening. Therefore, the application of existing gates have to review in order to reduce the truck turnaround time and to distribute the truck traffic volume in port container terminal. This paper analyzed the operation impact both the integrated gate and the separated gates. As the result of the analysis, this study suggests the separated gate system as an efficient design for gate operation considering integration of two individual berth.

The paper describes the evaluation of informatization level of importance is presented to efficient operate in a container terminal, the relative efficiency on informatization level is measured using Data Envelopment Analysis.
