A Study on the Charterer's Duty & Right in Applying Laytimes of the Voyage Charterparty (항해용선계약상 정박기간에 관한 용선자의 권리와 의무에 관한 연구)

  • The main purpose of tramp ships in shipping markets is to produce operation profits by minimizing the running days in a contract of the voyage charterparty. It is an especially difficult task for the owners to earn operation profits in the present recessional shipping market. Tramp ships are moving towards globalization in order to look for a variety of cargoes, which are distinguished from the liners operating regularly as per the fixed time schedule. Tramp shipping, therefore, requires special attention every voyage to secure operation efficiency which comes from minimized sea and laytime in port. The laytime is allowed by owners but if the charterers use more laytime than that which is incorporated in the charterparty, then a compensation known as 'demurrage' must be paid to owners. Conversely if the time is shorter this is called 'despatch' and in this case the owners are paid. As the laytime issue in the voyage charter is somewhat delicate, it often causes much disputes between charterers and owners during the cargo handling in ports. This study focuses on the charterers' right and duty on the laytime which is usually applied for the benefit of the charterers. Reference is also made to English law cases to reinforce this study and the conclusion will make relevant suggestions for further research.

  • It is a generalized way for the chartering business to fix the laytime bars except rarely adapting the customary despatch of the cargo work in port. The way of customary despatch is usually accepted by the owners in case the port facilities and other relevant infrastructures are in the satisfactory level for the cargo work whereas the laytime bars to be widely incorporated in the chaterparty for almost all occasions for owners and charterers to bind each other in loading and discharging cargo in port. The main purpose of establishing laytime bars on the charterparty is to secure the right and duty for both parties of the owners and the charterers, and furthermore to make the vessel despatched quickly from the port, whereby the costs incidental to the loading and discharging in port to be saved as much as possible. and the minimized costs in port will contribute to the profits in all parties involved in loading and discharging cargo. The conditions and terms on the laytime bars are expressed variously in their kinds according to the types of the charterparty to be used. The owners and charterers or the ship operators, however, seems not to be so accustomed in lawful understanding on these terms and conditions, and therefrom lots of disputes are noticed practically in the business field. As a result, this study is focused to render the owners and charterers rather clear understanding on their meanings and effects in legal aspects, and the various English Law Cases are referred in order to achieve the purpose of this study.

Basic Research for the Development of Collision Risk Model of Passing Vessels at an Anchorage (Safety Domain) (정박지 통항선박의 충돌위험 모델 개발을 위한 기초연구 - 정박지 통항선박의 안전 -)

  • The purpose of this study is to obtain a safe area for a passing vessel between anchored vessels by developing a model to predict the collision risk, frequent collisions occur between the anchored vessel and the passing vessel through the anchorage. For this, this study selected the southern anchorage of Busan port, which is the largest harbor in Korea, as the target area and extracted and analyzed VTS (Vessel Traffic Service) data during the period in which anchored vessels were the most waited. The ratio of D/L for each bearing was obtained to determine the safe distance (D) passes based on the length (L) of the passing vessel between anchored vessels. Based on the average domain of the D/L ratio distribution, the percentage of anchored vessels within the scope of the pre-studied ship's domain was analyzed to obtain a domain reflecting the degree of risk of VTSOs. Further research will evaluate and analyze the collision risk of a passing vessel using Domain-watch, the minimum safe distance between anchored vessels, and the safe domain of a passing vessel through anchorage, to develop a model for VTS to manage anchorages more efficiently and safely.

The Efficient Anchorage Management of VTS through Analysis of Domain Watch (영역감시 분석을 통한 VTS의 효율적 정박지 관리 방안에 관한 연구)

  • The purpose of this study is to estimate a proper Domain Watch between anchored vessels in order to propose a method for the efficient management of VTS(Vessel Traffic Service) of the N-anchorage in Busan harbor, which is the largest port in Korea. For this purpose, we proposed the calculation method of Domain Watch and investigated the ship length(L), the distance between anchored vessels ($D_{ij}$), the domain radius(R), and the domain radius vs L(R/L) during the peak time of the vessels in the latest usage of anchorage. As a result of technical analysis for the surveyed data, the minimum R/L for securing the safety distance between anchored vessels was selected based on 2.85 corresponding to the 70th percentile of the total data. This result was applied to the N-anchorage of Busan and compared with the 'Guidelines of Port and Harbor Design(2014)', and we have confirmed that it is reasonable to set the Domain radius with the minimum 2.85L or more in VTS. This study considers the safety management of anchorage for VTS. This study could contribute to the safety of vessels using anchorage and the safety management plan of VTS when it is applied to other ports in operation such as it was in Busan.

