A Study on the Copyright Policy and Open Access for Noncommercial Scholarly Works (비영리학술저작물의 저작권정책과 오픈액세스에 관한 연구)

  • This study is about the copyright policies by Korean government and the revision of the article 31 library exemption provision in the Copyright Act of Korea for noncommercial scholarly works considering through cases of copyright disputes occurred in Korea during the $2005{\sim}2007$. This study proposes that works not for sale including thesis should be exempted from the copyright compensation in the article 31(5) in the Copyright Act of Korea based on the properties of noncommercial scholarly works and the regulations on works for not for sale in the current Korean copyright act. Also, this study reports that the copyright trust of scholarly articles by the copyright trust management agency is illegal in part and the government which has a duty to direct it has to control the illegal actions. Finally, this study proposes that noncommercial scholarly works such as thesis and scientific articles are to be open access and Korean government should develop open policies for them.

  • Article 50 and article 18 related to orphan works in the Copyright Act of Korea and Enforcement Decree of the Copyright Act of Korea define 'considerable efforts' to locate copyright owners. This study analyzed the reasonableness of the efforts for mass digitization in libraries. The findings of the study were the duplication of searches on the 'Finding Copyright' website and the inquire to copyright trust management organizations by document, ambiguity of search criteria through information networks, and problems due to non-use of international standard identifiers in managing works on copyright register, works with undistributed compensation, and copyright trust management organizations. This study suggests that copyright trust management organizations should register trust works, the government should develop a guideline for detail guidance for searching information networks, and copyright works should be managed using international standard identifiers.

  • 멀티미디어 콘텐트를 제작하기 위하여 기존 저작물을 이용하고자 할 경우 '저작권 정보'가 기본적으로 요구된다. 해당 저작물과 저작에 대한 정보. 그리고 권리 정보를 얻기 위해서 현재에는 과도한 시간과 비용을 낭비하고 있다. 이런 불편을 해결해 주는 것이 저작권 집중관리 제도이다. 이 제도는 다수의 저작자로부터 권리를 신탁받은 단체가 위탁자의 이익을 위하여 그 권리를 통합적으로 관리하는 것을 말한다.

  • IT 기술에 의해 정보유통 환경이 진화하면서, 정보 획득의 방법에 있어서 웹과 디지털 기술을 활용하는 전자원문서비스가 활성화되고 있다. 그러나 국내 저작권법상 저작권자의 개별적인 허락없이는 해외 학술자료의 전자원문서비스가 불가능한 실정이다. 이 연구에서는 저작권법 조항의 문제점을 지적하고, 전자원문서비스의 실현을 위한 방안으로 확대된 저작권 집중관리제도의 도입을 검토한다. 확대된 저작권 집중관리제도(ECL)는 집중관리단체가 대리하지 않는 권리자에게로 이용허락계약을 확대시키는 것이다. ECL을 통해 국내 어문저작물의 복제 전송에 대한 저작자의 권리를 신탁관리하는 (사)한국복사전송권협회가 해외 학술자료의 이용에 대해서도 사용승인 및 사용료 징수 등의 역할을 수행하며, 이를 통해 도서관은 진정한 전자원문서비스를 실현할 수 있을 것이다. 전자원문서비스를 통해 저작권의 합리적인 준수는 물론, 학술정보 유통 활성화에 기여함으로써 궁극적으로 국가 경쟁력 제고를 도모할 수 있을 것이다.

  • The copyrights of music in Korea have been placed under the supervision of the associations which the government approved as a trusteeship. Since the industry of music in Korea has been changed from phonographic industry to on-line music service, it is required increasingly that the rights and interests of music should been protected. Korea government has been announced the amendment for levy of music royalties through on-line service according to the changes in the music industry and industries' demand. In this paper, the corporate structures in music industry has been investigated from the point of owner of copyright, recently at the heart of the debate, flat rate system and usage-based pricing in on-line music market has been compared. Consequently, the reasonable prices of music service through on-line market are not earmarked in reality for both consumers and copyright proprietors. Therefore, it is still necessary to improve the institutional.

  • This paper suggests how to systemize administrative metadata required for managing intellectual property rights and their applications, which has been newly requested in digital library environment. For this purpose, firstly, the types of metadata required in digital libraries were identified. Secondly, this paper detected problems in MARC that digital libraries have been using as the tool for information organization. Finally, the structures of administrative metadata required by copyright laws were analyzed. On the basis of the researches above, this paper proposed how to systemize and operate administrative metadata that interlocks MARC, Dublin Core and administrative system of copyright trust agencies.

  • The purpose of this study is to suggest concrete approaches of copyright application among various map price policies to establish the system of a digital map market, to revitalize its market, and to give the public better map services. To do this, we analyzed copyright law in Korea and the copyright protection of digital map in foreign countries firstly, investigated the applicability of copyright to the map market in Korea, analyzed the effect on this market, and suggested an direction of the revision for the Surveying law and the National Geographic Information (NGlS) law lastly. We drew several conclusions. Firstly, the protection of the rights of database makers is the best approach to protect digital maps in korea. Secondly, we need to adopt copyright to the Surveying law and the National Geographic Information Systems (NGlS) law. Lastly, establishing a copyright trust organization to improve the quality of digital maps and to manage various affairs is needed.

A Study on the Legitimacy on the Copyright-Using Charge Regulations for the Performing Cinematographic Works in Public Libraries (공공도서관의 영상저작물 공연에 대한 저작권료 징수 규정의 타당성 고찰)

  • This study analyzed the legitimacy issues of the current regulation for the copyright-using charge and the plans to revise the regulation for the performing the cinematographic works in the public libraries. Also, this study investigated the current situation of the performing the cinematographic works and the size of auditoriums in the 84 public libraries in Gyeonggi province with information on the library websites from February 2012 to January 2013. As a result, this study suggested that yearly charging for the performing the cinematographic works to the less than 6 months after publishing will be suitable than the current monthly charging. Also, this study suggested that the copyright agency for cinematographic works should increase the number of copyright works received in trust.
