A Comparative Study on the Foreign Corrupt Practices Act (FCPA) and Article 21.6 of the KORUS FTA (미국 해외부패방지법(FCPA)과 한미 FTA 제 21.6 조 비교연구)

  • Numerous discussions on the KORUS FTA has been centered around issues on trade in goods, services, or dispute settlement mechanisms. On the other hand, little attention has been given to Chpater 21 of the KORUS FTA on transparency, especially Article 21.6 which states about anti-corruption. Article 21.6 and the Foreign Corrupt Practices Act shares the common purpose to prevent corruptive business practice, and they show similarities in many aspects. The FCPA enforcement has dramatically increased over the past ten years by the U.S. Department of Justice and Securities Exchange Commission stretching its jurisdiction to foreign nationals and companies. Korean business professionals and corporations are exposed to both Article 21.6 and the FCPA on corruption issues. Thus, it is imperative to understand Article 21.6 to be equipped with anti-corruption compliance programs. This paper examines the FCPA and Article 21.6 through comparative analysis and proposes appropriate measures for Korea to take.

  • Some clauses of the prior review rules for broadcasting commercials, which are enforced by the Broadcasting Act violate the right to free speech guaranteed by the Constitution. The range of prohibited expression under the clauses are too vague and overbroad to distinguish between permissible and impermissible broadcasting commercials. The clauses also fail to pass the constitutional principle that restrict government from excessive regulation on constitutional rights. The principle has a four-pronged test on the government action; 1) the validity of its goal; 2) availability of appropriate means; 3) necessity of infringement; 4) and balancing test of interests. Some clauses of the prior review rules that forbid expressions on sensitive political and cultural issues fail to pass none of the four-pronged standards.

  • Corynoxeine, rhynchophylline, isocorynoxeine, isorhychophylline were isolated from Uncaria hooks and determined by HPLC. Their contents were : isocorynoxeine 0.21%, isorhynchophylline 0.16%, corynoxeine 0.28%, rhynchophylline 0.23%, respectively. Corynoxeine and isocorynoxeine, rhynchophylline and isorhychophylline were interconverted each other by heat treatment.

  • The Merit variety of soybean (Glycine max L.), harvested in 1971 was germinated in the dark at $21{\sim}25^{\circ}C$ for days. The soybean sprouts were divided into cotyledons and seedling axis (=hypocotlyplus root) and subjected to the determination of dry weight, crude fat content and lipid components (esterified sterols, triglycerides, free fatty acids, free sterols and phospholipids) at two-day intervals during the germination periods. The results are summarized as follows: 1) During the germination period, the dry weight and crude fat content in cotyledons decreased continuously, but the dry weight seedling axis increased continuously and crude fat content remained almost constent. 2) The triglyceride content in crude fat from cotyledons decreased and free fatty acid content increased continuously, but triglyceride content in crude fat from seedling axis showed no change until 6th day and increased slightly after 8th day, and free fatty acid content showed increase after 4th day and decrease after 6th day. Phospholipids, free and esterified sterols content in cotyledons increased continuously, but their content in seedling axis remained unchanged.

Fast Remote Detection Algorithms for Chemical Gases Using Pre-Detection with a Passive FTIR Spectrometer (수동형 FTIR 분광계에서 초동 탐지 기법을 이용한 고속 원거리 화학 가스 탐지 알고리즘)

  • In this paper, we propose a fast detection and identification algorithm of chemical gases with a passive FTIR spectrometer. We use a pre-detection algorithm that can reduce the spatial region effectively for gas detection and the candidates of the target. It is possible to remove background spectra effectively from measured spectra with the least-squares method. The CC(Correlation Coefficients) and the SNR(Signal-to-Noise Ratio) methods are used for the detection of target gases. The proposed pre-detection algorithm allows the total process of chemical gas detection to be performed with lower complexity compared with the conventional algorithms. This paper can help developing real-time chemical detection instruments and various applications of FTIR spectrometers.