A Study on the Laytime and Demurrage Clauses (LD Clauses) in Contracts for the International Sale of Goods (국제물품매매계약에서 정박기간과 체선료조항(LD Clauses)에 관한 연구 - 영국관습법을 중심으로 -)

  • The fact that one of the parties to the sale contract has had to pay demurrage to the shipowner under LD clauses in the charterparty does not of itself mean that he can recover that loss from his sale counter party under the sale contract: the route to such recovery is through express clauses in the sale contract itself. LD clauses in a sale contract stand free and independent of their counterparts in the relevant charterparty. LD clauses in a sale contract should be construed and applied as clauses in sale contracts, not as adjuncts to charterparties. Their interpretation should therefore be coloured not by decisions on laytime and demurrage in charterparties, but by their relationship to the contractual duties of CIF and FOB sellers and buyers. The results discussed here have implications for the drafting of LD clauses in sale contracts. If unwelcome surprises are to be avoided, it seems to advisable to start from the principle: what exactly do traders want or need in LD clauses. They need a clause which covers them against charterparty losses where those losses are the result of dealy caused by the counterparty to the sale contract. The parties to the sale contracts are well advised to prepare LD clauses concentrating on that purpose and bearing in mind the followiing questions. First, should the loading and discharge code in the sale contract appear in traders' or trade associations' standard terms and conditions or should they be left to ad hoc negotiation in contract sheets? Second, should that code be as complete as possible, covering loading or discharge periods or rates, demurrage and despatch, or is it enough for only some of those matters to be covered explicitly, leaving other matters to be governed" as per charterparty"? Third, does the introduction or incorporation of a stipulation for the giving of a notice of readiness make the start of laytime more or less predictable as between seller and buyer? Finally should a loading and discharge code in a sale contract actully be called a "laytime and demmurrage clauses"?

  • 허베이스피리트호 원유유출 사고는 2007년 12월7일 아침 7시6분경 서해안 만리포 북서쪽 10km 해상에서 크레인을 적재한 1만1800t급 바지선이 정박 중인 홍콩 선적 유조선 허베이 스피리트호(14만6000t급)와 부딪치면서 발생했다. 이와 같은 기름 유출 사고의 경우, 유출 범위를 정확하게 이해하는 것이 중요하다. 여기서는 위 사고 기간에 얻어진 인공위성 자료를 이용하여 기름 유출을 탐지하기 위한 연구결과를 소개한다. 광학과 마이크로파데이터에 대해 유출 범위의 계산 및 해석 알고리듬에 대한 현재까지의 결과를 소개한다. 광학데이터로는 아리랑 2호(다목적실용위성 2호, KOMPSAT II)) MSC(Multi Spectral Camera)자료가 사용되었으며, 합성개구레이더로는 ENVISAT ASAR, TerraSAR-X 및 ALOS PALSAR의 자료가 사용되었다.

Performance Assessment of Navigation Seakeeping for Coastal Liquified-Natural-Gas Bunkering Ship (연안선박용 LNG 벙커링 전용선박의 내항성능 평가에 대한 연구)

  • Through the Ministry of Trade, Industry, and Energy, South Korea is trying to support the "Building Project for Liquified Natural Gas (LNG) Bunkering Ship," centered on the Korea Gas Corporation, while the Ministry of Maritime Af airs and Fisheries is pushing to construct an LNG bunkering terminal at Busan New Port. LNG bunkering ships are essential for supplying LNG fuel from the terminal to the ships, resulting in the need for safety operation procedures. Therefore, in this study, the stability of a coastal LNG bunkering ship operating from Busan New Port to the anchorage in Busan Port was assessed to investigate the need for operational procedures for coastal LNG bunkering ships. Seakeeping analysis of the LNG bunkering ship was performed for each significant wave height by combining the response amplitude operator from the ship motion analysis under the potential flow theory with the actual observed sea data for five years and Texel, Marsen, and Arsloe (TMA) spectrum suitable for the Busan coast. The results showed that the roll and horizontal acceleration were the main risks that affected the navigation seakeeping performance above a significance wave height of 2 m. The operational periods of the LNG bunkering ship ranged from 83.3% to 99.9% of the total observation period.

  • In recent years, the rate of mean sea level rise is increasing rapidly from the phenomena of global warming, together with the increasing trend of the storm scale. The issue of sea level rise is multifaceted and produces a range of environmental problems. Especially, high tides and the tidal currents become higher, and wave base increases, so the energy received at the coastal boundary may increase. This brings that many coastal environments go into disequilibrium, such as damages to the structures, erosion, and deposition Similarly it was known that the problems of nearshore processes and damage of berth and counter facilities during storm period had appeared at the small fishery port. Here we try to analyze the impact of the rearrangement of counter facilities and berth layout adopted for tranquility of its'inner harbor. Because this harbor is being connected to channel and open sea, the rearrangement of the structures might affect to the current speed and direction and wave height, so do to the sea bottom undulation. Therefore, we made model test for the several layouts of the berth and breakwater in this area.
