A Study on the Judicial Precedent regarding a Right to a View (조망권에 관한 판례연구)

  • In this treatise I have advanced a theory to regulate legal problems rationally arising from a right to a view and I have checked some precedents dealing with the temporary injunction, compensation for damage and the demolition of a house(mainly apartment) owing to an infringement of a right to a view. Relating to an infringement of a right to a view, there are more lawsuits which are instituted together with an infringement of a right to enjoy sunshine than lawsuits related only to the right to a view. In the cases of an infringement of a right to a view connects with educational or religious environment, the court made it a decision that the construction is prohibited from constructing more than a certain-story building to protect a right to a view. Plaintiffs won a case their suit in the original judgement regarding a claim for damages owing to an infringement of a right to a view, but the Supreme Court reversed the decision of a lower court. The right to a sky view should not be infringed in case of a dwelling house which is not built for the purpose of business or a view.

The Effects of GyeongIn Ara Waterway on the Regional Property Value (경인아라뱃길이 지역 부동산 가격에 미친 영향 분석)

  • The purpose of this research is to evaluate the scenic value of the Gyungin Ara waterway in real estate prices. Apart from the multi-functionality such as transportation of passengers and freight, prevention of floods, and provision of leisure areas, the Ara waterway possesses a scenic function which offers people esthetic value through unique and beautiful scenery. This scenic function is an externality for apartment residents living nearby. The applied methodology for this research is the Hedonic Price Model (HPM) which creates a cause and effect model between real estate prices and attributes. Variables such as apartment sale prices, complex characteristics, location characteristics, timely characteristics have been deduced through data collected from a total of 4,207 households that have experienced actual transactions during the same period, all located within the scenic benefit boundaries of the waterway. Landscape variable has been derived from algorithm designed by a combination of digital map and Google Mapview. The scenic value of the waterway estimated through the application of HPM on these variables is 165,000 Won per area (pyeong). The regional asset enhancing effect caused by the landscape view of the waterway is estimated to be 89.1 billion won.

  • This study, as a purpose of viewshed anaiysis is selected for the landscape view point, View of the target Haenam Dalmasan Mihwangsa(Scenic site No.59) located in the terrain ridge. Criteria of landscape view point was built through both 3D visibility analysis by GIS and public preference. In results could be summarized as follows : Criteria of landscape view point by GIS was confirmed to be appropriate since a result of average score for 36 data calculated by 3D visibility analysis was higher than intermediate score. Futhermore, the landscape view point with higher score could be associate with higher public preference was determined. 3D visibility analysis in this study should be implemented additionally with not GIS, public preference but distance and extent of visibility research to discover, maintain and preserve objective and empirical landscape view point to public as resources of scenic sites.

A Study on Museum's Rest Area in Korea and Japan (한·일 뮤지엄 휴식공간에 관한 연구)

  • This study covers museum rest areas among the methods that reduce museum fatigue. The subjects of the study were Seoul branch of the representative National Museum of Contemporary Art and National Museum of Korea. These museums were compared and analyzed with The National Art Center of Tokyo and Tokyo National Museum. The first research step was the analysis of museums' floor plan, and the second step was the tracing survey of visitors' movement. The result of this study was as follows. The National Art Center of Tokyo and Tokyo National Museum had the rest space within the visitors' route along with good viewing areas. National Museum of Korea had poor viewing area even though there was the rest space withing the visitors' route. Lastly, Seoul branch of National Museum of Contemporary Art had the rest space out of visitors' route along with poor viewing areas. This study is meaningful in that it provided guidelines for museum space plan with visitors' route considered, so that their museum fatigue can be relieved along with the guideline that can be applied to space elements of rest space.

Application of Analysis within Technique of Visibility for Selecting the Route of Viewing (조망루트 선정을 위한 가시권 분석의 적용 -보길도 윤선도 원림(명승 제34호)을 중심으로-)

  • This study, as a purpose of viewshed anaiysis is selected for the view route, View of the target yunseondo wonlim (scenic sites No.34) located in the terrain ridge. Using GIS Viewshed analysis carried out and the results reflect the view route was selected. The basic research for this study, the scenic sites such as the natural and cultural resources for the efficient and optimized to create the route view. Viewshed Analysis results could be summarized as follows: Along a scenic sites located inside the main ridge Viewshed analysis was carried out. This overlapping the cumulative results are Leading to Nakseojae(樂書齎) Seyeonjeong(洗然亭) from space in the visible frequency higher natural villages of the district. Selected the view route and were on the road and in the topographic map nesting along Visible high-frequency region. Based on the results of the nested Viewshed major selected six points Viewshed analysis was carried out. Resource for the surrounding landscape. Results determine whether the visibility of the surrounding landscape was identified as the viewable area appears good. Finally Viewshed Analysis results for six points in the final review.