'96 과학기술 예산을 조명한다

  • 국민소득 1만달러시대를 구가하는 96년도의 정부 전처의 연구개발예산은 2조3천7백95억원으로 전년보다 24.9%, 4천7백45억원이 증가하였다. 다가오는 21세기에 우리나라가 세계 속의 중심국가로 부상하기 위하여 정부는 한정된 재원으로 다양한 행정수요에도 불구하고 연구개발투자에 매년 20% 이상씩 증가시켜 집중 배분하여 왔다. 이에따라 총예산중 연구개발예산의 점유율은 95년의 2.56%에서 96년에는 2.79%로 제고되었고, 이는 신경제5개년계획기간중에 국가 총연구개발 투자규모를 국민총생산의 3~4% 수준으로 확대하기 위해 정부가 의욕적으로 선도역할을 충실히 수행하고 있음을 웅변하고 있는 것이라 하겠다. 96년도 새해 정부의 연구개발 관계예산을 부처별로 보면, 규모면에서는 과학기술처가 가장 많은 7천8백41억원으로 전체 R&D예산의 33.0%를 차지하고 있고, 증가율면에서는 교육부가 제일 크게 62.9% 증가한 3천6백49억원 수준이다. R&D 에산의 규모와 운용전망을 좀 더 자세히 살펴보기로 한다.

자격검정제도의 제안

  • 한국주거학회 자격관리위원회는 자격검증을 위한 과목 선정을 위해 다수의 검정과목안의 장단점을 비교 분석하고, 국내 12개 주거학과의 의견조회 결과를 참고로 하여, 현행 주거학과의 교과과정을 잘 포괄하고 있고 직무영역의 능력을 균형적으로 평가할 수 있는 (가칭)2급 주택사 검정과목(안)과 직무영역의 평가가 강화된 (가칭)1급 주택사 검정과목을 제안하였다. (가칭)주택사는 설정된 검정과목에 따라 2급 주택사의 검정방법은 1차, 2차로 구분하여 실시하고 1차는 기본 지식 및 이론을 평가하는 객관식 시험형태를, 2차는 실무능력을 평가하는객/주관식 혼용의 시험형태를 제안하였다. 1급 주택사는 1차에 한하며 실무의 전문성을 평가하기 위한 논술형을 시험형태로 하였다. 또한 응시자격은 국가기술자격법 시행령 제 21조 제1항과 관련하여 2급의 경우 "기사"등급에, 1급의 경우 "기술사" 등급에 해당하는 자격을 기준으로 제안하였다.

Necessity of Improvements on Code of Practice at the Demolition Work considering Building Structure Type : Based on Demolition work of Permission and Registration (건축물의 구조유형을 고려한 해체공사 제도 개선 방안 필요성 - 해체공사의 허가 및 신고를 기준으로 -)

  • To prevent incident of demolition work the Building Management Act was implemented to manage demolition work. According to this law, buildings with the scale upper than 500㎡ of floor area are classified as permission to conduct the demolition work, however it may be hard to perform safety management at demolition work. In addition, the risk level of demolition work is varied with related to the structure type. So, the purpose of this study is to suggest the improvements of criteria on demolition work considering building structure types including small-scale structures such as masonry, wooden, and other structure. The research process was conducted by three steps. (I) Application of Building Management Act; (II) Analysis of demolition work by structure types; and (III) Subdivision of permission targets by building structure types. The result of this study, permission ratio was only 10% for total demolition work and 2.43% for masonry. Because the masonry, wooden, and other structure types are concentrated on a floor area of small-scale, the separate criteria of demolition work is need to prevent the accident and fatal incident. Through the results, the decision maker can be utilized (1) For the special building structure types, the criteria of enhanced safety management are applied by referring to the overseas law ; and (2) The demolition work can be considered by the criteria of separate permission in terms of structure types.
